52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(1) Evaluation criteria consist of factors and sub-factors. The proposals will be evaluated under 3 evaluation factors:
Factor 1: Mission Capability Sub-Factor 1: Staffing Plan Sub-Factor 2: Management Plan Sub-Factor 3: Risk Mitigation Strategy Factor 2: Past Performance Factor 3: Cost/Price
(2) Factor 1 – Mission Capability. The Mission Capability evaluation provides an assessment of the offeror’s capability to satisfy the Government’s requirements. The evaluation will focus on whether the offeror’s proposal is either acceptable or unacceptable to meet the subfactors below.
Sub-Factor 1: Staffing Plan. The staffing plan must clearly depict the total number of hours and labor categories and shall not contain cost or price information. All cross utilization of personnel shall be clearly explained and depicted. Man-hour matrices shall be provided, depicting the proposed labor effort for core operations. Employees shall be identified as exempt or non-exempt. If non-exempt, offerors shall clearly identify the specific level and title of the labor category. For conformed positions, offerors shall explain the rationale for development of the position.
Sub-Factor 2: Management Plan. Offerors shall delineate proposed organizational and management approaches and organization’s resources, tools and systems intended for the performance of the contract. Offerors shall describe its current organizational structure in terms of number of employees and describe how it will utilize such assets to implement its proposed organizational structure for the Army’s requirement. This should include detail on specific departments/disciplines for both the offeror and proposed subcontractors and the personnel positions to be staffed within those departments/disciplines (identify number of personnel and titles for each). The management plan shall also include what the contractor proposes to do in a time of a surge and then once the surge is over what will be the plan to ramp back down to normal operation.
Sub-Factor 3: Risk Mitigation Strategy. The Risk Mitigation Strategy shall include what the contractor proposes to do in a time of a surge and then once the surge is over what will be the plan to ramp back down to normal operation. Technical Exhibit 4 is a scenario each contractor shall propose to.
The Mission Capability Factors shall receive one of the adjectival ratings defined below. The Sub-factor ratings will be used to determine an overall rating for the factor.
Table A-1. Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
(3) Factor 2 - Past Performance. . Past Performance evaluation will be conducted by the Government using, Past Performance Information Retrieval System (PPIRS) and will be used to determine the rating for past performance.
(4) Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques the Government will determine whether prices are reasonable, complete and balanced.
(a) Proposal Pricing. Proposal prices shall be good for 90 days.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
Unbalanced Pricing may be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Proposal Submittal and Inquiries.
1. Proposals shall be submitted prior to the closing date and time identified on SF 1449, to the following address:
Mission and Installation Contracting Command Center
ATTN: KATIE PABEN

3. The point of contact responsible for supplying additional information and answering all inquiries is the Contracting Officer via the Contract Specialist. 3. It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, in accordance with (IAW) FAR Part mailto:katie.e.paben.civ@mail.mil mailto:melody.a.price8.civ@mail.mil
15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306 (c)(2).
4. Instructions outlined in paragraph C below, prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.
5. If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the offeror shall immediately notify the KO in writing with supporting rationale.
The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
6. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.
7. All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) website at http://www.fbo.gov. Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.

Legibility, clarity and coherence are very important. Your responses will be evaluated against the Technical factors defined in 52.212-2. -Evaluation Criteria
Sub-Factor One – Staffing Plan- In evaluating this factor, the assessment will concentrate on the offeror’s understanding and capability of providing the scope of services required. Proposals will be evaluated on proposed management, labor mix, and total number of full time equivalents (FTEs) per functional area, as well as proposed organizational structure, by functional area as depicted in TE 3 – Optimum Staffing. If the proposal lists alternative proposed staffing that differs from the staffing that the government deems optimal in order to support the requirements stated in the solicitation, the proposal shall support the alternative staffing in detail and explain how their proposed staffing will support the requirements stated in the solicitation. Otherwise, a proposal that lists alternative proposed staffing without this detail will result in an unacceptable rating for this factor.
Sub-Factor Two – Management Plan – In evaluating this subfactor, the assessment will concentrate on the extent to which it demonstrates a clear understanding of the organization, personnel, tools and processes required to address JPED’s challenges and issues. Proposals will be evaluated to determine whether the offeror’s organization, management techniques, processes, controls and personnel will meet requirements of the PWS and whether the proposal provides the government with confidence of successful performance may result in an acceptable rating.
SUB-Factor Three- Risk Mitigation Plan- In evaluating this subfactor, the assessment will concentrate on the contractor’s plan, on what to do in a time of a surge. After the surge is over, what will be the plan to ramp back down to normal operation. This evaluation will be done utilizing the attached scenario in Technical Exhibit 4 (TE4).
Past Performance- Past Performance evaluation will be conducted by the Government using Past Performance Information Retrieval System (PPIRS) and will be used to determine the rating for past performance. Should no past performance exist, the contractor will be rated neutral, which is acceptable.
(c) Volume III –Price Offerors shall ensure that no pricing information is displayed in the Mission Capability Volume; however, this restriction does not preclude the offeror from describing staff levels relevant to its proposal.
1. The offeror shall submit a price proposal for a one year base period and two one-year option periods. All final monetary extensions shall be in whole dollars only.
