SUMMARY OF CHANGES

SECTION 00010 - SOLICITATION CONTRACT FORM

The following have been added by full text:

AMENDMENT #3

Question 2: Will the ECPS1 contractor be allowed to establish a concrete batch plant for the construction of the parking structure? If so, is additional land available for this purpose?

Answer: Yes, a batch plant is permissible. The Government will, at its discretion, provide between 1 - 3 acres for exclusive use of a batch plant within the existing boundaries of the East Campus development area.

The contractor will be responsible for obtaining and maintaining all associated permits, maintenance, operation, removal, and restoration of the site at the conclusion of the Parking Structure contract. In addition, the contractor will not be restricted from providing concrete to other East Campus projects conditioned upon indemnification of the Government. However, other East Campus projects will not be required to purchase concrete from the Parking Structure batch plant.

Question 3: There is currently a concrete batch plant on the campus that is being utilized for other construction projects. In recent RFP’s, offerers have been disallowed from purchasing concrete from the on-site plant. Will that be the case for the East Campus Parking Structure, or will the successful offerer be permitted to purchase concrete from an on-site plant?

Answer: The awardee will not be permitted to utilize the existing batch plant on East Campus. However, it is permissible to establish a batch plant on East Campus for this project. Refer to RFI #2 for additional guidance.

Question 4: Electrical Power for West Surface Lot lighting with Phased Turnover: The West Surface Lot site lighting is fed from the Phase 1-2 Utility Room located between column line H – J and 4 -5. This Utility room will not be complete with the 1st Turnover: West Parking Lot. Please confirm that the Site lighting poles, fixtures, grounding and wiring are to be complete to the handholes shown on E-006 at Column line G and 4 at the 1st Turnover: West Parking Lot but that power (activation) of the site lighting is not required until the 2nd Turnover:

Phase 1-2 Parking

Answer: The site light poles on and around the west parking lot shall be operational when the west parking lot is turned over to the customer. This includes all components of the system existing in the West Parking Lot turnover area to include fixtures, grounding and handholes. It is understood that the utility room may not be completed at the time of the turnover. The contractor shall provide temporary power or other means necessary to ensure the light poles are operational until the utility room is completed and the light poles are connected per the permanent power design.

Question 13: During the pre-bid meeting held by USACE on 5/15/14, it was observed that there are existing OH power lines at the east side of the site. Phase 1-2 and 3 demolition plans C-002 and C3-005 do not show any existing OH lines to be removed. Are these lines scheduled to be removed prior to Notice to Proceed for this contract under a separate contract? Please advise.

Answer: The overhead power lines will be removed under a separate contract. The removal will be completed no later than 15 October 2014.

Question 28: Page 4 of 87 of the solicitation indicates "In Addition to the contract line items, the offerors are required to provide the rates for the items listed above." No items are listed above, please clarify

Answer: That statement should have said "Items listed below…" and has been corrected.

Question 30: Page 11 of the solicitation indicates that as part of the bid proposal, Tab H should include a bid bond which "... shall be 20% of the bid or 3% whichever is less." Page 38 of the solicitation indicates that the bid guarantee should be "...20% or $3,000,000 whichever is less." Please confirm that the bid bond should be for 20% or $3,000,000.

Answer: Page 11 should read, "…or $3,000,000 whichever is less."

Question 36: Page 1 of the Solicitation states that project shall be complete within 838 calendar days after notice to proceed. Page 5 of the solicitation states the overall delivery date for the contract shall be 838 days after contract award. Please confirm the performance period is 838 calendar days after notice to proceed.

Answer: Page 5 has been changed to read, "838 days after NTP"

Question 38: Page 23 of the Solicitation states "The Government will evaluate the use of the contract duration of 839 calendar days." Please confirm this should be changed to 838 calendar days.

Answer: Page 23 will be updated to read 838 days.

Question 72: Page 12 of 87 Tab K: Compliance Statement states that the completed statement should be submitted with their proposal in “Tab J of Binder 3.” Please clarify if this is Tab J or Tab K.

Answer: Compliance statement shall be included in Tab K

Question 74: We kindly request that Covers, Title Pages, TOC, Tabs, Safety Plan, Past Performance Questionnaires and any corresponding performance recognition documents not be included in the 60 page limit.

Answer: The page count is at the discretion of the contractor.

Question 75: Since Binder 2 and 3 are comprised of required forms, we request the 60 page limit only apply to Binder 1. Please confirm.

Typically the Government has evaluated the SB goals as a percentage of the total subcontracted value. Please confirm that was the intent of the Solicitation.

Answer: Small Business Participation is based on total contract value. The Subcontracting Plan is based on total dollars subcontracted.

The Offeror shall provide its OSHA DART (Days Away, Restricted or Transferred) rate for the past 24 months and also include the Company’s EMR rate.

