FACILITIES DESCRIPTION. LCPP visitor center has three levels consisting of two restrooms, an elevator, stairwell, observation deck, and interpretive displays.

CONTRACT FORMAT. This is a fixed-priced performance based contract containing performance oriented requirements.

Performance requirements specify that services be performed to achieve a desired result. In these cases the Contractor’s performance shall be measured by his/her outcome to performance requirements contained in this contract.

1.1. JANITORIAL SERVICES. The Contractor shall provide the

following janitorial services for the visitor center at LCPP.

1.1.1. CLEANING PERFORMANCE STANDARDS - GENERAL: Visitor Center shall be cleaned and maintained so as to provide an aesthetically pleasing and sanitary environment in accordance with contract specifications and in a manner that does not damage any of the infrastructure or interfere with normal use of facility.

Subsequently, remove all stains, growths, mold, mildew, and other material adhering to these items with a suitable cleaning compound, and follow this process by removing all remaining cleaning compound residues with a damp cloth or sponge. Wetting of wooden and electrical components, excluding exterior walls, by hosing off, is not an acceptable procedure.

1.1.3 WALLS, PARTITIONS, DOORS, WINDOWS, SCREENS, AND LOUVERS.

Remove all cobwebs, insects, insect nests (including dirt dauber and wasp nests), and other foreign material from windows, screens, louvers, and screen doors. Also, remove all stains, growths, mildew, graffiti, and other material adhering to the walls, partitions, and doors with a suitable cleaning compound, and follow this process by washing with a solution of water and a biodegradable disinfectant cleaner. Spot removal procedure using cleaning compound shall not result in damage to the surfaces of the items being cleaned. Also, graffiti removal which requires sanding, re-surfacing, and/or painting is not a requirement of this contract. The disinfectant solution shall be mixed according to the cleaner manufacturer's label instructions for the application. Upon completion of disinfectant cleaning, remove all remaining cleaning compounds and wipe with a damp cloth or sponge to remove all streaks, water droplets, cleaners, and foreign material. The Contractor shall also remove any overflow or excess trash deposited around any trash receptacle. All trash and debris collected by the Contractor shall be disposed of in accordance with paragraph entitled “Solid Waste Disposal” of the contract.

1.3. GROUNDS INSPECTION AND LITTER PICKUP AND DISPOSAL

SERVICES. The Contractor shall inspect all grounds, roads, boat ramps, sidewalks, steps, and parking areas. These areas shall be free of all trash, paper, cans, pop top tabs, cigarette butts, bottles, wire, rope, string, dead animals and fish; fallen trees and fallen limbs not exceeding 6 inches in diameter, and all other foreign materials deposited thereon. All litter and debris collected by the Contractor shall be disposed of in accordance with paragraph entitled “Solid Waste Disposal” of the contract.

Additional information is listed for the Contractor’s use:

1.3.1. For road and parking area rights-of-way, litter removal shall be completed weekly with the result that no litter shall be left in the rights-of-way, irrespective of litter's distance or visibility from the roadway. The areas to be cleaned under this requirement shall be designated by the COR.

1.3.2. All maintained grounds, roadways, parking areas, roofs, and other public facilities shall be inspected for the presence of fallen trees and fallen limbs weekly. All fallen trees and tree limbs not exceeding 6 inches in diameter shall be removed when found. All fallen trees and fallen limbs exceeding this diameter shall be reported to the COR. The Contractor shall dispose of all limbs and trees in accordance with paragraph entitled “Solid Waste Disposal” of the contract.

1.4. MOWING, TRIMMING, AND PLANT BED MAINTENANCE.

1.4.1. PUBLIC USE AREA & ACCESS ROAD RIGHT-OF-WAY MOWING AND

TRIMMING. The Contractor shall perform mowing and trimming operations for LCPP. All grass, weeds, vines, and other vegetation shall be mowed or trimmed not less than 2.5 inches to maintain an average height not to exceed 5 inches, except in September and October, when this average height shall not exceed 6 inches. The approximate acreage and general description for mowing and trimming this area is shown in Exhibit B. The specific locations for mowing or trimming within this area shall be provided by the COR. This is a performance based contract, and therefore, mowing and trimming services are to be accomplished as needed for compliance with contract specifications. Contractors are encouraged to develop schedules that will minimize cost and provide contract proficiency. The minimum time spacing will be developed by the contractor for mowing and trimming services.

