SPECIAL CONTRACT REQUIREMENTS
PART 1 GENERAL
1.1 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK
Comply with the Contract Clause 52.211-10.
1.2 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only or as otherwise designated. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section

1.3 LIQUIDATED DAMAGES--CONSTRUCTION
Comply with the Contract Clause 52.211-12.
1.4 DOCUMENT SECURITY
Contractors working for and on USACE projects shall provide the appropriate physical security for all related items as detailed/prescribed in AR 380-5, dated 29 September 2000.
1.4.1 For Official Use Only (FOUO)
For Official Use Only (FOUO): The unauthorized disclosure of the information contained in the attached documents is forbidden to protect the Government's interest in compliance with program effectiveness under AR 380-5 and as follows:
a. During working hours, reasonable steps shall be taken to minimize risk of access by unauthorized personnel. After working hours, FOUO information can be stored in unlocked containers, desks or cabinets if U.S. Government or U.S. Government-contract building security is provided. If U.S. Government-contract building security is not provided, FOUO information must be stored in locked desks, file cabinets, bookcases, or similar locked containers.
b. FOUO documents and material can be transmitted via first class mail, parcel post, or, for bulk shipments, fourth class mail. Electronic transmission of FOUO information by voice, data, facsimile or similar means, shall be by approved secure communications systems whenever possible. (AR 380-5 (dated 29 September 2000))
c. Record copies of FOUO documents shall be disposed of in accordance with AR 25-400-2. Non-record FOUO documents shall be destroyed by
DOCUMENT 00 80 00 Page 2 shredding or tearing into pieces and discarding the pieces in regular trash containers.
1.5 SECURITY REQUIREMENTS
All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities shall receive authorization to be on site at these facilities based upon a favorable background investigation in accordance with "Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors" (HSPD 12). The Huntington District Security Management Office shall submit contractor(s) personal information in order to complete the basic background investigation in order to make a recommendation to the Contracting Office of an employee's suitability for work on Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results provided by the Huntington District Security Management Office of the background investigation. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed an Operations Security (OPSEC) review of such items and determined they can be released.
Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or on District facilities. The Contractor must also provide the following: (1) Name of the Contract Specialist with whom he/she is working, (2) Project Name, (3) Contract Number and (4) Task Order Number when applicable.
The documents listed below are required:
SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form). FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-258) may be obtained by Contracting Division by contacting the Huntington District Security Management office).
Contractor shall report any changes in personnel or at anytime conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.
Following submission of paperwork, the Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, Security Management Office will make recommendations to the PCO or their Designated Representative. The Security Management Office cannot give approval due to unfavorable report(s). The Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative should a background investigation come back with derogatory information. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise Contractor of the decision.

1.5.1 Foreign Nationals
The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters Staff to accomplish. All Foreign Nationals must comply with the following paragraph:
In accordance with Engineering Regulation 380-1-18, "Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives" dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers' contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States. Such documentation shall include at least one of the following a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.
In order to assure forms are properly completed, and to minimize time delays, Contractor is encouraged to work closely with the Security Management Office. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.
Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

1.6 AT/OPSEC REQUIREMENTS
Contractors are required to comply with the following:

1. AT Level I Training. This provision/contract text is for Contractor employees with an area of performance within an Army controlled installation, facility or area. All Contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within thirty (30) calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the Contractor shall submit certificates of completion for each affected Contractor employee and subcontractor employee, to the Contracting Officer's Representative or to the Contracting Officer (if a Contracting Officer's Representative is not assigned), within five (5) calendar days after completion of training by all employees and subcontractor personnel.

2. Access and General Protection/Security Policy and Procedures. All Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
a. For Contractors who do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by Government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
3. Suspicious Activity Reporting Training (e.g., iWATCH, CorpsWatch, or See Something, Say Something). The Contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within thirty (30) calendar days of contract award and within thirty (30) calendar days of new employees commencing performance with the results reported to the Contracting Officer's Representative no later than five (5) calendar days after the completion of the training.
4. Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment

The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the Contracting Officer's Representative no later than three (3) business days after the initial contract award.
5. Threat Awareness Reporting Program. All new Contractor employees will complete annual Threat Awareness and Reporting Program (TARP) Training provided by a Counterintelligence Agent, IAW AR 381-12. The Contractor shall submit certificates of completion for each affected Contractor and subcontractor employee(s) or a memorandum for the record, to the Contracting Officer's Representative or to the Contracting Officer (if a Contracting Officer's Representative is not assigned), within five (5) calendar days after completion of training. 6. For Contracts that Require OPSEC Training. All new contractor employees will complete Level I OPSEC Training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC awareness training. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training. OPSEC awareness training is available at the following websites: https://www.iad.gov/ ioss/ or http://www.cdse.edu/catalog/operations-security.html; or it can be provided by the RA OPSEC Officer in presentation form which will be documented via memorandum.
1.7 RECORDKEEPING AND REPORTING
The Contractor shall maintain a roster of all background investigation requests. The roster shall be maintained and available for inspection by the Contracting Officer upon request. A copy will also be provided to the Contracting Officer on a monthly basis. At a minimum, the roster shall include the following information:

Other information may also be included on the roster. However, the Contractor is responsible for protecting all sensitive personal information such as social security numbers, birth dates, etc.
1.8 CONTRACT DRAWINGS AND SPECIFICATIONS
Comply with Contract Clause 252.236-7001. Contractor shall field verify all dimensions on drawings prior to commencing design and layout of the work.

