STATEMENT OF WORK

GENERAL: The Contractor is responsible for providing all materials, equipment, tools and labor to complete the items described in each Contract Line Item (CLIN) in accordance with applicable local and national codes, UFC’s (Unified Facilities Criteria), and ANG ETL’s (Engineering Technical Letter). All material/equipment to be used will be submitted to the Government prior to contractor procurement. The contractor is also responsible for the proper disposal of all waste, to include materials being removed as defined herein. The contractor shall work in a manner to ensure that daily operations are not impeded.

GOVERNMENT ERRORS AND OMMISIONS: The Contractor is responsible for providing the Government with a complete and usable product/facility. It is the Contractor’s responsibility to ensure that all applicable industry codes and standards are adhered to. Should apparent issues arise – the Contractor shall submit a Request for Information (RFI) to the Contracting Office. It is unacceptable for the Contractor to knowingly “look-over” an apparent issue, simply because it was not specifically called out in the Statement of Work. The Contractor and COR will review the provided Statement of Work and Drawing Set, if applicable.

The scope of work depicted on the drawings and Statement of work is intended to be inclusive. However, work to replace/reposition existing equipment /items; are considered required work to make the facility "Complete and Usable," even if not directly called out in the SOW or drawings.

1.0 – BACKGROUND

Charlotte Air National Guard Base (ANGB) is home of the 145th Airlift Wing (AW) based at the Charlotte- Douglas International Airport, NC. The 145th AW flies the C-17 aircraft in support of tactical operations in the United States and overseas, fulfilling a wide range of operational missions in both peace and war time situations.

2.0 – GOALS AND OBJECTIVES

The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items necessary to construct a new fire pump to support Bldgs. 43, 67 and 69.

3.0 CLIN 1: ALTER FIRE PROTECTION WATERLINES

3.1 The construction shall include, but may not be limited to: construction of a new fire pump house with an electric fire pump that will provide the required fire suppression flows for Bldgs 43, 67 and 69. Infrastructure improvements will include relocation of a gas service line, pavement removal and replacement, new concrete pavement, new water main connection, new fire main connections, new electrical service and capping of the existing fire protection line as shown in the drawings and specifications.

4.0 CONTRACTOR PERSONNEL:

4.1 Contractor Employees: Any employee identified to the Contractor by the Contracting Officer (CO) as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population will not be allowed to work on NCANG. The management and control of contractor employees in the performance of this contract shall be the responsibility and prerogative of the contractor; however, the contractor shall comply with the contract requirements and NCANG regulations concerning conduct of employees.

4.2 Security Requirements: Contractor personnel shall obtain pass and individual picture identification items in accordance with NCANG Base and Air Force regulations. These may be obtained at Pass & ID, Bldg 45, Security Police Section. "All contractors/sub-contractor personnel will follow the vetting process for the NC Air National Guard as outlined in the 145th Airlift Wing Instruction 31-101 and Contractors Handbook. Access will not be permitted until all personnel are vetted and approved for unescorted entry to the installation".

4.3 Pass and Identification: The Contractor shall turn in pass and identification items of employees who are terminated, quit, or otherwise leave the employ of the Contractor. The contractor will turn in all items to the Contracting Officers Representative (COR) or the CO within 2 business days.

4.4 Areas of Responsibility: The Contractor shall be responsible for the satisfaction of all applicable regulatory agency requirements, including transport and disposal of hazardous waste. In the event that a regulatory agency or authority assesses a monetary fine, surcharge or penalty against the government for violations caused by Contractor negligence, the Contractor shall reimburse the government for the amount of that fine. Also within the scope of Contractor responsibility are personnel qualifications, avoidance of nuisance conditions and complaints, disposal of all waste oils, filters, contaminated cleaning supplies, and other waste materials.

4.5 Quality Assurance: The government will evaluate the contractor’s performance. Government personnel will record all surveillance observations and COR will maintain a file of all inspection results. Government surveillance of tasks not listed in the SOW or by methods other than those listed in the SOW (such as provided for by the Inspection of Construction clause, FAR 52.246-12) may occur during the performance period of this contract. Such surveillance will be done according to standard inspection procedures or other contract provisions. Any action taken by the contracting officer as a result of surveillance will be according to the terms of this contract.

