Section C - Descriptions and Specifications
SECTION C1 – DESCRIPTION/SPECIFICATIONS
1 DESCRIPTION OF WORK
1.1 Scope
The Army Corps of Engineers is issuing this Request For Proposals (RFP), to acquire a base of 25,000 squares of articulated concrete mattress (ACM) with an option to acquire an additional 25,000 squares of articulated concrete mattress. The ACM will not be cast at the required delivery location, but instead will be at a location proposed by the bidder and approved by the Government. These squares shall be cast using the dimensional tolerances as read in these specifications in Section E, Paragraph 6 ACCEPTANCE and as seen on Drawing No. 3 and 4. The Government will provide the Contractor with a base of 25,000 units of wire mesh and an additional 25,000 units of wire mesh as needed if the additional option of 25,000 squares of ACM is exercised. The dimensions of the wire mesh are seen in Drawing No. 3. The Government will provide 150 forms to cast the articulated concrete mattress in. These can be seen in Drawing No. 4. Both sets of Government Furnished Equipment (wire mesh and forms) will be delivered to the Contractor’s casting facility by the Government or their approved representative.
Articulated Concrete Mattress cast by the Contractor will be delivered by truck or barge to St Francisville Casting Field at 11376 Ferdinand St, St. Francisville, LA 70775 or either optional location as specified in the contract. The articulated concrete mattress must meet a compressive strength of 3,000 psi at 28 days per ASTM C 39/C 39M and must be delivered to the site and delivered in orderly rows as laid out in Drawing No. 2.
The work to be performed under this contract consists of furnishing all plant, materials, equipment, supplies, labor, and transportation, including, fuel, power, water (except as provided in Section H1 – SPECIAL CONTRACT REQUIREMENTS, paragraphs entitled "GOVERNMENT-FURNISHED FACILITIES" and "IDENTIFICATION OF GOVERNMENT-FURNISHED PROPERTY"), and performing all work as required in casting, finishing, curing, delivering, and unloading squares of articulated concrete mattress to the location and in the quantity shown on the Bid Schedule, in strict accordance with the specifications, schedules and drawings, all of which are made a part thereof, and including such detail drawings as may be furnished by the Contracting Officer from time to time during the prosecution of the work. Upon completion of the Basic quantity of mattress to be cast, the Government may require the Contractor to complete all unfinished stacks of mattress as in accordance with the variation in quantity clause of Section F – DELIVERIES OR PERFORMANCE, paragraph entitled "VARIATION IN QUANTITY (FAR 52.211-16 – APR 1984)". The Government may elect to cast all or any portion of the Optional Work quantity specified.
1.1.1 General Requirements
The intent of these specifications is to secure articulated concrete mattress to armor the banks of the Mississippi River. Articulated Concrete Mattress units or squares consist essentially of 16 concrete blocks which are cast on Government furnished wire mesh within a Government furnished mat form to construct an articulated unit 25 feet by 4 feet by 3 inches thick. One square of the non-corrosive 16-block wire mesh consists of two longitudinal wires and eight bracket wires, as illustrated in Drawing No. 3. The wire mesh, therefore, is used as an assembly system for interconnecting the 16 concrete blocks of a concrete mattress unit. Once the concrete is poured onto the Government furnished wire mesh within the Government furnished mat form the concrete will be allowed ample time to cure and reach a 28 day compressive strength of 3,000 psi per ASTM C 39/C 39M. Once the 28 day compressive strength of 3,000 psi has been reached the Contractor shall be allowed to deliver the articulated concrete mattress squares to the St.
Francisville Casting Field. The vicinity map for the St. Francisville Casting Field is seen on Drawing No. 1. The Contractor shall be responsible for the loading, transportation, and the orderly delivery of the squares to the location provided. All squares must be unloaded by the Contractor at St. Francisville Casting field in a stack that is 13 squares tall in an orderly fashion as directed by the Contracting Officer. The basic layout of the field can be seen in Drawing No. 2.

