The following have been added by full text:
BIDDER INQUIRIES
Projnet Bidder Inquiries for Solicitation
1. Bidder Inquiry ID: 7078231 Can we burn the vegetative debris onsite?
Response to Bidder Inquiry ID: 7078231 As noted in the Specification 31 11 00 – Clearing, Grubbing and Stripping, Paragraph 3.5, there is NO burning permitted at Craney Island; and all vegetative debris must be disposed of off-site. The solicitation will be amended to also allow the top 6” of earth/roots mixture surface material to be transported, dumped, spread and compacted at a nearby Craney dike area that is not under construction at a location determined by the Contracting Officer instead of being disposed of off-site.
It is the contractor’s choice whether to dispose of this 6” of topsoil either onsite or offsite.
2. Bidder Inquiry ID: 7078232 Please confirm that any work in the berm areas will be built entirely to the lines and grades in the documents as funds are available. That the berms will not be built partially. Example: 3” lifts over long distances of berms; or installing only the initial working platform (toe) without simultaneously raising the berms to full depth as shown.
Response to Bidder Inquiry ID: 7078232 Task Orders will be issued that specify the height, length and location of dikes that will be raised.
Within this area, all three sides of the dike will be raised in one foot lifts as shown in the drawings.
The horizontal initial working platform will be placed in the sediment/water pond on interior side of the dike as a base to support the raising of the interior dikes’ slope. The platforms’ dimensions will vary depending the character of the sediment/water material in that area.
3. Bidder Inquiry ID: 7078233 What is the compaction requirements for the working platform? Is it 90% or 95% How will it be tested or proof-rolled?
Response to Bidder Inquiry ID: 7078233 The horizontal working platform will be placed in the sediment/water pond on interior side of the dike as a base to support the raising of the interior dikes’ slope. This sediment/water pond mixture is relatively unstable and personnel and equipment are not expected to work in this area. The contract only requires that a stable platform is built to support the addition and compaction of soil on the slopes of the interior dike. There are no specific compaction or moisture testing requirements for the working platforms.
4. Bidder Inquiry ID: 7078235 What percentage of the work must be self-performed versus subcontracted for the bidding?
Response to Bidder Inquiry ID: 7078235 As noted by reference in the Solicitation, per FAR 52.219-14 Limitations on Subcontracting: “(C)(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.”
5. Bidder Inquiry ID: 7078237 Will new wage rates be assigned to this project? They do not appear to apply to this solicitation.
(Note: wage rate attached to solicitation is for “Heavy Dredging.”) Response to Bidder Inquiry ID: 7078237 Wage rate will be revised to VA17055 “Heavy Construction” dated 01/06/2017
6. Bidder Inquiry ID: 7078239 What is the maximum speed limit for trucks on this project?
Response to Bidder Inquiry ID: 7078239 The maximum speed limit for trucks on top of the dikes and within the Craney site is 25 mph.
7. Bidder Inquiry ID: 7078241 Please confirm all material in borrow sites is suitable WITHOUT manipulation, screening or mixing.
Response to Bidder Inquiry ID: 7078241 Per specification 31 00 00 – Earthwork, borrow site material shall be tested every 3,000 cubic yards to verify that mix design requirements are met. If the material mix is deemed unsuitable per contract requirements, the Contractor is responsible for remixing available borrow site materials until the mixture meets contract requirements. The Government has already mixed the borrow site materials to meet contract requirements and it is expected that the majority of borrow dike material already meets these requirements. Screening of the material to remove stones and miscellaneous debris is not required.
8. Bidder Inquiry ID: 7078423 There is no performance/payment bond requirement. A bid bond is required. Are individual bonds for each task order required OR are blanket bonds needed per year and, if so, what size?
Response to Bidder Inquiry ID: 7078423 The bid bond is required for the award of the IDIQ contract. Performance/payment bonds are required for the award of each individual Task Order as per Specification 01 11 00 – Summary of Work; Paragraph 1.2.1 General Task Order Requirements; and Paragraph 1.14 Performance Bond will be clarified.
9. Bidder Inquiry ID: 7080694 Please describe how “period of performance” (duration) will be established for individual task orders and whether the contractor will be offered any input in this decision?
Response to Bidder Inquiry ID: 7080694 Per Specification 01 11 00 – Summary of Work; Paragraph 1.2.1 General Task Order Requirements, “the Period of Performance for each task order will be based on the size of the area awarded.”
Performance duration will primarily be based on an anticipated minimum production rate of placing 750 cubic yards of borrow material per day. This information will be added to the specifications.
10. Bidder Inquiry ID: 7080707 Please describe what “level of effort” will result in payment of “Partial Demob/Remob”? Will all equipment have to be removed from the site in order for payment to be triggered for this bid item?
