SUMMARY OF CHANGES

SECTION 00010 - SOLICITATION CONTRACT FORM

The following have been added by full text:

AMENDMENT #4

Question 15: If the existing CHWR/S, shown on C-012, has not yet been installed in current construction, we suggest incorporating the proposed relocation into original design of the chilled water piping. The relocation of those pipes will be very costly. Please confirm that the location of the CHWR/S will be coordinated and installed as needed to avoid conflicts per this solicitation.

Answer: Contractor shall follow the current contract documents.

Question 22: Earthwork spec 31 00 00 states that a copy of the Geotech Report may be requested from the COTR.

Please advise if it is acceptable to distribute this document for bidding purposes. If so, please provide.

Answer: Final Geotechnical Report will be provided. Please email Melissa Svetich at Melissa.A.Svetich2@usace.army.mil to receive the report. Same rules of engagement for document distribution apply to this document as all others.

Question 23: Please confirm the bid option 1 east surface lot should be as shown on C-010A in the volume 1 drawings dated 4/15/2014 and not as shown on C-010 of the permit set dated 10/25/2013.

Answer: Confirmed.

Question 31: Reference the Price Schedule included in Section 00010 - Solicitation Contract Form on pages 3 and 4 of the solicitation. For Options 1 through 8 it states to reference payment items as specified in 01 23 01, however these payment items do not appear to exist within 01 23 01. For example, both Option 2 and Option 5 refer to payment item 01 23 01-2 as specified in 01 23 01. Option 1 refers to payment item 01 23 01-01. Option 3 and Option 6 both refer to payment item 01 23 01-3. Option 5 makes no mention of a payment item. Please clarify what is meant by "payment item".

Answer: "Payment Item" refers to all components to complete the scope of work for the referenced Option.

The individual components are not itemized in the specifications. Refer to the drawings to identify the components of each option (payment item). It should be noted that both the Phase 1-2 structures (base bid) and Phase 3 structure (option bid) have options for a chain link facade and a freestanding canopy structure.

In addition, the term "Pay Item" will be deleted from an updated Price Schedule to avoid further confusion.

Question 32: Reference the Price Schedule included in Section 00010 - Solicitation Contract Form on pages 3 and 4 of the solicitation. Should Item No. 0002 also be exclusive of work covered under item 0001?

Answer: Correct, Item No. 0002 is exclusive of work covered under Item No. 0001.

Question 33: Reference the Price Schedule included in Section 00010 - Solicitation Contract Form on pages 3 and 4 of the solicitation. Should Item No's. 0003, 0004, 0005 and 0006 also be exclusive of work covered under items 0001 and 0002?

Answer: Refer to updated Price Schedule. Each item on the Price Schedule is exclusive of the other seven items.

Question 34: Reference the Price Schedule included in Section 00010 - Solicitation Contract Form on pages 3 and 4 of the solicitation. Should Item No's. 0007 and 0008 also be exclusive of work covered under items 0001, 0002 and 0006?

Answer: Each item on the Price Schedule is exclusive of the other seven items.

Question 37: Reference page 42 of the Solicitation. Are Annual Representations and Certifications required to be submitted with our proposal? If yes, please advise which Binder and Tab they should be located within.

Answer: No. The Government will pull the records from SAM.

Question 39: Please confirm that the vertical limit of our excavation included in our base bid is proposed subgrade and/or bottom of existing topsoil in embankment areas. Spec section 31 00 00 Par. 3.2 implies we will be compensated for removal and replacement of unsuitable materials below these elevations "as directed".

Answer: Correct, the contractor shall be compensated via a construction modification if the Government confirms that unsuitable material beyond the designed vertical elevations should be removed.

Question 40: Please confirm that any embankment placed by any of the previous three projects at this site have been or will be held to the same earthwork specification and these fills will not need to be removed and replaced.

Answer: The existing conditions (Sheet C-002) was modified in Amendment #1. Refer to this drawing for an update of existing conditions. No "embankments" will be existing on the project site.

Question 41: Please provide a location for the approx 40,000 CY of suitable borrow material available for this project.

Answer: Per Amendment #1 the stockpile is within 0.6 miles of project site. More specifically, it will be located in the vicinity of the existing concrete batch plant on East Campus.

Question 43: Reference Section 01 05 00 - 1.2. Please provide the start and finish dates for the ECB-MC Building which are currently shown as "TBD".

Answer: The status of ECB-MC is still TBD as it is unknown as to when the project will be awarded.

