2. PUBLIC BID OPENING will be held on 9 August 2021 at 1:00PM MST at Yuma Proving Ground, Walker Cantonment, Bldg. 2100, Room 35, MICC-YPG office.
3. Basis for Award: After bids are publicly opened, an award will be made to the responsible bidder (see FAR 9.1) whose bid is responsive to the terms of the invitation for bid and is most advantageous to the Government, considering only price and the price related factors included in this invitation for bid (FAR Subpart 14.101 e).. The MICC YPG office shall be award utilizing Sealed Bidding Procedures in accordance with Federal Acquisition Regulation (FAR) Part 14, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).
EVALUATION FACTORS FOR AWARD: To be considered for award, a bid must comply in all material respects with the invitation for bids. Such compliance enables bidders to stand on an equal footing, and maintain integrity of the sealed bidding system (Subpart 14.301). Once an “Apparent Low Bid” has been selected the bid submission will be examined to ensure that it completely addresses all of the requirements listed in Section 00100 of the IFB.
a. The Contracting Officer will determine that a prospective contractor is responsible (Subpart 9.1) and that the prices offered are reasonable before awarding the contract. The price analysis techniques in 15.404-1 (b) may be used as guidelines as provided for in Subpart 14.408-2.
b. The Government may determine that an offer is unacceptable if it is determined that the proposed line items are materially unbalanced (e.g. abnormally high cost line items followed by abnormally low cost line items proposed in a combination to give the appearance of reasonableness in an effort to gain award), as defined under FAR Subpart 15.404-1 (g).
c. The otherwise lowest-priced responsible bidder may be required to confirm/validate its price on a Contract Line Item (CLIN), element, or total price basis, and/or provide additional information in support of their price, prior to contract award at the Government’s request and discretion.
NON-RESPONSIVE BID SUBMISSIONS
a. All items specified in Section 00100 – Submissions of Bid Content shall be included in the bidder’s Invitation for Bid (IFB) package to be considered responsive.
b. Bidder’s initially determined to be the “Apparent Low Bid” of a sealed bid process that possess material omission(s) may cause the bid submission to be rejected as “non-responsive”.
Failure to provide this documentation will render the bid/offer non-responsive and no further consideration will be given to that bidder for award of this contract.
5. Pre-Bid and Pre-Construction Conferences: The Contracting Officer will conduct a pre-bid/pre-proposal conference in conjunction with the site visit. All potential bidders/offerors attending the site visit are highly encouraged to attend the pre-bid/pre-proposal conference. Information on the scheduled Site Visit is located in FAR 52.236-3 Site Visit (Construction) of this solicitation. Space limitations dictate that no more than two (2) representatives from each company attend. The Contracting Officer will review solicitation submittal requirements, and other administrative matters critical for successful and timely performance of the work.
a. The Contractor shall attend a Government coordinated preconstruction conference within 10 calendar days of contract award. As a minimum, the conference shall be attended by the Contractor’s appointed Project Manager, the Superintendent, the QCM, and administrative personnel responsible for preparation of contract documents, certified payroll records and invoices. The Contractor shall deliver letter appointments of its key personnel that include each individual’s duties, roles and responsibilities.
6. Subcontractor List: Bidders shall submit a list of proposed subcontractors as an attachment to their bid. If the Bidder does not intend on utilizing subcontractors (self-perform), Bidder shall state so in their bid. Failure to provide this listing or statement will render the bid nonresponsive and eliminate the offer from further consideration for award.

(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13
CFR 121.103.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.
(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
(h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
