About this file

This is a Questions and Answers document for federal contract opportunity W9123826QA026 concerning liner replacement and fence installation at three oxidation pond locations: Black Butte, Buckhorn, and Eagle Pass. The document clarifies solicitation requirements and modifies certain Performance Work Statement (PWS) sections through contractor inquiries and government responses.

Key modifications include: removal of solid waste disposal requirements because all sewage solids were removed during primary treatment at the septic tank; elimination of pond dewatering requirements because ponds are dry (restrooms have been closed and replaced with portable facilities); removal of gravel base removal requirements from the scope; and deletion of permit requirements, with all permits now contractor responsibility per SF-1444 conformance process. The Period of Performance has been extended to 360 calendar days from date of award in an upcoming amendment, though the contract is classified as a service contract (not construction), meaning Davis-Bacon wage requirements do not apply; Service Contract Act wages govern labor costs instead. Pipe penetration details and specifications are referenced on Sheets BB-2, BB-3, and BB-4, and liner specifications of 16 oz Geotextile underlayment with 45 mil RPP geomembrane in a single piece (with welds only at boots) are acceptable. CLINs 0023 and 0024 are removed as duplications. All testing, third-party destructive testing, and warranty costs are incorporated into CLINs 0005, 0012, and 0020; submittals into CLINs 0001, 0008, and 0016. No formal site visits are scheduled; this is a firm-fixed-price services contract with no change orders permitted. The question submission deadline was Tuesday, July 28th at 10am PDT, and all materials removed may be disposed of in Class III landfills.

• We are performing independent research on the Combined Synopsis/Solicitation

(W9123826QA026). We would like to know if this is a brand-new contract OR if there is (was) an incumbent performing these services. If not brand new, could you please provide the current / previous contract number and what the total contract value was?

o This is a brand-new requirement for this location.

• Can we conduct a site visit?

o No, a formal site visit will not be held, and Contractors are not prohibited to ask local staff for one.

• Within the Continuation of Supplies or Services and Prices/Costs, CLINs 0023 & 0024 appear to be duplications of CLIN 0002. Would you please clarify?

o CLINS 0023 and 0024 will be removed from the solicitation

• Attachment A does not provide existing elevations for the ponds. Could you please provide an elevation for the bottom of the existing pond surfaces in order to identify a removal quantity?

o All solids were removed during primary treatment at septic tank, so solid removal is deleted from this Performance Work Statement (PWS). See PWS Section 3.3.2.

• If no site visits are to be scheduled, can the contractor arrange to access the ponds to gather interior elevation measurements?

o No.

• For bidding purposes, what is the estimated volume of waste/spoils removal from each pond location?

o All sewage solids were removed during primary treatment at septic tank, so solid removal is deleted from this PWS. See revised PWS Section 3.3.2.

• Where can the contractor access construction water? Will there be a charge for construction water? If yes, what is the charge/fee?

o See revised PWS Section 3.3.1.

• Per the document Performance Work Statement number 6, Permits, the contractor shall obtain all permits. What permits are required for the project?

o Permit requirement, PWS Section 6, has been removed from PWS.

• Section 3.3.3, of the Performance Work Statement states the Contractor shall remove the existing gravel base. Is the gravel base located below or above the existing liner or only located on the surrounding maintenance road?

o Existing gravel base removal requirements have been removed from PWS. See revised PWS Section 3.3.3.

• What is the depth of the existing gravel base that is to be removed? Upon removal, can the gravel base be re-used within the subgrade of the pond or of the maintenance road? Upon removal, is the gravel base required to be disposed of?

• For proper disposal, would you please provide the waste characterization profile, hazardous classification, and liquid volume for each pond?

o All restrooms flowing into existing ponds have been closed and temporarily replaced with portable restrooms. Ponds are dry, so pond dewatering requirements have been removed from PWS. See revised PWS Section 3.3.2.