1.9 SUBMISSION OF CONTRACT DOCUMENTATION
Provide contract documentation in an electronic format to the greatest extent practicable. Contract documentation to be submitted electronically includes, but is not limited to, the following:
Submittals, including ENG 4025 transmittal form
Meeting Minutes
Construction Photographs
Correspondence
Requests for Information
Payroll Documents
Statement and Acknowledgement Forms (SF 1413)
Request for Additional Classification (SF 1444)
Progress Payment Requests and Supporting Documentation
Contract Modification Documentation, including SF 30, Contractor's Offer, Cost/Pricing Audit Report, and Certificate of Current Cost or Pricing Data

Electronic files must be of sufficient quality that all information is legible. Electronic format shall be in Adobe.PDF format, unless otherwise specified or directed by the Contracting Officer's Representative (COR).
Whenever possible, PDF files shall be generated from original documents so that the text included in the PDF file is both searchable and can be copied. If documents are scanned, Optical Character Resolution (OCR) routines are required. Files exceeding 30 pages shall be indexed and bookmarked to allow efficient navigation of the file. When required, the electronic file must include a valid electronic signature, or scan of a signature.
Email electronic documents fewer than 10MB to an email address as directed by the COR. Electronic documents over 10MB shall be provided on a CD/DVD, or through an electronic file sharing system such as the AMRDEC SAFE Web Application located at the following website:
https://safe.amrdec.army.mil/safe/
The Government reserves the right to request hard copy submission of any item, if deemed necessary. The Contractor shall be prepared to provide up to eight (8) additional paper hard copies of any contract document at the discretion of the COR, at no additional cost to the Government. In addition to the electronic file format described above, the following list

1.10 WAGE RATES
Wage rates shall be in accordance with Contract Clause 52.222-6
CONSTRUCTION WAGE RATE REQUIREMENTS.
1.11 CONTRACTOR SUPPLY AND USE OF ELECTRONIC SOFTWARE FOR PROCESSING
DAVIS-BACON ACT CERTIFIED LABOR PAYROLLS
(a) The Contractor is encouraged to use a commercially-available electronic system to process and submit certified payrolls electronically to the Government. The requirements for preparing, processing and providing certified labor payrolls are established by the Davis-Bacon Act as stated in FAR clause 52.222-8, PAYROLLS AND BASIC RECORDS and FAR clause 52.222-13, COMPLIANCE WITH CONSTRUCTION
WAGE RATE REQUIREMENTS AND RELATED REGULATIONS.
(b) If the Contractor elects to use an electronic Davis-Bacon Act payroll processing system, then the Contractor shall be responsible for obtaining and providing for all access, licenses, and other services required to provide for receipt, processing, certifying, electronically transmitting to the Government, and storing weekly payrolls and other data required for the Contractor to comply with Davis-Bacon and Related Act Regulations. When the Contractor uses an electronic Davis-Bacon Act payroll system, the electronic payroll service shall be used by the Contractor to prepare, process, and maintain the relevant payrolls and basic records during all work under this construction contract and the
DOCUMENT 00 80 00 Page 8 electronic payroll service shall be capable of preserving these payrolls and related basic records for the required three (3) years after contract completion. If the Contractor chooses to use an electronic Davis-Bacon Act payroll system, then the Contractor shall obtain and provide electronic system access to the Government, as required to comply with the Davis-Bacon and Related Act Regulations over the duration of this construction contract. The access shall include electronic review access by the Government contract admin office to the electronic payroll processing system used by the Contractor.
(c) The Contractor's provision and use of an electronic payroll processing system shall meet the following basic functional criteria:
commercially available; compliant with appropriate Davis Bacon Act payroll provisions in the FAR; able to accommodate the required numbers of employees and subcontractors planned to be employed under the contract; capable of producing an Excel spreadsheet-compatible electronic output of weekly payroll records (format at http://rms.usace.army.mil/Home/SiteMap) for export in an Excel spreadsheet to be imported into the Resident Management System (RMS) Contractor Mode, that in turn shall export payroll data to the Government's Resident Management System (RMS); demonstrated security of data and data entry rights; ability to produce Contractor-certified electronic versions of weekly payroll data; ability to identify erroneous entries and track the data/time of all versions of the certified Davis-Bacon Act payrolls submitted to the Government over the life of the contract; capable of generating a durable record copy, that is, a CD or DVD and PDF file record of data from the system database at end of the contract closeout. This durable record copy of data from the electronic D-B payroll processing system shall be provided to the Government during contract closeout.
(d) All Contractor-incurred costs related to the Contractor's provision and use of an electronic payroll processing service shall be included in the Contractor's price for the overall work under the contract. The costs for Davis-Bacon Act compliance using electronic payroll processing services shall not be a separately bid or reimbursed item under this contract.
1.12 REQUIRED INSURANCE
In reference to Contract Clause INSURANCE--WORK ON A GOVERNMENT INSTALLATION, FAR 52.228-5, the Contractor shall procure and maintain, during the entire period of his performance under this contract, the following minimum insurance:
a. Workmen's Compensation. Workmen's Compensation and Occupational Disease Coverage, as legally required by the State wherein the work is being performed.
b. Comprehensive Automobile Liability Insurance. Bodily injury coverage with minimum limits of $200,000 per person and $500,000 per occurrence, and $100,000 per occurrence for property damage shall be required.
c. Comprehensive General Liability Insurance. Bodily injury coverage with minimum limit of $500,000 per occurrence shall be required.
Property damage coverage with a minimum limit of $100,000 per occurrence shall be required.

