Section 00100 - Bidding Schedule / Instructions to Bidders

BASIS OF AWARD

This contract will be awarded to one contractor using a best value tradeoff source selection process outlined in FAR Part 15. The Government will use a trade-off process to determine the awardee considering price and other factors described below. The Government may award to other than the lowest-priced or highest-rated offer. This acquisition will be set-aside exclusively for small business in accordance with the procedures outlined in FAR Part 19. Similar past requirements have indicated that there are ample local small businesses capable of performing this project.

PROJECT BACKGROUND AND OBJECTIVES

The U. S. Army Corps of Engineers (USACE), Portland District, seeks a contractor to perform the installation of the Cougar Oil Spill Prevention System, and incidental related work. The project consists of installing structural, mechanical, electrical, and minor subsurface drainage systems and components. Specific project features include:

a. Installation of powerhouse sump dividing wall;

b. Installation of powerhouse sump pumps, piping, controls, and ancillary equipment;

c. Installation of external turbine bearing coolers and ancillary equipment;

d. Installation of directional main unit step up transformer pressure relief valve;

e. Installation of oil containment curbs and ancillary equipment in the intake tower and powerhouse;

f. Modification of existing drainage pipe systems in the intake the tower and powerhouse;

g. Installation of trench drain and discharge piping at the containment building.

SELECTION PROCESS

This section identifies the minimum requirements of the Offeror’s proposal, and provides guidelines for the preparation of the proposal. Due to the technical requirements and the complexity of the project a “Best Value- Tradeoff” acquisition strategy will be used. The solicitation is a 100% Small Business Set-Aside. The Government intends to award a single award, firm-fixed price contract. Award will be made to the Offeror whose proposal represents the best value to the government.

EVALUATION PROCESS

A. General.

(1) This solicitation is a total small business set-aside. The Government intends to award a single, firm-fixed price construction contract to the responsible Offeror whose proposal represents the best value after evaluation in accordance with the factors and sub-factors in the solicitation. Offerors shall submit a technical proposal, and a price proposal. The evaluation results of the non-price and price proposals will determine an awardee. All evaluation factors other than price are approximately equal in importance to one another. All evaluation factors other than price, when combined, are approximately equal to price.

(2) The Government intends to make an award without discussions, but reserves the right to conduct discussions should discussions prove to be necessary or advantageous to the Government. Because the Government does not intend to hold discussions Offerors are encouraged to include their best pricing in their initial proposal.

(3) In the context of this proposal, “Offeror” refers to the proposed prime contractor. A major subcontractor is defined as one who will be providing transformer work, dive work, sump work, or turbine bearing coolers and/or whose subcontract is for more than 25% of the total proposed price.

(4) Information submitted about any company other than the Offeror, whether an affiliated company, major subcontractor, or other associated business, may not be given much weight unless the proposal contains evidence that the Offeror has obtained a written commitment from this other business entity to perform a portion of the work.

00100-1

(5) All proposals received will stand alone and be considered complete and final. The evaluation board will not consider any information or data incorporated by reference or otherwise referred to. The successful Offeror will be selected solely on the basis of the evaluation factors set forth below. Accordingly, proposals submitted in response to this solicitation should provide clear, complete, concise, and straightforward responses to the evaluation factors.

Elaborate proposals, color brochures, and other excesses are discouraged.

B. Evaluation Ratings.

All non-price factors other than past performance shall be rated using the combined technical/risk rating as follows:

COLOR RATING DESCRIPTION

Blue Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses.

Risk of unsuccessful performance is very low.

Purple Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.

Green Acceptable

Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.

Yellow Marginal

Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by the strengths. Risk of unsuccessful performance is high.

Red Unacceptable Proposal does not meet the requirements and contains one or more deficiencies.

Proposal is unacceptable and unawardable.

C. Definitions.

Deficiency A material failure of a proposal to meet a Government requirement or a combination of weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.

Strength An aspect of an Offerors’ proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Significant Strength An aspect of an Offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

Weakness A flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.

Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.

