SECTION 01100 PAGE 5

1.7 PHYSICAL CONDITIONS AND DATA

1.7.1 General

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

1.7.2 Physical Conditions

The physical conditions indicated on the drawings and in the specifications are the result of site investigations by the U.S. Army Corps of Engineers, Charleston District, Technical Services Division, Operations Branch, Navigation Section.

It highly recommended that bidders conduct their own investigations and decide for themselves the wetness of the site, the character of the materials, and the difficulties of performing the work.

1.7.3 Weather Conditions

The areas in which work is to be done under these specifications are workable during the entire year; however, tropical storms may require that operations be suspended temporarily. The season for tropical storms is during the period June - October; during such disturbances precaution should be taken to secure all plant and equipment. In addition, heavy saturating rains can occur at any time of the year which will render the disposal site and/or materials too wet to work for extended periods of time.

1.7.4 Transportation Facilities

The Port of Charleston is served by Norfolk Southern Railway

System and CSX Transportation Railroad. Marine repair facilities, docking and fueling facilities, provisions, and marine supplies are also available.

1.7.5 Tides

The mean range of tide at U.S. Customhouse Wharf, Charleston, South Carolina is 5.22 feet and spring range is

6.15 feet.

SECTION 01100 PAGE 6

The mean range of tide in the vicinity of Clouter Creek

Disposal Area (north entrance of Clouter Creek into Cooper River) is 5.48 feet and spring range is 6.36 feet.

1.7.6 Location and Access

Clouter Creek Disposal Area is located on the east bank of the Cooper River, about four (4) miles upstream of the confluence of the Wando and Cooper Rivers, and about seven

(7) miles north of Charleston, South Carolina, and is accessible only by water. A fixed concrete pier on the Cooper River side of the South Cell may be used by the Contractor to tie up a work boat or crew boat. The Contractor shall obtain any and all rights-of-entry across private lands that he may use. The Contractor shall be held responsible for liabilities of any nature or kind arising from any trespassing or damage occasioned by his operations.

1.7.7 Condition of Site

It is highly recommended that prospective bidders examine the areas of work, prior to submission of bids, in order to determine for themselves the accessibility for transportation of personnel, supplies and equipment and also to familiarize themselves as to the nature and general arrangement of work areas.

1.7.8 Records

Field notes, maps, records, and other design data used to formulate the plans and specifications for this work are available for review at the U.S. Army Corps of Engineers, Charleston District, Technical Services Division, Operations Branch, Navigation Section, 69A Hagood Avenue, Charleston, South Carolina. To view these records, bidders may schedule an appointment with Mr. Brian Wells, phone (843) 329-8049.

Copies of historical files other than those which Mr. Wells has assembled may be requested under the Freedom of Information Act, attention: Office of Counsel. These records will be released to the Bidder within ten working days after the receipt of a proper Freedom of Information Act (FOIA) request.

SECTION 01100 PAGE 7

1.8 PAYMENT FOR SUSPENSION OF WORK, MOVEMENT OF EQUIPMENT,

DOWNTIME, AND BOGGED-DOWN TIME (SAC - RENTAL ONLY)

(a) The Government may suspend operations of any and all equipment when conditions exist which would hinder satisfactory performance. These conditions include, but are not limited to, adverse weather, wet materials, unstable foundations, or Contractor inefficiency. No payment will be made for lost time under such suspensions. The Contractor has the option, under suspensions of more than fourteen (14) calendar days, of moving equipment from the site of assignment, as convenience requires. If the Contractor exercises this option, additional mobilization and demobilization costs will be negotiated, but only in cases where such suspension does not involve Contractor inefficiency. The plant shall be returned, during such authorized suspensions, within five (5) calendar days after receipt by the Contractor or his authorized representative of notice to resume operations.

(b) Movement of equipment from designated mobilization points to areas where work is directed to begin and other movement within the disposal area, as directed by the Contracting Officer, will be paid for at the specified hourly rate. Maintenance and repair including routine fueling and lubrication are the Contractor's responsibility and no payment, therefore, shall be made for such downtime. It shall be the responsibility of the operator to determine suitability of supporting ground prior to advance. If the operator advances a piece of equipment in a negligent manner (as determined by the Contracting Officer) and "bogs" it down, no payment will be allowed for such "bogged-down" time.
