C.4.1 Equipment and Supplies. The Contractor shall furnish all equipment and supplies not identified in Section C.3 of this PWS.

C.4.2 Other Items. The Contractor shall furnish all transportation; power equipment with fuel;

Garlon 4 herbicide with marker dye; herbicide sprayer; post drivers, axes, and other hand tools; flagging; and all other supplies and equipment necessary to accomplish the services specified herein other than materials listed in C.3 and C.4.

C.4.3 COR Approval. All contractor furnished materials, equipment and supplies must be approved by the Contracting Officer’s Representative prior to initial use.

C.5 SPECIFIC TASKS.

C.5.1 Services. The Contractor shall clear all woody vegetation (including trees, limbs, vines, briars, shrubs, and brush) from an area extending from the Government boundary line back onto Government property a distance of four (4) feet. All stumps and stub cuts shall be horizontal (to preclude sharp stubs) and shall be cut as close to the ground as possible.

In no case shall any cut stumps or stubs exceed four (4) inches in height. All shall also be removed from this area. All cleared brush and limbs shall be piled on Government land, outside of the cut area. Trees that are not entirely on government land or, if cut, will fall onto private lands shall be left in place. The Contractor shall remove or cut a four (4) foot wide path through all dead trees previously dropped or cut trees that have fallen in the area of required clearing. Limbs from trees outside the (4) foot cleared area that intrude into the cleared line shall be cut a minimum height of (7) feet above ground.

C.5.1.2 Chemical Treatment. Except as stated in C.5.1.2.1, the Contractor shall apply

Garlon 4 (or equivalent substitute, at the discretion of Project personnel) herbicide to all cut stubs, stumps, and stems (except the cut ends of limbs on trees greater than 6 (six) inches within the cleared area. An adequate marker dye shall be mixed with the chemical in sufficient concentration to leave an obvious and durable stain on the treated stubs, stumps, and stems. All such stems shall be treated on the same day that they are first cut.

C.5.1.2.1 Application Procedures. Application of chemicals shall be according to the label directions for the material used. When it is the professional opinion of the Contractor that the use of chemicals, mix ratios, carriers, or rates of application, other than those specified, will result in equal or better results, the Contractor may request permission for their use. Any such request shall be submitted in writing and shall specify the chemical, its uses, rates of application, and cost. A label for the chemical shall be submitted with the Contractor's request. Requests shall be submitted to the Project Manager, Harry S. Truman Project Office, at least 30 days prior to the intended use. If granted, permission for the use of an alternate chemical, mix ratio, carrier, or rate of application will be in writing from the Contracting Officer, or his authorized representative. Chemicals, mix ratios, carriers, or application rates other than specified in the label will not be used in the absence of the above specified request and approval.

When the use of approved alternate chemicals, mix ratios, carriers, or application rates requested by the Contractor results in an increase in Contractor cost or time, an equitable adjustment will be made to the contract price through the issuance of a contract modification.

C.5.1.2.2 Label Directions. Label directions and/or warnings relative to temperature or other climatic factors shall be closely adhered to. Care shall be exercised at all times by the Contractor to protect desirable (non-target) species from damage by the required application of chemicals. The Contractor shall not apply chemicals to cleared areas where the Government boundary adjoins park areas, subdivisions, private residences, pastures, or animal pens. The Contractor will receive payment for chemical application only for the portion of boundary on which chemical was actually applied.

C.5.1.3 Mileage. The Contractor shall clear the mileage specified in the table C.1.2 for

FY-2018, and FY-2019 option thru FY-2022 options if exercised. Contingencies, such as flooding, will not relieve the Contractor from clearing the required mileage, but may result in identification of alternate work areas at the discretion of the COR.

C.5.1.4 Boundary Markers. The Contractor shall provide the Contractor Officer

Representative a list, to be delivered weekly, showing the location and number of any missing or damaged boundary monuments observed during the course of the work. The Contractor shall straighten and reset, as necessary, all damaged boundary reference posts.

Missing posts, broken posts, and posts that cannot be straightened shall be replaced with a new post set two (2) feet deep and one (1) foot on the Government side of the boundary monument. "U.S. Reservation Boundary Mark" signs that are missing or not legible (more than 2 words or 2 letters in any word) shall be removed and replaced with a new sign. All signs shall face toward the adjoining private property. Damaged posts and signs that have been replaced shall be delivered to the project maintenance building on the Access Road below Truman Dam.