Portland Cement shall conform to ASTM C 150, low alkali, Type I, including false set requirements, except that the maximum amount of C3A shall be 15 percent.
4.1.2 Quality Control and Quality Assurance
The Contractor shall notify the Contracting Officer of the source from which the cement will be obtained within ten days after award of the contract. Cement will be accepted on the basis of a manufacturer's mill certificate of compliance. Unless otherwise authorized, no cement shall be used until a satisfactory manufacturer's mill certificate for that cement is in the possession of the Contracting Officer at the site of the work and same has been accepted. If the manufacturer's certificate indicates that the cement, which has been delivered, is unsatisfactory, it shall be promptly removed from the site of the work by and at the expense of the Contractor. Cement samples may be tested periodically during the casting season, at the Government's expense, to check compliance with the specifications. Cement, which has not been used within four months after testing, shall be retested at the expense of the Contractor when directed by the Contracting Officer and will be rejected if test results are not satisfactory.
4.2 OTHER ADMIXTURES AS NEEDED
Additional admixtures may be used for this contract with approval by the contracting officer.
Any admixtures that will be used in this contract must be approved by the contracting officer by:
1 – Acceptance/award of the Contractor’s proposal to initiate the contract that specifies the use of a specific additional admixture.
2 – Written approval from the Contracting Officer if any additional admixtures will be used to construct articulated concrete mattress that vary from the Contractor’s initial approved proposal at contract award.
4.3 Aggregate
4.3.1 General
All aggregates used in concrete for casting mats shall be obtained from a listed source in accordance with Section H1 – SPECIAL CONTRACT REQUIREMENTS, paragraph entitled "AGGREGATE SOURCES”. Aggregate, as delivered to the mixer, shall consist of clean, hard, and uncoated particles.
4.3.2 Quality Control and Quality Assurance
The Contractor shall notify the Contracting Officer of the sources from which the aggregates will be obtained within ten days after award of contract. The aggregate will be accepted on the basis of Certificates of Compliance with accompanying gradation tests, which certify that the aggregates meet the specified requirements. Gradation tests shall be accomplished by the Contractor from materials at the aggregate source(s) prior to shipment to the Casting Field.
During construction, aggregate will be sampled in accordance with ASTM D 75/D 75M by the Contractor, as delivered to the mixer, to determine compliance with the specifications.
The Contractor shall provide facilities and labor as may be necessary for the ready procurement of representative test samples. Samples from the weigh batcher shall be obtained when directed by the Contracting Officer and under his/her supervision. The Government will test such samples at its expense using appropriate Corps of Engineers' and ASTM testing methods. Tests of aggregates at various stages in the casting process and handling operations will be made at the discretion of the Contracting Officer.
4.3.3 Fine Aggregate
Fine aggregate shall consist of natural sand, or a combination of natural and manufactured sands. The quality of the fine aggregates shall conform to ASTM C 33/C 33M.
4.3.4 Coarse Aggregate
Coarse aggregate shall consist of gravel, crushed gravel, crushed stone, or a combination thereof. Materials from different aggregate sources shall be stockpiled separately. When required, fines shall be removed from the coarse aggregates by adequate washing, or another suitable method approved by the Contracting Officer. The quantity of flat and/or elongated particles in the separate size groups of coarse aggregates, as defined and determined by ASTM D 4791, shall not exceed 25 percent. The quality of coarse aggregate shall conform to ASTM C 33/C 33M, Class 4M.
4.5 Water
Water for mixing shall be clean and potable, except that non-potable water may be used if it meets the requirements of CRD-C 400. Water for curing shall not contain any substance that is injurious to the concrete.