4.6 CONTRACTOR MANPOWER REPORTING: The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the AIR FORCE collection site. The contractor is required to completely fill in all required data fields using the following web address: https://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. 5.0 SECURITY

5.1 Physical Security: The Contractor shall be responsible for safeguarding all government property and equipment provided for Contractor use. At the end of each work period, all government facilities, equipment and materials shall be secured.

5.2 Key Control: The Contractor shall establish and implement methods of making sure all keys issued by the government at the time of service are not lost or misplaced and are not used by unauthorized persons. The Contractor shall not duplicate any keys issued by the government. The Contractor shall develop procedures for maintaining key control

5.3 Lost Keys: The Contractor shall immediately report to the COR or Contracting Officer any occurrences of lost or duplicated keys. In the event that any keys, other than master keys, are lost or duplicated, the Contractor may be required, upon written direction of the Contracting Officer, to re-key or replace the affected lock or locks without cost to the government. The government may, however, at its option, replace the affected lock or locks or perform re-keying and deduct the cost of such from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the government and the total cost deducted from the monthly payment due the Contractor.

5.4 Government Issued Keys: Government issued keys shall be limited to Contractor employees that are authorized to work at the NCANG and only for time on-site.

6.0 HOURS OF OPERATION:

6.1 Normal Hours of Operation: Normal base operating hours are from 0730-1600, Monday through Friday, excluding weekends and federal holidays. Interface with government personnel will be primarily during these hours. Requests must be made 2 weeks in advance if work is needed on weekends or holidays.

6.2 Conservation of Utilities: The Contractor shall make sure employees practice utilities conservation.

The Contractor shall be responsible for operating under conditions that prevent the waste of utilities to include the following:

6.3 Lights: Lights shall be used only in areas where work is actually being performed.

6.4 Water: Water conservation measures specified by the base shall be followed. Faucets and valves shall be turned off when not in use.

7.0 ENVIRONMENTAL CONTROLS:

7.1 Compliance with Laws and Regulations: The contractor shall be knowledgeable of and comply with all applicable Federal, State, and local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations/requirements change during the term of this contract, the contractor shall comply with such law/regulation as changed. If there is an increase or decrease in cost as a result of the change, the contractor shall immediately inform the Contracting Officer for possible modification of the contract.

7.2 Notification of Environmental Spills: If the contractor spills or releases any substance listed in 40

CFR 302 into the environment, the contractor shall immediately report the incident to the COR. The contractor shall be liable for the spill or release of such substances.

7.3 Environmental and Hazardous Materials Handling: The contractor is responsible for advising his employees of all Environmental and Hazardous Materials Handling and is also required to have and maintain Material Safety Data Sheets (MSDS) on all materials that are required by State and Federal Laws and/or Regulations. (Reference AFI 91-301 and OSHA requirements).

7.4 Hazardous Material: Hazardous material includes all material hazardous to health, safety, or the environment, such as but not limited to, hazardous chemicals, hazardous substances, toxic chemicals, and extremely hazardous substances, as defined by any of the following:

The government’s policy is to reduce the use of hazardous materials in keeping with federal pollution prevention goals. The NCANG operates a Hazardous Material Pharmacy (HMP), Bldg 49 to control and reduce the use of hazardous materials and to maintain a hazardous chemical inventory in accordance with policy and regulatory requirements. The contractor shall use nonhazardous materials whenever possible.

7.5 Approved Hazardous Material: All hazardous materials must be approved by the HMP prior to being brought onto the installation. The contractor shall submit a list of all hazardous materials intended for use, along with corresponding material safety data sheets (MSDS), to the HMP, through the contracting officer, at least fifteen (15) days prior to beginning work or bringing hazardous materials onto the installation. The listing shall include product name, chemical type, and quantity to be brought onto the installation, process for which it will be used, and disposal method for empty containers and any resulting hazardous or nonhazardous waste.

7.6 Hazardous Materials Report: The contractor shall report how and when approved hazardous materials are used, including any amount spilled, evaporated as an air emission, or properly disposed of as solid or hazardous waste. The contractor shall submit to the HMP, through the COR, an inventory of approved hazardous materials brought onto the installation within five (5) days after initial job start. The inventory shall include product name, chemical type, quantity on-hand, and quantity to be used. An updated quarterly inventory shall be submitted to the HMP, through the COR, not later than the 10th of the month following the previous quarter listing quantities used during the previous month, total quantities used since job start (on an annual basis), and any amount disposed of as hazardous or nonhazardous waste.