Response Bidder Inquiry ID: 7080707 Per Specification 01 22 00 – Measurement and Payment; Paragraph 1.3.2 Partial Demobilizations and Remobilizations, “this bid item is to cover partial costs of equipment and personnel when the Government does not announce and award a subsequent Task Order within 30 days (to be revised from 60 days) from government final acceptance of the Contractor’s work. No payment will be paid for equipment and associated costs that have left the Craney Island site for other work during this delay. This bid item applies when the Contracting Officer has announced that there will be a new Task Order issued to the Contractor but there is Government delay in the award process.
11. Bidder Inquiry ID: 7080716 Spec section 01 22 00 – Measurement and Payment calls for a second soil gradation test every 3,000 CY, “if required.” Assuming the soil blending requirement can be made into a separate bid item, can this second test also be separated and only be paid if used?
Response Bidder Inquiry ID: 7080716 Per Specification 01 22 00, Section 1.4.1 Payment Item No. 0006 – Gradation Testing at the CI Borrow Areas, “payment is for testing every 3,000 cubic yards of material” and “the first retest of the section will be at Government expense with all following retests at Contractor’s expense.” Payment is by quantity of verified individual tests performed.
12. Bidder Inquiry ID: 7080729 Will an office trailer be required, or is this up to the Contractor?
Response to Bidder Inquiry ID: 7080729 The contract does not require the Contractor to have an office trailer, but it does require the Contractor to supply sanitation facilities and protection from the weather for the workers which must be detailed in the Health and Safety Plan. See Specification 01 50 00 - Temporary Construction Facilities for additional information.
13. Bidder Inquiry ID: 7080748 Will the Government provide access to electricity at the laydown area? Will the contractor be required to pay for electricity?
Response to Bidder Inquiry ID: 7080748 A power connection is available to the contractor in the Contractor Laydown Area but the contractor is responsible for the expense and must contact Dominion Power and arrange for a meter to be installed in their name.
14. Bidder Inquiry ID: 7080772 Spec Section 01 35 26 – Government Safety Requirements, Paragraph 1.5.1.1 allows the SSHO and the CQC to be the same person under this contract while Section 01-45-00, Paragraph 3.4.1 states that “The Site and Health Officer (SSHO) must report directly to a senior project (or corporate) official independent from the CQC System Manager.” Please clarify these conflicting requirements.
Response to Bidder Inquiry ID: 7080772
These are not considered to be conflicting requirements. When performing their role as the Safety Officer of the job site, the Officer should be working independently of any CQC System considerations and should be reporting to an official who is also independent of the CQC System.
15. Bidder Inquiry ID: 7080775 Spec Section 31 00 00 - Earthwork, Paragraph 3.4 states “if dike material is classified as “unsatisfactory” due to the inclusion of unacceptable materials such as rocks, vegetation, and debris, remove and return the acceptable soil material to the borrow area for reuse and dispose of nonacceptable material offsite.” It was indicated at the site visit that contractors should not expect to haul off anything except the cleared and stripped material. If there is an expected quantity of “unsuitable” material such as debris within the borrow areas, please provide a quantity and a bid item.
Response to Bidder Inquiry ID: 7080775 Facility staff have specifically prepared the material in this area to meet contract requirements. See response to Bidder Inquiry ID #7078241.
16. Bidder Inquiry ID: 7080786 The solicitation requires all material in borrow site area meet gradation requirements. If the material does not meet the requirements, it must be excavated and mixed with approved material and retested.
Since the solicitation does not quantify the amount of material to be mixed and retested, that places an undue burden and risk on the Contractor. Obviously, the Government nor the Contractor has any way of knowing the material condition until it is tested. Therefore, the Contractor would be guessing and the Government could be paying for mixing and retesting it does not receive. Also, bids could be inflated to cover the unknown condition. Recommendation: add a new bid item number under the base year and each option to cover mixing the material. Maximum quantity would be estimated and would be cubic yard. Also, increase the Gradation Testing maximum quantity to cover the anticipated additional testing.
Response to Bidder Inquiry ID: 7080786 See responses to Bidder Inquiry IDs #7078241 and #7080716.
17. Bidder Inquiry ID: 7080812 Solicitation Page 19, Section 00 21 00.1, Paragraph 3, “the dredges to be used to perform the work under this contract” – please confirm there is no dredging requirement under this solicitation.
Response to Bidder Inquiry ID: 7080812 Dredging is not included in this contract and this paragraph section will be deleted from the solicitation by amendment.
18. Bidder Inquiry ID: 7080840 Wage Decision Number: VA 170001, 01/06/2017 VA1 has been incorporated into the solicitation.