4.6 Kraft Paper
The paper used as separators between mattress squares shall not be less than 48 inches wide and not greater than 50 inches in width and shall conform to the maximum requirements set out in Commercial Item Description Notice – CID A-A- 203C, Style 1 with the exception of the requirements specified herein. The paper basis weight shall be not less than 99 pounds; that is, 500 sheets, 24 inches by 36 inches shall weigh not less than 99 pounds. The Contractor may, at his/her option and at no additional cost to the Government, elect to use a heavier weight paper. The Contractor may use another material to separate the squares of concrete in a stack with prior approval by the Contracting Officer.
4.6.1 Quality Control and Quality Assurance
The Contractor shall either furnish mill certificates or certificates of compliance, in duplicate, to the Contracting Officer which certify that the paper meets the specified requirements.
5 ARTICULATED CONCRETE MATTRESS
5.1 Composition
5.1.1 Concrete
Concrete for articulated mattress shall be composed of at a minimum cementitious material, water, fine and coarse aggregate. Additional admixtures can be approved for use to cast articulated concrete mattress with the Contracting Officer’s written approval.
5.1.2 Strength
Concrete for articulated mattress shall achieve a minimum 28-day compressive strength of 3,000 pounds per square inch (psi).
6 CASTING
6.1 General
Squares of mattress shall be delivered in stacks as indicated Drawing No. 2. The stacks shall be neatly aligned vertically and by rows. At the beginning of delivery operations, if there are stacks that are not 13 squares high, the Contractor shall be required to complete these stacks first. When the Contractor approaches completion of the casting and delivery operations, he/she shall schedule concrete deliveries in order to complete the articulated concrete mattress delivery operation with no incomplete stacks. Incomplete stacks will be permissible only if completion cannot be achieved prior to the date established in the contract when casting and deliveries shall cease. At the conclusion of casting requirements and form cleanup, the steel forms and any additional wire mesh shall be picked up by the Government from the Contractor’s facility after the Contractor has cleaned and oiled all forms.
6.2 Casting Procedures - Form Placement
Kraft paper or another form of separation that is approved by the contracting officer is required between squares to assure that all squares are separated and do not attach to each other in the casting/delivery process. Any squares that are connected to each other will be rejected by the Government.
Wire Mesh (Drawing No. 3) and 150 mat forms (Drawing No. 4) will be supplied by the Government to complete the casting process. The Forms must be placed on a level surface.
Pouring mats on any unlevel surface is not acceptable. These forms shall be used to cast articulated concrete mattress and accomplish the required dimensions of each square. An example of the methodology that is currently used to cast articulated concrete mattress is found in the following paragraph:
Initially, Kraft paper shall be placed to allow for all concrete squares to be separate from any foreign object to include the surface of the earth or another concrete square. The wire fabric shall then be placed on the paper with the cross wires (bracket wires) on top of the longitudinal wires. Wire fabric that does not meet the required dimensions, as specified on Drawing No. 3, shall be removed and set aside. Once the wire is laid out the forms are then placed over the wire mesh. Forms shall not be placed upon a previously cast square of mattress until the concrete has obtained sufficient strength to withstand possible damage by the form.
The wire mesh is then drawn up into the notches in the sides and cross pieces of the forms and cross-rods driven to hold the wire mesh in place. If approved by the contracting officer the Contractor may use other methods to hold the wire mesh in place. The cams in the forms have been welded into the open position. Because of this, the Contractor must manually pull the wire mesh and secure it in its proper position, which is located in the center of the 3 inch layer of concrete and does not exceed more than a half inch above or below the central plane of the form section. The wire mesh shall be pulled up into and remain in its proper position, on the center plane of the form, with all four end loops being and remaining centered in height and flush with the outer edge of the mattress, during and after the concrete placement process. The central and lateral location of the fabric in the form is very important.
The corner of each square must be intact upon delivery. The definition of an acceptable corner is as follows. An acceptable corner shall be consolidated and have structural integrity with no defined structural cracks more than 1/3 of the distance between the scarfboxes in the corner or on two adjoining planes of the square. The wire within the square shall be encapsulated with no movement and the square shall have no unincorporated patches or cold joints within it.