1.12.1 Insurance Certification
Before commencing work under this contract, the Contractor shall certify to the Contracting Officer, in writing, that the required insurance has been obtained. The policies evidencing the required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be performed prescribe or (2) until thirty (30) days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
1.13 PERFORMANCE EVALUATION OF CONTRACTOR
It is the Corps' standard operating procedure that the Contracting Officer evaluate the Contractor's performance and prepare a performance report using the web-based application CPARS (Contractor Performance Assessment Reporting System) for construction contracts of $650,000 or more. After an evaluation (interim or final) is written by the Corps, the Contractor has a 60-day period to access, review and comment on the evaluation. Accessing and using CPARS requires having specific software, called PKI certification, installed on the user's computer. The certification, a Department of Defense requirement, was implemented to provide security in electronic transactions. The certification software could cost approximately $100-$125 per certificate, per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about the PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.gov. The Contractor is encouraged to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.
1.14 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE
(a) This special contract requirement does not apply to terminations.
See UAI 5152.249-9000, BASIS FOR SETTLEMENT OF PROPOSALS, and FAR Part 49.
(b) Allowable cost for construction and marine plant and equipment in sound workable condition, owned or controlled, and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the Contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the Contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, CONSTRUCTION EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE, REGION II. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, RENTAL COSTS. Rates for equipment
DOCUMENT 00 80 00 Page 10 rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.
(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the Simplified Acquisition Threshold (SAT), the Contracting Officer shall request the Contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

1.3 DESCRIPTION OF WORK
1.3.1 General Project Features
The project involves the installation of new waterlines to service the Visitor Center, Maintenance Compound, comfort stations, and picnic shelters at Beech Fork Lake, as shown and described in the contract drawings and specifications herein. The project will also include the installation of associated gate valves and fittings, a meter assembly and vault, and a backflow preventer and vault. Directional drilling is required for the creek crossing reflected in the drawings, along with all asphalt, sidewalk, and gravel crossing that are indicated for directional drilling. Sidewalk restoration, gravel pavement restoration, and asphalt pavement restoration will be required for waterline crossings in those crossing areas not shown to require directional drilling. All excavation is unclassified. The Base contract installs the line up to the backflow preventer, located at station 11+80. Option 1 begins at the end of the Base Contract and extends the remaining portion of the line, and to the existing valve pit located at station 0+00.

b. If the Contractor regards an action or inaction by the Contracting Officer as a change to the contract terms and conditions, the Contractor shall follow the procedures in Contract Clause
52.243-4 CHANGES.
c. The Contractor may propose a change by submitting a request for change to the Contracting Officer, describing the proposed change and its full effect on the work, with a statement describing the reason for the change, and the effect on the Contract Sum/Price and Contract Time with full documentation and a statement describing the effect on Work by separate or other contractors. Document any requested substitutions in accordance with Section 01 60 00.00 40 MATERIAL AND EQUIPMENT.
3.3 CORRELATION OF CONTRACTOR SUBMITTALS

3.1.1 Partnering
In order to most effectively accomplish this contract, the Government proposes to form a cohesive partnership with the Contractor and its subcontractors. This partnership would strive to draw on the strengths of each organization in an effort to achieve a quality project done right the first time, within budget, and on schedule. Participation in the partnership will be totally voluntary by the parties. Any cost associated with effectuating this partnership will be agreed to by both parties and will be shared equally, with no change in contract price.
3.1.2 Team Effort
This endeavor seeks an environment that nurtures team building cooperation, and trust between the Government and the Contractor.
3.1.3 Attendance
To attain this goal, the Government proposes a joint partnering conference attended by up to seven (7) officers from each organization representing management, and the key site staff of each entity.
3.1.4 Conference Chair
A designated person, agreed to by the partnership will facilitate and chair the conference, establish its agenda and issue its minutes to all participants.
3.1.5 Time
The conference will be held within thirty (30) calendar days after award.
The Contracting Officer will notify the Contractor of the exact days.
3.1.6 Duration
Maximum one (1) day.
