SUMMARY OF WORK

PART 1 GENERAL
1.1 WORK COVERED BY CONTRACT DOCUMENTS
1.1.1 Project Description
The major features of the EOD project include the Range Area and the Range Operations Center (ROC). The range area consists of eighteen (18) training sites, sixteen (16) MOUT Sites, three (3) demolition areas, an airfield mockup area, a battlefield mockup area, and a driving range training area.
The ROC is an administration/classroom/vehicle maintenance building.
Adjacent to the ROC there will be two (2) additional training facilities -the Advanced Robotics (AR) course, and Remote Opening Site (ROS). Service roads to provide access to each objective area and landing zones will be provided or be repaired.
The sites, access roads, airfield, battlefield, and driver training area will be cleared of all debris. An existing concrete pad at the Demolition-3 area Mosque must be demolished. Extensive clearing is required at the ROC site and grubbing is required to remove organic materials. Clearing shown on the other miscellaneous sites is largely limited to debris pickup where land disturbance is to be limited. Excess materials will be stored onsite.
Typical site grading will be required for the ROC site, access roads, and range sites to achieve the proposed site elevations.
Wetland delineations have been completed and survey results indicate that there are wetlands within the project area. The wetlands delineation data was incorporated into the design and the limits of construction were ad-justed accordingly. There shall be no land disturbances or construction activities within the 35 m (100 ft) Chesapeake Bay Resource Protection Areas (RPAs). These buffers are associated with all wetlands, intermit-tent, and perennial streams located throughout the project area.
The Architectural design primarily focuses on the ROC which is 1 building;
a building containing the administrative rooms, classrooms, and vehicle maintenance rooms. The ROC building will be ADA accessible.
The proposed HVAC system for the EOD facility is geothermal heat pumps serving the interior occupied spaces requiring air conditioning and heating. Each pump will be sized for 100% of the total capacity.
The electrical work includes providing exterior building lighting, exterior telecommunications systems connectivity for down range sites back to the Range Operations Center, exterior lightning protection mast system, interior electrical distribution system, interior lighting, interior telecommunications.
The project is required to meet LEED Silver rating.
1.1.2 Location
The work shall be located in the Brandywine or eastern section of Fort AP

Hill. The site is located between US Route 17 to the north, Enon Church Road to the east, North Range Road to the south and Lumpkin Road to the west. Users will access the site from North Range Road. The exact location will be shown by the Contracting Officer.
1.2 LOCATION OF UNDERGROUND FACILITIES
Obtain digging permits prior to start of excavation by contacting the Contracting Officer 15 calendar days in advance.
1.3 Notification Prior to Excavation
Notify the Contracting Officer's authorized representative at least 15 days prior to starting excavation work.

PART 1 GENERAL
1.1 REFERENCES
The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

1.2 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00.00 50 SUBMITTAL PROCEDURES:

1.3 SCHEDULE OF PRICES
1.3.1 Data Required
This contract requires the use of a cost-loaded Network Analysis Schedule.
The information required for the Schedule of Prices will be entered as an intregal part of the Network Analysis Schedule (NAS) and its Mathematical Analysis. Within 30 calendar days of notice of award, prepare and deliver to the Contracting Officer's authorized representative a schedule of prices (construction contract) on the forms furnished by the Government. Provide a detailed breakdown of the contract price, giving quantities for each of the various kinds of work, unit prices, and extended prices therefor.
1.3.2 Construction Categories
The following construction categories apply to work covered by this specification:

CATEGORY DESCRIPTION
Divide detailed breakdown into each construction category, stated in this contract. Subcontractors who may be involved in work under more than one of these categories shall be advised of this requirement in order to furnish such data without delay. Construction categories given above may be modified by the Contracting Officer's authorized representative as necessary during course of work.
1.3.3 Schedule Instructions
Payments will not be made until the cost-loaded NAS has been submitted to and accepted by the Contracting Officer's authorized representative.
Identify the cost for site work, and include incidental work to the 5 foot line. Identify costs for the building(s), and include work out to the 5 foot line. Work out to the 5 foot line shall include construction encompassed within a theoretical line 5 feet from the face of exterior walls and shall include attendant construction, such as cooling towers, placed beyond the 5 foot line.
1.3.4 Schedule Requirements for HVAC TAB
The field work Section 23 05 93.00 10 TESTING, ADJUSTING AND BALANCING shall be broken down in the cost-loaded NAS by separate line items which reflect measurable deliverables. Specific payment percentages for each line item shall be determined on a case by case basis for each contract.
The line items shall be as follows:
a. Approval of Design Review Report: The TABS Agency is required to conduct a review of the project plans and specifications to identify any feature, or the lack thereof, that would preclude successful testing and balancing of the project HVAC systems. The resulting findings shall be submitted to the Government to allow correction of the design. The progress payment shall be issued after review and approval of the report.
b. Approval of the pre-field engineering report: The TABS Agency submits a report which outlines the scope of field work. The report shall contain details of what systems will be tested, procedures to be used, sample report forms for reporting test results and a quality control checklist of work items that must be completed before TABS field work commences.
c. Season I field work: Incremental payments are issued as the TABS field work progresses. The TABS Agency mobilizes to the project site and executes the field work as outlined in the pre-field engineering report. The HVAC water and air systems are balanced and operational data shall be collected for one seasonal condition (either summer or winter depending on project timing).
d. Approval of Season I report: On completion of the Season I field work, the data is compiled into a report and submitted to the Government. The report is reviewed, and approved, after ensuring compliance with the pre-field engineering report scope of work.
e. Completion of Season I field QA check: Contract QC and Government representatives meet the TABS Agency at the jobsite to retest
SECTION 01 20 00.00 20 Page 2 portions of the systems reported in the Season I report. The purpose of these tests are to validate the accuracy and completeness of the previously submitted Season I report.
f. Approval of Season II report: The TABS Agency completes all Season II field work, which is normally comprised mainly of taking heat transfer temperature readings, in the season opposite of that under which Season I performance data was compiled. This data shall be compiled into a report and submitted to the Government.
On completion of submittal review to ensure compliance with the pre-field engineering report scope, progress payment is issued.
Progress payment is less than that issued for the Season I report since most of the water and air balancing work effort is completed under Season I.
1.4 CONTRACT MODIFICATIONS
In conjunction with the Contract Clause "DFARS 252.236-7000, Modification Proposals-Price Breakdown," and where actual ownership and operating costs of construction equipment cannot be determined from Contractor accounting records, equipment use rates shall be based upon the applicable provisions of the EP-1110-1-8.
1.5 CONTRACTOR'S INVOICE AND CONTRACT PERFORMANCE STATEMENT
1.5.1 Content of Invoice
Requests for payment will be processed in accordance with the Contract Clause "FAR 52.232-27, Prompt Payment Construction Contracts."
a. The Contractor's invoice certified by QC, on the form furnished by the Government for this purpose, showing in summary form, the basis for arriving at the amount of the invoice. Submit original and five copies.
b. The Contract Performance Statement on the form furnished by the Government for this purpose, showing in detail, the estimated cost, percentage of completion, and value of completed performance. Submit original and two copies.
c. Final invoice shall be accompanied by Final Release Form.
d. Updated network mathematical analysis (three copies).
1.5.2 Mailing of Invoices
a. All invoices shall be forwarded with specific marking on the envelope. This marking shall be in the front lower left hand corner, in large letters, "INVOICES - ENCLOSED."
b. Invoices not completed in accordance with contract requirements will be returned to the Contractor for correction of the deficiencies.
c. Final invoices not accompanied by Final Release Form will be considered incomplete and will be returned to the Contractor.

