Tab B, Factor #2 CONSTRUCTION SCHEDULE

Tab C, Factor #3 PAST PERFORMANCE

c. Page Limitations. The following page limitations are established for each factor described above:

Factor #1 Construction Experience Limited to 2 pages per project (maximum of five (5) forms) sent electronically

Factor #2 Construction Schedule Limited to ten (10) 8 1/2" x 11" pages or five (5) 11" x 17" fold-out pages (including narrative)

Factor #3 Past Performance No page limitation

Tables of content, proposal cover letters, and tabs between proposal information do not count toward any page limitations in the proposal.

PART III - EVALUATION OF OFFEROR PROPOSALS

1. ELIGIBILITY FOR CONTRACT AWARD

In accordance with the FAR, no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

2. SOURCE SELECTION USING THE LOW-PRICED, TECHNICALLY ACCEPTABLE PROCESS

SECTION 00 22 11 Page 8

An evaluation for acceptability will be performance on each proposal in accordance with FAR 15.101- 2(b)(3). The proposal that provides the lowest price and is otherwise technically acceptable in all factors will be selected for award. To be considered technically acceptable, no technical factor in the proposal may be determined to be unacceptable. The failure of a proposal to meet any of the acceptability standards for non-cost factors will result in a technically unacceptable rating and preclude award.

3. BASIS OF AWARD

Award will be made on the basis of the lowest evaluated price of technically acceptable proposals meeting or exceeding the acceptability standards for non-cost factors. Tradeoffs will not be permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors.

4. EVALUATION OF THE PRICE PROPOSALS

a. Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

b. The otherwise technically-acceptable, lowest-priced offeror may be required to confirm its price on either a, CLIN, element, or total price basis, and/or provide additional information in support of their price, prior to contract award at the Government’s request and discretion.

c. The statutory limit for construction for this project is $2.67M. This is the statutory limit for Unspecified Minor Military Construction projects. Any proposals that exceed this limit will NOT be accepted.

5. INTENT TO AWARD WITHOUT DISCUSSIONS

The Government intends to evaluate proposals and award a contract without discussions. Offerors are reminded to include their best technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interests of the Government.

6. PROPOSAL EXPENSE AND PRE-AWARD COSTS

The Request for Proposal does not commit the Government to pay any costs incurred in the preparation and submission of the initial and/or any subsequent proposals.

7. EVALUATION OF THE TECHNICAL PROPOSAL

The Technical Proposal will be evaluated based on the criteria identified in the individual attachments for the Factors.

8. GENERAL TECHNICAL CRITERIA

a. Material omission(s) may cause the technical proposal to be rejected as

SECTION 00 22 11 Page 9 unacceptable.

b. Proposals which are generic, vague, or lacking in detail may be considered unacceptable. The offeror’s failure to include information that the Government has indicated should be included in the proposal may result in the offer being found deficient.

c. The Government cannot make award based on a deficient offer. Therefore, receipt of an “UNACCEPTABLE” determination of acceptability for any factor will make the offer ineligible for award, unless the Government elects to enter into discussions with that Offeror and all deficiencies are remedied in a revised proposal.

9. 52.217-5 EVALUATION OF OPTIONS (If applicable)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options (if options are applicable) to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

10. TECHNICAL PROPOSAL

FACTOR #1

TAB A: FACTOR 1, CONSTRUCTION EXPERIENCE: Demonstrate the experience of the offeror and/or proposed team, including subcontractors on projects same/similar in SIZE, SCOPE, and COMPLEXITY to that described in the solicitation. If using subcontractors as team members in demonstrating experience describe the roles the prime contractor and sub-contractors will play in the project and the percentage and type of work each will perform.

Same/similar experience is defined as:

1) Construction contract value of at least $1,500,000.00; AND

All projects submitted must be at least 50% complete for current on-going projects and for projects that are 100% complete, these projects must have been completed within the last six (6) years.

If any of the information required is not included in the form then the contractor will be considered non- responsive and evaluated as “UNACCEPTABLE”.