5.2 FACTOR 2: SITE LOGISTICS AND RISK MANAGEMENT PLAN:

SITE LOGISTICS PLAN:

The Offeror shall submit a plan that describes in both narrative and illustrative form the methodology for constructing the project. The Offeror must demonstrate the capability and flexibility to plan the complete project with minimal impacts to the adjacent active construction projects. The Offeror’s plan should show elements such as, but not limited to, site utilization, construction trailers, lay down area, crane access areas and site access for both deliveries and employees.

RISK MANAGEMENT PLAN:

The Offeror shall submit a Risk Management Plan that demonstrates how the Offeror plans to mitigate uncertainties to include but not limited to differing site conditions, construction phasing, and cost and time growth. Identify the risks that exist in the critical or near-critical path (either inside or outside the Offeror’s control) which may impede project success in delivery, and what measures the Offeror shall take to mitigate potential impacts of all identified risks. Included in this discussion shall be the Offeror’s plan for ensuring adequate concrete quantities are available for pours on the day they are scheduled given the security and screening requirements for vehicles to access the project site.

The Offeror shall discuss its approach to managing large-scale projects and describe its ability to work on a constrained site with limited access. The Offeror shall demonstrate how it intends to pursue concreting operations throughout the winter months without delay to the project due to the weather.

The Offeror shall demonstrate how it will physically separate and provide the necessary safety measures to protect pedestrians, vehicles, existing infrastructure, etc. after the west parking lot has been accepted by the owner and the project remains an active construction site. The Offeror shall then demonstrate the same as above for when the Phase 1-2 structured parking has been accepted by the owner and the project remains an active construction site.

The Offeror shall present this phased plan in both illustrative and narrative formats.

5.3 FACTOR 3: PAST PERFORMANCE OF RELEVANT PROJECTS

The Offeror shall submit information on at least three but no more than five similar completed projects within the last six years clearly identifying its role and responsibility for the projects. The information regarding the project that is required to be supplied is identified on the form entitled, “CONTRACTOR PAST PERFORMANCE” (Attachment A).

In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least three of the five projects submitted for Factor 3 for consideration in response to the past performance requirements of this

RFP.

An Offeror that relies upon the performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this RFP. As a part of the proposal, the Offeror must provide a contractor team agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship (teaming/partnering, joint venture, etc.) and its role on this project. Past Performance information will not be considered without the teaming arrangements. In the case of joint ventures, at least one project will be submitted from each member to demonstrate past experience. This documentation shall be provided in Binder 1 of the Offeror’s proposal.

Similar projects shall demonstrate all of the following project types, either individually or in combination thereof:

a. Construction contracts valued at $25,000,000 or more

b. Multi-story parking garage in excess of 1000 parking stalls

Additionally, it is highly desired that the projects also demonstrate the following, very relevant elements of work:

a. Mass notification system

b. Life-safety generator

c. Metal panel exterior skin

d. Deep foundation system

e. Pervious street pavement

Clearly identify the project type, i.e. design-bid-build, design-build etc. The Offeror may submit other types of projects, but must explain the relevancy of those projects to the project that is being solicited. Each project that is submitted must also clearly state the total man-hours involved in the project and the DART rating for each project.

If a DART rating is not available, please explain.

The submitted projects must clearly identify the following criteria in addition to the construction elements that it demonstrates:

a. Contractor’s Name

The Offeror shall provide the performance evaluations for the submitted projects that demonstrate the Offeror’s performance on recent and relevant projects. The offeror shall provide formal performance evaluation if available.

Formal performance evaluations are those similar to the Department of Defense Performance Evaluation (Construction) Form DD 2626. The Government’s preference is the formal evaluation. If the formal evaluation is included, a Past Performance Questionnaire (PPQ) is NOT required or desired.

If a formal evaluation is unavailable, the offeror shall obtain the information using the form entitled, “NAVFAC/ USACE Past Performance Questionnaire” included (Attachment B). The Past Performance Questionnaire included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 3, Past Performance of Relevant Projects. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed Past Performance Questionnaires should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Melissa Svetich via email at Melissa.A.Svetich2@usace.army.mil prior to proposal closing date. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. Offerors may use previously completed PPQs and do not need to have one completed specifically for this project but must include it as a hardcopy.

Offerors may include performance recognition documents received within the last six years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.

