Control Number: 17-HRCO-132
For Official Use Only (See FAR 2.101 and 3.104-4)
Sole Source Justification and Approval Under FAR 13.501
1. Contracting Activity: Health Readiness Contracting Office (HRCO) U.S. Army Medical Command (USAMEDCOM), 2199 Storage Street, Building 4197, Suite 68, Joint Base San Antonio (JBSA) Fort Sam Houston, Texas 78234-5074.
2. Description of Action: The HRCO requests approval to The HRCO requests approval to negotiate a new 3-month sole-source follow-on contract for non-personal services with the incumbent provider, Sierra7, Inc. (herein referred to as Sierra7) to provide administrative support services at the Warrior Transition Brigade (WTB), Walter Reed National Military Medical Center (WRNMMC), Bethesda, MD and Northern Regional Medical Command (NRMC), Fort Belvoir, VA. A Firm Fixed Price (FFP) contract with FFP line items is anticipated. The type of funds to be used is FY 17 Defense Health Program, Operations and Maintenance (O&M) funds for the 3-month base period
3. Description of Supplies/Services:
a. These services are necessary to provide administrative support services at the Warrior
Transition Brigade, Walter Reed National Military Medical Center, Bethesda, MD and Northern Regional Medical Command, Fort Belvoir, VA. to support the integrated health care delivery systems offering military personnel and their families, in and around Washington, DC, access to comprehensive medical care. Sierra7 has been providing critical administrative support services for the WTB throughout the region by providing 47 full-time equivalents to support the WTB in accordance with applicable Army regulations, policies, and directives. The WTB administrative services to include but not limited administrative support services under which the personnel rendering services are not subject, either by the contract’s terms or by the manner of administration, to the supervision and control usually prevailing in relationships between and government and its employees, to include but not limited to; the Warrior Transition Brigade (WTB) Walter Reed National Military Medical Center (WRNMMC), Bethesda, MD and Northern Regional Medical Command (NRMC), Fort Belvoir, VA. to support the Military Members and other beneficiaries within the Northern Regional Medical Command.
b. The administrative support services include personnel such as Administrative Assistants, Rehabilitation Internship Coordinators, Executive Service Event Coordinators, Mail Clerks, Training Specialists, Property Administrators, Supply Technicians, Receptionists, and General Clerks. This is a non-personal services contract to provide administrative support services under which the personnel rendering services are not subject, either by the contract’s terms or by the manner of administration, to the supervision and control usually prevailing in relationships between the government and its employees. The government shall not exercise any supervision or control over the Contract Service Providers (CSPs) performing the services herein. Such CSPs shall be accountable solely to the contractor who in turn is responsible to the government.
This purchase order will extend the services an additional three months to allow the government time to complete the award.

c. The estimated value of this proposed action is $1.1 million for a 3-month period of performance from 7 January 2017 through 6 April 2017. Federal Acquisition Regulation (FAR) Clause 52.217-8, Option to Extend Services, will be included in the contract to allow for an additional 6-month extension of services, if needed, at an estimated value of $2.2 million. Total contract value will be $3.3 million if the full 6-month option is exercised.
4. Authority Cited: The statutory authority permitting other than full and open competition is 41 United States Code 1901 as implemented in Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii), sole source (including brand name) under the authority of the simplified procedures for certain commercial items.
5. Reason for Authority Cited: Pursuant to the provisions of FAR 13.501(a)(1)(ii), Sierra7 (the incumbent) is the only source that can provide the required follow-on competitive contract for services to fulfill the customer’s mission, allow the government time to issue an amendment to solicitation for the follow-on SDVOSB competitive contract, evaluate revised pricing from offerors, and make an award. This purchase order will extend the services an additional three months to allow the government time to issue an amendment to solicitation for the follow-on competitive contract, evaluate revised pricing from offerors, and make an award.

