9.1. For contractors that do not require CAC, but require access to a DoD facility or installation: Contractor and all associated subcontractor employees shall comply with adjudication standards and procedures using the National Crime Information Center interstate identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

CLAUSES INCORPORATED BY FULL TEXT
52.211-6 BRAND NAME OR EQUAL (AUG 1999)
(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.
(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must--
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by--
(i) Brand name, if any; and
(ii) Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
(d) Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.
(End of provision)
52.211-8 TIME OF DELIVERY (JUN 1997)
(a) The Government requires delivery to be made according to the following schedule:
REQUIRED DELIVERY SCHEDULE
ITEM NO. QUANTITY WITHIN DAYS
AFTER DATE OF
CONTRACT
CLIN 0001 4 45 DAYS
CLIN 0002 4 366 DAYS
CLIN 0003 4 731 DAYS
The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
(End of clause)
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)
The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
(b) Submission of offers
(c) Period for acceptance of offers
(f) Late submissions, modifications, revisions, and withdrawals of offers
(g) Contract award.
(h) All or None-Commercial Item Acquisition
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of quotes.
(1) Submitting your Quote: All quotes shall be submitted to the Government through FBO.GOV with a cover letter that identifies all enclosures being submitted with your quote.
(2) Submitting your Technical Capability: The offeror shall complete each section of the Technical Information Questionnaire (TIQ) (Attachment 0001). Failure to complete every section of the TIQ may render your quote ineligible for award. Digitally sign or print and sign your TIQ prior to submitting it to FBO. The Government will NOT be responsible for your answer(s) being inadvertently changed.
The offeror shall support its responses by submitting supporting documentation in FBO on items provided. The offeror shall submit a technical description and/or product literature for the equipment it is proposing, which clearly identifies the manufacturer, make and model. The offeror must demonstrate that its proposed equipment meets or exceeds each minimum requirement described in the statement of work by providing a citation to the relevant section of its technical description or product literature.
(3) Submitting your Price Quote: The offeror shall submit (1) one copy of the completed SF 1449. The offeror unit price, amount, and net amount shall be documented in the space provided for each CLIN on the SF 1449. The Government may reject your quote if the offeror fail to complete the CLIN pricing section of the SF 1449. The offeror shall quote a firm-fixed-price for each CLIN.
Contractor shall state express warranty coverage.
(4) Submitting your Delivery Schedule: The offeror shall submit a schedule and milestones chart that is detailed to a level that clearly shows its delivery schedule. Offeror shall complete provision 52.211-8 and submit with their quote.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers. The Government intends to evaluate quotes and award a contract without discussions with Offerors. The offeror's initial quote should contain the offeror's best terms from a price.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) We must receive your quote by the deadline specified on the Standard Form 1449 in block 8. We will not consider any quote that we receive after the deadline. Offerors are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government via FBO by the time specified in the solicitation. You may submit revisions to your quote during the solicitation period and it must be clearly visible as a revision. Electronic submission via facsimile will not be accepted.
(g) Contract award. The Government intends to evaluate quotes and award a contract without discussions with offerors. Therefore, the offeror's initial qoute should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) All or None-Commercial Item Acquisition: Paragraph (h) is modified to say that your quote must offer to provide the total quantity of the items in this solicitation. Only one award will be made as a result of this solicitation.
Quotes submitted for less than the total quantities of all the items in this solicitation will NOT be considered for award.
(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

ADDENDUM TO 52.212-2 -- Evaluation -- Commercial Items.
The following provisions are incorporated into 52.212-2 as an addendum to this solicitation:
(a) The Government will award a single Firm-Fixed Price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Evaluation will be based on FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items. Award will be made to the lowest responsive offer that meets the salient characteristics in the SOW.
(ii) PRICE FACTOR: The information submitted in response to this solicitation on the SF 1449 will be evaluated to assess the reasonableness of the offeror's total evaluated price.
Price will not be assigned an adjectival rating and will be evaluated to determine if the offeror quoted price is fair, reasonable, and balanced. The Government may determine that an offer is unacceptable if prices are significantly unbalanced.
Unrealistically low quoted prices, initially or subsequently, may be grounds for rejection for this solicitation.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR
