SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been added by full text:

QUESTIONS & ANSWERS

Questions & Answers Q: Can I get last year’s contract prices? What has changed in this solicitation?

A: The previous contract for maintenance services at this site was W912ES-13-P-0054. This contract was awarded to Jason Hearn for a total price of $375,945.61 for the base year and 4 option years. The current solicitation has numerous changes from the previous contract, including eliminating Picnic Shelter Custodial Services, a change in the number of waste cans, eliminating responsibility for supplying hand sanitizer, adding Responsibility for the main swimming beach and fishing piers have been added and changes made to the frequency and standards of some cleaning services. The period of active contract performance, as well as the units of measure for payment have also changed.

Q: The solicitation SOW states that fish waste must be disposed of “off site.” Please clarify where “off site” is. Whose responsibility is the disposal (and any associated fees)?

A: "Off Site" means an appropriate commercial or private waste disposal site (e.g. landfill, incinerator, compost, etc.) not located on Federal Property. It is the contractor's responsibility to ensure that this waste is handled and disposed of properly, as are all costs associated with the transportation and waste disposal fees.

Q: The SOW states that drains in comfort stations and fish houses need to be free flowing. Does this mean that on May 1 (start date of contract), said drains are already free flowing, and not slow draining or clogged?

A: Yes; drains will be free flowing on May 1, when contract performance begins.

Q: The SOW states that uniforms are requested. Previous Federal contracts [at other facilities] stated “uniform type” clothing must be worn. Is this a new requirement? Is this a contractor expense?

A: Uniforms are REQUIRED. As stated in the solicitation SOW, "The contractor shall furnish his/her employees with uniforms consisting of long or short sleeved shirts with collars, long pants and steel-toed shoes and all personal protective equipment required under EM385-1-1. All uniforms shall be of the same color and style. Uniforms will be maintained in a serviceable condition without rips, holes, missing buttons, etc. The contractor shall ensure that the uniform is regularly cleaned so that when worn it is clean, neat, and presentable. Workers not meeting the criteria specified above shall not be allowed to perform duties under this contract until such time as the uniform violations have been corrected."

W912ES-17-T-0025

Q: [The solicitation] states under Executive Order (EO) 13706 the listed categorized labor rates.

Does the Health & Welfare - $4.27 apply to part-time seasonal labor?

A: Executive Order 13706 established Paid Sick Leave for Federal Contractors. Under the final ruling, employees accrue 1 hour of paid sick leave for every 30 hours worked on or in connection with a covered contract. Please see https://www.dol.gov/whd/govcontracts/eo13706/PaidLeaveFS.htm for more detail.

Executive Order 13658 establishes the minimum hourly wage for employees working on or in connection with Federal Contracts subject to the Service Contract Act (SCA). "If this contract is covered by the EO, the contractor must pay ALL workers in any classification listed on this wage determination at least $10.20 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2017." “All workers” includes part-time seasonal labor.

Every covered contract in excess of $2,500 contains a provision specifying the fringe benefits to be furnished to service employees and must be paid in addition to the minimum wage. The fringe benefit amount is listed in the wage determination. SCA makes no distinction, with respect to its compensation provisions, between temporary, part-time, and full-time employees. However, temporary and part-time employees are only entitled to an amount of the fringe benefits specified in an applicable determination which is proportionate to the amount of time spent in covered work.

Please see www.dol.gov for more information on required compliance with wage determinations.

Q: What is the policy with regard to the option years? Is it the option of both the contractor and the Government if they want to exercise the option years?

A: The option periods in this type of contract are a unilateral right which may be exercised by the Government. The contractor proposes and agrees to the pricing for all five years of the contract (base year + four option years) when signing the contract. If the Government exercises an option, the contractor is obligated to provide the services required to fulfill the contract, at the rates agreed upon at the contract signing. If the Government chose not to exercise an option (such as a major change in requirements), the contract would end, and the obligations of all parties would be considered fulfilled.
