The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

This paragraph applies to contracts and purchase orders that require the contractor to comply with EM 385‐1‐1 (e.g., contracts that include the Accident Prevention clause at FAR 52.236‐13 and/or other safety provisions). The Contractor shall be responsible for complying with the current edition and all changes posted on the web as of the effective date of this solicitation.
ACCESS FOR FOREIGN NATIONALS
SITE VISIT AND CONTRACT WORK: Security clearance for foreign nationals to attend a site visit or to perform onsite work requires a minimum of 4 weeks. Please send documentation by email (.pdf files are preferred) to ruth.a.johnson@usace.army.mil.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

(a) The Government will provide to the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.
(b) The Contractor shall--
(1) Check all drawings furnished immediately upon receipt;
(2) Compare all drawings and verify the figures before laying out the work;
(3) Promptly notify the Contracting Officer of any discrepancies;
(4) Be responsible for any errors that might have been avoided by complying with this paragraph (b); and
(5) Reproduce and print contract drawings and specifications as needed.
(c) In general--
(1) Large-scale drawings shall govern small-scale drawings; and
(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.
(d) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

Contract drawings created on CADD will be available in electronic form for use by the Contractor. No For Information Only drawings are available on CADD. The Contractor assumes all risks associated in using electronic CADD drawings. The contract drawings shall govern if there are any discrepancies between the electronic copy and the contract drawing. The Contractor shall promptly notify the Contracting Officer of any discrepancies. The Government will not be responsible to correct the electronic CADD drawing. If contract modifications are issued, the associated electronic CADD drawings will not be available to the Contractor. 1. Instructions to Prospective Offerors
A. Proposal Composition General Requirements
Proposals must set forth full, accurate, and complete information as required by this RFP. Proposals shall contain only data essential for evaluation of proposals to expedite both the RFP proposal preparation and evaluation.
To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein and in accordance with FAR Clause 52.212-2 Evaluation of Commercial Items. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the RFP solicitation at or before the exact time specified. There will be no public opening of the proposals received as a result of this solicitation. Failure to meet a requirement may result in an offer being ineligible for award.
Release of Information: After receipt of proposals, no source selection information will be available to any Offeror until contract award. This includes, but is not limited to, the relative standing of the offeror’s proposal or the number or identity of the participating offerors.
Proposal Expenses and Pre-Contract Costs: The Government is in no way responsible for costs incurred in the preparation and submission of a proposal or for any other costs incurred prior to the execution of a formal contract.

D. Subcontractors
The Government recognizes that completion of a project is often a team effort. Therefore, if an Offeror wishes to be credited with experience and/or past performance of a subcontractor, a letter of commitment signed by the subcontractor must be submitted. If a letter of commitment is not submitted, the experience and past performance of subcontractor firms will not be considered. If the Offeror’s proposal includes the use of subcontractors, the Offeror may not change subcontractors without the Contracting Officer’s approval. Approval will not be given unless the Contracting Officer considers the proposed substitute to be comparable in all respects to the originally proposed subcontractor and that the substitution is in the best interests of the Government. The consideration of subcontractor experience or past performance does not relieve the offeror from compliance with FAR 52.219-14, Limitations on Subcontracting. Also, see FAR 9.6 for additional information about teaming arrangements.
E. Proposal Submission
The Government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of the Offeror. The Government may reject incomplete proposals after initial evaluation without further consideration. Therefore, the proposal shall meet the following basic requirements.
a. The Proposal shall be typed and submitted in English and easy to read.
b. Proposal shall be organized, concise, and submitted in the volumes and in the order indicated below. Volumes shall be clearly identified and tabbed. Each factor shall be described in a separate tabbed section.
c. Proposals must be sent in two separate volumes. Each volume shall be contained within a separate binder. Each volume shall be identified by the solicitation number, volume number, and name, address, and telephone number of the prime Offeror on the binder cover. Each volume shall contain a Table of Contents and include at the bottom left side of each page, the volume and page number.
d. Offerors shall verify that the information for all forms submitted are current, correct and complete including names of the points of contact, email address, and telephone number.
e. Pricing Schedule(s), Volume II, shall be completed in full.
f. Offerors shall submit a CD copy of each proposal Volume.
g. Offerors shall submit a signed Standard Form 33 in Volume II for this solicitation, including verification of all amendments received.
h. Offerors are reminded that elaborate corporate marketing information, formatting, special reproduction techniques, etc. are not necessary. Proposals shall completely and adequately address the requirements of this solicitation.
i. If additional information is provided, it shall be in regard to the solicitation requirements only.
j. Failing to submit or properly complete attachments may result in rejection of the offer without further evaluation. Therefore, Offerors are urged to follow instructions and resend questions to the individual indicated below.

Three ring binders or bound with tabs or separators dividing each of the sections noted below.
Proposals shall be submitted on 8.5” X 11” paper, utilizing both sides of the paper unless otherwise stated under each Factor. Larger format drawings or tables may be added by folding them to fit within the binder. Paragraphs should be separated by at least one blank line. A standard 12-point font in either Arial or Times New Roman fonts is required. Tables and illustrations may use a reduced font size not less than 8-point and the layout may be landscape. The technical proposal shall be submitted in one binder and shall include the following information separated by tabs:
Tab IA Factor 1 – Recent Relevant Experience
Tab IB Factor 2 – Past Performance
Tab IC Factor 3 – Certification and Capability
Subfactor 3.1 – Contractor Facilities Subfactor 3.2 – Project Management Plan Subfactor 3.3 – Key Personnel and Subcontractors Subfactor 3.4 – Fabrication Schedule
This volume shall also include the following:
Letters of Commitment for Subcontractors, if applicable (see above paragraph D Subcontractors, and
FAR 9.6)
DO NOT INCLUDE ANY PRICE INFORMATION WITH THE TECHNICAL PROPOSAL