• Is there historical data for past maintenance and disposal of the ponds waste? If so, would you please provide the testing data, trucking and disposal manifests, location of disposal, dates, and any other relevant information?

• Are the ponds currently full of water? If so, what is their approximate capacity in gallons?

o All restrooms flowing into existing ponds have been closed and temporarily

• If full of water can it be pumped into Containment site or Fraq Tank then pumped back into Pond after liner is installed.

o All restrooms flowing into existing ponds have been closed and temporarily

• What is the depth of the ponds after finished grade, and what is the depth of the rock layer? This information will help us calculate the necessary truckloads for hauling.

• Could you provide the sizes for all inlet and outlet pipes for the ponds? Our liner manufacturer needs these dimensions to ensure proper boot sizing.

o See “Penetration” tables on Sheet BB-2, BB-3 & BB-4.

• Additionally, could you provide the dimensions for the concrete pad supporting the outlet pipe at the Buckhorn pad? This detail is difficult to determine from the uploaded pictures and is necessary for proper welding and seams.

• Can reuse clean portions of the rock to be removed. Outside the lined area (e.g., on exterior slopes or in the maintenance road around the outside of fence base if it meets spec), this will aid in Vegetation growth around permiter of fence.

revised PWS Section 3.3.3

• Western Liner Specs they have in Stock 16 oz Geotextile underlayment, 45 mil RPP geomembrane liner, Will this be sufficient? Liners will be Placed in 1 peace No welds will be done Except around Boots.

o Yes

• Also Liners all weldes will be done at Warehouse, At they will make Fabric big enough to cover entire Pond in 1 peace. Western Liner has 3rd party testing done their Warehouse and has proper paperwork, of test results. This can be sent Via Western Liner. Would this be OK.

• The Period of Performance is stated as 180 calendar days from date of award, and the CLIN delivery schedules repeat “180 Calendar Days / Date of Award.” The solicitation includes no Notice to Proceed provision. Confirm whether contract time begins on the date of award or on the date of a written Notice to Proceed.

o This is not a construction contract, this is a service contract, therefore, the Period of Performance will begin on the date of award of the contract.

• Confirm whether the Government will permit performance during the spring and summer 2027 construction season so that the three pond liner replacements may be completed in a single continuous sequence rather than interrupted across two seasons. Award and obligation of funds may proceed on the Government’s current schedule, with the Period of Performance commencing upon a Notice to Proceed issued in spring 2027.

o The Period of Performance will be extended to 360 days from date of award in the upcoming amendment.

• There is no separate CLIN for third-party seam testing, permits, submittals, or warranty.

Confirm these costs are to be carried within the existing task CLINs, and identify the CLIN in which the Government expects third-party destructive-testing fees to be priced.

o All Testing – CLIN 0005, 0012 & 0020.

o Permit requirement has been removed from PWS.

o Submittals – CLIN 0001, 0008 & 0016.

o Warranty - CLIN 0005, 0012 & 0020.

• Confirm the Service Contract Act governs the labor on this contract and that Construction

Wage Rate Requirements (Davis-Bacon, FAR 52.222-6) do not apply.

o This is a service contract, therefore Davis Bacon wages to not apply.

• The wage determination lists no geomembrane installer/seamer or fence-erector classification. Confirm the SF-1444 conformance process governs these classes, and identify any federal-grade equivalent the Government expects for them.

o This is a service contract; every classification does not need to be listed on the Wage Determination. If you have questions about labor wages, please contact the Department of Labor.

• The Buckhorn topographic plan states the pond bottom was not surveyed. Provide estimated sludge and sediment depths, or soundings/borings, for all three ponds so that dewatering, solids handling, and disposal quantities can be priced.