5.4 FACTOR 4: SMALL BUSINESS:

SMALL BUSINESS PARTICIPATION PLAN (required for all offerors): All offerors (both large and small businesses) will be evaluated on the level of proposed participation of U.S. small businesses in the performance of this acquisition relative to the objectives and goals established herein. The offeror should articulate how small businesses will participate through performance as a small business prime offeror and/or through small business subcontracting. The government will evaluate:

a. The extent to which such firms, as defined in FAR Part 19, are specifically identified in proposals;

b. The extent of commitment to use such firms (enforceable commitments will be considered more favorably than non-enforceable ones). Provide documentation regarding enforceable commitments i.e. mentor protégés, joint ventures, subcontracting or partnership letters of commitment(s), etc to utilize any Small Business category, as defined in FAR Part 19, as subcontractors. The SBEB must be able to verify enforceable commitments;

c. Identification of the complexity and variety of the work small firms are to perform;

d. The extent of participation of small business prime Offerors and small business subcontractors in terms of the percentage of the value of the total acquisition;

e. The extent to which the Offeror meets or exceeds the goals. These goals are a percentage of the total contract value. The Goals for this procurement are:

Small Business: {35%} of the total contract value;

Small Disadvantaged Businesses to include 8(a): {12%} of the total contract value;

Woman-Owned Small Business (WOSB): {14%} of the total contract value;

Historically Underutilized Business Zone (HUBZone) SB: {5%} of the total contract value;

Veteran Owned Small Business (VOSB): {10%} of the total contract value;

Service Disabled Veteran Owned Small Business (SDVOSB): {7.5%} of the total contract value.

*Historically Black Colleges and Universities and Minority Institutions (HBCU/MI) {0%}

(Note, a participation plan that reflects {14%} of the contract value for WOSB would also count towards the overall Small Business Goal; and percentages for SDVOSB also count towards

VOSB).

The Government must be able to verify that each percentage is based on the value of the total acquisition (not percentage of subcontracted dollars).

Small Business Participation Format

All Offerors (both large and small businesses) are required to complete a Small Business Participation Proposal.

Offerors should propose the level of participation of small businesses (as a small business prime and/or small business subcontractors) in the performance of the acquisition relative to the objectives/goals set forth in the evaluation of this area.

(a) Check the applicable size and categories for the PRIME offeror only -- Check all applicable boxes:

{ } Large Prime { } Historically Black Colleges or Universities and Minority Institutions (HBCU)

Or

{ } Small Business Prime; also categorized as a { } Small Disadvantaged Business (SDB) { } Woman-Owned Small Business (WOSB) { } Historically Underutilized Business Zone (HUB Zone) Small Business { } Veteran Owned Small Business (VOSB) { } Service Disabled Veteran Owned Small Business (SDVOSB)

(b) Submit the total combined percentage of work to be performed by both large and small businesses (include the percentage of work to be performed both by Prime and Subcontractors):

Example: If Prime proposes a price of $1,000,000 (including all options), and small business(es) will provide $250,000 in services/supplies as a prime or subcontractor, the % planned for small businesses is 25%; and 75%for large business equaling 100%.

Total Percentage planned for Large Business(es) _______% = $ _______

Total Percentage planned for Small Business(es) _______% = $ _______

100% = $ _______

(c) Please indicate the total percentage of participation to be performed by each type of subcategory small business. The percentage of work performed by Small Businesses that qualify in multiple small business categories may be counted in each category:

Example: Victory Prop Mgt (WOSB and SDVOSB) performing 2%; and Williams Group (SDB, HUBZone and WOSB) performing 3%. Results equate to: SDB 3%; HUBZone 3%; WOSB 5%; SDVOSB 2%; VOSB 2%;). SDVOSBs are also VOSBs automatically; however VOSBs are not automatically SDVOSBs.

Small Disadvantaged Business _________% = $___________ HUB Zone Small Business _________% = $___________ Woman Owned Small Business _________% = $___________ Service Disabled Veteran Owned SB _________% = $___________ Veteran Owned Small Business _________% = $___________

HBCU/MI _________% = $___________

Detailed explanations must be provided when the percentages fall short of the participation goal listed within the RFP. The Government does not recognize zero percent as a goal. However, if zero percent goals are submitted they must be supported with a detailed explanation and/or a mitigation plan to address how the Offeror will achieve participation where zero goals are cited. If the Offeror does not submit a detailed rationale/explanation, the zero percentage will be evaluated as a weakness. All percentages should use the value of the total acquisition as a baseline. The SBEB must be able to verify that each percentage is based on the value of the total acquisition.

The Government must be able to verify that each percentage is based on the value of the total acquisition (not percentage of subcontracted dollars).

(d) List principal supplies/services to be performed by Small Businesses:

Example: If a Small Business qualifies also as a WOSB and a SDVOSB, you can add them to each category below in which they qualify.

Name of Company Identify Type of Service/Supply

Small Business (SB):

Small Disadvantaged Business (SDB):

Women-Owned Small Business (WOSB):

Historically Underutilized Business Zone (HUB Zone):

Veteran Owned Small Business (VOSB):

Service Disabled Veteran Owned Small Business (SDVOSB):

Historically Black Colleges and Universities and Minority Institutions (HBCU/MI):

(e) Describe the extent of commitment to use small businesses (for example, what types of commitments if any are in place for this specific acquisition either – small business prime, written contract, verbal, enforceable, non-enforceable, joint venturing, mentor-protégé, etc.). Provide documentation regarding enforceable commitments to utilize any Small Business category, as defined in FAR Part 19, as subcontractors.
