2. RESPONSIBILITY DETERMINATION WITH DEFINITIVE RESPONSIBILITY CRITERIA

2.1 Summary: The U.S. Army Corps of Engineers-Norfolk District intends to issue a solicitation for a Total Small

Business Set Aside, firm-fixed-price, Invitation for Bid (IFB) with Definitive Responsibility Criteria (DRC). This action will utilize FAR Part 14, Sealed Bidding Procedures.

2.2. Definitive Responsibility Criteria: Definitive Responsibility Criteria (DRC) are specific and objective standards established to inform the Contracting Officer's responsibility determination in accordance with FAR

9.104-2. These criteria assess whether the apparent low bidder can demonstrate the expertise and specialized facilities need for adequate contract performance. The inability of a contractor otherwise eligible for award to demonstrate minimally acceptable experience as measured by the DRC may result in the Contracting Officer determining the contractor is not responsible. The DRC must be provided in the form of a written detailed narrative, with a page limitation that shall not exceed three (3) pages for each listed DRC.

The written narrative for each DRC listed below must demonstrate a bidder’s successful completion of at least one

(1) year total project experience within the past five (5) years of the date of this solicitation for each of the definitive responsibility criteria listed. The bidder shall provide the contract number for each project provided as experience, the period of performance of the contract, and a brief description of the work performed under the contract. Bidders may use one or more projects to demonstrate past experience.

If a subcontractor was used to complete a work component of a bidder’s project experience, bidders shall provide that subcontractor’s past project experience associated with the applicable DRC. The bidder shall provide the contract number for each project provided as experience, the period of performance of the contract, and a brief description of the work performed under the contract.

The Definitive Responsibility Criteria is provided as follows:

Criteria No. 1: Beach Nourishment work. Bidders shall provide project experience comparable (in size and scope) and consistent with the scope of work described in the attached drawings and specification sections contained in

Division 35 – Waterway and Marine Construction, included as part of this solicitation.

http://www.projnet.org/projnet

Criteria No. 2: Dredging. Bidders shall provide project experience comparable (in size and scope) and consistent with the scope of work described in the attached drawings and specification sections contained in Division 35 –

Waterway and Marine Construction, included as part of this solicitation.

3. RESPONSIVENESS OF BIDS (FAR 14.301)

a. To be considered for award, a bid must comply in all material respects with the invitation for bids.

Such compliance enables bidders to stand on an equal footing and maintain the integrity of the sealed bidding system.

b. Facsimile and emailed bids shall not be considered unless permitted by the solicitation.

c. Bids should be filled out, executed, and submitted in accordance with the instructions in the invitation.

If a bidder uses its own bid form or a letter to submit a bid, the bid may be considered only if --

i. The bidder accepts all the terms and conditions of the invitation; and

ii. Award on the bid would result in a binding contract with terms and conditions that do not vary from the terms and conditions of the invitation

4. BID EVALUATION AND AWARD EVALUATIONS

a. The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government considering only price and the price-related factors specified elsewhere in the solicitation. Price will be evaluated based upon the total evaluated price in accordance with FAR

52.217-5.

b. The Government may –

i. Reject any or all bids;

ii. Accept other than the lowest bid; and

iii. Waive informalities or minor irregularities in bids received.

5. INSPECTION OF THE SITE

Prospective bidders are invited to visit the site of the work in order to acquaint themselves as to site conditions and other problems incident to the prosecution of the work. Arrangements for inspection of the site shall be made through the Office the Area Engineer identified in the clause 52.236-27, entitled "SITE VISIT

(CONSTRUCTION)."

7. EVIDENCE OF AUTHORITY TO SIGN OFFER

Evidence of the authority of individuals signing offers to submit firm offers on behalf of the offeror is required except where the offer is signed, and shows that it is so signed, by: the President, Vice-President, or Secretary of an incorporated offeror; a partner in the case of a partnership; or the owner in the case of a sole proprietorship. Failure to submit with the offer satisfactory evidence of the authority of all other persons may be cause for rejection of the offer as invalid or nonresponsive.

8. DREDGING AND DREDG RELATED MARINE WORK

The Contractor shall comply with the provisions of EM 385-1-1. If the Contractor is a currently accepted participant in the Dredging Contractors of America (DCA)/United States Army Corps of Engineers (USACE) Dredging Safety

Management Program (DSMP), as determined by the DCA/USACE Joint Committee, and holds a current valid

Certificate of Compliance for both the Contractor Program and the Dredge(s) to be used to perform the work under this contract, the Contractor may, in lieu of the submission of an Accident Prevention Plan (APP),

(1) make available for review, upon request, the Contractor’s current Safety Management System (SMS) documentation,

(2) submit to the Contracting Officer the current valid Company Certificate of Compliance for its SMS,

(3) submit the current dredge(s) Certificate of Compliance based on third party audit, and submit for review and acceptance, site-specific addenda to the SMS as specified in the solicitation.

9. INCURRED COSTS

The Government is not liable for any costs incurred by the offeror submitting an offer in response to this solicitation.

10. AGENTS

Offers signed by an Agent must be made in the name of the Principal and must be accompanied by evidence of said

Agent’s authority to act on behalf of its Principal.

11. UNBALANCED BIDS

Any offer which is materially unbalanced as to prices for the Base Items and the Optional Items may be rejected as non-responsive or otherwise not considered for award. An unbalanced offer is one which is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

12. UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT OR OTHER PERSONNEL

The contractor shall not accept instructions issued by any person, employed by the U.S. Government or otherwise, other than the Contracting Officer or the Authorized Representative of the Contracting Officer acting within the

Designation of Authority letter. A copy of the Designation of Authority letter will be furnished to the contractor at time of contract award.

13. TOTAL EVALUATED BID PRICE

The Government will evaluate offers for award purposes by adding the total price of the base contract line items

(CLINs) plus the optional contract line items (CLINs) for total evaluated bid price. Evaluation of options will not obligate the Government to exercise the optional CLINs. Optional CLINs, if exercised, will be awarded in accordance with clause 52.217-7.

14. OPTIONAL CLIN

It is the Government’s intent that the successful bidder will dredge to the optional depth, if so exercised by the

Government, concurrent with dredging to the depth required in the base scope of work. The optional items may be awarded with the base award. If optional items are exercised, additional performance time will be added to the contract based on one additional day per 500 cubic yards of dredged material added.

15. SPECIAL NOTE

Bidder’s attention is directed to Paragraph 1.5.7 of Section 01 14 00 of the Plans and Specifications regarding adjacent oyster grounds and should be mindful of these areas during the performance of the contract.
