PERFORMANCE WORK STATEMENT

Performance Work Statement for the LED Lighting Retrofit and Installation Revised 15 September 2015

BACKGROUND: The US Army Corps of Engineers, Sacramento District, desires to take an action that will demonstrate a decrease in overall electrical consumption due to lighting requirements. The goal of this project will be an overall decrease in Energy Intensity. Objectives of this project include: decreasing the total wattage required to light defined areas, decreasing the expenditures and costs incurred from electrical consumption, decreasing associated carbon emissions from electrical generation needed for electrical lighting requirements. The catalyst for this effort is Presidential Executive Order 13514.

STATEMENT OF WORK. Contractor to provide a firm fixed price quote for the LED lighting retrofit and installation of this project. In accordance with these specifications the Contractor shall supply all labor, materials, appurtenances, equipment, shop facilities, supervision, tools, staging, scaffolding and any other items necessary to remove and properly dispose of all High Intensity Discharge (HID), Incandescent, and/or Compact Fluorescent (CFL) bulbs as called for within this SOW, and install Light Emitting Diode (LED) lamps in their place so as that the lumens per light fixture in each lit area is equal to or greater than the original lumen condition. The contractor may use lux or foot candle as long as there is consistent use of a single measurement unit. In addition, the ground surface area lit by LED’s will be equal to or greater than the original condition. Every attempt will be made to preserve existing poles, heads, housings, and existing support infrastructure of the current lighting systems. The lighting upgrade shall be performed as specified and in accordance with terms, conditions, general, specific and technical provisions, drawings, attachments, and exhibits contained herein or incorporated by reference. The quantities and/or work to be performed are listed on separate sheets as exhibits or contracted items. These quantities are exact and are provided as information only to assist in the preparation of the contractor’s quote. There will be no contract modifications for additional requests of drawings, specifications, or design plans. The Contractor is solely responsible for obtaining the necessary information required to complete the work and this requirement shall be considered an inherent action within this contract.

The Contractor’s work and responsibility shall include, but not be limited to, planning, programming, administration, management, supervision, and inspection necessary to assure that services and materials are conducted and/or provided in accordance with the contract and applicable laws, regulations, codes, and directives. The Contractor shall ensure that work meets or exceeds critical reliability rates or tolerances specified or included in referenced documents. The Contractor shall perform related contractor administrative services necessary to complete the work such as supply, procurement, quality control, contractor financial control, and maintenance of accurate and complete records and files.

The general location of the work will take place at eight civil works water resource development projects (Projects) located within the State of California. These projects are:

Success Lake and Dam, Porterville, Tulare County, CA Hensley Lake Hidden Dam, Raymond, Madera County, CA Eastman Lake Buchanan Dam, Raymond, Madera County, CA Stanislaus River Parks, Knights Ferry, Stanislaus County, CA New Hogan Lake and Dam, Valley Springs, Calaveras County, CA Englebright Lake and Dam, Smartsville, Yuba County, CA Black Butte Lake and Dam, Orland, Tehama County, CA Martis Creek Lake and Dam, Truckee, Nevada County, CA

All lamps, lamp accessories, photocells, timers, lighting support infrastructure, and lighting will be fully operational and in complete working order upon completion of this contract. Regardless of the existing condition of the bulbs, lamps, lamp accessories, photocells, timers, lighting support infrastructure, or any other items that are integral to the complete turn-key operation of the lighting system, the Contractor will ensure that every lamp designated within this contract is fully operational according to the Park Manager’s terms. Some lamps may operate manually; others may operate from a photocell; others may operate from a timer. If ballasts, photocells, or other ancillary equipment is not fully functional, and is determined to be the root cause of lamp failure, then repair and/or replacement of that ancillary equipment will be considered part of the work to ensure a fully functioning lamp system in addition to the replacement of existing bulbs to LED technology.

LOCATION OF WORK. Work is located at:

Success Lake and Dam, 29330 Highway 190, Porterville, Tulare County, CA 93258 Hensley Lake Hidden Dam, 25207 Road 407, Raymond, Madera County, CA 93653 Eastman Lake Buchanan Dam, 32175 Road 29, Raymond, Madera County, CA 93653 Stanislaus River Parks, 17968 Covered Bridge Road, Oakdale, Stanislaus County, CA 95361 New Hogan Lake and Dam, 2713 Hogan Dam Road, Valley Springs, Calaveras County, CA 95252 Englebright Lake and Dam, 12896 Englebright Dam Road, Smartsville, Yuba County, CA 95977 Black Butte Lake and Dam, 19225 Newville Road, Orland, Tehama County, CA 95963 Martis Creek Lake and Dam, 11989 Martis Dam Road, Truckee, Nevada County, CA 96161

Performance Assessment Plan.

Monitoring Performance. During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor's performance during the period being evaluated. At the end of the period, the COR will assess the Contractor's performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.

Contractor Self-Assessment. Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer.

The self-assessment shall be submitted not later than 5 working days after the end of each evaluation period. The self-evaluation shall not exceed 1 page per PRS element. The self-assessment shall address both the strengths and weaknesses of the Contractor's performance during the evaluation period. Where deficiencies in performance are noted, the Contractor shall describe the actions planned or taken to correct such deficiencies and avoid their recurrence. The self-assessment itself will NOT be the basis for the payment re-calculation determination.

COR Recommendation. The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR's draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.

Payment Determination. The Contracting Officer may meet with the COR to discuss the COR's report.

The Contracting Officer will make a final determination in writing as to the percentage of work successfully completed, and the resulting payment to be made. A copy of the determination will be provided to the Contractor no later than 45 calendar days after the end of the period being evaluated. All Contracting Officer decisions regarding payment re-calculations are unilateral decisions made solely at the discretion of the Government.

Payment Re-Calculations. Notwithstanding any other clause of this contract, payment re-calculations will be made within the later of 60 days after the end of the evaluation period or 30 days after receipt of an approved invoice.

The Quality Assurance Surveillance Plan is one evaluation method the government uses to surveillance performance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the government under any other provision of the contract in determining the quality of the Contractor performance.