6.2.1 Concrete Placement
Excessive thickness of individual squares shall not exceed 3/8 inch, and the height of the finished stacks shall not be in excess of 42 inches. Any squares in which the surface of the concrete is not finished flush with the top of the forms, resulting in "dished" tops or in excess of the allowable overbuild, will be rejected. The top of the completed stack shall be relatively straight and level, and the height of the center of the stack shall not be greater than 1-1/2 inches higher or lower than the ends of the stack.
Finished stacks shall not be out of plumb on the ends or sides by more than two inches. The maximum allowable offset between successive squares shall not exceed 1/4 inch on the ends or sides.
6.2.2 Roughened Finish
The top of each square shall be roughened to provide indentations of approximately 1/8 inch in depth and 1/8 inch in width. The depth shall in no way reduce the three inch required thickness of mat by more than 1/4 inch. The indentations may be made using a bull float with rollers that ride on the edge of the forms or another approved method by the Contracting Officer. The indentations shall be spaced no greater than one inch apart for the maximum width or no less than 1/2 inch apart for the minimum width. The roughening shall be performed at the end of the casting process or as approved by the contracting officer and at a time, which will provide indentations that meet the minimum width specified above. The indentations shall be installed in the longitudinal direction of the mat. The indentions shall include the whole mat other than the area above the centerline of the longitudinal wires. This area should have a buffer where no indentions will be allowed from said centerline of the longitudinal wire to 1 and ½ inches outward and inward on the block. A total buffer of 3 inches will be located over the longitudinal wire unless otherwise instructed by the Contracting Officer. This procedure is a Best Management Practice described in the Endangered Species Act Section 7(a)(l) Conservation Plan and should not be modified without coordination with the environmental resource agencies, pursuant to the Endangered Species Act. The Contractor's proposed plan for furnishing the roughened finish shall be submitted a minimum of 30 days prior to commencement of casting for review by the Contracting Officer. No separate payment will be made for roughening the mat. All costs, therefore, shall be included in the contract unit price per square for "Delivered Mattress”.
6.2.3 Form Cleanup and Form Straightening
After removal from the new mattress and placed on level ground, the forms shall be thoroughly chipped and brushed clean of all concrete prior to reuse. Use of equipment or procedures that causes damage to forms will not be allowed.
The straightening of forms will not be allowed while the form remains on the mattress. No form shall be replaced without approval of the Government Representative. Upon completion of any casting period, the cleaned forms shall be oiled and any damaged forms shall be straightened and repaired as necessary.
7 CURING AND PROTECTION
7.1 Rainy Weather
The Contractor shall take such steps as may be necessary to protect green concrete from rain damage. Any mattress, which is damaged due to lack of protection from rain damage, will be rejected. The following guidelines shall be followed in determining if a square has rainwash damage:
1. The concrete shall be given a uniform thickness of no less than 3 inches.
2. The concrete shall not have aggregate separation on the surface of the square.
Specifically, the coarse aggregate must be embedded into the concrete and have no movement by physical touch.
3. All corners of the block/square shall be undamaged. The corners shall not have any deterioration that would cause the corners to be out of shape or rounding.
These guidelines show examples of extreme cases of rainwash. If a square has not been rejected from rainwash and meets any of the above criteria it shall be rejected. This does not alter the finish requirements of any other squares.
8 EXCESS PAPER
Prior to final inspection of the mattress, all paper extending more than 1/2 inch outside the straight lines of the completed mattress shall be removed by tearing and/or burning. The following restrictions apply when burning is used as a means of removing the paper:
(1) Burning will not be permitted in violation of city, State or Federal Air Pollution laws.
(2) Burning will not be permitted if the concrete in the completed stack and adjacent stack is less than 14 days old.
(3) Burning agents such as gasoline or other highly volatile liquids will not be permitted. Diesel fuel, propane and kerosene are acceptable for use as burning agents. The amounts of burning agent used should be the minimum required to remove the excess paper. If the Contracting Officer determines that excessive amounts of burning agent are being used, the Contractor shall decrease the amount to an acceptable level.
9 REPLACING DEFICIENT MATTRESS

11.2 Casting Mattress
Measurement for articulated concrete mattress will be by the squares of articulated mattress cast, cured, and delivered in accordance with these specifications and accepted by the Contracting Officer. Payment will be made at the contract unit price per square for “Delivered Mattress to St. Francisville” once the concrete meets all requirements from Section E, Paragraph 6 ACCEPTANCE and Drawings No. 3 and 4. Price and payment shall constitute full compensation for producing, loading, transportation, and the orderly unloading of the concrete mattress at the designated location, and shall include all costs involved in any approved additional admixtures, roughening mattress materials, and full repair of forms entering into the completed mattress except:
12 Partial Payments
(1) As provided by the Contract Clause entitled “PAYMENTS” (FAR 52.232-1), payments will be made on partial deliveries at monthly intervals. However, if upon the determination of the Contracting Officer the amount due on deliveries warrants it, payments may be made at more frequent intervals. In the preparation of payment estimates, the Contracting Officer may authorize material delivered on the site to be taken into consideration.
(2) All material and work covered by partial payments made shall, at the time of payment, become the sole property of the Government, but this shall not be construed as:
a. Relieving the Contractor from the sole responsibility for all material and work upon which payments have been made or the restoration of any damaged work;
b. Waiving the right of the Government to require the fulfillment of all of the terms of the contract.
(3) In making these partial payments, the Government shall, upon request, reimburse the Contractor for the amount of premiums paid for performance and payment bonds (including coinsurance and reinsurance agreements, when applicable) after the Contractor has furnished evidence of full payment to the surety.
(4) In making these partial payments, the Government may adjust payment due to unacceptable performance in accordance with Section F – DELIVERIES OR PERFORMANCE, paragraph entitled "Prosecution and Completion", subparagraph entitled "Assessing Retainages".
13 Wet Field Conditions
Delivery operations, including the delivery of articulated concrete mattress shall not be permitted on the field during such periods when, in the opinion of the Contracting Officer, such operations would cause undue damage to the field or roadways. Such periods are notated in Section C1, paragraph 14.
14 Casting Field Flooding
The St. Francisville casting field is subject to flooding when the Mississippi river stage reaches elevation 49.0 feet at St. Francisville. This event has occurred several times in the past 20 years. Stage hydrographs for the Red River Landing (Drawing No. 5) and Baton Rouge (Drawing No. 6) gages are provided in the drawings. Delivery of articulated concrete mattress will not be allowed to the St. Francisville Casting Field during these events. In the event, St.
Francisville floods or Articulated Concrete Mattress cannot be delivered to St. Francisville the Government shall have the option to move deliveries to either Richardson Landing Casting Field or Delta Point Casting Field at the price identified in the bid schedule above (0002B, 0002C, 0004B, and 0004C).
15 TRIAL OPERATION
15.1 Batch Operation
Not less than 10 days prior to commencement of mat casting the Contractor shall make a full-scale trial test of the batching and mixing plant for each mix design to be used during this casting contract in order to check operational efficiency. The Contractor shall provide a minimum of 48 hour notice of the beginning of trial batch operations.
Government QA testing of the batching and mixing plant will be done in accordance with CRD-C 55, Test Method for Within-Batch Uniformity of Freshly Mixed Concrete by an ACI Field Grade I technician. During the trial batch operation the Contractor will cast a minimum number of cylinders to document the compressive strength at 24 hr, 7, 14, and 28 days in accordance with ASTM C 39/C 39M for each mix design.
The Contractor will also use this trial batch operation period to establish and document mixing times for each mix design.