7.7 Hazardous Material: The contractor shall be responsible for knowing which materials are considered hazardous and shall comply with federal, state, and local requirements pertaining to the proper use, labeling, storage, transporting, and disposal of hazardous materials and hazardous wastes.

7.8 Fines: Any costs or fines levied against the installation due to the contractor’s failure to comply with applicable federal, state, or local laws shall be borne by the contractor.

7.9 Hazardous Waste: Hazardous waste includes, but is not limited to, material discarded or disposed of which exhibits characteristics of toxicity, reactivity, corrosives, or ignitability, or which is listed as hazardous waste by any of the following:

The government’s policy is to reduce the disposal of hazardous waste in keeping with federal pollution prevention goals. The contractor shall be responsible for the proper disposal of any hazardous or nonhazardous waste generated as a result of the contract. The contractor shall minimize the generation of hazardous waste whenever possible.

7.10 Generating Hazardous Waste: Prior to generating any hazardous waste, such as sludge from sumps and waste oil, the contractor shall submit a hazardous waste disposal plan to the COR for

The plan shall include, but is not be limited to, type(s) and estimated quantities of hazardous waste expected to be generated; spill containment and response measures; proof of hazardous waste worker training in accordance with OSHA standards; copies of federal, state, or local regulatory permits required to generate, store, transport, or dispose of the hazardous waste, as applicable; and names and EPA identification numbers of proposed hazardous waste disposal facilities and transporters. The government will characterize hazardous waste sludge by analysis prior to off-site disposal.

7.11 Spill Prevention and Response: The contractor shall ensure all employees are knowledgeable of spill prevention and response procedures. If a spill does occur, the contractor shall take immediate action to contain it and report the incident to the Fire Department by dialing 4911 from any base phone and 145 CES Production Control at (704) 391-4140. If calling by cellular phone, dial (704) 391-4911. The contractor shall also notify CEV at (704) 391-4327, Major Sam Ingram (commercial). The spill shall also be reported in writing to the CO within 48 hours.

7.12 Spill Clean Up: The contractor shall clean up, containerize and properly dispose of, to the satisfaction of the CO, any spills caused by contractor employees such that no petroleum product, toxic chemicals, or hazardous substance enters any creek, gutter, or other appurtenance leading to natural drainage, storm drainage, or sanitary sewer systems. This includes any chemicals or substances that cause soil staining or other potential for air, water, or soil degradation as determined by the base environmental flight.

7.13 Hazardous Spills or Discharges: The contractor should anticipate that the government will report any hazardous spills or discharges to federal, state, and local environmental regulatory agencies, as appropriate, and that the contractor will be held responsible for cleanup and remedial action according to federal, state, local and government specifications. If required by the government, the contractor shall sample, in the presence of CEV, the spill site to show adequacy of spill cleanup.

7.14 Spill Cleanup Using Government Resources: Spill cleanup using government resources will be charged to the contractor at an amount determined by the CO, based upon actual costs incurred.

7.15 Ozone Depleting Chemicals (ODCs): The Contractor shall not use, in performance of this requirement, Class I ODCs, nor shall the delivery of these Class I ODCs be any item of supply or part of any service. If no suitable substitute to a Class I ODC exists, the Contractor must contact the Contracting Officer.

7.16 Safety: The Contractor shall be responsible for complying with safety standards furnished by the Ground Safety Office and instructing employees in all appropriate safety measures as specified in AFI 91-301, Air Force Occupational and Environmental Safety, Fire Protection and Health (AFOSH) Standards.

7.17 Warranty Replacement: The Contractor shall be responsible for honoring manufacturer's and contract warranties and shall maintain on-site records of equipment bearing warranties. Records shall be annotated showing warranted items and warranty expiration dates on all Contractor furnished equipment. The Contractor shall provide support documentation for any warranty claims.

7.18 Contractor Cleanup: The Contractor shall, at all times, keep work areas free from accumulations of waste material, rubbish, tools, equipment, and materials. Upon completion of the job or when away from the work site, the Contractor shall leave the work area and premises in a

Contractor is responsible for removal and proper disposal of all job related waste material at a permitted off base facility. All waste shall be disposed of by the Contractor at a permitted off-base facility in accordance with federal, state, and local regulations. The Contractor shall be responsible for documentation, packaging, and transportation of items and material for disposal. The Contractor shall coordinate with the base Asset Management Flight for any manifesting requirements concerning hazardous waste disposal.