In the event that rainfall, high water, or other circumstances cause a delay in the performance of mowing and trimming in any area which subsequently results in mowing services being delayed, the Government is obligated to pay for only those accepted services meeting Acceptable Quality Levels (AQL) successfully completed during the billing period.

1.4.2. MOWING & TRIMMING PERFORMANCE STANDARDS AND OPERATIONAL

LIMITATIONS. The following performance standards are supplied for the Contractor’s use for mowing and trimming operations:

1.4.3. Mowing and trimming in a given area should be conducted concurrently so as to help maintain uniform grass height and aesthetic appearance.

1.4.4. Mowing or trimming operations may be conducted at Lake Chicot Pumping Plant Monday through Friday during daylight hours and on Saturdays, Sundays and Federal Holidays with advanced approval by the COR .

1.4.5. Mowing and trimming operations should be conducted in a prudent manner to protect the grass sod, project features, equipment, buildings, trees, shrubbery, and ground cover, and also to insure the safety of all persons and equipment around the mowing operations. Relatedly, the Contractor shall not allow the alignment or facing of any mower discharge in the general direction of buildings, vehicles, or persons within the potential range of objects which might be thrown from the mower. All mowers shall be equipped with deflector shields at the clipping discharge points to help alleviate the safety problem associated with thrown objects. However, the use of these shields shall not relieve the Contractor of any other requirements contained in this contract, including liability.

1.4.6. Mower blades shall be kept sharp to help assure clean

cutting and minimize grass foliage breakage and bruising as evidenced by the browning of the grass turf following mowing operations.

1.4.7. Prior to mowing in any area, the Contractor shall

inspect the area to be mowed, and remove all objects, fallen limbs up to 6 inches in diameter, and litter which could be scattered by or thrown from the mower during the operation. The Contractor shall not avoid the removal of any of this material by mowing around it. Should any litter or objects be inadvertently scattered by the mowing operation, the Contractor shall immediately retrieve and dispose of this material. All material collected by this operation shall be disposed of in accordance with paragraph entitled “Materials Hauling” of the contract.

1.4.8. The Contractor shall mow and trim to a uniform height so as to maintain an aesthetic appearance of the grounds.

1.4.9. In conducting mowing operations, the Contractor shall

not cause any rutting or sod damage. The Contractor is not relieved of any requirements for mowing and trimming in soft and damp areas unless all mowing procedures and/or equipment cannot be adjusted to prevent rutting or sod damage.

1.4.10. The Contractor shall utilize trimming methods, i.e., the use of sickles, sling blades, and mechanical trimmers and edger’s within those locations where the use of mowing equipment potentially endangers persons, property, or natural resources.

Such locations include, but are not necessarily limited to, the perimeters of buildings, posts, trees, shrubs, ground cover, sidewalks, curbs, parking blocks, telephone poles, guard rails, rip rap areas, recreational equipment, signs, piezometer markers, ditches, drains, and culvert headwalls. The Contractor shall exercise special care in trimming so as to avoid damage to the above items.

1.4.11. The COR may direct the Contractor to selectively not mow or trim certain areas containing vegetation which has aesthetic value, i.e., wildflowers at certain times of the year.

1.4.12 The Contractor may apply herbicide, in lieu of trimming, around non-living objects with prior written approval of the type, mixture, location, and method of application by the COR.

The Contractor shall provide herbicide at his/her own expense.

Prior to commencing any herbicide application, the Contractor shall submit copies of certifications and licenses indicating that all herbicide applicators proposed for use on the job are qualified and licensed in accordance with State of Louisiana, State of Arkansas and/or Federal requirements.

1.4.13. In the event that any mowing or trimming operation

results in the production of piles of clippings or other deposits of cut vegetation which, in the COR's opinion, may result in damage to the grass sod if left in place, then the COR may direct the Contractor to remove and dispose of such piles or deposits.

All clipping removal shall be at the expense of the Contractor.

1.4.14. Upon completion of mowing and trimming in any area, all grass clippings and debris deposited on sidewalks and paved surfaces by the operation shall be removed by sweeping or blowing.

1.4.15 MOWING OF PRECIPITOUS SLOPES. The Contractor shall be

aware of the hazard presented by steep and/or slippery slopes.