This Wage Decision is for “Heavy Dredging.” Please confirm it is correct for this type of work.
Response to Bidder Inquiry ID: 7080840 See response to Bidder Inquiry ID #7078237.
19. Bidder Inquiry ID: 7080983 How many Task Orders will encompass each section?
Response to Bidder Inquiry ID: 7080983 The expectation is that we will be awarding up to $5M in work for each contract year (base plus two option years). One or multiple task orders may be awarded each year.
20. Bidder Inquiry ID: 7080985 What is the sequence of Construction? i.e. which section will get the first Task Order and so on.
Response to Bidder Inquiry ID: 7080985 The first Task Order is expected to include portions of the west perimeter dike. Subsequent task orders are anticipated to cover portions of the remaining perimeter of Craney Island and then the two cross-roads will be raised. However, sequencing of work is subject to change based on needs of the Craney Island facililty.
21. Bidder Inquiry ID: 7080991 It is understood that the contractor keeps the USACE pumps running. Who is responsible for routine maintenance, clogs or breakdowns?
Response to Bidder Inquiry ID: 7080991 The Government will not be supplying pumps to the Contractor and the Contractor has no responsibility for the running or maintenance of Government pumps at Craney. The Contractor is responsible for supplying and maintaining pumps as needed to meet contract requirements.
22. Bidder Inquiry ID: 7081012 Can we screen out the stripped organics and reuse the soil on-site?
Response to Bidder Inquiry ID: 7081012 See response to Bidder Inquiry ID #7078231. All material for dike placement must meet contract requirements for satisfactory mix design.
23. Bidder Inquiry ID: 7081016 Is Tier 4 equipment a requirement of this project?
Response to Bidder Inquiry ID: 7081016 Tier 4 equipment is not a requirement of this project.
24. Bidder Inquiry ID: 7081030 Will there be an Erosion Control Plan issued?
Response to Bidder Inquiry ID: 7081030 There will not be an Erosion Control Plan issued by the Government. All erosion control requirements are already included in the specifications and drawings. Per Spec. 01 57 20 – ENVIRONMENTAL PROTECTION, the Contractor must submit an Environmental Protection Plan.
25. Bidder Inquiry ID: 7081619 Can we install a well or create a pond for fresh water supply on site?
Response to Bidder Inquiry ID: 7081619 Contractor may not install a well or pond for fresh water on site but must import all water required from off-site sources.
26. Bidder Inquiry ID: 7081630 Should the bond amount cover the first year base contract or the entire 3 years?
Response to Bidder Inquiry ID: 7081630 See response to Bidder Inquiry ID #7078423.
27. Bidder Inquiry ID: 7081689
1. Is there a minimum volume of material that the Contractor is expected to handle each day to keep up with the construction schedule (i.e. cubic yards) RESPONSE: See response to Bidder Inquiry ID #7080694.
2. The solicitation provides no details for or makes no mention of erosion and sediment (E&S) controls that may be required during construction (e.g. silt fencing). Is there a project and/or facility wide E&S Plan? If yes, can it be provided to the Contractors for review? If no, is one required and who will be responsible for preparing the Plan?
RESPONSE: See response to Bidder Inquiry ID #7081030.
3. Is perimeter or personal air monitoring required? If yes, please provide a description of the minimum requirements?
RESPONSE: No air monitoring is required.
4. Do any of the site workers require HAZWOPER training? If yes, what are the minimum requirements?
RESPONSE: No HAZWOPER training is required.
5. Are buried Navy pipelines (e.g. natural gas) located within the work limits?
RESPONSE: No pipelines are within the work limits.
6. If we are placing borrow material directly into standing water to build the platform, why are worried about the moisture content of material being used to build the base of the platform (submerged platform)?
RESPONSE: See responses to Bidder Inquiry IDs #7078232 and #7078233
7. During placement of material into standing water to build platform to build platform, turbid conditions are expected to be created. Are there any limitations posed by the turbid conditions especially when working and building platforms near spillboxes?
RESPONSE: There are no limitations regarding turbid conditions.
8. Where can surface water and/or groundwater generated during dewatering be discharged? Are there any groundwater or surface water treatment or monitoring requirements during discharge?
RESPONSE: Water from pumping should be discharged back into the interior cells/ponds at a distance from the construction site area such that it does not drain back to the site.
9. During the site visit, the Government stated that they MAY provide pumps for controlling water for controlling water and dewatering. If the Government will be providing pumps, what type, how many, and what is the Contractor’s responsibility concerning fueling, repair and maintenance?
RESPONSE: See response to Bidder Inquiry ID #7080991.
