STATEMENT OF WORK
Project Statement of Work Removal and Disposal of 350-ft Cherry Creek Dam Spillway Boresight Radio Tower
1. Background.
1.1. In 1981 an approximately 350-ft radio tower was installed by the US Air Force (USAF) on US Army Corps of Engineers, Omaha District (USACE) property approximately 600 feet south of the Cherry Creek Dam Emergency Spillway in the City of Aurora, approximately one mile east of Parker Road and 1/4 mile North of Hampden Road. Additional adjunct communications equipment was added to the tower during the time it was functional, but sometime prior to 2010 the USAF removed their communications equipment and abandoned the tower. Presently the tower houses an FAA flashing aviation safety light along with ground-based supporting power, generator and operations equipment. At this time the USACE wants to remove and dispose of the abandoned tower. The removal does not include tower ground support facilities except as described below. The contract is a lump sum contract.
2. The contractor accepted by the US Army Corps of Engineers, Omaha District (USACE) to remove and dispose of the radio tower will perform the following tasks.
2.1. Within 20 days of the contract award, submit a comprehensive removal and disposal plan to the USACE
Contracting Officer’s Representative (COR). The plan will include, but not be limited to, the removal operations plan, operations and safety oversight plans including an Activity Hazard Analysis (AHA) and Overall Safety Plan, survey equipment, authorized crane operations and tower transportation.
2.2. The COR review time should not exceed 10 days. Upon review and acceptance of the submitted plan by the COR, the contractor will remove the tower and secure the tower site according to this Statement of Work and the submitted plan within 30 days of the COR’s acceptance of the plan.
2.3. Remove and dispose of the radio tower including all components of the truss steel tower above grade, and all equipment attached to the tower including cables and all guy anchors (tower debris).
2.4. Cut all guy anchors off 1 foot below grade and remove the anchor wires along with the tower.
2.5. Transport tower and all equipment to a recycling facility acceptable to the COR. If an acceptable recycling facility is not available, the removed tower and tower debris will be taken to a disposal facility acceptable to the COR.
2.6. Clean up all debris from the site pertaining to tower removal as determined by the COR.
2.7. Apply for and receive all appropriate tower removal and disposal government and agency permits, including but not limited to access and environmental permits.
2.8. All other tasks necessary for the complete logistical and lawful removal and disposal of the radio tower and debris.
3. Additional tower operations structures at or near the radio tower.
3.1. All additional radio tower operations equipment and structures at or near the radio tower, including but no limited to buildings, power equipment, building pads, gas containers and any other tower-operations equipment are not part of the debris to be removed along with the tower.
3.2. If needed, the existing chain-link fence surrounding the tower facility may be detached during the tower removal process, but will be re-installed at its current location and with its full security function for protection of the equipment and materials left on site after the tower removal.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