EVALUATION FACTORS

Volume I – Technical (Non-Price) Submission Requirements and Evaluation Method:

FACTOR 1 (TAB 1) – Experience

00100-2

Submission Requirements:

The Offeror shall provide project information for a minimum of 2 and a maximum of 4 projects for the prime, and a minimum of 1 project for each proposed major subcontractor(s)*, completed or substantially completed** in the past 10 years that are comparable in size, scope, and complexity with the project required by this solicitation and as described in the Project Background and Objectives.

Submit information for each recent and relevant project with the information contained at Attachment B, Offeror’s Experience Form.

* If the Offeror will not be having any major subcontractors (as defined above in paragraph (A)(3), Basis of Award) perform a portion of the work, clearly indicate. An Offeror will not be treated unfavorably for failing to utilize a major subcontractor.

** Substantially completed is defined as having completed more than 75% of the project work at the time of proposal submission.

Evaluation Method:

The Government will review the submitted projects to evaluate the relevance of the Offeror’s experience with performing work that is similar in size, scope, and complexity to the work being solicited by this RFP.

The Government intends to give greater weight to projects that demonstrate relevant experience in the following areas:

Performing concrete work, steel erection, welding, and mechanical and electrical work in permit-required confined spaces;

Installation and/or rehabilitation of mechanical piping, turbine bearings, and electrical systems in and around hydropower generating units.

Offerors that demonstrate more relevant experience in the above areas will be rated more favorably.

Note: The Government may consider experience information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement.

FACTOR 2 (TAB 2) – Past Performance

Submission Requirements:

The offeror shall provide past performance information for each project listed by the offeror under Factor 1: Experience for the Prime only. Recent and relevant projects are those projects completed or substantially completed** in the past 10 years that are comparable in size, scope, and complexity with this project.

** Substantially completed is defined as having completed more than 75% of the project work at the time of proposal submission.

If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal. Do not submit a PPQ when a completed CPARS is available. Completed PPQs should be submitted with your proposal if a CPARS is not available. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment A), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of

00100-3 questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Michael I. Grasso, via email at Michael.I.Grasso@usace.army.milprior to proposal closing date. The offerors shall instruct the clients to refer to the solicitation number in the subject line. The PPQs are Source Selection materials. All successfully submitted PPQs will receive an e-mail confirmation upon receipt. If the offeror does not receive the confirmation, it is their responsibility to follow up to ensure the government has received the information.

Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted past performance information in the past performance evaluation.

Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror.

In addition to the above, the Government may review other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the PPIRS, including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s),FAPIIS, telephone interviews with organizations familiar with the offeror’s performance, Government personnel with personal knowledge of the offeror’s performance capability, and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Evaluation Method:

The Government seeks a contractor who maintains a strong commitment to customer satisfaction and superior performance. It is the offeror’s responsibility to affirmatively document these qualities in his technical proposal. In doing so, be mindful that “past performance” and “experience” are not identical. Experience measures what you have done and how many times, or for how long, you have done it. Past performance, however, measures how well you have performed.

There are two aspects to the past performance evaluation. Evaluators will first review each project submitted to determine how relevant the project is to the work being solicited by this RFP. The second aspect of the past performance evaluation is to determine how well the offeror performed on those projects. A final Performance Confidence Assessment Rating will be given for this factor based on the assessment of recent and relevant past performance information and the assessment of the quality of past performance on prior contract efforts.

With respect to relevancy, more relevant past performance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment than past performance of lesser relevance.

Relevancy will be determined based on how closely the Past Performance effort involved similarity of scope and magnitude of effort, dollar value, and complexities this solicitation requires.

There are four levels of relevancy as shown in the Table below: Note that although relevance is a significant contributor to the final Past Performance Rating, it is not a formal Rating in and of itself.

00100-4

Past Performance Relevancy

RATING DEFINITION

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Present/past performance effort involved some of the scope and magnitude

Relevant of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The SSEB will review the past performance information and determine the quality and usefulness as it applies to performance confidence assessment. In conducting a performance confidence assessment, each offeror shall be assigned one of the ratings using the Table below, focusing on performance that is relevant to the contract requirements.

Performance Confidence Assessments

RATING DESCRIPTION

Substantial Confidence

Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence

Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Unknown Confidence (Neutral)

No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

If any performance issues are identified, the Government will consider the number, type and severity of the problems and effectiveness of corrective actions taken.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance, and therefore may receive an “Unknown Confidence” rating.

FACTOR 3- Project Execution

Sump dividing Wall Installation Plan.

Submission Requirements:

Submit a detailed description of the Offeror’s method for installing the powerhouse sump dividing wall and other mechanical/electrical components required by the RFP.

The detailed description should include:

00100-5

Methods and sequence for handling and installing the wall components, to include the proposed equipment and use of the equipment to handle the anticipated modular wall component weights and sizes.

How installation efforts will be coordinated and controlled both outside and inside the powerhouse sump.

Methods to protect wall components to minimize damage to paint coatings and sealing surfaces.

How the wall placement sequence will accommodate other installation activities for other mechanical and electrical work required in the sump.

Turbine Bearing Cooler Installation Plan.

Submission Requirements:

Submit a detailed description of the Offeror’s method for installing the turbine bearing cooler system.

The detailed description should include:

The methods and sequence for handling and installing the bearing cooler components, to include the Offeror’s plan to handle the anticipated bearing cooler component weights and sizes.

Plan to demolish existing bearing coolers and install new bearing coolers, while minimizing damage to existing equipment. Include plan to ensure that reassembly will meet allowable tolerances.

How installation efforts will be coordinated and controlled on, in, and around the units.

Evaluation Method:

A highly rated plan will demonstrate that the Offeror understands the required work, the contingencies that may arise and how to deal with them (and still meet the outage window schedule), the site constraints, and the proper installation techniques to achieve success.

A more detailed and specific plan that thoroughly addresses the work tasks and contingency responses needed to successfully accomplish the work required by the RFP will be rated more highly than a vague and general plan.

The Government will give greater weight to plans that demonstrate the following:

A thorough understanding of the needed coordination and quality control efforts for quality installation;

Feasible methods and realistic sequencing for handling and installing the system components;

A feasible plan to protect wall components and minimize damage to paint coatings and sealing surfaces (wall installation);

An achievable method for ensuring a water tight seal between the two halves of the sump (wall installation);

00100-6

A plan for accommodating other mechanical and electrical work required in the sump (wall installation).

A feasible plan to minimize damage to existing equipment during demolition and installation (bearing coolers);

A plan that ensures reassembly will meet allowable tolerances (bearing coolers).

FACTOR 4 (TAB 5) – Schedule

Submission Requirements:

Gantt Chart. The Offeror shall submit a Gantt chart (Adobe PDF and either MS Project or Primavera software formats) showing a planned schedule to complete the project in accordance with the Plans and Specifications, to include Section 01 10 10.00 25 Contractor’s Operations and Requirements (covering work periods for the In-Water Work and Sump Work). The schedule should identify critical path items.

Narrative. The Gantt chart shall be accompanied with a narrative addressing how the Offeror will maintain and accomplish the project schedule. Examples of narrative topics include critical path, production rates, weather days, assumptions used (i.e. size of crew, hrs/day, days/wk), anticipated problem areas or delaying factors and their impact, proposed corrective actions and contingency plans to meet project milestones/outage windows (In-Water Work (IWW) and Sump Work Periods), and other factors that demonstrate the ability to accomplish the schedule.

Evaluation Method:

The Government will evaluate the submitted Gantt chart and the Narrative for practicality, flexibility and thoroughness.

The Government will give higher ratings to proposed schedules that identify the major tasks needed to accomplish the work, include major tasks in a logical sequence, and include realistic timeframes for each major task needed to accomplish the scope of work. The Government will evaluate the Offeror’s schedule and narrative to determine the Offeror’s understanding of the work’s schedule constraints and ability to complete the work on time despite schedule constraints and potential contingencies that may arise.

A highly rated schedule will demonstrate that the Offeror has a realistic plan to complete the work on time. A more highly rated schedule will include:

Information on the anticipated wall and sump equipment placement rates to meet the dates specified in the contract;

Information on the anticipated bearing cooler demolition and installation rates; and

Installation duration of the directional main unit step up transformer pressure relief valve.