10. Spec 00 31 32 – Geotechnical Data Report, paragraph 1.1, states that the Contractor is required to excavate and blend material and retest if an area fails gradation testing. Based on the Government’s past experience working with this material and on similar projects, what is the percentage of failed tests and average number of blending events.
RESPONSE: See response to Bidder Inquiry ID #7078241.
11. When should the contractor complete the BD survey, before or after clearing, grubbing and stripping? If the BD survey differs greatly from the Government survey and quantities are found to differ from those contracted, can the Contractor petition for a funding adjustment?
RESPONSE: The BD survey shall be completed after clearing, grubbing and stripping given that it is taking the elevations of the existing ground surfaces. The specifications will be revised to reflect this phasing. As this is an IDIQ contract, all bid items are already unit priced to allow for variability in quantities.
12. Spec 01 22 00 – Measurement and Payment, paragraph 1.3.1.2 and 1.3.2: Will contractor be reimbursed for monthly equipment rental fees for equipment left on site between Task Orders, during temporary delays, and/or when a partial demobilization and remobilization is requested? The Spec only states that the Contractor “may” be paid for these fees.
RESPONSE: See response to Bidder Inquiry ID #7080707 .
28. Bidder Inquiry ID: 7081704
13. Spec 01 57 20 – Environmental Protection, paragraph 3.4.1, states that the contractor is responsible for controlling particulates at all times including weekends, holidays, and when work is not in progress. Has particulate control on off work hours been required and/or needed on past projects and how is the source of particulates determined when several projects are being conducted simultaneously?
RESPONSE: Per the specification, the contractor is responsible for controlling Particulates which exceed Federal, State, and local air pollution standards in your work areas and haul routes.
14. Spec 01 57 20, paragraph 3.5: will the contractor be compensated for lost time and potentially costs associated with working around nesting birds which have a long nesting season (6 months)?
RESPONSE: No compensation for lost time and associated costs due to nesting birds will be provided.
15. Are there any restoration or other conditional requirements for borrow areas after the borrow site material is removed?
RESPONSE: See Specification Section 31 00 00 – Earthwork, Paragraph 3.7 Finishing.
16. Spec 31 00 00, paragraph 3.1.1: Please define “significant concentration” when describing expectations for rock and debris to be encountered in the borrow material.
RESPONSE: See response to Bidder Inquiry ID #7078241
17. Spec 31 00 00, Earthwork, paragraph 3.2.3: please define what “disposal” is required when dealing with surface and subsurface water.
RESPONSE: See response to your Bidder Inquiry ID #7081689, item #8.
18. Spec 31 11 00 – Clearing, Grubbing and Stripping, Paragraph 1.4.3 states stripping includes removal and disposal of disposal of topsoil to a depth of 6 inches. Is this truly a requirement? And if yes, should we assume the topsoil requires off-site disposal along with other vegetation waste?
RESPONSE: See response to Bidder Inquiry ID #7078231.
19. Does the cleared, grubbed, and stripped waste require any special handling and disposal or is it considered typical, non-contaminated waste?
RESPONSE: there are no special handling requirements for vegetative debris.
20. Does the Government anticipate encountering any large size debris (3-inches and larger per Spec 31 00 00) in the designated borrow sites? Does the Government expect the Contractor to screen the Government the Government furnished borrow material to remove all debris greater than 3 inches in size?
RESPONSE: See response to your Bidder Inquiry ID #7078241
21. Spec 32 92 19 - Hydroseeding, Paragraph 3.1.2, states that all debris and stones larger than ¾-inch must be removed. This contradicts the 3-inch size limit of stones and debris allowable in the borrow material used for construction. Is this truly a requirement?
RESPONSE: This specification is for hydroseeding the finished dike surface and is not related to work in the borrow area.
22. Spec 32 92 19, paragraph 3.7.3: what weed, insect and disease eradication is required and has this been required or needed on past projects?
RESPONSE: See Spec 32 92 19 Hydroseeding information.
29. Bidder Inquiry ID: 7081708
23. Spec 35 41 00, Dike Construction, paragraph 1.5.2.b: Why does the contractor have to assume costs to recondition materials that pass classification but are deemed unsuitable by the Government?
RESPONSE: The specification will be amended to clarify that the material must also meet compaction and moisture content requirements in accordance with specification section 35 41 00, paragraphs 3.17 Compaction and 3.19 Testing.
24. Spec 35 41 00, Dike Construction, paragraph 1.8.3: what constitutes or what conditions that constitute a slide that is not the fault of the contractor?
RESPONSE: The Contracting Officer will determine the reason for the slide as to whether it is due to the fault of the Contractor or not.
