GEOTECHNICAL DATA REPORT

A 200 foot wide times 1,000 foot long section that runs west to east near the southern road in the borrow site at the south-east corner of the Craney Island site was sampled by the USACE Geo-Environmental Section around September 15, 2016. Samples were taken at various depths from the material that will be used for dike construction. The material tested was deposited there by pumping from multiple dredging barges over a period of many years after channel dredging from various sources in and connected to the Norfolk Harbor. The material was placed in layers over a long period and is not consistent as it was removed from various rivers and harbors and must be blended before placement at the new dike locations to meet contract requirements.

The Government has been blending the material as it prepares the Craney Island borrow sites for Contractor excavation and removal of material to the dike construction sites. Before the material can be excavated, gradation testing is required to verify that the blended material meets contract requirements. If the material does not meet contract mix requirements, the Contractor is to excavate and blend the material with approved material and retest.

SUMMARY OF WORK

1.1 DESCRIPTION OF CRANEY ISLAND DREDGED MATERIALS MANAGEMENT AREA

The Craney Island Dredged Material Management Area (CIDMMA) is a 2,500 acre confined dredged material disposal site located at the north end of the town of Portsmouth near Norfolk, Virginia. CIDMMA serves as a long-term disposal site for material dredged from the rivers, channels and ports in the Norfolk Harbor area. By 2010, the site had received over 253 million cubic yards of dredged material. The heights of the dikes are being raised to increase the site’s storage capacity. The site is divided into three large storage cells that are contained by compacted soil dikes that average 30 to 40 feet high. The top of the dikes serve as roadways and are interconnected. The site is a peninsula that is approximately 2 miles wide times 2 miles long that extends into the Norfolk Harbor. The south end includes access roads, the USACE office, and the Contractor’s laydown yard. Access to the site is limited and must be approved by the site’s USACE office. A permanent crew of USACE personnel maintain the roads, dikes and associated structures. The island is a known nesting area for protected birds during the March 1 through August 15 period which may cause delays and relocation of work.

1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 General Task Order Requirements

The work included in this Indefinite Delivery/Indefinite Quantity (IDIQ) contract will be awarded using Task Orders with each task order covering a different section of the Craney Island dikes that will be raised to a higher elevation. Each dike raising will be in approximately two foot to four foot increments per Task Order. The unit prices from the awarded IDIQ contract will be used to prepare the individual Task Orders to match available funding. Each Task Order is handled as a separate contract and will require a full set of submittals, surveys and drawings. Task orders will be issued by the Contracting Officer in the order and locations deemed necessary and may include any dike sections on Craney Island. The Government’s preference is that the dike sections included in the following Task Orders will be a continuation of the work from a previous task order.

Each task order will include all applicable bid items at the unit prices awarded per the Base Bid. The Period of Performance for each task order will be based on size of the area awarded. The IDIQ specifications apply to all Task Orders but new drawings will be issued for each Task Order to detail the work included. The Government will work to award subsequent task orders in a timely manner such that the Contractor can work continuously from one Task Order to the next Task Order without demobilizing and then remobilizing to the site. If there is a major delay between task orders, as determined by the Contracting Officer, there is a bid item for a partial demobilization and then partial remobilization of the Contractor’s equipment and personnel that may have left the site. The total value of the Task Orders included in the IDIQ contract are limited to $5,000,000 per year for each of three (3) years for a total IDIQ value of $15,000,000. If a Task Order is not issued during a contract year, a minimum guarantee of $10,000 will be awarded.

SECTION 01 11 00 Page 3

All work specified in this contract shall be performed in accordance with the contract documents, specifications and drawings applicable to the respective Task Order’s pay items indicated and as stated in this Summary of Work. The Contractor shall begin work within 10 days after receiving the Notice to Proceed (NTP) for each Task Order which is normally issued by the Contracting Officer after that Task Order’s Pre-Construction Conference.

Each task order is considered a separate legal contract and requires its own full set of documentation, schedules, work plans and all other items required per the Bid Document’s specifications and the individual Task Order’s drawings.

1.2.2 Project Description

The dikes surrounding the three holding ponds at Craney Island Dredged Materials Management Area (CIDMMA) are slowly being raised to increase the site’s dredged material storage capacity. Currently, the three containment areas (also known as “ponds”) are slowly approaching maximum capacity. The work is currently divided into two phases: Phase I is the first two foot compacted soil raise; and Phase II is the second two foot compacted soil raise. It is anticipated that the majority of work included in this first IDIQ contract will involve Phase I work, but Phase II work may also be added as part of the same Task Order or a future Task Order, as conditions require. It is expected that work will start at the south-west corner of the site and run north and then east to include the entire outer perimeter of dikes. Work will then move to the inner three east-west cross dikes.

