DB MCCAULEY AND BC-6214 DRY DOCKING SPECIAL PROVISIONS– Rev 04 NOV 2015 PAGE 4 of 6
SP-11 CLEANLINESS ABOARD PLANT- The Contractor shall keep working areas clean and shall clean up such working areas to a condition "as found prior to commencement of work." The Contractor shall at all times refrain from marring, marking, or defacing any portion of the interior of the vessel. Any such marring, marking, or defacing shall be restored to its original condition by and at the expense of the Contractor prior to acceptance of the plant by the Government as provided in Paragraph SP-5.
SP-12 SERVICES TO BE FURNISHED BY THE CONTRACTOR WITHOUT FURTHER COST- The Contractor shall furnish without further cost to the Government the services listed below.
SP-12.1 The Contractor shall furnish and connect a temporary auxiliary electric power supply to permit heating, lighting, and ventilation of quarters, the galley, and machinery spaces, and for the operation of necessary deck and auxiliary machinery. The Derrickboat McCauley will require 200 Amp, 240 VAC, 3 phase service.
SP-12.2 The Contractor shall make provisions to remove the garbage and trash from each vessel at least once daily.
SP-12.3 The Contractor shall furnish crane service to place stores and other Government equipment aboard the vessel and to remove supplies and equipment from the vessel. Crane services shall be provided at times mutually agreeable to the Contractor and the Contracting Officer.
SP-12.4 The Contractor shall ensure that the Derrickboat McCauley is kept heated and with electrical power at all times during the period that they have custody of the vessel, in order to ensure that vessel systems are not damaged by exposure to freezing conditions.
SP-13 FINAL EXAMINATION AND ACCEPTANCE- As soon as practical after the completion of the entire work as may be designated in the specifications a thorough examination thereof will be made by the Contracting Officer's Representative at the site of the work. If such work is found to comply fully with the requirements of the Contract Job Order it will be accepted, and final payment will be made in accordance with the Contract article entitled "Payment".
SP-14 LIQUIDATED DAMAGES- For each work day beyond the adjusted scheduled completion date that completion of the work is delayed, liquidated damages will be assessed at the following rates:
Administrative Costs $1025/work day
Starting on 18 April 2016, the following additional liquidated damage rates will apply:If the adjusted scheduled completion date is 17 April 2016 or later, the following additional liquidated damage rates will apply:
Vessel Costs Derrickboat McCauley $7640/work day Barge BC-6214 $250/work day
RFI #1, Received Tue 11/3/2015 6:03 PM.
Question 1: SP-1 of the Solicitation provides for a Completion Date of no later than 4 Jan 2016, but does not specify a Start Date. Please advise of anticipated Start Date.
Answer 1: Contract award is anticipated to be made approximately one week after the close of the solicitation, and Notice to Proceed will be issued once contract signatures are received by both parties.
Weather permitting, the government intends to begin transport of the vessels to the dry dock facility on the date of award, or as soon thereafter as the successful offeror indicates that they will be prepared to receive the vessels. Arrival date will depend on the travel distance. Offerors should note that a government accepted safety plan must be in place prior to commencement of any other contract work.
Question 2: SP-5, paragraph SP-5.1 states that the plant will be available in Cleveland no later than 16
Nov 2015. However, proposals are due the next day, on 17 Nov 2015. Please clarify.
Answer 2: As indicated, the vessels are anticipated to be in Cleveland by 16 NOV 2015. Potential offerors can arrange to inspect the vessels during the solicitation period in accordance with Special
Provision SP-17.
Question 3: SP-14 provides that, for each work day beyond the adjusted scheduled completion date that completion of the work is delayed, liquidated damages will be assessed. Please define “adjusted scheduled completion date.”
Answer 3: The adjusted scheduled completion date will be either 04 January 2016, or a later date if the contract completion date is extended as part of a contract modification at the request of the government to accommodate unanticipated additional work not included in the initial award. The length of the extension would be negotiated with the Contractor as part of the contract modification.
Question 4: SP-14 of the Solicitation goes on to state that, if the adjusted scheduled completion date is 17 April 2016 or later…additional liquidated damage rates will apply. Please explain the intent of these provisions.
Answer 4: The language of SP-14 is hereby amended as follows: Delete the sentence reading
“If the adjusted scheduled completion date is 17 April 2016 or later, the following additional liquidated damage rates will apply:”
and replace it with the following text:
“Starting on 18 April 2016, the following additional liquidated damage rates will apply:”
The date of 18 April 2016 is the scheduled start of the work season for the government vessels being repaired under this contract. Starting on this date, Contractor delay of completion would impact the government's ability to execute the planned work of the season. The additional liquidated damages amounts represent the daily billing rates established for each vessel in Fiscal Year 2016.
Question 5: We ask that the Government provide an anticipated Award Date, and the date the
Government will deliver the plant to the Contractor. Alternatively, we ask that the Government stipulate in the Solicitation the total number of calendar days that the plant will be available to the
Contractor to complete all Mandatory and Optional Work Items.
Answer 5: Please refer to the response to Question 1 above. Given the uncertainty as to the specific date of award, and the date of arrival of the vessels at the Contractor’s dry dock facility, the government cannot stipulate in advance the number of calendar days that the vessels will be available to the
Contractor to complete the work. However, offerors are required to provide information on the Proposal
Schedules as to the number of days that they require to complete the work. If delivery of the vessels to the Contractor is so delayed that the Contractor will not have the number of days that they indicated in their offer were required for completion of the work, the government will modify the contract and extend the completion date to provide the required number of days indicated on the Proposal Schedule.
Question 6: The total period between Proposal Due Date and the Contract Completion Date is only
48-days. Please advise how late into the contract performance period, after the Award Date, the
Government may exercise an Optional Work Item without extending the contract completion date.
Answer 6: If the government awards Item 9 Crop and Replace Port Side Plating and Steel Pipe Fendering
(Optional), it will be done as part of the initial award. Optional items 11-13 and 23-25, for electric welding and cropping and renewing steel, will only be exercised as part of contract modifications to address unplanned repair needs that may emerge based on hull soundings and visual inspections of the vessels in the dry dock. Negotiations for such modifications would address the need for extension of the completion date, and for award of optional Items 10, 14, 22, and 26. Award of the optional dockage items 14, 15, and 26, may also be required if weather prevents departure of the vessels from the shipyard upon completion of the repair work. In this case, the contract completion date would also be extended to accommodate provision of the dockage services.