25. Spec 35 41 00, Dike Construction, paragraph 3.6.4 states a more than 3 day delay in placement of the next lift or rain event after testing but before placement of next lift requires retesting before placement of the next lift. What constitutes a “rain event” and an adequate drying period and who pays for the additional testing? This is a major concern during rainy seasons, bird nesting seasons, and managing conditions outside the control of the contractor.
RESPONSE: Per specifications, a “rain event” is defined as a 3 day delay in placement of the next lift. The timing of the testing is the responsibility of the contractor.
26. Spec 35 41 00, paragraph 3.9: what constitutes a slide due to no fault of the Contractor?
RESPONSE: See response to Bidder Inquiry ID #7081708, item #24
27. Spec 35 41 00, paragraph 3.13: why is the contractor responsible for all expenses associated with dike protection, especially if erosion and settlement occurs as a result of an event outside the contractor’s control (e.g. major storm event)?
RESPONSE: Contractor is responsible for their dike work and needed repairs before Government acceptance.
28. How is the Contractor expected to be responsible and fully informed of the extent and limits of work being performed by USACE and others on unrelated projects at Craney Island?
RESPONSE: USACE has a permanent office with staff at the site. Contractor is responsible for coordination of their work with USACE and their contractors.
30. Bidder Inquiry ID: 7081713
29. General profiles of the proposed dike raising show that the majority of the fill material will be placed on the interior side of the perimeter dike, on the top of existing dredged spoils and underwater (along the west perimeter dike) -- 29a. How soft is the existing grade (ie top of the existing dredged spoil) along the west side? Is mud wave/stability a concern and has it been on past and similar construction efforts? This is both a constructability and safety concern. Is there a limitation on the rate of filling and the initial lift thicknesses on top of the water table (working pad) and the subsequent lifts after because of the soft compressible subgrade?
RESPONSE: See response to Bid Inquiry ID #7078233
29b. Is compacting the fill immediately above the 6 foot thick “working platform” placed underwater feasible since the working platform will be completed underwater and be entirely saturated?
RESPONSE: See responses to Bid Inquiry IDs #7078232 and #7078233.
29c. Please provide any stability evaluation of the filling on top of the existing dredged spoils to create the platform – AND:
29d. Please provide all available settlement information for the perimeter dikes and the spillbox structures – AND:
29e. Please provide all geotechnical information of the existing perimeter dikes and the existing dredged spoils RESPONSE: See Specification 00 31 32 – Geotechnical Data Report. The additional information requested should not be needed to perform this contract.
30. Drawing No. 9 through 19: please show the station lines on the plan view that correlate to the shown profiles. What does “existing surface, typical” line represent? Is this meant to be the existing surface of the crest? If so, these profiles show that in some areas it may require +-8 feet of fill to reach the Phase I target elevation. Please clarify RESPONSE: The drawings provided include all information required to bid this IDIQ contract.
Payment is by cubic yard of material placed and contractor is to meet elevations specified in the Task Orders.
31. Please show the sample locations of the lab results provided in Spec 00 31 32 RESPONSE: All samples are from the east side of the south borrow site.
32. Spec 31 00 00, paragraph 1.5.1 states that the maximum allowable moisture content for the material to be satisfactory is 25% per ASTM D6938 test. Paragraph 3.1.1 of the same section states that only satisfactory material shall be used to construct the dike. This ASTM test is for the in-place compaction test (nuclear gauge test). Does this mean that the Contractor is to check the suitability of the material after it was placed and compacted and not prior to using the material? Why not check the moisture of the government furnished borrow site prior to using it so it would be easier to dry the borrow material at the designated borrow site(s) by either spreading it in a thin layer and/or mixing it with drier borrow material.
RESPONSE: The contractor is responsible for means and methods for placing satisfactory material on the dikes which passes the specified tests.
31. Bidder Inquiry ID: 7081730
33. Is the modified proctor test ASTM D1557 required? Spec 35 41 00, paragraph 1.5.6 implies that is part of the contract but the proctor test requirement is not mentioned elsewhere in the specification.
RESPONSE: The proctor test is not required.
34. Spec 35 41 00, Dike Construction, paragraph 1.8.3 states that if the foundation failure occurs through the fault of the Contractor, the repair shall be made at no cost to the Government. What actions are considered the fault of the Contractor? No specific limitations/guidelines are provided in construction of the new dike on the soft dredged spoil. Typically, the contract would specify the rate of filling over the soft dredged spoil in order to prevent foundation/slope failures.
RESPONSE: The Contracting Officer will take into account the history of the work area and all mitigating factors in determining fault.
35. Spec 35 41 00, Dike Construction, paragraph 3.17: Is the target density of 115 pcf the dry maximum density of the modified proctor ASTM D1557? Doe the Government truly believe this compaction requirement can be achieved on sloped sides compacted by an excavator bucket and material placed on platforms within open water?