Task Orders will be issued for specific sections of the dikes with the bid item’s volumes and surface areas based on USACE surveys. After the Notice to Proceed (NTP) is issued, the Contractor will complete a Before Dike (BD) surveys of the entire area included in the Task Order and determine Acceptance Areas and their quantities. The BD surveys and associated calculations shall then be submitted to USACE to for review and approval.

There are two separate construction areas: 1) excavation and hauling material from either or both of the two Borrow Sites; and 2) material placement at the task order specified dike construction area and associated activities. See Section 31 00 00 EARTHWORK for information on Borrow Site work items. See Section 35 41 01 DIKE CONSTRUCTION.

The borrow sites contain layers of material from different dredging operations near the Norfolk Harbor which the Government has been mixing and compacting into blended mixtures that will be used for dike construction.

The top of the material is at the same elevation as the adjoining dikes’ roadways. The Contractor shall first divide the material into 3,000 cubic yard sections which shall be gradation tested based on a maximum 40% fine materials. Approved materials shall be loaded by the Contractor into trucks and delivered to the dike construction area. Disapproved materials shall be remixed and retested until they meets testing requirements. The Contractor shall maintain logs of all material quantities and their delivery locations by acceptance areas.

The dike surface area to be covered in new dike material shall be cleared and grubbed before material deliveries may start. The Contractor shall excavate and haul approved blended soil materials from Craney’s two borrow sites to the dike placement areas where it will be stockpiled. The Contractor shall place and compact the material in one foot lifts on the top and two sides of the dike as shown in the drawings. Settlement plates shall be placed every 1,000 foot along the dike crest before the dike material is placed to measure settlement of the construction area due to the new soil load. Once a full raise of new dike material has been achieved in an acceptance area and is approved by the Contracting Officer’s

SECTION 01 11 00 Page 4

Representative, no further dike placement work is required even if there is a general sinking of the area due to compaction and compression.

Per the drawings, some of the sections will require placement of material on the interior/pond side of the dike slopes down to and beyond the water surface and into the pond water and sediment. Material will be required to build “initial working platforms” below the water surface to serve as foundations to support the material being placed along the exposed slopes.

As the volume of this material will not be included in the AD surveys since it cannot be measured when immersed in the water, the volume will be calculated using truck load volume logs for each acceptance area.

As soon as the dike raising work is completed in an acceptance area, the Contractor shall complete an After Dike (AD) Survey of that area and submit with quantity calculations to the Government to support progress payment requests. After Government acceptance, either partially or for the entire area included in the Task Order, the Contractor shall hydroseed the two side slopes of the newly raised dike areas.

1.2.3 Location

The work is located at the Craney Island Dredged Material Management Area which is located at the north end of the town of Portsmouth, Virginia on a peninsula extending into the Norfolk Harbor. Craney Island is directly west of downtown Norfolk, VA. The exact location is shown on the plans.

The USACE office is at the south-east corner of the site at: 4599 River Shore Road, Portsmouth, VA 23703 and can be contacted at 757-201-7605.

Access to the site is limited by fencing and access gates and requires USACE approval.

1.2.4 Safety Requirements

See Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS and EM 385-1-1.

1.3 TRANSPORTATION FACILITIES

The Facility is served by a secondary compact soil, unpaved roads around the perimeter with three connecting cross roads. Road(s) within the Facility that the Contractor proposes to be used shall be subject to prior approval of the Facility authorities. Haul and connecting roads used by Contractor shall be maintained throughout construction and shall be restored to as good condition as existed prior to their use. The Contractor shall also construct, subject to approval, such temporary haul roads and bridges as may be deemed necessary for conducting his work. Any such temporary construction shall be removed and the affected area restored to its original condition before demobilization from the site.

All costs for the use of existing transportation facilities, for the construction of temporary facilities, and for maintenance, repair, removal and restoration shall be borne by the Contractor. The condition of the construction access route roadways shall be documented in writing and supplemented with pictures and video. The report shall be submitted to the Contracting Officer prior to starting the construction. Any existing roads, structures, or utilities damaged by moving equipment and materials to the construction site and during construction shall be repaired and/or replaced by the Contractor at no additional cost to the government.

SECTION 01 11 00 Page 5

1.3.1 Use of Roads

Hard-surfaced paved and unpaved roads from major and primary municipal roads serve the exterior side of the site. The movement of all vehicles shall be confined to the roads designated and shall comply with traffic regulations. The Contractor shall keep all roads clear of all obstructions and free of mud and other foreign materials resulting from operations.