(SEE CONSTRUCTION EXPERIENCE FORM IN ATTACHMENT 2)

TAB A: FACTOR 1, CONSTRUCTION EXPERIENCE WILL BE EVALUATED BASED ON THE

FOLLOWING CRITERIA:

SECTION 00 22 11 Page 10

The Government will review the project experience of the offeror, including subcontractors, on projects provided in response to the Construction Experience Factor. Offerors must meet all of the following minimum acceptability standards to receive an “ACCEPTABLE” on this factor:

5) All “Experience Information” forms submitted under Factor 1 must be completely filled out.

Failure to demonstrate the minimal acceptability standards under this factor will result in an “UNACCEPTABLE” rating and possible elimination from further consideration for contract award.

FACTOR #2

TAB B: FACTOR 2, CONSTRUCTION SCHEDULE: The Offeror shall provide a Narrative and a time scaled (Gantt Chart) summary level network construction schedule that demonstrates the Offeror has a clear understanding of the requirements of the contract and the contract duration. The summary network schedule will indicate the total contract duration in calendar days on the Schedule. The summary schedule will, after contract award, be replaced with a project schedule as required by specifications.

The Schedule shall fully demonstrate how the Offeror plans to complete all contract work, with the specified completion of Base Offer and Option Item work from the receipt of the contract Notice-to- Proceed (NTP) in accordance with Section 01 00 00.00 44 Construction Schedule. The submitted Schedule is to include sequencing of work for construction activities, mandatory tasks, specified time for Government required review and approval periods of required submittals, construction submittals, long lead procurement items, all required construction phasing of work, all Option work items, and contract closeout submittal items. (See Section 01 32 01.00 10 Project Schedule, and Section 01 33 00 Submittal Procedures). The submitted Schedule shall identify and include all Option Work Items and any specified phasing of work in accordance with the Breakout Price Schedule, Section 00 11 01. Completion of option work items is in accordance with the Breakout Price Schedule Notes unless otherwise noted in the solicitation Construction Schedule.

The Narrative shall include discussion of any construction challenges the Offeror foresees that may jeopardize the successful completion of all contract

SECTION 00 22 11 Page 11 work to include required construction phasing, construction execution without impacting facility operation, and Option work items. The Offeror shall describe the plans for overcoming these challenges including the steps to guarantee that facility operation is neither impacted nor disrupted by the Contractor’s workmen. If no challenges are foreseen, then state as such. Any deviation from the solicitation requirements will be considered non-responsive and evaluated as unacceptable.

Offerors must submit a summary schedule for construction. Offerors must meet all of the following minimum acceptability standards to receive an “ACCEPTABLE” on this factor. The Government will take into account how well the summary schedule supports the contract duration, as well as other information, such as (but not limited to) independent judgment concerning logic, constraints and typical construction durations. The summary schedule shall be task oriented, indicating the number of calendar days after notice to proceed by which milestones are to be achieved. Give attention to the following features:

1) Show the overall construction schedule and duration for the base bid and all options.

2) Explain the greatest risk(s) to completing the project on schedule.

Provide Narrative that discusses how any construction challenges the Offeror foresees are overcome to insure all contract work is successfully completed within contract requirements.

NOTE: SCHEDULES ARE TO BE IN SUFFICIENTLY CLEAR AND COMPLETE FORM SUCH THAT

THE SUCCESSFUL OFFEROR, UPON AWARD OF THE TASK ORDER, WILL BE ABLE TO BEGIN

MEANINGFUL WORK IMMEDIATELY. THE SCHEDULES ARE BINDING IN INTENT WITH REGARD

TO COMPLETION DATE.

TAB C: FACTOR 2, CONSTRUCTION SCHEDULE WILL BE EVALUATED BASED ON THE

2) Describing the overall construction packaging plan, AND

SECTION 00 22 11 Page 12

3) Describe sequencing and time frames of all long lead item equipment that must be ordered.

Failure to demonstrate the minimal acceptability standards for the schedule and for the narrative under this factor will result in an “UNACCEPTABLE” rating and possible elimination from further consideration for contract award.

FACTOR #3

TAB C: FACTOR 3, PAST PERFORMANCE:

The Contractor shall provide a completed Past Performance Questionnaire for each project submitted in Factor 1. Do not submit Past Performance Questionnaires on projects that have final CCASS or ACASS evaluations.