Volume II - Price.

PRICE Evaluation

For this solicitation, the non-price factors, when combined, are approximately equal to price. The Price Proposal will be evaluated to determine fairness and reasonableness.

The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of

00100-7 cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

SUBMISSION OF PROPOSALS AND EVALUATION

A. Administrative Details and General Instructions: Proposals are due no later than the time and date specified in Block 13 of Standard Form 1442.

(1) General Proposal Format. Submit each copy of the proposal in tabbed, 3-ring binders with a “D” ring or locking closures.

Title Page. Each copy must include the Offeror’s name and address, phone number and email address, title of the solicitation, solicitation number and date of submittal clearly identified on the front cover of the binder.

Table of Contents. Each binder of the proposal shall contain a detailed table of contents. The complete table of contents shall be included in each binder.

Printed Matter Submissions. Pages containing text are expected to be 8 ½ x 11 inches with at least one-inch margins at the top, bottom, and both sides. Paragraphs should be separated by at least one blank line. A standard 11-point font in either Arial or Times New Roman is preferred.

Organization charts or schedules. A folded 11” x 17” format may be used. Larger format drawings or tables may be added by folding them to fit within the binder.

All information must be confined to the appropriate volume. If the materials do not fit within a single volume, they should be separated in additional binders, but clearly identified as such. Each volume of the proposal is expected to contain a table of contents, summary section with a brief abstract of the volume, and the narrative discussion.

THE OFFEROR SHALL SUBMIT AN ELECTRONIC VERSION OF EACH PROPOSAL. The electronic version shall be on a readable CD. Any discrepancies between the electronic and paper copies shall give precedence to the paper copy.

(2) Proposal Content Limitations.

The Offeror must confine the proposal to relevant information and documentation sufficient to provide an adequate basis for evaluation. Offerors are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of the proposal. The page count is at the discretion of the Offeror, however the proposal may not be more than 50 pages total. The 50 page limit does not include past performance information submitted under Factor 2.

The evaluation panel for the Government is instructed to evaluate the non-price proposal factors on the basis of the information provided. Extraneous information provided in the proposals will not be considered in the evaluations; therefore, the Offeror should only provide information that satisfies the solicitation requirements. Merely restating the specifications without sufficient elaboration demonstrates a lack of understanding of the requirement.

DO NOT cross reference past performance information. It is acceptable to repeat data, project information or experience in more than one non-price area as long as it satisfies the requirements of the factor.

00100-8

Proprietary information must be clearly marked.

B. Content of Proposals: All proposals must be prepared in two volumes: A technical proposal (Volume I), a price proposal (Volume II). Each of the volumes shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other. The technical proposal (Volume I) must not contain reference to price. The narrative and content structure of the proposal shall follow the format shown under Volume I below. Offerors who fail to submit a complete proposal may be excluded and thus receive no further consideration for award.

(1) Technical Proposal, Volume I: Provide one (1) original and three (3) copies and one (1) pdf. file on a CD-ROM. Volume I shall consist of information for the six (6) factors, and the associated sub-factors, listed in tabular form, as noted below. Repeating or restating the specifications without sufficient elaboration will be determined to show a lack of understanding of the requirement.

EVALUATION, the PPQ included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 3, Recent of Current Past Performance.

AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CPARS IS AVAILABLE.

CLAUSES INCORPORATED BY FULL TEXT

52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (JAN 2004)

(a) Definitions. As used in this provision--

“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.

“In writing or written” means any worded or numbered expression which can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.

Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show--

(i) The solicitation number;

00100-14

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, or revision, of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of

00100-15 items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).

(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--

(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and

(2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.

(f) Contract award. (1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.

(2) The Government may reject any or all proposals if such action is in the Government's interest.

(3) The Government may waive informalities and minor irregularities in proposals received.

(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.

(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.

00100-16

(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the

Government.

(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

(9) If a cost realism analysis is performed, cost realism may be considered by the source…