In these areas conventional mowing methods and equipment may be dangerous due to overturning and sliding hazards. Accordingly, the Contractor shall employ specialized mowing procedures to avoid the hazard in these areas. Also, the Contractor shall exercise extra caution under these circumstances so as to minimize the hazard and prevent damage to sod.

1.4.16 WEED AND GRASS REMOVAL FROM PAVED SURFACES. In

conjunction with each scheduled mowing and trimming operation, the Contractor shall kill (by the application of an approved herbicide) all weeds and grass growing in cracks and expansion joints in paved surfaces. The use of herbicides shall be in accordance with requirements contained in paragraph entitled “Mowing & Trimming Performance Standards and Operational Limitations”.

1.5. MATERIALS HAULING. All materials hauling conducted by the Contractor in the performance of work under this contract shall include the use of appropriate methods to prevent any material, including solid waste, from falling or blowing out of the transporting equipment. Also, the Contractor shall be responsible for the recovery of all materials which fall or blow out, regardless of the location. All hauling equipment or containers shall be sealed to prevent the drainage or leakage of liquids there from. All liquids which accumulate in these vehicles and containers shall be disposed of in accordance with paragraph entitled “Liquid Disposal”.

1.6. SOLID WASTE DISPOSAL. For the purpose of this contract, solid waste is defined as all solid materials, trash, or other debris which is either generated or accumulated by the Contractor in the performance of this contract. The Contractor shall haul and dispose of all solid waste which he/she generated or collected in the performance of this contract to an off-project location which is approved both by the COR, and by the applicable State and/or local governmental agencies having jurisdiction over hauling and solid waste disposal operations. The Contractor shall assume all costs associated with solid waste disposal. If the Contractor utilizes any landfill which is owned or leased by a non-public entity, the Contractor must provide written evidence to the COR of appropriate State approval of the landfill prior to beginning work under this contract. If the Contractor utilizes any publicly-owned and State-approved landfill, then he/she shall present written evidence to the COR that he/she has the owner's approval to use such landfill prior to beginning work under this contract. All trash, litter, and other solid waste material collected by the Contractor under the terms of this contract becomes the property of the Contractor at the time it is removed from its point of origin. The point of origin is defined as the definitive point where the Contractor picks the solid waste material up, and not the general location of a recreation area or a project. Additionally, the Contractor shall not store or accumulate any solid waste within the Corps of Engineers' property boundaries without COR approval.

1.7. LIQUID DISPOSAL. The Contractor shall dispose of all

excess or residual water and mixtures of water, and non-volatile cleaning agents used for cleaning purposes or generated by cleaning processes, either at on-project locations approved by the COR, or at off-project locations approved by the State and local government agencies having jurisdiction over the disposal of such material. The Contractor shall dispose of all other liquids including, but not limited to, chemical cleaning agents, pesticides, and herbicides, as well as their containers, in a manner and at off-project locations approved by State or local government agencies having jurisdiction over such matters. Upon request by the COR, the Contractor shall provide written evidence to the COR of State and local approval of these activities.

1.8. PROHIBITED METHODS AND EQUIPMENT: The Contractor shall not use any cleaning, mowing, or trimming methods, equipment, or agents which endanger his own employees or other persons in the area, or which generate noise levels which, in the COR's determination, are disruptive to public use and/or public enjoyment of an area or its facilities. The COR may require the Contractor to discontinue the use of unsafe or noisy devices, methods, or agents at any time during the period of this contract. Also, specific devices and methods included in this prohibition are listed as follows:

1.8.1. The use of any type of wheeled or hand-held blower for grill cleaning. Specifically included are devices commonly referred to as leaf or back-pack blowers. However, such devices may be used for the collection and removal of litter and grass clippings.

1.8.2. Mowing with the wing of a bat-wing bush hog mower in

the raised position.

1.8.3. Driving any equipment, excluding mowing equipment, off of designated road or parking area surfaces without prior approval of COR.

1.8.4. Using bush hog, belly-type, or hustler-type mowers for mowing within a 3-foot distance from any tree, shrub, post, building, or other man-made objects.

1.8.5. The deposit of any cleaning agent, petroleum product, chemical, or wash water onto project grounds, sidewalks, or other areas or facilities. See paragraph entitled “Liquid Disposal” for liquid disposal requirements.