1.6 PAYMENTS TO THE CONTRACTOR
Payments will be made on submission of itemized requests by the Contractor which comply with the requirements of this section, and will be subject to reduction for overpayments or increase for underpayments made on previous payments to the Contractor.
1.6.1 Obligation of Government Payments
The obligation of the Government to make payments required under the provisions of this contract will, at the discretion of the Contracting Officer's authorized representative, be subject to reductions and/or suspensions permitted under the FAR and agency regulations including the following in accordance with "FAR 32.503-6:
a. Reasonable deductions due to defects in material or workmanship;
b. Claims which the Government may have against the Contractor under or in connection with this contract;
c. Unless otherwise adjusted, repayment to the Government upon demand for overpayments made to the Contractor; and
d. Failure to provide up to date record drawings not current as stated in Contract Clause "FAC 5252.236-9310, Record Drawings."
1.6.2 Payment for Materials Offsite
Payments may be made to the Contractor for materials stored off construction sites under the following conditions:
a. Conditions described in the paragraph entitled "Payments to the Contractor";
b. Material within a distance of 50 miles by streets and roads to the construction site;
c. Materials adequately insured and protected from theft and exposure;
d. Materials not susceptible to deterioration or physical damage in storage or in transit to the job site are acceptable for progress payments. Items such as steel, machinery, pipe and fittings, precast/prestressed concrete piles, and electrical cable are acceptable; items such as gypsum wallboard, glass, insulation, and wall coverings are not;
e. Materials in transit to the job site or storage site are not acceptable for payment; and
f. Conditions specified in "FAR 52.232-5(b) Payments Under Fixed Price Construction Contracts."

PROJECT WORK REQUIREMENTS AND RESTRICTIONS

PART 1 GENERAL
1.1 DEFINITIONS
Facility: The facility is FT A.P. Hill
CO: Contracting Officer or his authorized representative.
1.2 SPECIAL CONTRACTOR REQUIREMENTS
1.2.1 Facility Requirements
Barricades and signs shall be posted at project areas while work is in progress to ensure safety of personnel entering or working in the area.
The Contractor shall assure that work does not interrupt the flow of storm water nor interfere with the daily operations of the base.
The Contractor shall schedule the work so as to cause as little interruption of utility services as possible. Water and electrical services shall be terminated only as necessary, and shall be restored at the end of each working day.
The Contractor shall be required to plan and coordinate the activities with the Contracting Officer in order to provide all necessary controls for the abatement of dust and noise and lessen the inconvenience to Government or non-Contractor personnel during all phases of the work.
1.2.2 Project Phasing and Performance period
The Contractor shall complete the work within the duration specified in Section 00800 "Contract Requirements".
1.2.3 STRUCTURAL DRAWING DIMENSIONS
The building layout, including both horizontal and vertical dimensions, is shown on the Architectural sheets contained in the contract drawings.
The Contractor shall use the dimensions from the Architectural sheets to obtain dimensions for foundation layout and structural members as necessary to prepare all shop drawings and fabricate structural members. There may be some instances where the Contractor shall have to adjust actual dimensions to the submitted items that he will use, to finalize the location of a structural member. Any such adjustments shall be clearly identified on the submitted shop drawings for Government review.
1.3 COOPERATION WITH USING AGENCY AND OTHER CONTRACTORS
During the period of this contract, other contracts may be in force for the construction of other features of work on or adjacent to the site of work being accomplished under this contract. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other Contractors. Should there be any conflict between these limits, it shall be brought to the attention of the

