The following have been modified:

Portions of this solicitation are altered as follows:

(1) Revises Section 00 21 13 - Instruction to Bidders as follows:

IMPORTANT BID NOTES
(THE ABOVE SOLICITATION SECTION 00 10 00 IS TO BE USED BY BIDDERS TO SUBMIT THEIR BIDS;
IT IS ALSO CONSIDERED THE “BID SCHEDULE” AS TERMED THROUGHOUT THE SOLICITATION.)
BID CONDITIONS:
a. From this Solicitation, the Government intends to award one firm-fixed price construction contract to the responsive, responsible bidder submitting the lowest aggregate price for all Items. The intent is to immediately award the base and option items at the time of award.
b. Federal Acquisition Regulation (FAR) Subpart 14.301, provides the “responsiveness of bids” provision, bidders must comply with all material respects of this Solicitation (Invitation for Bids) to be considered for the resulting award.
Accordingly, bids submitted by EMAIL must be in compliance with the submission requirements discussed below. (Refer to clause 52.214-5 at Section 00 21 13 of this Solicitation)
c. Split or multiple awards will not result from this Solicitation.
d. STANDARD FORM (SF) 1442: Bidders must complete all required areas located on Page 2 of the Solicitation document (SF 1442 Back) - refer to Block’s 14 through 20C.
e. Bidders must acknowledge receipt of all Solicitation amendments on the Standard Form https://sam.gov/
(SF) 1442 in the space provided OR, by completing Blocks 8 and 15 of the Amendment Form itself (Standard Form 30).
f. PRICE SCHEDULE: The total evaluated price for the work shall be based on the TOTAL of all BASE AND REPLACE (OVER and ABOVE WORK) line items included in the Bid Schedule. The Contractor shall enter both its unit price and extended price next to each Bid Contract Line Item Number (CLIN). Offerors/bidders shall bid ALL items in the Bid Schedule, with no exceptions. Should a Contractor fail to fully complete the bid schedule, its bid will not be considered responsive to the solicitation and eligible for the resultant contract award.
g. BID GUARANTEE: Bidders are required to submit with their bid, a Bid Guarantee for this project in accordance with the Federal Acquisition Regulation Clause 52.228-1, “Bid Guarantee” – Refer to Solicitation Section 00 21 00 for the full text of this Clause.
Any bidder failing to submit a Bid Guarantee will be considered non- responsive to the Solicitation and ineligible for award. A bid guarantee shall be submitted at 20% of the bid price or $3M whichever is the lesser.
h. PREAWARD SURVEY FORM – The bidder shall complete and submit the preaward survey form with the bid. The preaward survey form aids in expediting the award of this project. The Government will survey, as part of making an affirmative determination, the apparent successful bidder.
i. SECTION 00 45 00 (REPRESENTATIONS AND CERTIFICATIONS): The bidder must complete the representations and certifications, and submit along with all other documents required by this Solicitation. In order to place a bid in response to this Solicitation, the bidder must be registered in an “active status” at the System for Award Management (SAM) (registration can be completed on line for free at www.sam.gov).
Accordingly, any bid furnished without an active registration at SAM may be considered non-responsive to the material requirements of this Solicitation and ineligible for award.
j. A small business joint venture offeror must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with 52.204-8(d) for the following categories:
(A)Small business;
(B)Service-disabled veteran-owned small business;
(C)Women-owned small business (WOSB) under the WOSB Program;
(D)Economically disadvantaged women-owned small business under the WOSB Program; or (E)Historically underutilized business zone small business.

The only authorized transmission method for bids/proposals in response to this solicitation is electronically via the PROCUREMENT INTEGRATED ENTERPRISE ENVIRONMENT (PIEE) system. NO OTHER TRANSMISSION METHODS (EMAIL, FACSIMILE, REGULAR MAIL, HAND
CARRIED, ETC.) WILL BE ACCEPTED.

TEHCNICAL DIFFICULTIES: It is the Offeror’s responsibility to obtain written confirmation of receipt of all electronic files of the full proposal by the Contracting office. In the event that the Solicitation Module is down, the alternate method for proposal submission is via email the Contracting Officer and Contract Specialist. The Offeror must obtain prior approval from the Contracting Officer to use the alternate submission method. “In the unlikely event the PIEE system is not operational, experiences technical difficulties, or a Contractor is temporarily unable to access or use the system, the Contractor shall immediately notify the Contracting Officer. This Notification must occur prior to the submission deadline. Contractor notification shall be in writing and may be in conjunction with verbal notification, but verbal notification alone shall not be sufficient.
In the event that the Contractor alleges technical difficulties and does not notify the contracting officer until after the closing date and time, the contracting officer will determine the Contractor’s bid/proposal submission as late. All bids/proposals received after the exact time specified for receipt shall be treated as late submissions and will not be considered except under facts and circumstances allowed by the Federal Acquisition Regulation (FAR).
FORMAT OF BIDS/PROPOSALS:
(1) Electronic copies of each volume shall be compatible with the current software products: Adobe
Acrobat Reader and Microsoft Office Suite. Narrative portions of the proposal shall be in Adobe Acrobat portable document file (pdf) searchable text format. The Offeror shall not embed sound or video (e.g., MPEG) files into the proposal files. Electronic files shall be clearly identified for each volume, section, and item. Offerors are responsible for ensuring electronic copies are virus-free and shall run an anti-virus scan before submission. The Bidder/Offeror shall verify all contents of its attachments to ensure they are readable and in full compliance with the Solicitation requirements.
(2) Submission limitations: twenty-five (25) maximum files per upload (total size cannot exceed 8GB).
You may use compression utility software such as WinZip or PKZip to reduce file size and facilitate transmission. It is the responsibility of the contractor to determine the size of its electronic file.
Should the Bidder need to break up its submittal, it may provide separate attachment to avoid exceeding the size limit.
(3) FILE DESCRIPTION: Include a “File Description” for each file(s) you upload in the following format: CUI_SP_PROPIN_Solicitation Number_Volume No._ Firm Name. For example, CUI_SP_PROPIN _W912P62xR000x_Volume I_ USACE. The “File Description” will be included in the email notice to each of the recipients you choose to have access your file(s). Solicitation Section 00 22 13).
SUBMISSION DATE AND TIME:
(1) Bid’s are due one hour prior the time specified on Page 1 of this
Solicitation, Block #13a. Bid’s are due on the date and time specified on Page 1 of this Solicitation, Block #13a. Please note, FAR Subpart 14.302 Bid submission; “Bids shall be submitted so that they will be received in the office designated in the invitation for bids not later than the exact time set for opening of bids.” The District is in the Eastern Time Zone.
(2) RECEIPT OF SUBMISSIONS: For the purposes of establishing whether a bid/proposal submission is considered timely, the Government considers the date and time the submission is completely uploaded and posted into the PIEE website, which requires a PIEE electronic signature.
(3) The PIEE electronic signature process requires time to obtain through PIEE, a digital pin. Bidders/Offerors are responsible for allotting sufficient time to obtain this pin during the submission process in order to complete the PIEE signing and posting process prior to the date and time for submission. Once an offeror successfully signs and posts the offer, PIEE will send official submission date and time email to government Contracting Officials; it is the responsibility of the Offeror to confirm receipt of proposal.
Do not assume that electronic communication is instantaneous. It can take several minutes or, in some cases, hours. Bidders/Offerors are responsible for ensuring that bids/proposals are submitted reach the designated location in time, thus responsible for allowing sufficient time for submission.
VIRTUAL BID OPENING:

The bids will be read aloud and individuals will be able to view the Bid Primary information on the WEBEX screen as the bids are opened. Should technological issues ensue from the visual viewing at the WEBEX, the audio access will take precedence and satisfy the conditions of bids being communicated publicly/read aloud. Within 3 days prior to the bid opening, the government will provide a meeting link with a password and phone number at the sam.gov website (https://sam.gov), wherein the Solicitation package is published.
BIDDER QUESTIONS MUST SUBMIT USING PROJNET
Submit solicitation questions only [not bids or proposals] via Bidder Inquiry in ProjNet at https://www.ProjNet.org/ProjNet. As noted below, bidders/offerors shall not submit their proposals via ProjNet. Bidders will need to be a current registered user or self-register into the system. The Projnet call center operates weekdays from 8AM to 5PM U.S. Central Time Zone (Chicago); their telephone number is 800-428-HELP.

Specific Instructions for ProjNet Bid Inquiry Access:
1. From the ProjNet home page linked above, click on Quick Add on the upper right side of the screen.
2. Identify the Agency. This should be marked as USACE.
3. Key. Enter the Bidder Inquiry Key listed above.
4. Email. Enter the email address you would like to use for communication.
5. Select Continue. A page will then open stating a user account was not found and will ask you to create one using the provided form.
6. Enter your First Name, Last Name, Company, City, State, Phone, Email, Secret
Question, Secret Answer, and Time Zone. Make sure to remember your Secret Question and Answer as they will be used from this point on to access the ProjNet system.
7. Select Add User. Once this is completed you are now registered within ProjNet and are currently logged into the system.
NOTES:
1. Bidders/offerors are requested to review the specification in its entirety and to review the Bidder Inquiry System for answers to questions prior to submission of a new inquiry. Bidders will receive an acknowledgement of their question via email, followed by an answer to their question after it has been processed by our technical team.
Information concerning the status of the evaluation and/or award will NOT be available after receipt of bids/proposals.
2. Bidders/offerors may submit only one question per inquiry. All inquiries containing multiple questions will be rejected. Only questions pertaining to the Design Services Indefinite Delivery Contract will be entertained.
3. Government responses to technical inquiries and questions relating to proposal procedures that are submitted to ProjNet in accordance with the procedures above are not binding on the Government unless an amendment is issued on beta.SAM.gov. In the case of any conflicts, the last posted notice or, if applicable, amendment posted to beta.SAM.gov governs. Any changes or revisions to the solicitation Notice will be issued on beta.SAM.gov.
4. The ability to enter technical inquiries and questions relating to proposal procedures will be disabled ten (10) calendar days prior to the closing date stated in this solicitation Notice. No Government responses will be entered into the ProjNet system within five
(5) calendar days prior to the closing date stated in this solicitation Notice.

a. For future access to ProjNet, you will not be emailed any type of password. You will utilize your Secret Question and Secret Answer to log in.
b. From the ProjNet home page linked above, click on Quick Add on the upper right side of the screen.

e. Email. Enter the email address you used to register previously in ProjNet.

RESPONSIBLE PROSPECTIVE CONTRACTORS
Bidders/offerors must be found to be responsive and responsible in order to be considered for award. See FAR Subpart 9.1, Responsible Prospective Contractors for more information. To assist the Government in establishing the responsibility of bidders/offerors, bidders/offerors must be registered in sam.gov, submit a complete the following Preaward Survey Form, and submit the required representations and certifications included in this solicitation in Section 00 45 00. In accordance with FAR 9.104-1(d), the Government may use Contractor Performance Assessment Reporting System (CPARS) and/or references to determine if a bidder has satisfactory performance records. Offerors may submit a statement regarding previous experience in performing comparable work, business and technical organization, financial resources, and other plant available to be used in performing the work.
REGISTRATION IN SAM
The System for Award Management (SAM) is the Government’s online database of federal contractors.
Contractors self-register in SAM at the website www.sam.gov . Registration is free to all users. In accordance with FAR Provision 52.204-7 SYSTEM FOR AWARD MANAGEMENT, an bidder/offeror must be registered in SAM when submitting an offer, and must continue to be registered until time of award, during performance, and through final payment of any contract. Bidders/offerors shall complete and submit any additional full text certifications that are included in the solicitation. A bidder/offeror may also complete the certifications at https://www.sam.gov in lieu of completing the representations and certifications in this solicitation provided that all the FAR and DFARS certifications contained in the solicitation have been completed. All Bidders/offerors shall be registered at https://www.sam.gov with the NAICS code that is shown on the front page of the solicitation prior to submitting an offer.