RESPONSE: The target density of 115 pcf is an average based on the material being placed on the dikes. Testing is not required for submerged platforms.
36. Will the contractor be held accountable or responsible for using material from borrow sites that is deemed unsuitable by the contractor for the dike construction? On a similar note, it was noted that during the site walk through one of the borrow areas that will not even be ready for use until a year from now.
RESPONSE: The contractor is responsible for preparing and placing material on the dike that is deemed “satisfactory.” The first Task Order will be removing material from the south Borrow Site which is ready for immediate use. The north Borrow Site will be available for the second Task Order.
37. After how many attempts at blending of material that fails gradation testing, will the Government concede that the material is unsuitable for use in dike construction activities?
RESPONSE: The contractor is responsible for the means and methods required to produce a satisfactory material for dike placement.
38. What is the anticipated size, scope, and dollar value of each Task Order?
RESPONSE: See response to Bidder Inquiry ID #7080983
32. Bidder Inquiry ID: 7081738
39. Will bonding be required on each task order or will be required for the entire estimated value for the total IDIQ contract? Should we also assume each bond will be expeditiously be released after each Task Order is successfully completed?
RESPONSE: See response to Bidder Inquiry ID #7078423.
40. Does the Solicitation contain the correct Wage Rate determination? During the site visit, it was mentioned that the wrong one was included.
RESPONSE: See response to Bidder Inquiry ID #7078237.
41. Solicitation Section 52.211-11, Liquidated Damages, are sediment geotechnical conditions and compaction issues out of the control of the Contractor acceptable delays?
RESPONSE: The Contracting Officer will determine if the delay is related to conditions outside the scope of the contract.
42. Solicitation Section 52.211-18, Variation in Estimated Quantity: the 15% above estimated quantity represents a large quantity on several of the Bid Items. It seems unfair to the Contractor that they should not be compensated for quantities over the estimated quantity and that time extensions for addressing additional quantities is entirely up to the judgement of the COR?
RESPONSE: The Contractor will be paid for all quantities placed and accepted by the Government.
Placed quantities subject to the ‘variation in estimated quantities’ clause may be considered.
43. What is the Government’s intentions with respect to FAR Clause 52.203-6 Restrictions on Subcontractor Sales to the Government? Why was it included in this solicitation?
RESPONSE: This clause was incorporated by reference in the solicitation per FAR requirements to cover unexpected events and may or may not apply to a specific project.
33. Bidder Inquiry ID: 7081775 During the site visit, the Government stated that they may provide pumps for controlling water and dewatering. If the Government will be providing pumps, what type, how many and what is the Contractor’s responsibility concerning fueling, repair and maintenance?
Response to Bidder Inquiry ID: 7081775 See response to Bidder Inquiry ID #7080991.
34. Bidder Inquiry ID: 7081792 Section 01 22 00, Page 4, 1.3.2 Partial Demobilizations and Remobilizations. “this bid item is to cover partial demobilizations and then remobilizations of equipment and personnel when the Government does not award the next Task Order in less than 60 days from the last day of Contractor work at the site which results in the Contractor temporarily removing equipment and personnel from the site while waiting for the next Notice to Proceed (NTP). A) To think Contractor personnel and equipment will stay on-site for up to 60 days pending issuance of the next task order is unreasonable and not cost effective for the Contractor or the Government. This type of requirement will inflate the Contractor’s bid and the Government would potentially be paying for unnecessary delay cost. B) Suggestion: reduce the 60 days or less to a more definitive and reasonable time frame, such as 5 or 7 days, or remove it from the solicitation and handle any delay cost with an equitable adjustment negotiated between the Government and the Contractor.
Response to Bidder Inquiry ID: 7081792 See response to Bidder Inquiry ID #7080707
35. Bidder Inquiry ID: 7082393 If the Government determines each task order’s size and duration, and each task order can be different, how the contractor determine the equipment and personnel needed? Can the Government provide a quantity of material they want moved per day?

36. Bidder Inquiry ID: 7082395 The time of performance for each task order shall include final cleanup (per Solicitation Section 52.211-10) which, in my reading should include demobilization. Please clarify or change the requirement as this is an IDIQ contract.
Response to Bidder Inquiry ID: 7082395 A full demobilization will be paid when it is announced there are no task orders to be issued and/or the IDIQ contract has expired. The contractor may choose to partially demobilize between task orders. See response to Bidder Inquiry ID #7080707.
37. Bidder Inquiry ID: 7082396 Do Liquidated Damages apply to each Task Order or only the final completion?
Response to Bidder Inquiry ID: 7082396 Each Task Order will be subject to its own Liquidated Damages. Specification 01 11 00 will be clarified.
