Section H - Special Contract Requirements
SPECIAL CONTRACT REQUIREMENTS
H.1. Contractor's Points of Contact. The Contractor shall, prior to beginning services under this contract and thereafter on a continuing basis, keep the Government informed of the telephone numbers where both he/she and his/her authorized representative (if one is appointed) may be contacted.
H.2. Service Contract Act. Offerors are advised that this procurement is subject to the requirements of the Service Contract Act, as amended, and attention is requested to the obligations of the Contractor under Section 4 (c) of the amended Service Contract Act. Any questions regarding these obligations shall be addressed to the Department of Labor.
H.3. Damage to Property or Injury to Persons. By execution of this contract, the Contractor agrees to hold and save the United States harmless from all claims for damages to property or injuries to persons which may arise from or be incidental to the performance of work under this contract, or for damages to the property of the contractor, or for damages to the property or injuries to the person of the Contractor's officers, agents, employees, or subcontractors, and the United States shall not be responsible for such damages or injuries.
H.4. Wage Rates. Professionals are exempt from Service Contract Act requirements (FAR Clause 52.222-41 and 52.222-42) and the subsequent applicable wage rates. However, there may be some categories of employees that the successful Contractor will employ in performance of this contract that require payment of a certain wage as required by the Department of Labor. Since it is not known during the solicitation process in which state the successful Contractor will be located nor all the labor categories a successful Contractor will use, each Offeror is required to submit, with their proposal a list of labor categories that might be affected by this contract.
Once the successful Contractor is selected and the labor categories and particular state are identified, a Department of Labor Wage Rate will be made a part of the contract award.