Contracting Officer(CO)and the CO's decision shall be final. Also, prior to completion of work under this contract, members of the Using Agency may be performing work or occupying facilities on or adjacent to the area. The Contractor shall arrange his plant and shall schedule and perform this work so as to effectively cooperate with all other Contractors and Government agencies.
1.4 PERSONNEL RESTRICTIONS
Personnel are limited to the immediate site areas and shall not enter buildings or facilities not involved in the work. All employees of the Contractor will be subject to all rules and regulations of the Facility which pertain to personnel. The Contractor shall erect fences and signs as specified and be responsible for the restrictions of all personnel. The Contractor's plans for restricting personnel access to the project site shall be submitted for approval as a part of the Safety Plan (Accident Prevention Plan). Facility access shall be restricted. Contractor shall comply with current security requirements. All vehicles shall be registered with the military police.
1.5 TRANSPORTATION FACILITIES
The Facility is served by an all weather surfaced road network. Road(s) within the Facility proposed to be used by the Contractor shall be subject to prior approval of the Facility authorities and such roads, if used, shall be maintained throughout construction and shall be restored to as good condition as existed prior to their use. The Contractor shall also construct, subject to approval, such temporary haul roads and bridges as may be necessary for conducting his work. Any such temporary construction shall be removed and the affected area restored to its original condition.
All costs for the use of existing transportation facilities, for the construction of temporary facilities, and for maintenance, repair, removal and restoration shall be borne by the Contractor.
1.5.1 Use of Roads
Hard-surfaced roads from major and primary municipal roads serve the Facility. The movement of all vehicles within the Facility shall be confined to the roads designated and shall comply with traffic regulations within the Facility. The Contractor shall keep all roads clear of all obstructions and free of mud and other foreign materials resulting from operations. The Contractor's vehicles shall at no time follow a vehicle closer than 50 feet, and all vehicles shall pull off the road and come to a complete stop when meeting emergency vehicles, or vehicles with flashing lights. Facility speed limits and traffic controls shall be observed.
1.5.2 Road Restrictions
The movement of all vehicles within the Facility shall be confined to the roads designated and shall comply with traffic regulations within the Facility. Other roads may be used only with the approval of the CO.
1.5.3 Cleated Vehicles
Cleated vehicles shall not be moved over surfaced roads except at the immediate site of the area where they are to be used.

1.6 COORDINATION IN WORK AREAS
1.6.1 Unoccupied Work Area
The area where the Contractor is scheduled to perform the work will not be occupied during the work, however, the Contractors work activities may affect other area(s) that are occupied. All work shall be in accordance with the Contractor's work plan.
1.6.2 Maintenance of Utilities
Any active utilities, including but not limited to electricity, gas, water, sewer, heating, air conditioning, or any like service, that will require interruption or replacement in any occupied area affected as a result of the Contractors scheduled work activities, shall be temporarily provided by the Contractor at his own expense until the affected service is fully and permanently restored. All temporary method(s) of service replacement the Contractor proposes for use on this contract shall be approved by the CO prior to commencing the work.
1.6.3 Hours of Work
The normal work hours for construction shall be from Monday through Friday of each week. Any request to change these hours shall be made in writing to the Contracting Officer at least two calendar days prior to the desired day on which the change is to go into effect. The changed hours shall not go into effect until written permission has been received from the Contracting Officer.
1.6.4 Existing Utility Location
Existing utilities must be located before doing any digging work on Facility. The Contractor shall be responsible to contact Miss Utility, obtain all necessary existing utility locations, which may be necessary to accomplish his work, and mark any utility lines in the immediate vicinity of his work. It shall be the responsibility of the Contractor to contact Miss Utilities at 1-800-552-7110 for locating commercial utilities 48 hours prior to digging operations.
1.6.5 Digging Permits
Contractor is responsible for obtaining all digging permits, including associated locating and marking services, in accordance with installation and local requirements, at no additional cost to the Government.
"Clearance Permits for Digging', must be obtained before doing any work on Facility. The Contractor shall be responsible to obtain all necessary digging permits and pay costs associated with the permit,which may be necessary to accomplish his work.
1.6.6 Personnel Escort
An authorized Contractor representative must escort all personnel attempting to obtain a badge to Security. The representative shall sign documentation that the employee meets Security criteria and is suitable for a badge to be issued.

1.7 INTERRUPTIONS OF UTILITIES
1.7.1 Approval
Utility services shall not be interrupted by the Contractor to relocate, make connections, or interrupt for any purpose, without written approval of the CO.
1.7.2 Request
Request for permission to shut down services shall be submitted in writing to the CO not less than 10 calendar days prior to date of proposed interruption.The request shall give the following information:
a. Nature of Utility (Gas, L.P. or H.P., Water, Elec.)
b. Size of line and location of shutoff.
c. Buildings and services affected.
d. Hours and date of shutoff.
e. Estimated length of time service will be interrupted.
1.7.3 Service Interruptions
Services shall not be shut off until receipt of approval of the proposed hours and date from the Contracting Officer.
1.7.4 Timely Disconnections
Shutoffs which will cause interruption of Government work operations as determined by the Contracting Officer shall be accomplished during regular non-work hours or non-work days of the Using Agency without any additional cost to the Government.
1.7.5 Utilities Operation
1.7.6 Gas
Flow in gas mains which have been shut off shall not be restored until the Government inspector has determined that all items serviced by the gas line have been shut off.
1.8 PHYSICAL DATA
The physical conditions indicated on the drawings and in the specifications are the result of site visits, and surveys.
1.9 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "Default: (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, SECTION 01 30 00.10 50 Page 4 more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
1.9.1 Schedule
The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

1.9.2 Records
Upon acknowledgement of the Notice to Proceed and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day.
1.9.3 Impacted Days
The number of actual adverse weather days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day in each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in the schedule of monthly anticipated adverse weather delays, above, the contracting officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Contract Clauses entitled "Default (Fixed Price Construction)".
1.10 IDENTIFICATION OF GOVERNMENT-FURNISHED PROPERTY
The Government will furnish to the Contractor the property identified in the Schedule below to be incorporated or installed into the work or used in performing the contract. The listed property will be furnished f.o.b.
railroad cars at the place specified in the contract Schedule or f.o.b.
truck at the project site. The Contractor is required to accept delivery, pay any demurrage or detention charges, and unload and transport the property to the job site at its own expense. When the property is delivered, the Contractor shall verify its quantity and condition and acknowledge receipt in writing to the Contracting Officer. The Contractor shall also report in writing to the Contracting Officer within 24 hours of delivery any damage to or shortage of the property as received. All such property shall be installed or incorporated into the work at the expense of

1.11 SITE CONTAMINATION
This site is designated a Category I site and is defined as a site that is located in a traditional non-hazardous location, such as in an administrative, recreation, or housing area and that the Government has no reason to suspect contamination.
1.11.1 Contamination Removal
In the event that contamination beyond that shown or specified is encountered, the Contracting Officer shall be advised immediately. The contamination shall be removed as directed and replaced with satisfactory material. Payment therefore will be made in conformance with the CHANGES clause of the CONTRACT CLAUSES.
1.11.2 Compliance Requirements
The Contractor shall comply with applicable Federal, state and local laws, codes, ordinances and regulations (including the obtaining of licenses and permits) in connection with any hazardous material, substance or waste.
1.11.3 Requirements
The requirements of this clause and any act or failure to act by the Government shall not relieve the Contractor of any responsibility or liability for the safety of Government, Contractor or subcontractor personnel or property.
1.12 WORK IN QUARANTINED AREA
The work called for by this contract involves activities in counties quarantined by the Department of Agriculture to prevent the spread of certain plant pests which may be present in the soil. The Contractor agrees that all construction equipment and tools to be moved from such counties shall be thoroughly cleaned of all soil residues at the construction site with water under pressure and that hand tools shall be thoroughly cleaned by brushing or other means to remove all soil. In addition, if this contract involves the identification, shipping, storage, testing, or disposal of soils from such a quarantined area, the Contractor agrees to comply with the provisions of ER 1110-1-5 and attachments, a copy of which will be made available by the Contracting Officer upon request.
The Contractor agrees to assure compliance with this obligation by all subcontractors.
1.13 HISTORICAL AND ARCHAEOLOGICAL FINDS
Federal legislation provides for the protection, preservation, and collection of scientific, prehistoric, historical, and archaeological data, SECTION 01 30 00.10 50 Page 6 including relics and specimens which might otherwise be lost due to alteration of the terrain or building features as a result of any Federal construction project. Should the Contractor, or any of the Contractor's employees, or parties operating or associated with the Contractor, in the performance of this contract discover evidence of possible scientific, prehistoric, historical, or archaeological data, the Contractor shall immediately cease work at that location, avoid further disturbance, and notify the Contracting Officer, giving the location and nature of the findings. The Contractor shall forward written confirmation to the Contracting Officer as directed. The Contractor shall exercise care so as not to disturb or damage artifacts or fossils uncovered during excavation operations, and shall provide such cooperation and assistance as may be necessary to preserve the findings for removal or other disposition. Any person who, without permission, injures, destroys, excavates, appropriates, or removes any historical or prehistoric artifact, object of antiquity, or archaeological resource on the public lands of the United States is subject to arrest and penalty of law. Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance or changes in the work, or both. If such delays or changes are ordered, an equitable adjustment will be made in the contract in accordance with the applicable clauses of the contract.
1.14 EQUIPMENT-IN-PLACE LIST:
The Contractor shall maintain a list of equipment installed under the terms of the contract. In the event that the contract includes more than one building or facility, a list must be maintained for each and delivered to the Contracting Officer upon acceptance of each building or facility.
Forms to be used for this purpose shall be obtained from the Area Engineer's Office. The list shall include the following:

1.15 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE
1.15.1 Allowable Costs
Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a Contractor or subcontractor at any tier shall be based on actual cost data when the Government can determine both ownership and operating costs for each piece of equipment or equipment groups of similar serial and series from the Contractor's accounting records. When both ownership and operating costs cannot be determined from the Contractor's accounting records, equipment costs shall be based upon the applicable provisions of EP 1110-1-8, "Construction Equipment Ownership and Operating Expense Schedule," Region II. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using
SECTION 01 30 00.10 50 Page 7 the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retrospective pricing, the schedule in effect at the time the work was performed shall apply.
1.15.2 Rental Costs
Equipment rental costs are allowable, subject to the applicable provisions of the Federal Acquisition Regulations, and shall be substantiated by certified copies of paid invoices. Rates for equipment rented from an organization under common control, lease-purchase or sale-leaseback arrangements will be determined using the schedule except that rental costs leased form an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees are allowable. Costs for major repairs and overhaul are unallowable.
1.15.3 Equipment Costs
When actual equipment costs are proposed and the total amount of the pricing action is over $25,000, cost or pricing data shall be submitted on the Standard Form 1411, "Contract Pricing Proposal Cover Sheet". By submitting cost or pricing data, the Contractor grants to the Contracting Officer or an authorizing representative the right to examine those books, records, documents and other supporting data that will permit evaluation of the proposed equipment costs. After price agreement the Contractor shall certify that the equipment costs or pricing data submitted are accurate, complete and current.
1.16 SUBCONTRACTS AND WORK COORDINATION
Contract Clauses "SUBCONTRACTS", "PERMITS AND RESPONSIBILITIES", and "MATERIAL AND WORKMANSHIP" are supplemented as follows:
a. Divisions or sections of specifications are not intended to control the Contractor in dividing the work among subcontractor, or to limit work performed by any trade.
b. Contractor shall be responsible for coordination of the work of the trades, subcontractors, and materials.
c. The Government or its representative will not undertake to settle any difference between the Contractor and Contractor's subcontractors, or between subcontractors.
d. The Government reserves the right to refuse to permit employment on the work or require dismissal from the work of any subcontractor who, by reason of previous unsatisfactory work on Corps of Engineers projects, or for any other reason is considered by the Contracting Officer to be incompetent or otherwise objectionable.
1.17 CONSTRUCTION MANPOWER AND EQUIPMENT REPORT
The Contractor shall submit executed CENAO Form 987, Construction Manpower and Equipment Report daily. The report shall include manpower and equipment for the general and subcontractors. Forms are available from the Contracting Officer.

1.18 PURCHASE ORDERS
To ensure proper expediting of orders the Contractor and his subcontractors shall furnish to the Contracting Officer, one copy of each purchase order covering supplies or services required for performance of the work. Each purchase order shall clearly indicate the date of placement, the date delivery is required in order to avoid delay in the scheduled progress of the work, and the date delivery is promised by the supplier or producer.
Copies of purchase orders shall be forwarded on the date issued.
1.19 PROFIT
1.19.1 Weighted Guidelines
Weighted guidelines method of determining profit shall be used on any equitable adjustment change order or modification issued under this contract. The profit factors shall be as follows:

1.19.2 Value
Based on the circumstances of each procurement action, each of the above factors shall be weighted from .03 to .12 as indicated below. The value shall be obtained by multiplying the rate by the weight. The value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement.
1.19.2.1 Degree of Risk
Where the work involves no risk or the degree of risk is very small, the weighting should be .03; as the degree of risk increases, the weighting should be increased up to a maximum of .12. Lump sum items will have, generally, a higher weighted value than the unit price items for which quantities are provided. Other things to consider: the portion of the work to be done by subcontractors, nature of work, where work is to be performed, reasonableness of negotiated costs, amount of labor included in costs, and whether the negotiation is before or after performance of work.
1.19.2.2 Relative Difficulty of Work
If the work is most difficult and complex, the weighting should be .12 and should be proportionately reduced to .03 on the simplest of jobs. This factor is tied in to some extent with the degree of risk. Some things to consider: the nature of the work, by whom it is to be done, where, and what is the time schedule.
1.19.2.3 Size of Job
All work not in excess of $100,000 shall be weighted at .12. Work

1.19.2.4 Periods of Performance
Jobs in excess of 24 months are to be weighted at .12. Jobs of lesser duration are to be proportionately weighted to a minimum of .03 for jobs not to exceed 30 days. No weight where additional time not required.
1.19.2.5 Contractor's Investment
To be weighted from .03 to .12 on the basis of below average, average, and above average. Things to consider: amount of subcontracting, mobilization payment item, Government furnished property, equipment and facilities, and expediting assistance.
1.19.2.6 Assistance by Government
To be weighted from .12 to .03 on the basis of average to above average.
Things to consider: use of Government owned property, equipment and facilities, and expediting assistance.
1.19.2.7 Subcontracting
To be weighted inversely proportional to the amount of subcontracting.
Where 80 percent or more of the work is to be subcontracted, the weighting is to be .03 and such weighting proportionately increased to .12 where all the work is performed by the Contractor's own forces.

PART 1 GENERAL
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only or as otherwise designated. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section

Physical examples of materials, equipment or workmanship that illustrate functional and aesthetic characteristics of a material or product and establish standards by which the work can be judged.
Color samples from the manufacturer's standard line (or custom color samples if specified) to be used in selecting or approving colors for the project.
1.2 COLOR/FINISH BOARDS
Submit five sets of color boards within 63 calendar days after notice to proceed. The samples shall be presented on 8-1/2 by 11 inch boards (modules) with a maximum spread of 24 by 31 1/2 inches for foldouts.
Modules shall be designed to fit in a standard loose-leaf, three-ring binder. Where special finishes such as architectural concrete, carpet, or prefinished textured metal panels are required, samples not less than 12 inches square shall be submitted with the board. If more space is needed, more than one board per set may be submitted. The Contractor shall certify that he has reviewed the color samples in detail and that the color samples are in accordance with contract drawings and specifications, except as may be otherwise explicitly stated. Submittal of color samples shall not relieve the Contractor of the responsibility to submit samples required elsewhere herein. Submittals shall be complete; Sheets containing samples shall consist of heavy, medium gray illustration board (not white or colored) capable of supporting a four inch by eight inch quarry tile without distorting the binder release or causing sheet tear-out due to hole failure. The sample board backing material shall be of sufficient strength to maintain its original configuration after samples have been attached to it for the duration of the construction.

1.2.1 Interior color/finish boards
Interior color/finish boards shall have attached samples of all interior appearance related construction items the Contractor proposes to furnish, including, but not limited to such items as interior paints; wood finishes;
ceramic tile; floor coverings; wall coverings; ceiling tiles; plastic laminates; solid surface materials; signage, etc.
1.2.2 Exterior color/finish boards
Exterior color/finish boards shall have attached samples of all exterior appearance related construction items the Contractor proposes to furnish, including but not limited to such items as brick, mortar, paints, window and door frames, roof, soffits, pre-cast units, gutters, and downspouts, etc.
1.2.3 Content
Color board shall consist of all samples, a finish schedule, floor plan, and interior elevations with each clearly indicating the location of each finish/color. Items other than material sample boards may be folded to 8-1/2" by 11" (i.e., floor plans, finish schedules etc.).
1.2.4 Identification
Identify each sample by use, location, and manufacturer's name. Group according to the location where each used.
1.2.5 Approval
Upon final approval, the Contractor shall prepare and submit to the Contracting Officer's authorized representative one set of the approved and corrected color/finish sample boards.
1.3 VIEW LOCATION MAP
Submit to the Contracting Officer's authorized representative, prior to or with the first digital photograph submittals, a sketch or drawing indicating the required photographic locations. Update as required if the locations are moved.
1.4 PROGRESS AND COMPLETION PICTURES
Provide monthly, and within one month of the completion of work, digital photographs, 1600 x 1200 x 24 bit truecolor minimum resolution in JPEG file format showing the sequence and progress of work. Take digital photographs prior to the seventh day of each month from a minimum of ten views from points located by the Contracting Officer's authorized representative.
Submit a sketch or drawing indicating points of view. Submit with the monthly invoice two sets of digital photographs each set on a separate CD-R, cumulative of all photos to date. Cross reference submittals in the appropriate daily report.
1.5 SUPERVISION
Contractor shall have at least one qualified supervisor capable of reading, writing, and conversing fluently in the English language on the job site during working hours. In addition, if a Quality Control (QC) representative is required on the contract, then that individual shall also

1.6 PARTNERING
LEVEL B PARTNERING: To most effectively accomplish this contract, the Government requires the formation of a cohesive partnership with the contractor and its subcontractors. In addition, other key personnel, including the client who will occupy the facility, the designer-of-record, principal individuals from the Government, the project sponsor, and the representative(s) of the facility owner will also be invited to participate in the partnering process. The partnering relationship is based upon trust, dedication to common goals, an understanding of each other's expectations and values, and a commitment to success. The goals of the partnering process are improved communication, efficiency and cost effectiveness, increased opportunity for innovation, and the continuous improvement of product quality. The partnership will strive to draw on the strength of each organization in an effort to achieve a quality project done right the first time, within budget, on schedule, and without any safety mishaps, thereby providing the opportunity for the contractor to make a reasonable profit.
Anticipate that the initial session will be one-day and the follow-on session(s), held at a minimum of once every three months or as agreed to by the partners, will be half-day. The initial partnering session shall be held away from the project site location; the follow-on session(s) can be held at locations agreed to by the partners. Key members of the prime and subcontractors teams, including senior management, must participate. Level B partnering sessions are facilitated by in-house facilitators (a trained facilitator from an EFD/A, another ROICC office, another Government agency, or from a contractor association). The contractor shall pay all costs associated with the partnering effort, including facilitator, meeting room, audio-visual equipment, refreshments, and working meals. All participants are responsible for the costs for their own meals, lodging, and transportation required in order to attend the partnering session.
1.7 AVAILABILITY OF CADD DRAWING FILES
After award and upon request, the electronic "Computer-Aided Drafting and Design (CADD)" drawing files will be made available to the Contractor for use in preparation of construction data related to the referenced contract subject to the following terms and conditions.
Data contained on these electronic files shall not be used for any purpose other than as a convenience in the preparation of construction data for the referenced project. Any other use or reuse shall be at the sole risk of the Contractor and without liability or legal exposure to the Government.
The Contractor shall make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files. The Contractor shall, to the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic files.