Question 44: Please provide a copy of the Final Geotechnical Report referenced by Section 01 05 00 - 1.5.2.

Answer: Final Geotechnical Report will be provided. Please email Melissa Svetich at Melissa.A.Svetich2@usace.army.mil to receive the report.

Question 45: Will the Government pay for electrical consumption charges required for temporary construction power?

Answer: No, the Government will not pay for temporary power service.

Question 47: Reference Section 01 41 00 Special Inspections. Paragraph 1.7.1 states that the Contractor shall retain a third-party to conduct Special Inspections. However, paragraph 3.1 states the inspections shall be carried out by an Independent Testing Agency retained by the Contracting Officer's Representative (COR). Is the Contractor or the Government/COR required to retain and pay for the third party Independent Testing Agency to perform special inspections?

Answer: The Contractor is required to pay for the third party Independent Testing Agency to perform special inspections.

Question 51: Section 014532 - 1.6 (B)(4) states the Commissioning Specialist shall attend/witness Factory Acceptance Testing and Site Acceptance Testing as required by the Government. Please advise if this will be required?

Answer: Yes, the Commissioning Agent shall attend/witness both the Factory Acceptance Testing and Site Acceptance Testing.

Question 53: Section 015720.0010 - 3.10 Munitions and Explosives of Concern, sub-paragraph b, states "The Construction Contractor shall follow the Land Use Controls for the site as developed by Fort Meade and approved by USEPA (attached at the end of this section)." The Land Use Controls does not appear to be attached to the end of this section. Please provide.

Answer: Land Use Controls will be provided. Please email Melissa Svetich at Melissa.A.Svetich2@usace.army.mil to receive the document.

Question 54: Reference Section 015720.0010-3.10 (b). Please confirm the MEC Contractor and UXO Technicians are provided by the Government.

Answer: MEC Contractor and UXO Technicians shall be provided by the contractor.

Question 71: Phase 1-2 Drawing C-001, site utility note 13, states "A Professional Engineer, registered in Maryland, shall be responsible for general oversight and observation of the site utility system installation for compliance with American Water Standards and Testing Requirements." Is this professional engineer provided by the Government or the Contractor?

Answer: The Professional Engineer shall be provided by the contractor.

Question 73: Page 17 of 87: Safety – “The Offeror shall submit a detailed Site Specific Safety Plan.” Including a proper detailed site specific safety plan will consume a significant number of pages, and the Solicitation only allows a total of 60 pages for our combined response. Is it possible to include the detailed site specific safety plan as an Appendix that does not count toward the 60 pages?

Answer: The page count is at the discretion of the contractor.

Question 78: We kindly request that the Government consider extending the deadline for submission of RFI's to May 27, 2014 to allow the subcontractors more time to review the bid documents and submit RFI's to the bidding general contractors.

Answer: The submission of RFI's will not be extended.

Question 79: Specification section 01 57 20, 3.10, paragraph b. lists a "Land Use Controls" plan that was to be attached at the end of the Spec Section. None is attached. Also paragraph e. references a "Draft Record of Decision, Former Mortar Range Munitions Response area as an attachment to the end of this section. Please provide the attachment.

Answer: Land Use Controls will be provided. Please email Melissa Svetich at Melissa.A.Svetich2@usace.army.mil to receive the document.

Question 81: Section 3.04.5 explains the vetting process for approval on Non-U.S. Citizens working on the project.

Page 15 of the SFO states “Please note: All personnel working under this contract shall be U.S. citizens.” Will approved Non-U.S. Citizens be allowed to work on this project?

Answer: This statement from the solicitation has been deleted. Refer to the Site Construction Security Plan (SCSP) in the specifications which clarifies how a non-U.S. citizen may be approved to access the project site.

Question 82: An adjacent project site at the Fort Meade campus presently hosts an on-site batch plant to support that job’s concrete operation. It is our understanding that the concrete operations at the adjacent project site will be winding down by the time the ECPS project begins placing concrete in significant volumes. It may prove beneficial to the ECPS project to utilize concrete from the existing batch plant. A batch plant at or near the job-site would reduce concerns over delayed deliveries through the Ft Meade security entrances, reduce the impact to the campus by removing some significant construction traffic from roads on post, and potentially provide greater control over the quality of the concrete mix. Please confirm that it will be acceptable to include the use of the existing batch plant in our overall approach to pricing and executing the ECPS project.

Answer: Refer to responses from RFI #2 and RFI #3 in Amendment #3.