The Contractor's vehicles shall at no time follow a vehicle closer than 50 feet, and all vehicles shall pull off the road and come to a complete stop when meeting emergency vehicles, or vehicles with flashing lights. Speed limits and traffic controls shall be observed.

1.3.2 Cleated Vehicles

Cleated vehicles shall not be moved over surfaced roads except at the immediate site of the area where they are to be used.

1.4 SPECIAL CONTRACTOR REQUIREMENTS

1.4.1 COORDINATION IN WORK AREAS

1.4.1.1 Sharing of Roadways and Work Areas

During the period of this contract, in addition to Government personnel and equipment working at the site, other contractors may be on the island for the construction of other features of work that is on or adjacent to the site being accomplished under this contract. This work includes the pumping of new dredge material into the storage cells using pipelines from the bay;

and dike, borrow area and road work. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other Contractors. 1.7 HISTORICAL AND ARCHAEOLOGICAL FINDS

Federal legislation provides for the protection, preservation, and collection of scientific, prehistoric, historical, and archaeological data, including relics and specimens which might otherwise be lost due to alteration of the terrain or building features as a result of any Federal construction project. Should the Contractor, or any of the Contractor's employees, or parties operating or associated with the Contractor, in the performance of this contract discover evidence of possible scientific, prehistoric, historical, or archaeological data, the Contractor shall immediately cease work at that location, avoid further disturbance, and notify the Contracting Officer, giving the location and nature of the findings. The Contractor shall forward written confirmation to the Contracting Officer as directed. The Contractor shall exercise care so as not to disturb or damage artifacts or fossils uncovered during excavation operations, and shall provide such cooperation and assistance as may be necessary to preserve the findings for removal or other disposition. Any person who, without permission, injures, destroys, excavates, appropriates, or removes any historical or prehistoric artifact, object of antiquity, or archaeological resource on the public lands of the United States is subject to arrest and penalty of law. Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance or changes in the work, or both. If such delays or changes are ordered, an equitable adjustment will be made in the contract in accordance with the applicable clauses of the contract.

1.8 SUBCONTRACTS AND WORK COORDINATION

Contract Clauses "SUBCONTRACTS", "PERMITS AND RESPONSIBILITIES", and "MATERIAL AND WORKMANSHIP" are supplemented as follows:

a. Divisions or sections of specifications are not intended to control the Contractor in dividing the work among subcontractor, or to limit work performed by any trade.

SECTION 01 11 00 Page 8

b. Contractor shall be responsible for coordination of the work of the trades, subcontractors, and materials.

c. The Government or its representative will not undertake to settle any difference between the Contractor and Contractor's subcontractors, or between subcontractors.

d. The Government reserves the right to refuse to permit employment on the work or require dismissal from the work of any subcontractor who, by reason of previous unsatisfactory work on Corps of Engineers projects, or for any other reason is considered by the Contracting Officer to be incompetent or otherwise objectionable.

1.9 CONSTRUCTION MANPOWER AND EQUIPMENT REPORT

The Contractor shall submit executed CENAO Form 987, Construction Manpower and Equipment Report daily. The report shall include manpower and equipment for the general and subcontractors. Forms are available from the Contracting Officer.

1.10 PROFIT

For modifications to this Craney Dike Construction contract, profit must be calculated using the Weighted Guidelines method.

1.10.1 Weighted Guidelines

Weighted guidelines method of determining profit shall be used on any equitable adjustment change order or modification issued under this contract. The profit factors shall be as follows:

Factor Rate Weight Value

Degree of Risk 20% Relative difficulty of work 15% Size of Job 15% Period of performance 15% Contractor's investment 05% Assistance by Government 05% Subcontracting 25%

Total 100%

1.10.2 Weighted Values

Based on the circumstances of each procurement action, each of the above factors shall be weighted from .03 to .12 as indicated below. The value shall be obtained by multiplying the rate by the weight. The value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement.

1.10.2.1 Degree of Risk

Where the work involves no risk or the degree of risk is very small, the weighting should be .03; as the degree of risk increases, the weighting should be increased up to a maximum of .12. Lump sum items will have, generally, a higher weighted value than the unit price items for which

SECTION 01 11 00 Page 9 quantities are provided. Other things to consider: the portion of the work to be done by subcontractors, nature of work, where work is to be performed, reasonableness of negotiated costs, the amount of labor included in costs, and whether the negotiation is before or after performance of work.