38. Bidder Inquiry ID: 7082401 Will separate Performance and Payment (P&P) Bonds be required for each Task Order or will the initial P&P Bonds be written for the full bid price including all alternates? Or will it be written for the estimated $15M budget? Or will it be for $5 million per year?
Response to Bidder Inquiry ID: 7082401 See response to Bidder Inquiry ID #7078423
39. Bidder Inquiry ID: 7082402 Do solicitation paragraphs 1 and 2 of 252.236-7004 need percentages of payment entered?
Response to Bidder Inquiry ID: 7082402
The percentages to be entered in Clause 252.236-7004 Payment for Mobilization and Demobilization are listed in Specification 01 22 00 – Measurement and Payment as 60% for mobilization and 40% for demobilization.
40. Bidder Inquiry ID: 7082403 Is VA170001 the correct wage determination?
Response to Bidder Inquiry ID: 7082403 See response to Bidder Inquiry ID #7078237.
41. Bidder Inquiry ID: 7082404 Spec 00 31 32 – Geotechnical Data Report states that “if the material does not meet contract mix requirements, the Contractor is to excavate and blend the material with approved material and retest” which is not fair or equitable for the Contractor. We have no control over the existing material or any way to quantify this work. Please consider adding a time and material or separate item for blending material, as necessary. The Recap of soil gradation chart provided 5 of the 13 samples did not pass.
Furthermore, only a very small quantity (area) was sampled.
Response to Bidder Inquiry ID: 7082404 See response to Bidder Inquiry ID #7078241
42. Bidder Inquiry ID: 7082405 The measurement and payment for the Partial Demobilization/Mobilization is not clear to me. First issue is that a 60 day time for idle equipment before we receive any consideration for payment is very costly. The second issue is that there is some language referencing possibly paying for idle equipment. The third issue is that you are asking for cost breakdown on fixed price item. Is it being paid as cost reimbursement?
Response to Bidder Inquiry ID: 7082405 See response to Bidder Inquiry ID #7080707
43. Bidder Inquiry ID: 7082409 Per spec section 01 22 00.1.4, Measurement and Payment, payment item #0008 Grubbing and Clearing, this item requires the grubbing and clearing with material to be disposed of offsite. Please consider changing the requirement to allow grubbing and clearing material to be placed at the toe of the slope either interior, exterior, or both. You may also consider hauling the grubbing material back to the excavation site and disposing Response to Bidder Inquiry ID: 7082409 See response to Bidder Inquiry ID #7078231
44. Bidder Inquiry ID: 7082410 Can you provide your calculations for determining the bid quantities for all items?
Response to Bidder Inquiry ID: 7082410 Calculations are not available as part of this solicitation. Bid quantities were based on existing Government surveys. Each task order’s bid schedule quantities will be based on government surveys of the specific area associated with the task order.
45. Bidder Inquiry ID: 7082411 Per spec section 01 22 00.1.4.8 Measurement and Payment, payment item #0010 Maintain Contractor’s Borrow Work Site, how will it be determined if this pay item will be used. If the contractor invests his own money up front and does a good job properly establishing and maintaining the 7080991, work after a storm should be minimal but if the site is not well maintained on regular basis, more work will be required and paid for by the Government. I am also questioning why we need to justify costs on a firm price bid item?
Response to Bidder Inquiry ID: 7082411 Specification will be amended to remove reference for requirement to submit specific listing of equipment, personnel, work, and costs for bid schedule. As noted in the specification, this bid item only applies to major weather events where access to the site for work is denied for full weather delay days; and for costs over and above those required for daily site maintenance which must be verified.
46. Bidder Inquiry ID: 7082412 Per spec section 01 22 00.1.6 Measurement and Payment, regarding Monthly Partial Payments, does an acceptance area (1,000+) need to be 100% complete including AD survey and calculations to receive payment or will partial payments be made for work performed based on load count.
Response to Bidder Inquiry ID: 7082412 Partial payments will be made in accordance with contract requirements, and will be based on work completed to date.
47. Bidder Inquiry ID: 7082413 Per spec section 01 30 00.1.3.1 Administrative Requirements, Preconstruction Conference scheduling, is a preconstruction conference required for each task order? Can we assume that a schedule will be required for each task order and that they will be independent schedules or all schedules combined?
Response to Bidder Inquiry ID: 7082413 A preconstruction conference and schedule will be required for each task order issued as part of the overall IDIQ contract.
48. Bidder Inquiry ID: 7082414 Spec section 01 78 00.1.5.3 General Requirements Section, in the third sentence, should the rounding up to number be 1,000 and not 10,000?
Response to Bidder Inquiry ID: 7082414 Clarification will be made to the solicitation by amendment. The dike length should be rounded up to the nearest 1,000’ and not the nearest 10,000’.
49. Bidder Inquiry ID: 7082415 Spec section 31 00 00.1.2.c Earthwork, Sequence of Work, requires the contractor to submit a work plan for the excavation site to include dewatering. At the pre-bid site visit, it was indicated that Government owned pumps will be available for the contractors to use. Please confirm that Government pumps will be available to the contractor and what level of operation and maintenance sill be the contractor’s responsibility.
Response to Bidder Inquiry ID: 7082415 See response to Bidder Inquiry ID #7080991.
50. Bidder Inquiry ID: 7082416 Spec section 31 00 00.1.2.g Earthwork, Sequence of Work, requires material to be stockpiled at the dike area. At the site visit it was expressed that the material does not have to be stockpiled. Please remove this requirement to stockpile or change the language to allow stockpiling but not requiring.
This requirement is included in several sections of the specification.
Response to Bidder Inquiry ID: 7082416 Solicitation will be revised by amendment to state “MAY” stockpile. The contractor is responsible for means and methods and stockpiling material at the dike site in preparation for placement is their choice.
51. Bidder Inquiry ID: 7082417 Spec section 31 00 00.1.6.2 and 3.2.4 Earthwork, System Description, Borrow Site Dewatering Work Plan requires submission of a work plan 30 days prior to the start of work. Given that we will not know where we are digging and then the time to develop the plan, get it approved and then implemented and actually get the material dewatered could cause delay to the project. Section 3.2.4 dewatering also requires the 30 day advance submission of the plan prior to excavation. Does this include excavation as part of the dewatering plan?
Response to Bidder Inquiry ID: 7082417 The solicitation will be revised by amendment to require the contractor to submit the Borrow Site Dewatering Work Plan at least 15 days prior to the start of work. A separate Borrow Site Excavation and Hauling Work Plan is also required.
52. Bidder Inquiry ID: 7082419 Spec section 31 00 00.2.1 and 3.4 Earthwork, Borrow Site Materials, implies that unsuitable material will be disposed of offsite. This contradicts what was said at the pre-bid meeting. Please confirm that no material will be removed from the site.
Response to Bidder Inquiry ID: 7082419 To clarify, no borrow site material is required to be removed offsite. See Bidder Inquiry ID #7078241.
53. Bidder Inquiry ID: 7082423 Spec section 31 00 00.3.7 Earthwork, Borrow Site Finishing requires that the Borrow Sites meet certain “finishing” requirements at the end of the contract. Is finishing in accordance with this paragraph required? Does 3.7.1 – Subgrade and Embankments apply?
Response to Bidder Inquiry ID: 7082423 The contractor is responsible for meeting all contract requirements.
54. Bidder Inquiry ID: 7082433 Spec section 31 11 00 Clearing, Grubbing and Stripping. The required 6” of stripping will generate a substantial volume of material. Regardless of whether it is disposed of on-site or off-site, how will the void of material be replaced or calculated in the embankment? All indications are that the BD survey must be performed prior to stripping so the volume will not be included in the AD survey.
Response to Bidder Inquiry ID: 7082433 See response to Bidder Inquiry ID #7078231 for the disposal of the 6” of soil/root mixture. See response to Bidder Inquiry ID #7081689 for the timing of the BD survey.
55. Bidder Inquiry ID: 7082434 Spec section 31 11 00.3.2 Clearing, Grubbing and Stripping. Can the clearing and grubbing and stripping operations be performed in a single operation, ie strip the vegetation and 6” of topsoil at the same time commingling the material?
Response to Bidder Inquiry ID: 7082434 See response to Bid Inquiry ID #7078231.
56. Bidder Inquiry ID: 7082436 Spec section 32 92 19.3.1.2 Hydroseeding, Final Clearing requires the contractor to remove debris and stones larger than ¾” from the surface. Is this required and, if so, to what depth?
Response to Bidder Inquiry ID: 7082436 Contractor is required to meet contract specifications. Material on the surface that should be removed should be visible to the human eye.
57. Bidder Inquiry ID: 7082702 Spec section 01 22 00.1.3.1 Measurement and Payment, Payment Item No. 0001 – Full Mobilization and Demobilization. Mobilization/Demobilization has a 60/40 split for payment. If the contractor does not fully demobilize in year 1, what happens to the 40% remaining payment for demobilization?
Is it forfeited? Would we receive 40% of the Mob/Demob item for the year we actually demobilize or would we receive the balance of the initial pay item? This similar question can be asked regarding item 0002, 1002, and 2002.
Response to Bidder Inquiry ID: 7082702 See response to Bid Inquiry ID #7082395.