7.19 Coordination with Other Contractors: The government may undertake or award other contracts for additional work, and the Contractor shall fully cooperate with such other Contractors and government employees and carefully fit his own work to such additional work as may be directed by the Contracting Officer. The Contractor shall not commit or permit any act which will interfere with the performance of work by any other Contractor or by any government employee.

8.0 FIRE AND SECURITY POLICE

8.1 Fire Prevention Procedures: Contractor shall follow fire prevention procedures as outlined in NCANG instructions 92-1. Security Police telephone number is (704) 391-4152; Fire Department telephone number is (704) 391-4206 and 4911 for emergencies. The Contractor shall post and maintain these telephone numbers during the contract period for easy access by employees.

Applicable phone numbers will also be reviewed at the pre-construction meeting held after award of the contract.

8.2 Permits: Prior to performing “hot work” (welding, burning, lead-melting, use of blow torches, tar pots, etc.) or operating other flame producing devices, the Contractor shall obtain a Portable Gas/Arc Equipment Cutting and Welding Permit. This permit will be issued by the Fire Department Technical Services Section, telephone (704) 391-4206. The Contractor shall request the permit a minimum of five (5) calendar days prior to desired use. The Contractor shall check the welding area for combustibles, including flammable liquids.

8.3 Additional Requirements: The Contractor shall ensure that all personnel engaged in welding/cutting or open flame operations are properly trained and comply with the requirements of AFOSH Standard 91-5 and 29 CFR 1910.252. In addition, no welding/cutting or open flame operations shall be conducted in facilities when automatic fire detection and suppression systems are out of service. If possible, automatic fire detection systems shall be extended to unprotected areas.

Automatic fire detection and suppression systems shall be returned to service when the facility is unoccupied. In facilities where the fire detection or suppression systems cannot be returned to service or do not exist, the Contractor shall post a fire guard for 24 hours after the welding/cutting or open flame operations or provide written certification that the facility is fire safe.

9.0 GOVERNMENT FURNISHED PROPERTY AND MATERIAL

9.1 General Information: The government shall provide the facilities, equipment, materials, listed here or in Technical Exhibits. The government will not be held responsible for damage due to fire, theft, accident, or any other cause to the Contractor's supplies, materials, or equipment or to personal belongings of the Contractor's employees.

9.2 Government Furnished Facilities: None

9.3 Government Furnished Materials: The government will provide operational manuals if applicable.

The contractor will turn in to the COR or KO all operational manuals provided by the government within 2 business day of termination of this contract or a proportional part of payment will be withheld until turn-in.

9.4 Government Furnished Records: None

9.5 Government Furnished Services: The government will furnish existing utility services identified below. However, if contractor personnel require utility services that do not exist within the facility, or area of the facility, it shall be the contractor's responsibility to provide such utility service. This shall be accomplished by a portable or temporary means.

9.6 Telephone Services: None

9.7 Security Police and Fire Protection: The government will provide security police and fire protection to the extent necessary to ensure a secure and safe installation. In return for these services, the contractor shall adhere to the security and fire directives, instructions, and policies of NCANG.

9.8 Emergency Medical Services: EMT Firefighters as first responder medical assistance. Dial 911 for all emergencies and inform them you’re on the Air National Guard base.

10.0 CONTRACTOR FURNISHED ITEMS AND SERVICES:

10.1 General Information: The Contractor shall furnish all necessary supplies, chemicals, parts, materials, tools, support equipment, labor and vehicles required to perform all operations required by this contract, except for those items listed in this SOW.

10.2 Quality Standards: The Contractor shall acquire the materials, parts and supplies required for performance of this contract. Materials shall be standard products from manufacturers regularly engaged in the production of such supplies.

10.3 Vehicles: The Contractor shall furnish the necessary vehicles and equipment to perform all requirements of this contract. All vehicles shall be in operable condition and meet base, local, state, and federal insurance, registration, and safety requirements.

10.4 Hazardous Waste Removal: The Contractor will be held liable for all fines and penalties imposed by environmental regulators for any noncompliance associated with hazardous waste removal levied by the regulator.