1.10.2.2 Relative Difficulty of Work

If the work is most difficult and complex, the weighting should be .12 and should be proportionately reduced to .03 on the simplest of jobs. This factor is tied in to some extent with the degree of risk. Some things to consider: the nature of the work, by whom it is to be done, where, and what is the time schedule.

1.10.2.3 Size of Job

All work not in excess of $100,000 shall be weighted at .12. Work estimated between $100,000 and $5,000,000 shall be proportionately weighted from .12 to .05.

1.10.2.4 Periods of Performance

Jobs in excess of 24 months are to be weighted at .12. Jobs of lesser duration are to be proportionately weighted to a minimum of .03 for jobs not to exceed 30 days. No weight where additional time not required.

1.10.2.5 Contractor's Investment

To be weighted from .03 to .12 on the basis of below average, average, and above average. Things to consider: amount of subcontracting, mobilization payment item, Government furnished property, equipment and facilities, and expediting assistance.

1.10.2.6 Assistance by Government

To be weighted from .12 to .03 on the basis of average to above average.

Things to consider: use of Government owned property, equipment and facilities, and expediting assistance.

1.10.2.7 Subcontracting

To be weighted inversely proportional to the amount of subcontracting.

Where 80 percent or more of the work is to be subcontracted, the weighting is to be .03 and such weighting proportionately increased to .12 where all the work is performed by the Contractor's own forces.

1.11 BLASTING

Blasting will not be permitted for this project.

1.12 CONTRACTOR QUALITY CONTROL RESPONSIBILITY

The Contractor is fully responsible for the management and supervision associated with Quality Control of all construction work included in this contract. The Government is responsible for Quality Assurance by reviewing all Contractor documentation and work has been completed to meet contract requirements.

SECTION 01 11 00 Page 10

1.13 LIQUIDATED DAMAGES

Refer to contract clause LIQUIDATED DAMAGES – CONSTRUCTION (FAR 52.211-12) of Section 0700 CONTRACT CLAUSES in Volume 1.

1.14 PERFORMANCE BOND

The Contractor's Performance Bond shall remain effective throughout the construction period.

a. In the event the Contractor fails to commence and diligently pursue any construction warranty work required, the Contracting Officer will have the work performed by others, and after completion of the work, will charge the remaining construction warranty funds of expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.

b. In the event sufficient funds are not available to cover the construction warranty work performed by the Government at the Contractor's expense, the Contracting Officer will have the right to recoup expenses from the bonding company.

c. Following oral or written notification of required construction warranty repair work, the Contractor shall respond in a timely manner.

Written verification will follow oral instructions. Failure of the Contractor to respond will be cause for the Contracting Officer to proceed against the Contractor.

MEASUREMENT AND PAYMENT

This section describes how Line Items will be measured and paid for when making progress payments for this Craney Island (CI) Dike Construction contract. Work to be measured is described in the applicable specification sections listed for each Line Item. Measurement procedures for payment, required quantity surveys and/or procurement documentation and payment restrictions are also described in applicable specification sections.

Allocate costs for work not specifically mentioned to the Line Item most closely associated with the work involved. Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items.

This full set of seven Bid Items 0001 thru 0010 is listed three times on the contract’s Base Bid Schedule, with the first time for the Base Bid’s first year; the second time for Option Year #1; and the third time for Option Year #2. Similar work will occur during each of these three years.

The main difference in the pricing between the three years is the addition of a price escalation factors to the unit prices.

Schedule of Values for Dike Placement; G

Using the information obtained from the Contractor’s Before Dike (BD) surveys for the area specified in the Task Order, the Contractor shall submit a breakdown by Acceptance Areas for CLIN Item 0002AA – Place Material at Craney Island (CI) Dikes per BD and AD surveys. Each Task Order will require its own Schedule of Values based on the area awarded. The maximum number of acceptance areas is based on the total distance between the stations per the layout of the Government’s center line. The distance is the difference between the Task Order’s starting and ending station numbers, which is then rounded up to the nearest 10,000, and then divided by 1,000 (for example: if the length is 135+00 feet, this rounds up to 14,000 and the maxi mum number of acceptance areas is 14).

The Schedule of Values should list all acceptance areas with their starting and ending station numbers, the dike length, the calculated volume of new fill, and surface areas for clearing and grubbing and hydroseeding, the agreed upon unit price, and the total contract dollar value for each acceptance area. A Schedule of Values shall be submitted for each Task Order. See Section 01 78 00 SURVEY AND RECORD CONSTRUCTION DRAWINGS for additional information.
