52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Award will be made to the responsible offeror submitting the Lowest Price Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire non-price proposal being rated “unacceptable”.

The following ratings will be used in evaluating all non-price factors and subfactors:

Technical Ratings Rating Description Acceptable Proposal submitted with all required documentation meets the minimum requirements of the solicitation.

Unacceptable Proposal submitted with all required documentation DOES NOT meet the minimum requirements of the solicitation or required documentation was incomplete.

I. FACTOR A – TECHNICAL: Each sub-factor will be rated either acceptable or unacceptable. A rating of unacceptable for any sub-factor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements outlined in one of the below subfactors, overall proposal will be rated “unacceptable” and will not be eligible for award.

Sub-factor 1. Prior Experience: The offeror shall submit resume with at least three (3) year of experience in Administrative Assistant within the last ten (10) years. Document of prior experience shall clearly identify the information required below:

(1) A description of qualifying work experience as identified in PWS Section 1.6.8.

(2) Length of contract/project (year/month/date – year/month/date)

(3) Company Name/Employer and Phone number of POC of Client

Sub-factor 2. License/Certificate of training: The offeror shall provide a copy of training certificates for Microsoft Office products (Word, Excel, PowerPoint, Outlook).

Sub-factor 3. English Proficiency: The offeror shall be able to read, write, speak, and understand the English Language and achieve a minimum score of 50 on the Test for English as a Foreign Language (TOEFL) or equivalent.

II. FACTOR B. Price Proposal:

1. The Offeror shall provide complete price proposal to include:

(a) Schedule of Services (CLINs) of the solicitation for both option years.

(b) Prices shall be in local currency (Korean Won) or USD (US Dollar).

(c) Any escalation in option year pricing shall be identified.

2. Proposed price will be evaluated to determine if the estimate is complete, balanced, and reasonable.

The pricing proposals will be evaluated in accordance with FAR 15.404-1 (b).

(1) Completeness. The offeror shall complete the pricing information for all CLINs identified for base period plus four option years.

(2) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, current market prices for same or similar services and/or when compared among other technically acceptable offerors.

(3) Unbalanced Pricing. As part of the price evaluation, proposals will be reviewed to identify any unbalanced pricing. IAW FAR 15.404-1(g) (3), Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government.

(4) Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period of five (5) years from the date of award. Price must include all CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.

(5) FAR Clause 52.217-8, Option to Extend Services: As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one half of the Offeror’s final option period prices to the Offeror’s total price. The Government may determine that an offer is unacceptable if the option prices are unrealistic. Evaluation of options shall not obligate the Government to exercise the option.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (NOV 2021)