b. The period of performance on the current contract and task order can no longer be extended. FAR Clause 52.217-8, Option to Extend Services, has already been utilized to its maximum usage of six months and this option period will expire on 6 January 2017. The proposed 3-month sole-source contract will need to be awarded by 6 January 2017 in order to continue the current level of services until a new competitive contract can be completed. It is estimated that it will take approximately two months to complete the follow-on award due to the amending solicitation, evaluating revise pricing, and making an award. In addition, it is estimated that it will take an additional 30 days of transition time in order for a new contractor to complete the recruitment and placement process of its employees to start performance on a new contract. Sierra7 is the only responsible contractor with the required and qualified personnel already in place to begin contract performance on 7 January 2016.
c. Furthermore, a delay of services will negatively impact the requiring activity’s mission of providing administrative support services at the Warrior Transition Brigade (WTB), Walter Reed National Military Medical Center (WRNMMC), Bethesda, MD and Northern Regional Medical Command (NRMC), Fort Belvoir, VA., to support the integrated health care delivery systems offering military personnel and their families, in and around Washington, DC, access to comprehensive medical care.
6. Efforts to Obtain Competition:
a. Effective competition. No other efforts are being made to obtain competition as only one responsible source, Sierra7, is capable of meeting the minimum requirements prior to the expiration of the current contract.
b. Subcontracting competition. The current requirement is for small business; therefore, the contracting officer has determined that a subcontracting plan is not required per the exemptions at FAR 19.702(b) (1).
7. Actions to Increase Competition: A Request for Information (RFI) and notice of the Government’s intent to award a sole-source contract was publicized in FedBizOpps. It is not possible to compete this requirement in time for service to commence on 7 January 2017. The Government is currently in the process of awarding a 5-year contract for these services through competitive solicitation W81K04-15-R-0006.
8. Market Research: Market research, in accordance with FAR Part 10, was conducted by issuing an RFI seeking sources from industry within the last 12 months. The Government also notified industry of the Government’s intent to award a sole source contract to the incumbent, Control Number: 17-HRCO-132

Sierra 7 on 22 December 2016. Based on market research, to include the contracting officer’s personal knowledge of recently awarded administrative support services contracts, other contractors are capable of providing similar services if there were adequate time to compete the requirement and allow for a reasonable transition period. It is not feasible to competitively solicit and evaluate proposals, and make an award on or about 6 January 2017. Sierra7 has the existing management and support structure, resources, and demonstrated experience to perform these services.
9. Interested Sources: To date, 35 potential offerors, including 21 Service-Disabled Veteran- Owned Small Business (SDVOSB), have written to express an interest. The notice required by FAR 5.201 of our intent to award a sole-source contract for this requirement was published in FBO informing the interested parties that any quotes, proposals, or capability statements received would be considered. However, it is not feasible to solicit a bridge contract with any source other than Sierra7. Sierra7 possesses the unique qualifications to instantly perform the continuation of these services given that Sierra7 already has the required resources and trained manpower, and has completed all in-processing requirements for their employees, thus requiring no transition efforts to continue performing these services.
10. Other Facts:
a. Procurement history.
(1) Contract numbers and dates of last several awards. This contract was competed as a
Service-Disabled Veteran-Owned Small Businesses (SDVOSB) set-aside. A firm-fixed price contract (W91YTZ-12-C-0129) was awarded to Jamison Professional Services, Inc., a SDVOSB, for a period of performance from 1 October 2012 through 31 March 2014. A sole-source, interim contract (W91YTZ-14-C-0229) was awarded to Jamison Professional Services, Inc. for the a period of performance from 1 April 2014 through 31 July 2014 and included FAR clause 52.217- 8, Option to Extend Services, which was exercised to extend services through 31 January 2015.
Another sole source purchase order (W91YTZ-15-P-0080) was awarded to Jamison Professional Services with a period of performance from 1 February 2015 – 30 June 2015. There was a break in service of six days after the expiration of this contract due to delays in the source selection process at NRCO. The current contract (W91YTZ-15-C-0020) was awarded to Sierra7 on a competitive basis (1-year base and 1-year option). The contract period of performance is from 7 July 2015 through 6 July 2016 and includes a one-year option period from 7 July 2016 through 6 July 2017. The option period was not exercised because the Government anticipated the award of the follow-on contract (1-year base and four 1-year options) with RFP W81K04-15-R-0016;
however, follow-on contract has been delayed due to DoL audit issues. A three month extension of services was exercised, with a period of performance from 7 July 2016 through 6 October
