WORK RESTRICTIONS

3.1.1 Temporary Construction Features

The Government may require the Contractor to perform the work identified as option item(s) (CLIN(s) 1001 through 1006) at the price stated in the Schedule. The Contracting Officer may exercise the option(s) by written notice to the Contractor at any time before the required completion date stated in 52.236-27 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK or any extensions thereto.

Is hereby changed to state:

The Government may require the Contractor to perform the work identified as option item(s) (CLIN(s) 1001 through 1006) at the price stated in the Schedule. If awarded, the option items(s) shall be awarded at the time of contract award.

Site Visit:

A site visit was conducted on Tuesday, December 1, 2020. The following vendors where in attendance:

LS Marine – Taylor Luke, Dale Rother Kaiyuh Services – David Roels, Chantelle Wernecke J.F. Brennan – Zach Pontzer

The following questions were asked and addressed:

Q - What are the access dredging limits; what is allowed?

A – In this location, there are a lot of compressible soils. We are envisioning building in stages; to a certain height in one season, and then further in the next season. This is stated in the specs.

Q - Can we assume that the we will have full access (minus the eagle exclusions zones) to the main channel through this way?

A - To our knowledge, yes, but you would need to coordinate with the industries.

Q – Are you going to provide depths on here; was there a survey? Did we provide bathometric data, and how old, and how was it collected?

A – The Vendor was asked to submit the question.

Q - If there is a mud wave, what are we to do with the excess. If you have a mud wave, where do you put it?

A - Plans and specs do not assume any removal of mud waves.

Q – Is this the same area in which we can put trailers, laydown yard, whatever we may need; or is there a separate area for that?

A – The staging areas are in the plans.

Q – So anything in this area would need to be coordinated with the industrial sites?

A – Yes.

Q - Are there any restrictions on means or methods; whether mechanical or hydraulic?

A - No

Q - There is an exclusion zone at the far end (North) does that have to do with the utility lines?

A – Environmental exclusion. Although, there may be multiple, those of us currently on the ground are not sure.

Would you please confirm if a subcontracting plan is required since FAR 19.702(b) states that subcontracting plans are not required from a small business. Said another way, we are asking if the increased SB participation that is required is in line with the above referenced FAR clause.

On: Nov 25 2020.

A subcontracting plan is not being required of small businesses in accordance with the FAR. A small business participation plan is being required from all offerors in accordance with the DFARS 215.

Paragraph 1.9.1.2: If the Contractor chooses to place temporary features and is required to use the material on the islands, why would the survey volume calculation differ from the barge count segregation? Shouldn't these volumes match?

On: Dec 14 2020.

The recovered volume is expected to be less than the originally placed volume (as measured) for the following reasons:

1) Removal of temporary feature is limited to 8" above the existing ground – to avoid fines materials mixed in with placed granular.

2) Potential settlement of the temporary structure due to soft soil conditions

3) Erosion (water and wind) of the temporary structure during its lifetime in place

As defined on the plans, there are currently no eagle's nests within the 660' exclusion zone. However, 3.2 states that the survey for nests was conducted in 2016 and prior to construction (and each year following), a survey would be completed to determine if any new nests are in the area. In the event a new nest is found and the construction boundaries are within an exclusion zone, will the government reimburse the contractor for expenses associated with delays in the work or additional costs for work-arounds?

On: Dec 15 2020.

Yes, the construction pads are optional, and can be added or relocated as necessary. The Contractor’s Work Plan must indicate where construction pads will be constructed. See amendment 0002 for revised specifications.

On: Dec 15 2020.

While the Government tries to show all utilities on the plan sheet, there may be utilities unknown to the Government. Per the contract requirements, the Contractor shall identify and locate all utilities in the vicinity of the work and take all necessary precautions to ensure the protection of those utilities.

On: Dec 15 2020.

The contractor may request additional compensation via the terms and conditions of the contract.

8970199

3.5 addresses 'Slides'. For the purposes of the project, is a 'Slide' the same as a 'Global Stability Failure'?

Also, the section identifies that in the event of a Slide, the contractor is to restore the feature at no additional cost to the Government. If additional material is required from the borrow site, is the contractor going to be compensated per the unit prices in the contract? Will the native material be allowed to remain within the project site, or will the Government require the material be exported to the borrow sites? Or will the Government require the material be disposed of in a different manner?

On: Dec 15 2020.

Paragraph 3.5 has been removed from the specification section. See amendment 0002.

8970207 35 20

1.5 indicates mud waves are expected. What is the intent to do with the material produced from the mud wave (assuming all means and methods were utilized to minimize)?

On: Dec 15 2020.
