Performance Work Statement Catered Meals

1. Introduction: The Texas Army National Guard will at times require the services of a caterer. A catered meal is defined as “a meal prepared in a commercial establishment for consumption there or delivered to a specific location, or prepared at the consumption site using the caterer’s portable equipment and subsistence supplies.” There is no authority for a caterer to use Government‐furnished equipment or Government‐furnished facilities to prepare the meals. Catered meals are authorized to the National Guard and Reserve Components in accordance with AR 30‐22, Operating Procedures for the Army Food Program, Para 3‐42.

2. Scope of Work: The caterer shall provide personnel, supervision, and any items and services necessary to perform full catering services and in accordance with State and Local sanitation law requirements. All setup, serving, breakdown and cleanup will be the responsibility of the contractor. Installation access for contractor vehicles and personnel must be coordinated with the unit point of contact.

3. Contract Tasks Performed by the Caterer

3.1 Prepare food listed on menu provided in response to the Request for Quote or Request for Proposal, according to commercially acceptable standards for the particular menu item. The caterer shall plan the menu to ensure that no “same main entrée meat, starch or vegetable combination menu” is served within a 7‐day period for any lunch or dinner meal. The caterer shall provide all plates, napkins, bowls, cups, cutting utensils, serving utensils, and condiments to compliment the meal being served. Additionally, no “same menu” for breakfast should occur in a 5‐day period. Meal plan shall not include alcoholic beverages of any type. A minimum of two drinks per meal should be offered.

3.2 Comply with sanitation requirements of the State and Local laws regarding food code which would result in a satisfactory or better rating from a health inspections. To the greatest extent possible, all food should be prepared on the day it is to be served. All menu items will be prepared, transported, served and maintained at the temperatures recommended by the USDA. Food should be handled in strict adherence to food safety and precautions as recommended by the State of Texas and the U.S. Department of Agriculture (USDA) – http://www.fsis.usda.gov/fact_sheets/safe_food_handling_fact_sheets.

Caterer’s staff will wear hairnets and if handling food, must wear gloves and have a general neat and clean appearance.

Additionally, the staff shall be easily recognized. The Government’s kitchen area along with all cooking utensils will NOT be available to the contractor. Only the serving line will be utilized by the contractor for food distribution. Clean up and sanitation requirements will also cover the food distribution area. If violations occur, the contractor will be notified and future awards could be jeopardized.

3.3 Deliver timely service as stated in the award document. The caterer shall staff the operation with the optimum number of employees for efficient operation at all times. The staff will place emphasis on quality of service. The Government reserves the right to require the caterer to remove staffs that are deemed careless or otherwise objectionable.

3.4 The caterer will be responsible for portioning and serving each main menu meat, starch, and vegetable item to the soldiers, ensuring enough food is provided for all personnel attending the event. Additional second portions will be authorized only when all personnel have been served and if enough food is available. Contractor shall keep the serving area sanitary, clean and in compliance with health standards ensuring that all individual service items are replenished to provide a pleasant dining environment in either an indoor or outdoor service situation.

3.5 At a minimum, all caterers and designated assistant(s) must possess and maintain a current Food Managers Certificate issued by a program accredited by the Texas Department of State Health Services under Texas Health and Safety Code (HSC).

Certificates must be available for inspection at any time during the catering hours. The Government will not be held liable for the cost of certification. Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors, applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is the victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

1) COMPUTER EMPLOYEES: Under the SCA at section 8(b), this wage determination does not apply to any employee who individually qualifies as a bona fide executive, administrative, or professional employee as defined in 29 C.F.R. Part 541. Because most Computer System Analysts and Computer Programmers who are compensated at a rate not less than $27.63 (or on a salary or fee basis at a rate not less than $455 per week) an hour would likely qualify as exempt computer professionals, (29 C.F.R. 541.

400) wage rates may not be listed on this wage determination for all occupations within those job families. In addition, because this wage determination may not list a wage rate for some or all occupations within those job families if the survey data indicates that the prevailing wage rate for the occupation equals or exceeds $27.63 per hour conformances may be necessary for certain nonexempt employees. For example, if an individual employee is nonexempt but nevertheless performs duties within the scope of one of the Computer Systems Analyst or Computer Programmer occupations for which this wage determination does not specify an SCA wage rate, then the wage rate for that employee must be conformed in accordance with the conformance procedures described in the conformance note included on this wage determination.

Additionally, because job titles vary widely and change quickly in the computer industry, job titles are not determinative of the application of the computer professional exemption. Therefore, the exemption applies only to computer employees who satisfy the compensation requirements and whose primary duty consists of:

(1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;

(2) The design, development, documentation, analysis, creation, testing or modification of computer systems or programs, including prototypes, based on and related to user or system design specifications;

(3) The design, documentation, testing, creation or modification of computer programs related to machine operating systems; or

(4) A combination of the aforementioned duties, the performance of which requires the same level of…
