JUSTIFICATION AND APPROVAL

FOR BRAND NAME OR EQUAL

1. Organization/Line Office U.S Army Engineer District, Norfolk 803 Front Street Norfolk Virginia, 23510-1096

2. Description of Action being approved: This Justification and Approval (J&A) addresses certain proprietary cleaning agents to be included for the masonry cleaning as part of phase III of the Columbarium Repairs on Arlington National Cemetery (ANC). The project will be procured using an Invitation for Bid (IFB) with Definitive Responsibility Criteria (DRC) following FAR Part 14 – Sealed Bidding. During the development of the technical requirements the need for two separate cleaning actions was identified. The first process is the application of a mild detergent on 105,456 SF of stone and concrete elements within the Columbaria with the intent of a reduction of biofilm buildup on the surface.

The second process is the targeted spot cleaning and stain reduction of approximately 10 locations each consisting of 1 SF. Mock-ups will be required for all chemical applications prior to product approval to ensure that the product is acceptable and that the contractor can install the product according to contract specifications. The cost of the cleaning agents specified has been estimated to $28,473.15, which is less than 1% of the overall project cost. The total estimated cost of the contract is around $4,100,000.

Authority to act on this J&A expires 730 days (2 years) after issuance of the Notice to Proceed (NTP) date. There is a requirement for a mock-up for any cleaning product regardless of whether it is listed below or considered to be an equal.

3. Description of Product, Supplies or Services - Mild Detergent Arlington National Cemetery has conducted phased testing to determine cleaning products that would effectively reduce and remove the biofilm. The cemetery has found that products who possessed the active ingredient of quaternary ammonium (quats) were shown to provide the necessary reduction in biofilm to be effective without causing damage to stone. Mild Detergent is defined as the mildest cleaner that is determined to be effective by a mock-up. Any other ingredients in the product must be shown not that have a detrimental effect on stone or marble surfaces. Products that have been tested and approved for the biofilm reduction application are listed below.

D/2 Biological Solution (D/2) Clorox® Pro Quaternary All-Purpose Disinfectant Cleaner (Clorox Pro Quat) Lysol® IC™ Quaternary Disinfectant Cleaner (Lysol) Enviro Care ® Neutral Disinfectant Cleaner (Enviro Care) Sentinel® II Disinfectant Cleaner (Sentinel II)

4. Description of the Product or Process – Targeted Spot Cleaning and Stain Reduction

There is sporadic staining throughout the Columbaria that has been deemed objectionable. These areas include severely soiled areas of limestone, coatings, asphalt or tar stains, and iron stains. There are an array of products that may be used to treat each of these individual conditions and the following products have been seen to be effective in treating each of these conditions. The government may approve other products that have demonstrated effectiveness in addressing the specific conditions seen on the stone or concrete. All products should be used in accordance with manufacturer’s specifications or as directed by the government.

5. An identification of the statutory authority permitting other than full and open competition.

(Requesting Office completes with assistance of Contract Specialist) 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(c)(1), only one responsible source and no other supplies or services will satisfy agency requirement-application for brand name descriptions.

6. Identification of the Justification Rationale:

Arlington National Cemetery is a member of the national register of historic places and considered to be the nations most hallowed ground, therefore, maintaining the character of the committal shelters and monuments is of upmost importance. To maintain a uniform look across the cemetery while preserving the character of the finishes of the facilities it is critical that known and reliable products are used. The cleaning products must provide for efficient and cost effective cleaning while striking a balance of not being so harsh that the finishes can be impacted. The cleaning of the Columbarium courts has been conducted in a phased approach spanning over the past three years. The identification of the items provide a description of productions that strike that balance in a way that mere listing of salient characteristics cannot meaningfully accomplish. In addition, the use of a cleaning solution that weathers well with age is important in maintaining the integrity of the work already performed and currently being performed. Any cleaning products to be used during this contract should be tested with a Mock-up according to the manufacturers directions and outlined below.

a. Prepare mockups on existing walls under same weather conditions to be expected during remainder of the Work.

b. Area(s) where mockup are to be applied shall be selected by the COR in consultation with the Contractor.

c. Area of each mockup shall be 4 square feet for each material and surface condition at each Court.

d. Additional mockups shall be made until an acceptable result is achieved on each material.

e. Prior to proceeding with samples, test cleaners and methods for adverse reactions on adjacent materials or other materials that may be affected by the cleaning process, if those materials are to remain unprotected.

f. Allow a waiting period of not less than 14 days after completion of mockup or longer as directed by COR to permit a study of sample area for effectiveness of cleaner and for negative reactions.

7. Efforts to Obtain Competition

Market research as described in paragraph 7 will continue to be conducted to determine if other sources are available for potential competition through a notice of intent. As detailed in paragraph 5 above, the contractor will have to perform mockups on any cleaning solution used during this contract to demonstrate effectiveness. Cleaning is not intended to establish a “like-new” surface but to undertake the most effective and gentlest means to remove approximately 80% to 85% of the soiling without negative reactions or damage to existing materials.

8. Market Research

The Arlington National Cemetery Conservation and Cultural Resources team has extensively tested cleaning methods on various stone, masonry, and concrete surfaces throughout the cemetery. The cleaning products listed have proven to work the best on these historic surfaces and their effects over time are known. D2 Biological Solution was the overall cleaning agent used on Phase 2 of the Columbarium Court repair projects and has weathered well over the past three years. The Contract Specialist called D2 Biological Solutions on 23 February 2021 to conduct market research on the product and its known competition. According to the company president, D2 Biological Solution, which originally was developed to clean buildings, has proven to be more effective over time than the competitors in its market. D2 Biological Solution’s use expanded and has been used extensively in cemeteries to include Arlington National Cemetery.

The cemetery does not want to limit the use of other cleaning products on this project but would like to approve any product that is applied to ANC stone or masonry. For any product used, to include those listed, the contract will be required to perform a mock-up in accordance with paragraph 5 above and the manufacturer’s directions to ensure the technical competence of the applier and that the desired effect is achieved.

A Notice of Intent was posted to Beta.sam.gov on March 10, 2021 in an effort to ensure any additional products on the market had the opportunity to be considered for selection as a cleaning agent. One response was received from Exoban, LLC with a product called “AM1000 Antimicrobial” that did have the active ingredient of quaternary ammonium (quats). The company’s product information was sent to the technical team for review. The quaternary ammonium compound is 81-100% of the mix, whereas a mild detergent product only has 2% or less of quats, 2-4% surfactants, and the rest is water. After review, it was determined based on the concentration of quaternary ammonium contained that the product would be too strong for the overall cleaning solution but that it would be accepted as appropriate for a targeted cleaning solution for severely soiled limestone.

Contracting Officer

12. Approval Based on the foregoing justification, I hereby approve the procurement in support of the cleaning services as part of the ANC Columbarium Phase III Court Repairs on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c)(1) implemented by FAR 6.302-1(c)(1), subject to for availability of funds, and provided that the components herein described have otherwise been authorized for acquisition.