C.5.1.5 Access. Access to the Government boundary shall within reason be by public access roads. The contractor shall be responsible for securing needed access by non-public routes. At no time shall the contractor trespass without written permission from the landowner(s). Clearing work shall be performed only on the Government side of the boundary line. Boundary monuments (located on the property line) and reference posts (located 1 foot inside the boundary line) are installed to allow line-of-sight from post to post. The Contractor shall, by using flagging, range poles, or similar aids, establish the location of the boundary within the immediate work area prior to cutting. The Contractor shall make diligent efforts to locate and expose each monument. Difficulty in locating monuments or the boundary line shall be referred to the COR for assistance.

C.5.1.6 Boundary Offsets. In areas where the boundary is marked by boundary offsets

(e.g.- actual boundary is located along the centerline of a road or creek), the Contractor will clear and spray all vegetation as described in paragraphs 5.1 within a (3) foot radius of all offset posts.

C.5.1.7 Encroachments.

C.5.1.7.1 Reporting. The contractor shall report in writing any encroachment onto government property. This includes but not limited to fences, trash, abandoned vehicles, buildings or structures, trails and roadways, sewage and sewer lateral lines, mowing or clearing of vegetation or branches. Encroachments shall be documented by date and time when the encroachment was discovered, type of encroachment, and location using county, section, township, range, and A.P. and P.O.L. boundary markers. An encroachment is any unauthorized use of government land by adjacent land owners, persons, or businesses.

C.5.1.8 Marking Monuments

Locate and Mark Existing Monuments: Existing monuments along the boundary line will be located and plotted using a Trimble GPS unit supplied by the Corps of Engineers.

Information including: monument type, monument number, monument condition, and section/township/range, will be collected using provided GPS unit. The GPS unit will be returned to a Corps of Engineers Official weekly so that the data can be downloaded. All monument caps will be left uncovered, and free of dirt and debris. A diligent effort of at least 15 minutes will be made to locate each monument. The use of steel tape or metal detector may be necessary if other methods fail. Use of a metal detector may require the marker post to be removed. If removed, the marker post must be correctly placed back in the ground when monument is located (monuments not found will be listed on the daily report).

5. METHODS OF QA SURVEILLANCE.

Various methods exist to monitor performance. The COR shall use the surveillance methods listed below in the administration of this QASP.

Regardless of the surveillance method, the COR shall always contact the contractor's task manager or on-site representative when a defect is identified and inform the manager of the specifics of the problem. The COR, with assistance from the PM, shall be responsible for monitoring the contractor’s performance in meeting a specific performance standard/AQL.

a. VALIDATED USER/CUSTOMER COMPLAINTS. (Relies on the user of the service to identify deficiencies. Complaints are then investigated and validated. Highly applicable to services provided in quantity and where quality is highly subjective.)

b. 100% INSPECTION. (Evaluates all outputs. Most applicable to small quantity, but highly important services. May be used where there are written deliverables and stringent requirements such as tasks required by law, safety, or security.)

c. RANDOM SAMPLING. (Designed to evaluate the outputs of the award requirement by randomly selecting and inspecting a statistically significant sample. Highly recommended for large quantity repetitive activities with objective and measurable quality attributes.)

Surveillance results may be used as the basis for actions (to include payment deductions) against the contractor. In such cases, the Inspection of Services clause in the Contract becomes the basis for the KO’s actions.

6. RATINGS.

Metrics and methods are designed to determine if performance exceeds, meets, or does not meet a given standard and acceptable quality level. A rating scale shall be used to determine a positive, neutral, or negative outcome. The following ratings shall be used:

EXCEPTIONAL: Performance significantly exceeds contract requirements to the Government’s benefit.

SATISFACTORY: Performance meets contractual requirements.

UNSATISFACTORY: Performance does not meet contractual requirements.

7. DOCUMENTING PERFORMANCE.

a. ACCEPTABLE PERFORMANCE (EXCEPTIONAL/SATISFACTORY).

The Government shall document positive performance. A report template is attached. Any report may become a part of the supporting documentation for fixed fee payments, award fee payments, or other actions.

b. UNACCEPTABLE PERFORMANCE (UNSATISFACTORY).

When unacceptable performance occurs, the COR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file.

When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor's task manager or on-site representative. A CDR template is attached to this QASP.

The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to present this corrective action plan to the COR. The Government shall review the contractor's corrective action plan to determine acceptability.

Any CDRs may become a part of the supporting documentation for contract payment deductions, fixed fee deductions, award fee nonpayment, or other actions deemed necessary by the KO.

8. FREQUENCY OF MEASUREMENT.

a. Frequency of Measurement.

During contract/order performance, the COR shall take periodic measurements, as specified in the Performance Standards Summary Matrix, and shall analyze whether the negotiated frequency of measurement is appropriate for the work being performed.

b. Frequency of Performance Assessment Meetings.

The COR shall meet with the contractor to assess performance and shall provide a written assessment.