1.9. OPTIONAL SPRAYING OF RIP-RAP AREAS. The spraying of rip-rap areas is an optional award item and the decision to award this will be at the discretion of the government. The Contractor, if and when directed by the COR, will spray rip-rap areas for control of unwanted vegetation with an Environmental Protection Agency (EPA) and Vicksburg District approved herbicide for use around water surfaces in accordance with all label directions and all applicable state and federal laws. Herbicide must be uniformly applied over the treatment areas. Applicator shall protect, preserve, and maintain the land, waters, and non-target vegetative resources within the designated treatment areas. Applicator will provide proof of current state certified commercial applicators license for the categories of "right-of-way" and "aquatic" applications prior to commencing work.

Applicator will complete and submit to the COR a spill prevention plan (Exhibit L) prior to commencement of work. Applicator will complete the post application herbicide treatment documentation form (Exhibit K) upon completion of work. 3. INSPECTION AND ACCEPTANCE

3.1. GENERAL: Reference Contract Clause 52.212-4(a). The

inspection and acceptance procedures specified herein set forth a general policy that only the services performed by the Contractor in strict accordance with the contract requirements will merit payment. This policy will be implemented through close Government inspection of the services performed and acceptance or rejection of the services by the Government. However, neither the presence nor absence of Government inspection shall relieve the contractor from any requirements of contract.

3.2. INSPECTION REPORT FORM: Exhibit E is the inspection

report form to be used by the Government in advising the Contractor of performance deficiencies.

3.3. CONTRACTOR'S CHECKLIST: Exhibit M is the contractor's

inspection report form to be submitted to the COR within three days following each mowing cycle.

3.4. QUALITY ASSURANCE SURVEILLANCE: The Government will

monitor and inspect the Contractor’s performance using any reasonable inspection method. The Government will record all surveillance observations. The Government may inspect services provided by the Contractor both during and/or after performance is complete. When an observation indicates defective performance, the COR may request the Superintendent or Contractor’s Representative to initial the observation. The Government may use a combination of unscheduled, 100%, random and/or planned inspection(s).

The COR will inform the Contractor how the Government intends to inspect the contract and who is in charge of Quality Assurance.

The COR will appoint authorized representative(s), Quality Assurance Inspector (QAI), to perform quality assurance inspections. The QAI will keep a daily log of all communications with the Contractor and/or Contractor Superintendent(s) or Representative(s). The Contractor and the QAI shall coordinate work schedules and inspections to best evaluate Contractor performance

3.4.1. QUALITY ASSURANCE SURVEILLANCE PLAN:

Reference Contract Clause 52.212-4(a), Inspection/Acceptance.

The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights---

(1) Within a reasonable time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

The inspection and acceptance procedures specified within this contract set forth a general policy that only the services performed by the Contractor in strict accordance with the PWS will merit payment. The Government will inspect and monitor the Contractor’s performance by appointing a representative(s), Quality Assurance Inspector (QAI), to monitor performance to ensure services are received under this contract. The Government representative will evaluate the Contractor’s performance through close on-site inspections and receipt of complaints from the public. The Government will also receive and investigate complaints from the public. The COR shall be responsible for initially validating customer complaints and shall make final determination of the validity of customer complaint(s) in cases of disagreement with customer(s).

This plan is provided for information purposes only. This Quality Assurance Surveillance Plan is not part of the Request for Proposal (or Invitation for Bid) nor will it be made part of any resulting contract. The Government has the right to change or modify inspection methods at its discretion.

3.5. EFFECT OF UNSATISFACTORY PERFORMANCE ON CONTRACT PAYMENTS:

If performance of any required service is determined to be unsatisfactory, and that performance is the result of actions (or lack of action) by the Contractor, the Government may reduce the payments for such performance to reflect the reduced value of the services performed in accordance with Paragraphs 6.2.3 or 6.2.4 of this contract.

3.6. COMMUNICATIONS WITH CONTRACTING OFFICER'S REPRESENTATIVE

(COR) OR ALTERNATE COR: The Contractor will make verbal contact with the COR or alternate COR after 1615 and prior to 1630 every Monday and Friday to discuss contract performance.