The Past Performance Questionnaire included in the solicitation (Attachment 3) is provided for the offeror or its team members to submit to the client for each project the offeror included in its proposal for Factor 1. Ensure correct phone numbers and email addresses are provided for the client point of contact.

Completed Past Performance Questionnaires (PPQ) should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror shall complete and submit with the proposal the first page of the PPQ (Attachment 3), which will provide contract and client information for the respective project(s).

Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If any negative past performance information is received, and the contractor has not yet been given an opportunity to provide a response, the contractor will be given an opportunity to provide a response.

If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Contract Specialist, Rochelle Ross, via email at: Rochelle.Ross@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposals PPQ’s previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

NOTE: Do not request past performance questionnaires (PPQ) on projects that have final CCASS, CPARS or ACASS evaluations. If a CCASS, CPARS or ACASS evaluation exists and a PPQ is provided for the same project, the CCASS, CPARS or ACASS evaluation will be reviewed as the official past performance record for the project, and the PPQ will not be considered by the Source Selection Board, Contracting Officer, or the Source Selection Authority (if applicable).

For USACE or other DoD projects which are underway but do not yet have an interim or final CCASS, CPARS or ACASS evaluation, one PPQ per contract may be submitted; to be considered, the PPQ shall be signed by the Administrative Contracting Officer (ACO) for the contract.

Also include performance recognition documents received within the last six

(6) years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

SECTION 00 22 11 Page 13

In addition to the above, the Government may review any other sources of information for evaluation past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS number of team members (Partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquires of owner representative(s), Federal Awardees Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rest with the Offeror.

New entities that have no past customers shall notify the Contracting Officer in writing, prior to the date and time established for the Solicitation or Request for Proposal closing, that they have had no previous clients and that the minimum number of questionnaires cannot be provided; It is the contractor’s responsibility to ensure that the reference documentation is provided and accurate, as the Government may not make additional requests for past performance information from the references.

The Government will review all CPARS, ACASS, CCASS and the Government wide Past Performance Information Retrieval System (PPIRS) evaluations regardless of project and past performance questionnaires for projects submitted under the Factor for Experience. The Government may contact points of contacts listed on the “Experience Information” forms submitted.

TAB C: FACTOR 3, PAST PERFORMANCE WILL BE EVALUATED BASED ON THE FOLLOWING

CRITERIA:

The Contractor shall provide a completed Past Performance Questionnaire for each project submitted in Factor 1. Do not submit Past Performance Questionnaires on projects that have final CCASS, CPARS or ACASS evaluations.

Each Contractor shall provide a minimum of three (3) and no more than five (5) past performance ratings.

Any rating an offeror has in ACASS, CCASS, CPARS and PPIRS will count toward this requirement. The offeror is responsible for ensuring that the Contracting Officer has received any completed questionnaires prior to the closing date/time.

All past or current references must have overall ratings of satisfactory or above in order to receive an “ACCEPTABLE” rating.

In accordance with FAR 15.101-2(b)(1), if the Contracting Officer determines that a small business' past performance is not acceptable, the matter is referred to the Small Business Administration for a Contracting Officer’s Compliance determination.

In accordance with FAR 15.305 (iv), in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. Offerors with no past performance information will receive an “Unknown” or NEUTRAL rating for this factor. Therefore, an Offeror

SECTION 00 22 11 Page 14 receiving an “Unknown” rating may not be evaluated favorably or unfavorably on past performance. In the context of acceptability/unacceptability, "Unknown" shall be considered "Acceptable".

Failure to demonstrate the minimally acceptable criteria under this factor will result in an “UNACCEPTABLE” rating and elimination from further consideration for contract award.

If the Government does not obtain past performance information and cannot establish a past performance record for the Offeror through other sources, a rating of Unknown (Neutral) confidence will be assigned.

If negative information is received, the Offeror will be given an opportunity to provide input as required by FAR 15. CPARS, CCASS that are part of the official record will be utilized as if the Offeror has already had an opportunity to respond.
