SECTION 00 20 00 - INSTRUCTIONS FOR PROCUREMENT
INSTRUCTIONS TO BIDDERS
INSTRUCTIONS TO BIDDERS
BID OPENING
The bid opening will be held at US Army Corps of Engineers, 502 8th Street, Room #419, Huntington, WV 25701. For date and time of Bid Opening, see block 11 on Standard Form 1442.
Upon arrival, Contractors must check in with the Security Desk to have them contact Corey Black at ext. 5348 to submit your bid and be escorted to the room for the Bid Opening.
PRICE BASIS
Bidders are advised that only bids submitted on a firm-fixed price basis will be considered, and that bids submitted on any other than firm-fixed price basis will be rejected.
Bid price alterations, i.e., crossed-out or white-out changes on the bid will not be accepted unless the change (s) is/are initialed by the person authorized to sign bid package.
BID QUANTITIES
Bids for less than specified quantities of each item in the Schedule will not be considered.
Failure to submit a unit price for each item where required in the Schedule will be considered as a material deviation from the requirements of the solicitation, and the bid will be rejected. (FAR 14.201-5)
ARITHMETIC DISCREPANCIES
(a) For the purpose of initial evaluation of bids, the following will be utilized in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by the bidders:
(1) Obviously misplaced decimal points will be corrected;
(2) In case of discrepancy between unit price and extended price, the unit price will govern;
(3) Apparent errors in extension of unit prices will be corrected;
(4) Apparent errors in addition of Job and extended price will be corrected; and
(b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidders intends their bid to be evaluated on the basis of unit prices, extensions, and totals arrived at by resolution of arithmetic discrepancies as provided above and bid will be so reflected on the abstract of bids.
ADDITIONAL INSTRUCTIONS
I. BIDS MUST SET FORTH FULL, ACCURATE AND COMPLETE INFORMATION AS
REQUIRED BY THIS INVITATION FOR BID (INCLUDING ATTACHMENTS). THE
PENALTY FOR MAKING FALSE STATEMENTS IN BIDS IS PRESCRIBED IN 18 U.S.C.
1001.
II. THE HUNTINGTON DISTRICT, CORPS OF ENGINEERS DOES NOT ACCEPT BIDS
BY FACSIMILE TRANSMISSIONS AND/OR EMAIL.
III. NOTE THE AFFIRMATIVE ACTION REQUIREMENTS OF THE EQUAL
EMPLOYMENT OPPORTUNITY CLAUSE (FAR 52.222-23) WHICH WILL APPLY TO
THE CONTRACT RESULTING FROM THIS SOLICITATION.
SECTION 00 21 00 - INSTRUCTIONS
52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

SECTION 00 70 00 - CONDITIONS OF THE CONTRACT
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than April 15, 2019. The time stated for completion shall include final cleanup of the premises.
