SECTION M - EVALUATION FACTORS FOR AWARD

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The

Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement.

Subject to the provisions contained herein, the Government intends to award a single contract resulting from the

Solicitation, to the Quoter who is deemed responsible in accordance with the FAR, as supplemented, whose

Proposal conforms to the Solicitation’s requirements (to include all stated terms, conditions, and all other information required by the Solicitation), and provides the lowest priced, technically acceptable proposal to satisfy the requirements of this Solicitation and the PWS. The Government intends to award the contract without discussions. Therefore, the quote should contain the Contractor's best terms from Mission Capability and Price standpoint; however, the Government reserves the right to conduct discussions.

1.1Evaluation criteria consist of two (2) evaluation factors. The Proposals will be evaluated under the following evaluation factors:

Factor 1: Mission Capability mailto:abelardo.c.lopez.civ@mail.mil mailto:ronald.a.ascher.civ@mail.mil

Factor 2: Price

Assigning Ratings: The Mission Capability Factor will be assigned one of the ratings defined below.

Table A-1. Technical Acceptable/Unacceptable Ratings

Table A-1. Mission Capability Acceptable/Unacceptable Ratings

Rating Description

Acceptable Quote meets the minimum requirements of the RFQ

Unacceptable Quote does not meet the minimum requirements of the RFQ

1.2 Evaluation Factors. The Government’s technical evaluation team will evaluate proposals to determine either technically acceptable or technically unacceptable (price excluded). In order to be considered technically acceptable, the proposal for Factor 1 must be determined acceptable and must demonstrate an understanding of the requirements for all task areas described in the PWS. The proposal must demonstrate a practical/functional technical approach that meets the needs of the Solicitation. Failure to meet the criteria will render the proposal to be technically unacceptable and will not be considered for award.

1.2.1 Factor 1: Mission Capability

To be deemed technically acceptable, the Quoter’s Mission Capability must demonstrate the following:

(i) The Quoter provided a plan demonstrating an understanding of the requirement and how the tasks in the PWS would be fulfilled.

(ii) The Quoter provided a realistic and effective phase-in approach that demonstrated how the Quoter would be fully staffed and operational to perform all the PWS requirements within 15 days after award.

(iii) The Quoter provided an organizational chart with a detailed explanation of its organizational structure, including key positions, qualifications of the position(s), and if applicable, identified specific work the prime, subcontractors, or teaming partners would perform.

(iv) The Quoter provided a feasible staffing plan that meets the requirements of the PWS, the minimum staffing in Technical Exhibit 5, and meets the minimum qualifications for each labor category as identified in the PWS. The Quoter also provided a breakout chart by labor category, number of FTE’s, hours, skill level, SCA applicability, and how the staffing proposed can successfully perform each task area of the PWS, to include any cross-utilization.

1.2.2 Factor 2: Price. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 13.106-3 will be the primary means of assessing price analysis for commercial items to determine price reasonableness. The price must be complete and accurate. To be viable for award, a Quoter’s price must be determined fair and reasonable. The total evaluated price includes the price of the base period and all option periods (to include the option to extend services in accordance with FAR 52.217-

8).

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Quoter’s final option period price to the Quoter’s total price. Thus, the Quoter’s total price for the purpose of evaluation will include the Base Period, 1st Option Period, 2nd Option Period, and 1/2 of the 2nd Option Period. Quoters are not required to enter a price for the six-month period. The Government may determine that an quote is unacceptable if the option prices are significantly unbalanced. Unbalanced Pricing may be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk for unreasonably high prices. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Definitions.

Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.

Completeness/Accuracy. The quote is in compliance with the instructions for the Price Volume in the solicitation.