3.7. SAFETY INSPECTION: All of the Contractor's activities

conducted within the project boundaries as well as his/her equipment and facilities maintained or operated within the project boundaries, are subject to inspection by the Government for compliance with the safety provisions of this contract. Any violation of these provisions shall be promptly corrected by the Contractor and any Contractor equipment which is not in compliance shall be immediately removed from service until the problem is corrected. The Contracting Officer, his/her authorized representative, and his/her alternate each have on-site authority to totally or partially suspend any of the Contractor's operation due to unsafe conditions. In the event that the unsafe conditions were either caused by the Contractor or were allowed to arise or exist by the Contractor, any work stoppages will be the responsibility of the Contractor and no requirements of this contract will be waived. If work is not completed per entirety due to suspended unsafe operations, a non-compliance report will be issued.

3.8. REQUIRED PRESENCE OF CONTRACTOR'S CHIEF EXECUTIVE

OFFICER/OWNER DURING INSPECTION: Upon verbal, written, or email request by the Contracting Officer or his/her authorized representative, the Chief Executive Officer/Owner of the Contractor shall be present at specified inspections for the purpose of alleviating any misunderstanding concerning the contract requirements or illustrating performance deficiencies.

3.9. GOVERNMENT POSITION ON AVAILABLE OPTIONS IN HANDLING

DEFICIENT WORK: The Contractor shall be aware that the Government has several unilateral options available in handling deficient contractor work as provided in the Contract Clause 52.212-4(a). These options are listed below:

a. Require the Contractor to perform the services again.

b. Require the Contractor to take necessary action to insure that future performance meets the contract requirements.

c. No payment will be made for services performed that failed to meet AQL performance thresholds.

If the Contractor subsequently fails to promptly perform the services again (if option a. is selected by the Government), or if the Contractor fails to take the necessary action to insure that future performance meets the contract requirements, then the Government may either perform the services and charge the Contractor for any and all related and other cost related to paragraph: 3.10.1. or terminate the contract for default.

The Contractor shall be advised that, absent an accompanying notation on the inspection form of the Government's election of option a, the identification of performance deficiencies on the inspection report form automatically constitutes the notification to the Contractor of the Government's election of option b.

Subsequently, in the event that future performance of the same type of work by the Contractor does not meet the contract requirements, no further notices or communications are owed to the Contractor prior to the Government electing to perform the services and charge the Contractor for any and all related costs.

The Contractor shall also be advised that the Government has determined that the re-performance of deficient work (option a) is not normally practical under the circumstances of this contract. Basically, work can not be rescheduled without creating prohibitive administrative expenses to the Government such as those for after-hours inspection. Also, rescheduling tends to adversely impact follow-on work schedules.

3.10. PAYMENT ADJUSTMENTS ASSOCIATED WITH DEFICIENCY CORRECTION:

In the event that the Government corrected Contractor performance deficiencies, and the Contracting Officer advised the Contractor of this action in accordance with Contract Clause 52.212-4(a) entitled Inspection/Acceptance, the Government may charge the Contractor for the related costs; 3.10.1. In this instance, the Contractor shall include the cost of the deficient work in the invoice, and the Government will deduct from the invoice amount the total related cost of deficiency corrections. The actual Government costs for correcting deficiencies may be affected by available resources, time of performance, travel distance, number of deficiencies corrected by a single crew, and the extent of the deficiencies. Also, corrective work performed may include only certain aspects of the requirements of this contract and exclude other aspects due to limited resources to perform such work. See

3.10.1. for further guidance.

3.10.1. PAYMENT DEDUCTION CLAUSE: In the event that work is

found unsatisfactory and not re-performed by anyone, or work not performed at all:

20% of service value lost for administrative costs plus cost of service value lost.

If the Government had to use an additional contractor to complete the work, then 20% of service value lost for administrative costs plus the contract price for the additional contractor.

If the Government performed/re-performed to complete the work, then 20% of service value lost for administrative costs plus the contract price for the additional contractor.

3.10.2. FAILURE TO PROVIDE SUPERINTENDENT (S) AND MEET

ADMINISTRATIVE REQUIREMENTS OR PROVIDE SERVICES: Should the Contractor fail to provide an on-site Superintendent or fail to meet the administrative requirements or provide the services of this contract, the Government may make deductions from the payment due the Contractor.

3.10.3. DEDUCTION SCHEDULE: These deductions may be made from payment due the Contractor by the Government should the Contractor fail to provide a Superintendent(s) and/or meet the administrative and performance requirements or provide the services of this contract:
