SECTION 00120

SECTION 00120 PROPOSAL EVALUATIONS AND BASIS FOR AWARD

1. GENERAL INFORMATION

1.1 ACQUISITION APPROACH. This is a competitive acquisition using the Low Price Technically Acceptable source selection process for the award of a firm fixed-price construction contract. This process will allow an award made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. This acquisition will use FAR Part 15 and is intended to minimize the complexity of the solicitation, the evaluation, and the source selection decision while maintaining a process designed to foster an impartial and comprehensive evaluation of the offeror’s proposals, leading to selection of the proposal representing the best value to the Government.

The primary NAICS code for work under this procurement is 238210 (Electrical Contractors and Other Wiring Installation Contractors) which has a size standard of fifteen million dollars ($15,000,000) in average annual receipts.

In accordance with FAR 19.705-2, the following actions were taken to determine whether a subcontracting plan is required for this acquisition: (a) determine if the proposed contractual action meets the dollar threshold ($1.5M for construction) at 19.702(a)(1); (b) determine if subcontracting possibilities exist by considering (1) if firms engaged in the business subcontract for performance or maintain sufficient in-house capabilities to perform work, and (2) likelihood for the need to prequalify products. A review of the requirements of the work indicates that subcontracting opportunities exist. This work requires a variety of disciplines to include structural, mechanical, electrical, controls, and equipment demolition and disposal. Based on this determination, if the offeror is a large business, a subcontracting plan is required to be submitted with the proposal.

As prescribed in FAR Part 19.708(b)(1), the solicitation includes FAR clause 52.219-9, Small Business Subcontracting Plan, Alternate II. The Small Business Subcontracting Plan is not a requirement for evaluation in source selection, but rather a requirement for award to a large business concern. The Subcontracting Plan will be incorporated into the resultant contract and the contractor’s implementation of Subcontracting Plan evaluated as part of the project evaluation completed in the Government’s Contractor Performance Assessment Reporting System (CPARS).

1.2 BASIS OF AWARD. Award will be made to the acceptable proposal meeting or exceeding the technical acceptability standards for non-cost factors and is the lowest price of all acceptable proposals. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors.

1.3 EVALUATION OF THE TECHNICAL PROPOSAL. The Technical Proposal will be evaluated based on the criteria identified in the individual attachments for the Factors. Failure to demonstrate the minimum acceptability standards under ANY factor will result in an “UNACCEPTABLE” rating and elimination from further consideration for contract award.

1.4 EVALUATION OF THE PRICE PROPOSALS

1.4.1 Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

1.4.2 The otherwise technically-acceptable, lowest-priced offeror may be required to confirm its price on a CLIN, element, or total price basis, and/or provide additional information in support of their price, prior to contract award.

1.5 SUBMISSION REQUIREMENTS AND EVALUATION MINIMUM REQUIREMENTS

2) FACTOR 2 – PAST PERFORMANCE

Table C-2: Past Performance Acceptable/Unacceptable Ratings

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Past performance shall be used as an evaluation factor within the LPTA process. It shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table above. The Past Performance evaluation will consider such things as an Offeror’s business practices, customer relationship, ability to successfully perform as proposed and other considerations as described in Performance sub-factors, elements and other considerations.

[*Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”]

The past performance evaluation will assess the offeror’s probability of meeting the minimum solicitation requirements. This assessment is based on the offeror’s record of relevant past performance information that pertain to the products and/or services outlined in the solicitation requirements.

The past performance evaluation will be used to determine if the offeror’s present/past performance is relevant or not relevant to the effort to be acquired. The criteria to establish what is relevant shall be unique to each LPTA source selection. Therefore, the solicitation shall establish the criteria for relevancy in relation to the specific requirement being procured. In establishing what is relevant for the acquisition, consideration will be given to the aspects of an offeror’s contract history that would give the most confidence that the offeror will satisfy the current procurement.

2.1.1 Submission Requirements:

2.1.1.1 Past Performance Information (PPI) is to be provided for the projects listed on the Offeror and Subcontractor Experience Information Forms submitted in Factor 1.