The number of full-scale concrete batches required to be produced in trial runs will not exceed ten and shall be proportioned as directed by the Contracting Officer. During these trial runs, the Contractor will field adjust the design mix before production of mat begins to assure the required compressive strength and all tolerances found in this Section and Section E are obtained.
The Contractor shall set up forms and conduct a trial casting with the trial batch material.
The Contractor shall demonstrate his/her ability to perform casting by demonstrating the ability to produce the required compressive strength and be within all tolerances of the contract while producing a trial batch of 26 squares. If any deficiencies are found the Contractor shall show the ability to repair the squares at the time of the trial batch. The Contractor shall also show his/her ability to load, transport the squares a minimum of 1 mile, and unload the squares at this time to allow for the Contractor to initiate casting the Base Contract. Disposal of the trial batch material shall be conducted under the direction of the Contracting Officer.
Trial batch operations not meeting the required compressive strength and all tolerances found in this Section and in Section E will be addressed by the Contractor and deficiencies found in the operation shall be corrected and documented to the satisfaction of the Contracting Officer prior to start of concrete placing operations.
No separate payment will be made to the Contractor for plant, labor, or materials, required by the provisions of Section 15 TRIAL OPERATION.
Section D - Packaging and Marking
SECTION D - PACKAGING AND MARKING
PART 1 PACKAGING
The articulated concrete mattress shall be packaged in bundles of uniform quantities of concrete squares. The number of squares of articulated concrete mattress packaged per bundle shall be uniform throughout the contract and shall not exceed 13 concrete squares high without the Contracting Officer’s approval. If the Contractor must transport the squares of articulated concrete mattress in a bundle that is less than 13 concrete squares high, the Contractor shall deliver the squares in stacks of 13 concrete squares high at the delivery location. The Contractor shall advise the Contracting Officer of the number to be contained in each bundle prior to delivery of the first shipment. Sufficient bracing and/or buffer material shall be used between bundles to prevent damage to the articulated concrete mattress caused by vibrations or movement during shipment. If alternate packaging methods and materials are proposed, samples shall be submitted to the Contracting Officer for approval before being used. Care shall be taken to avoid damage to articulated concrete mattress during packaging, shipment, and delivery. The finished bundles will be inspected by the Contracting Officer's Representative. All articulated concrete mattress damaged during packaging shall be corrected prior to shipping at no additional cost to the Government. If a bundle is damaged in transit or while loading and/or unloading, it will be rejected at the loading or delivery point and the Contractor shall be responsible for replacement of the entire bundle at his expense.
PART 2 MARKING
Each bundle of articulated concrete mattress shall be permanently marked to show the contract number, the number of pieces contained therein, and an identifying number or code for the particular bundle. The required information shall be marked on each bundle in a manner that is noticeable at delivery.
PART 3 PAYMENT
All cost of packaging, preparing for shipment, and shipment shall be included in the applicable contract unit price.

52.246-2 INSPECTION OF SUPPLIES--FIXED-PRICE (AUG 1996)
(a) Definition. "Supplies," as used in this clause, includes but is not limited to raw materials, components, intermediate assemblies, end products, and lots of supplies.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering supplies under this contract and shall tender to the Government for acceptance only supplies that have been inspected in accordance with the inspection system and have been found by the Contractor to be in conformity with contract requirements. As part of the system, the Contractor shall prepare records evidencing all inspections made under the system and the outcome. These records shall be kept complete and made available to the Government during contract performance and for as long afterwards as the contract requires. The Government may perform reviews and evaluations as reasonably necessary to ascertain compliance with this paragraph. These reviews and evaluations shall be conducted in a manner that will not unduly delay the contract work. The right of review, whether exercised or not, does not relieve the Contractor of the obligations under the contract.
(c) The Government has the right to inspect and test all supplies called for by the contract, to the extent practicable, at all places and times, including the period of manufacture, and in any event before acceptance. The Government shall perform inspections and tests in a manner that will not unduly delay the work. The Government assumes no contractual obligation to perform any inspection and test for the benefit of the Contractor unless specifically set forth elsewhere in this contract.
(d) If the Government performs inspection or test on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties. Except as otherwise provided in the contract, the Government shall bear the expense of Government inspections or tests made at other than the Contractor's or subcontractor's premises; provided, that in case of rejection, the Government shall not be liable for any reduction in the value of inspection or test samples.
(e)(1) When supplies are not ready at the time specified by the Contractor for inspection or test, the Contracting Officer may charge to the Contractor the additional cost of inspection or test.
(2) The Contracting Officer may also charge the Contractor for any additional cost of inspection or test when prior rejection makes reinspection or retest necessary.
(f) The Government has the right either to reject or to require correction of nonconforming supplies. Supplies are nonconforming when they are defective in material or workmanship or are otherwise not in conformity with contract requirements. The Government may reject nonconforming supplies with or without disposition instructions.
(g) The Contractor shall remove supplies rejected or required to be corrected. However, the Contracting Officer may require or permit correction in place, promptly after notice, by and at the expense of the Contractor. The Contractor shall not tender for acceptance corrected or rejected supplies without disclosing the former rejection or requirement for correction, and, when required, shall disclose the corrective action taken.
(h) If the Contractor fails to promptly remove, replace, or correct rejected supplies that are required to be removed or to be replaced or corrected, the Government may either (1) by contract or otherwise, remove, replace, or correct the supplies and charge the cost to the Contractor or (2) terminate the contract for default. Unless the Contractor corrects or replaces the supplies within the delivery schedule, the Contracting Officer may require their delivery and make an equitable price reduction. Failure to agree to a price reduction shall be a dispute.
(i)(1) If this contract provides for the performance of Government quality assurance at source, and if requested by the Government, the Contractor shall furnish advance notification of the time (i) when Contractor inspection or tests will be performed in accordance with the terms and conditions of the contract and (ii) when the supplies will be ready for Government inspection.
(2) The Government's request shall specify the period and method of the advance notification and the Government representative to whom it shall be furnished. Requests shall not require more than 2 workdays of advance notification if the Government representative is in residence in the Contractor's plant, nor more than 7 workdays in other instances.
(j) The Government shall accept or reject supplies as promptly as practicable after delivery, unless otherwise provided in the contract. Government failure to inspect and accept or reject the supplies shall not relieve the Contractor from responsibility, nor impose liability on the Government, for nonconforming supplies.
(k) Inspections and tests by the Government do not relieve the Contractor of responsibility for defects or other failures to meet contract requirements discovered before acceptance. Acceptance shall be conclusive, except for latent defects, fraud, gross mistakes amounting to fraud, or as otherwise provided in the contract.
(l) If acceptance is not conclusive for any of the reasons in paragraph (k) hereof, the Government, in addition to any other rights and remedies provided by law, or under other provisions of this contract, shall have the right to require the Contractor (1) at no increase in contract price, to correct or replace the defective or nonconforming supplies at the original point of delivery or at the Contractor's plant at the Contracting Officer's election, and in accordance with a reasonable delivery schedule as may be agreed upon between the Contractor and the Contracting Officer;
provided, that the Contracting Officer may require a reduction in contract price if the Contractor fails to meet such delivery schedule, or (2) within a reasonable time after receipt by the Contractor of notice of defects or nonconformance, to repay such portion of the contract as is equitable under the circumstances if the Contracting Officer elects not to require correction or replacement. When supplies are returned to the Contractor, the Contractor shall bear the transportation cost from the original point of delivery to the Contractor's plant and return to the original point when that point is not the Contractor's plant. If the Contractor fails to perform or act as required in (1) or (2) above and does not cure such failure within a period of 10 days (or such longer period as the Contracting Officer may authorize in writing) after receipt of notice from the Contracting Officer specifying such failure, the Government shall have the right by contract or otherwise to replace or correct such supplies and charge to the Contractor the cost occasioned the Government thereby.