• Provide any existing waste characterization or analytical data for the pond effluent and solids. Confirm the acceptable disposal classification (for example, non-hazardous biosolids) and whether a specific disposal facility is designated.

o All solids were removed during primary treatment at septic tank, so solid removal is deleted from this Performance Work Statement (PWS). See PWS Section 3.3.2.

o All restrooms flowing into existing ponds have been closed and temporarily

• The liner areas are stated as approximate. Confirm the Government will accept the bidder’s field-verified quantities and that the Firm-Fixed-Price CLINs are not subject to remeasurement or adjustment.

o This is a firm-fixed-price (FFP) services contract. Contractors should quote to the sq.ft listed in the PWS. IF the amount is significantly more or less, the Contactor must work with the COR and KO to have a modification issued BEFORE any cost is incurred.

• The length of the new Eagle Pass perimeter fence is not dimensioned. Provide the fence alignment and length, or confirm the bidder is to determine the quantity from the plans and field.

o See Sheet BB-3, 4. – Satellite Imagery for Fence & Gate alignment and quantities.

• Confirm the number and size of pipe penetrations to be sealed with boots at each pond.

Sheet BB-2 shows 3-inch PVC and 4-inch steel at multiple inverts.

• The satellite image on the Eagle Pass sheet (BB-3) is captioned “Buckhorn Oxidation Pond.” Confirm the correct pond depicted.

o Sheet BB-3 has been corrected.

• State the procedure and lead time to obtain access to the installation for a pre-bid site inspection and confirm whether the Government will schedule a site visit before the 06 AUG 2026 offer due date.

o There will not be a site visit for this requirement. Additionally, this is a firm fixed price contract.

• Confirm the deadline and method for submitting pre-quote questions to the Contracting Officer.

o The due date for questions is Tuesday, July 28th at 10am PDT. No other questions will be accepted after that date and time.

• Only Eagle Pass fence and gate replacement is in scope. Confirm existing gates at Buckhorn and Orland Buttes may be temporarily removed and reinstated for equipment access, and that any incidental damage to existing fencing is to be repaired in kind.

o Buckhorn & Orland Buttes gates can be temporarily removed as long as gates are replaced to existing or better condition prior to gate removal.

• The staff gauge is specified by performance only (corrosion-resistant, UV-resistant, high-contrast graduations legible at 25 feet). No detail sheet, overall length, graduation range or increment, elevation datum or zero reference, or mounting method is provided.

Provide a staff gauge detail, or specify the required overall length, graduation range and increment, the elevation datum or reference point for the zero mark, and the mounting method. Confirm whether the new gauge is to match the existing removed gauge and whether the mounting may penetrate the new liner or must stand clear of it.

o See revised staff gauge requirements in PWS Section 3.3.7.

• If hazardous waste is found within the existing facilities or material to be removed contained within, we assume this will be a changed condition and justification for a change order to dispose of properly. Please confirm o This is not a construction contract; this is a services contract, therefore change orders are not allowed on this type of contract. Additionally, this is a firm-fixed price contract.

o All solids which could be deemed hazardous were removed during primary treatment at septic tank, so solid removal is deleted from this Performance Work Statement (PWS). See PWS Section 3.3.2.

• We assume the adjacent parking area(s) and leveled access areas may be used for laydown. Please confirm o Yes, parking areas and leveled access areas may be used for laydown area but must be noted in Work Plan per PWS Section 3.2.4.

• The current conditions of the ponds do not appear to include liquid/water. Is dewatering necessary if no water/liquid is present? If dewatering is required, what treatment of the water is required?

o All restrooms flowing into existing ponds have been closed and temporarily

• Please confirm all material to be removed may be disposed of within a Class III landfill and do not require Class II or Class I disposal. If otherwise, please describe?

o All materials required to be off hauled can be disposed of within a Class III landfill.

• If the removal of the liner, clearing and associated material causes the pond elevations to drop below the elevations of the original improvement plan per Attachment A, will import borrow be required to meet the original improvement plan elevations? If import borrow is required, please provide specifications. If import borrow is NOT required, can elevations be lowered utilize onsite soil while maintaining slopes and requirements per the performance work statement?

o See revised PWS Section 3.3.3.
