PART 3 EXECUTION

3.1 ISLAND BERM CONSTRUCTION

Place the granular fill material in such a manner as to minimize mud waves and reduce the potential for global stability failure. Refer to SECTION 35 20 23.40 13 PLACEMENT OF DREDGED AND STOCKPILED FILL MATERIAL for definitions, a summary of soil conditions and their anticipated response during construction, and suggestions for the Work and Placement Plan.

3.1.1 Temporary Construction Features

Temporary construction features include, but are not limited to, sand bridges, construction pads, and sand plugs. These temporary features (where shown) are not required, but may be necessary for proper prosecution of work under this contract and are at the option of the Contractor.

If the Contractor determines different or additional locations for temporary features are necessary for the proper prosecution of work under this contract, this information must be submitted in the Work and Placement Plan in accordance with SECTION 35 20 23.40 13 PLACEMENT OF DREDGED AND STOCKPILED FILL MATERIAL, and approved by the Contracting Officer.

Temporary features are considered to be incidental and will not be a separate bid item for payment. If the Contractor chooses to construct the temporary features shown on the plans, the Contractor must reuse the material on the islands, and comply with the Island Construction - Granular Fill Measurement paragraph in SECTION 01 22 0.00 10 MEASUREMENT AND PAYMENT. A spoil site for the temporary feature material will not be provided by the Government.

3.1.2 Overwintering Seed Mix

For construction season 1, after the initial placement of granular material, island berms shall be left without fine fill and unseeded overwinter in order to determine island settlement. After the second construction season, and subsequent seasons, no finished construction area shall be left without fine fill and unseeded during the winter months.

Place overwintering (temporary) seed in accordance with SECTION 32 92

19.00 13 SEEDING

SECTION 01 14 00.00 13 Page 3

3.2 EAGLE NEST EXCLUSION ZONE RESTRICTIONS

Four active eagle nests in the project area were identified in 2016. The nests and the 660 foot buffer are located as shown on the contract plans.

Prior to start of the construction season in spring of 2021 and future years, the United States Fish and Wildlife Service (USFWS) will conduct eagle nest surveys for the project area. If the nests at these locations are determined to be active or if additional active nests are identified within the project area, the USFWS will notify the Contracting Officer.

The Contractor will be notified of new active nest locations and comply with the avoidance measures specified herein.

3.2.1 Required Bald Eagle Protection Act Avoidance Measures

The Contractor's activities near any active eagle nest shall comply with the avoidance measures of the Bald and Golden Eagle Protection Act (16 U.S.C.668-668c) as follows:

(1) Maintain a buffer, identified as the eagle nest exclusion zone, of at least 660 feet (200 meters) between project construction activities and any active nest.

(2) Restrict all project construction activities within 660 feet of any identified active eagle nest to outside the nesting season (i.e. outside the nesting season is from August through mid-January in the Midwest). The USFWS will determine when nesting activity has ended (i.e.,eaglets have fledged) and will notify the Contracting Officer that the Contractor may immediately proceed with construction activities within the eagle nest exclusion zone.

(3) Maintain established landscape buffers that may screen the activity from the nest.

3.2.2 Identification of Limits of Eagle Nest Exclusion Zone

Clearly mark the limits of all eagle nests. Show exclusion zones that overlay with the project features such as site access, dredging, and island construction.

3.3 PIGS EYE ISLAND HERON ROOKERY SCIENTIFIC AND NATURAL AREA (SNA)

The SNA is identified as an EXCLUSION ZONE with RESTRICTIONS, and is denoted on the contract plans. Do not enter the SNA exclusion zone boundary. Clearly mark the limits of the exclusion zone with floating in-water boundary markers in accordance with the Minnesota DNR's Public Waters Work Permit provided as an attachment in SECTION 01 57 20.00 13.

3.4 FISHERY PROTECTION Zones - Work Exclusion Dates

No activity affecting the bed of the protected water may be conducted between April 1 and June 30, to minimize impacts on fish spawning and migration. If this type of work is essential during this timeframe, it shall be done only upon written approval of the Area Fisheries Manager.

See contact list at:

http://files.dnr.state.mn.us/fisheries/management/dnr_fisheries_managers.pdf.

Should work begin elsewhere in the project area within these dates, all exposed soils that are within 200 feet of Public Waters and drain to those waters must complete erosion control measures within 24 hours.

SECTION 01 14 00.00 13 Page 4

All work must be in accordance with the Public Waters Work Permit provided as an attachment in SECTION 01 57 20.00 13.

3.5 ACCESS DREDGING (optional)

Access dredging shall be determined by the Contractor's means and methods, and will not be a separate bid item. The Contractor shall perform access dredging only at locations within the permit limits and as approved by the Contracting Officer.

Water depths in the river and access channel are sufficient for the Contractor's dredging equipment to reach the beginning of Pigs Eye Lake without the need for dredging.
