Section 00 00 00 - Procurement and Contracting Requirements

BRIEF DESCRIPTION OF NEED

The U.S. Army Corps of Engineers, Pittsburgh District, has a project to refurbish an existing electrical geared traction elevator at Monongahela River Charleroi Locks and Dam in Westmoreland County, Pennsylvania. The existing elevator is in the land-wall dam pier house. The major features of the requirements are identified below:

1. Removal and replacement of the electric geared traction elevator driving machine, existing controls, control wiring, power cables, car fixtures and controls, all travel cables, suspension cables and the governor assembly and rope. The existing car, crosshead, safety plank and deflector sheaves shall be inspected and reused if in satisfactory condition.

2. Install the Elevator Machine room Split System Air Conditioner, Heat Pump and all associated control wiring. Also provide 30A non-fused disconnect switch for outdoor condenser unit.

3. Remove and upgrade existing light fixtures.

4. Remove and upgrade existing receptacles in cab, hoistway and machine room with GFCI receptacles.

5. Remove and upgrade existing elevator disconnect switch.

6. Install heat detector in hoistway and machine rooms. Install smoke detector in each lobby area of the elevator. All wiring shall go back to the Elevator Control Panel.

7. Testing new elevator control and functions.

Disposal of electrical equipment will be required. Hazardous materials will be disposed of in accordance with all federal, state and local regulations. Ferrous and all other construction waste material will be disposed of at commercially permitted facilities licensed to accept waste or recyclable materials as applicable.

00 21 00-1 LOCATION AND DESCRIPTION OF WORK

Location. The work is located at Charleroi Locks and Dam, Monongahela River, Westmoreland County, Pennsylvania.

Description of Work. This work package will include removal and replacement of the existing elevator with non-proprietary elevator controls, geared traction machine, magnetic tape landing system, Hollister-Whitney Rope Gripper, hoist cables, governor & tail sheave, governor cable, car guide rollers, car door equipment, car doors, door operator, door zone unlocking device, door protection, hoistway door equipment, hoistway doors, hoistway door unlocking device, car top inspection station, fire service operation, car operating panel, dedicated heating and cooling system for elevator machinery space, electrical upgrades, and fire alarm upgrades.

00 21 00-2 MAGNITUDE OF THE WORK

The estimated cost of the proposed work is between $250,000 to $500,000.

52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS--SECONDARY SITE OF THE WORK (MAY

2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements,of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3 Million, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.233-2 SERVICE OF PROTEST (SEP 2006)

52.236-27 SITE VISIT (CONSTRUCTION) (FEB 1995) – ALTERNATE I (FEB 1995)

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

(b) An organized site visit has been scheduled for--

Approved foreign nationals may provide the passport of their country of citizenship;

(ii) Safety boots are required.

Section 00 21 13 - Instructions to Bidders

INSTRUCTIONS TO BIDDERS

(THE ABOVE SOLICITATION SECTION 00 10 00 IS TO BE USED BY BIDDERS TO SUBMIT THEIR BIDS;

IT IS ALSO CONSIDERED THE “BID SCHEDULE” AS TERMED THROUGHOUT THE SOLICITATION.)

BID CONDITIONS:

a. From this Solicitation, the Government intends to award one firm-fixed price construction contract to the responsive, responsible bidder submitting the lowest aggregate price for all Items. The intent is to immediately award the base and option items at the time of award.

b. Federal Acquisition Regulation (FAR) Subpart 14.301, provides the “responsiveness of bids” provision, bidders must comply with all material respects of this Solicitation (Invitation for Bids) to be considered for the resulting award.

Accordingly, bids submitted by EMAIL must be in compliance with the submission requirements discussed below. (Refer to clause 52.214-5 at Section 00 21 13 of this Solicitation)

c. Split or multiple awards will not result from this Solicitation.

d. STANDARD FORM (SF) 1442: Bidders must complete all required areas located on Page 2 of the Solicitation document (SF 1442 Back) - refer to Block’s 14 through 20C.

e. Bidders must acknowledge receipt of all Solicitation amendments on the Standard Form (SF) 1442 in the space provided OR, by completing Blocks 8 and 15 of the Amendment Form itself (Standard Form 30).

f. PRICE SCHEDULE: The total evaluated price for the work shall be based on the TOTAL of all BASE AND REPLACE (OVER and ABOVE WORK) line items included in the Bid Schedule. The Contractor shall enter both its unit price and extended price next to each Bid Contract Line Item Number (CLIN). Offerors/bidders shall bid ALL items in the Bid Schedule, with no exceptions. Should a Contractor fail to fully complete the bid schedule, its bid will not be considered responsive to the solicitation and eligible for the resultant contract award.

g. BID GUARANTEE: Bidders are required to submit with their bid, a Bid Guarantee for this project in accordance with the Federal Acquisition Regulation Clause 52.228-1, “Bid Guarantee” – Refer to Solicitation Section 00 21 00 for the full text of this Clause.

Any bidder failing to submit a Bid Guarantee will be considered non- responsive to the Solicitation and ineligible for award. A bid guarantee shall be submitted at 20% of the bid price or $3M whichever is the lesser.

h. PREAWARD SURVEY FORM – The bidder shall complete and submit the preaward survey form with the bid. The preaward survey form aids in expediting the award of this project. The Government will survey, as part of making an affirmative determination, the apparent successful bidder.

i. SECTION 00 45 00 (REPRESENTATIONS AND CERTIFICATIONS): The bidder must complete the representations and certifications, and submit along with all other documents required by this Solicitation. In order to place a bid in response to this

Solicitation, the bidder must be registered in an “active status” at the System for Award Management (SAM) (registration can be completed on line for free at www.sam.gov).

Accordingly, any bid furnished without an active registration at SAM may be considered non-responsive to the material requirements of this Solicitation and ineligible for award.

j. A small business joint venture offeror must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with 52.204-8(d) for the following categories:

(A)Small business;

(B)Service-disabled veteran-owned small business;

(C)Women-owned small business (WOSB) under the WOSB Program;

(D)Economically disadvantaged women-owned small business under the WOSB Program; or

(E)Historically underutilized business zone small business.

TEHCNICAL DIFFICULTIES: It is the Offeror’s responsibility to obtain written confirmation of receipt of all electronic files of the full proposal by the Contracting office. In the event that the Solicitation Module is down, the alternate method for proposal submission is via email the Contracting Officer and Contract Specialist. The Offeror must obtain prior approval from the Contracting Officer to use the alternate submission method. “In the unlikely event the PIEE system is not operational, experiences technical difficulties, or a Contractor is temporarily unable to access or use the system, the Contractor shall immediately notify the Contracting Officer. This Notification must occur prior to the submission deadline. Contractor notification shall be in writing and may be in conjunction with verbal notification, but verbal notification alone shall not be sufficient.

In the event that the Contractor alleges technical difficulties and does not notify the contracting officer until after the closing date and time, the contracting officer will determine the Contractor’s bid/proposal submission as late. All bids/proposals received after the exact time specified for receipt shall be treated as late submissions and will not be considered except under facts and circumstances allowed by the Federal Acquisition Regulation (FAR).

FORMAT OF BIDS/PROPOSALS:

(1) Electronic copies of each volume shall be compatible with the current software products: Adobe

Acrobat Reader and Microsoft Office Suite. Narrative portions of the proposal shall be in Adobe Acrobat portable document file (pdf) searchable text format. The Offeror shall not embed sound or video (e.g., MPEG) files into the proposal files. Electronic files shall be clearly identified for each volume, section, and item. Offerors are responsible for ensuring electronic copies are virus-free and shall run an anti-virus scan before submission. The Bidder/Offeror shall verify all contents of its attachments to ensure they are readable and in full compliance with the Solicitation requirements.

(2) Submission limitations: twenty-five (25) maximum files per upload (total size cannot exceed 8GB).

You may use compression utility software such as WinZip or PKZip to reduce file size and facilitate transmission. It is the responsibility of the contractor to determine the size of its electronic file.

Should the Bidder need to break up its submittal, it may provide separate attachment to avoid exceeding the size limit.

(3) FILE DESCRIPTION: Include a “File Description” for each file(s) you upload in the following format: CUI_SP_PROPIN_Solicitation Number_Volume No._ Firm Name. For example, CUI_SP_PROPIN _W912P62xR000x_Volume I_ USACE. The “File Description” will be included in the email notice to each of the recipients you choose to have access your file(s). Do NOT enter Privacy Act Data (Personal Identification Information (PII)) in the File Description.)

(4) The bid/proposal submission shall include all required documents. (re: “Important Bid Notes,” Solicitation Section 00 22 13).

SUBMISSION DATE AND TIME:

(1) Bid’s are due one hour prior the time specified on Page 1 of this Solicitation, Block #13a. Please note, FAR Subpart 14.302 Bid submission;

“Bids shall be submitted so that they will be received in the office designated in the invitation for bids not later than the exact time set for opening of bids.”

The District is in the Eastern Time Zone.

(2) RECEIPT OF SUBMISSIONS: For the purposes of establishing whether a bid/proposal submission is considered timely, the Government considers the date and time the submission is completely uploaded and posted into the PIEE website, which requires a PIEE electronic signature.

(3) The PIEE electronic signature process requires time to obtain through PIEE, a digital pin. Bidders/Offerors are responsible for allotting sufficient time to obtain this pin during the submission process in order to complete the PIEE signing and posting process prior to the date and time for submission. Once an offeror successfully signs and posts the offer, PIEE will send official submission date and time email to government Contracting Officials; it is the responsibility of the Offeror to confirm receipt of proposal.

Do not assume that electronic communication is instantaneous. It can take several minutes or, in some cases, hours. Bidders/Offerors are responsible for ensuring that bids/proposals are submitted reach the designated location in time, thus responsible for allowing sufficient time for submission.

VIRTUAL BID OPENING:

(2) Interested individuals will navigate to a WEBEX link. The bids will be read aloud and individuals will be able to view the Bid Opening information on the WEBEX screen as the bids are opened. Should technological issues ensue from the visual viewing at the WEBEX, the audio access will take precedence and satisfy the conditions of bids being communicated publicly/read aloud.

Within 3 days prior to the bid opening, the government will provide a meeting link with a password and phone number at the sam.gov website (https://sam.gov), wherein the Solicitation package is published.

BIDDER QUESTIONS MUST SUBMIT USING PROJNET

Submit solicitation questions only [not bids or proposals] via Bidder Inquiry in ProjNet at https://www.ProjNet.org/ProjNet. As noted below, bidders/offerors shall not submit their proposals via ProjNet. Bidders will need to be a current registered user or self-register into the system. NOTES:

1. Bidders/offerors are requested to review the specification in its entirety and to review the Bidder Inquiry System for answers to questions prior to submission of a new inquiry. RESPONSIBLE PROSPECTIVE CONTRACTORS

Bidders/offerors must be found to be responsive and responsible in order to be considered for award. See FAR Subpart 9.1, Responsible Prospective Contractors for more information. SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
