CMO Control Number: 2017-001

DEPARTMENT OF THE ARMY

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: Army Contracting Command – Warren (ACC-WRN) is the procuring activity for this action.

2. Description of Action: This action will result in a new firm fixed price, one-year requirements contract with an estimated total quantity of twelve each Petroleum Quality Analysis System – Enhanced (PQAS-E) Instrumentation Sets; four each under CLIN 0011AA and 4 each under Option CLIN 0012AA and Option CLIN 0013AA. The anticipated award date is December 2016 and FY16 Army Other Procurement Appropriation funding will be used for the initial order quantity of four each.

3. Description of Supplies/Services: The Product Management Office for Petroleum and Water Systems has a requirement for the PQAS-E Instrumentation Sets. The PQAS- E Instrumentation Set is a collection of 33 interior PQAS-E components, all of which are “Brand Name” items. The PQAS-E Instrumentation Sets will be used to train newly enlisted Military Occupation Specialties 92L on PQAS-E lab operations. The PQAS-E Instrumentation Set contains 33 components which are placed in a fixed Petroleum Lab.

The PQAS-E Instrumentation Set consists of high technology lab equipment, which provides military lab personnel with enhanced capabilities to perform missions on petroleum analysis. Table 1 below identifies the complete listing of the PQAS-E Instrumentation Set items that are described as brand-name components. The total estimated dollar value for the PQAS-E Instrumentation Set over the life of the contract, including options is $7,592,257.

4. Authority Cited: The Statutory Authority permitting other than full and open competition for this action is 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(c)(1), “Only One Responsible Source and no other supplies or services will satisfy agency requirements - Application for brand name descriptions.”

5. Reason for Authority Cited: The use of brand name descriptions in this acquisition is essential to the Government’s requirements, thereby precluding consideration of products manufactured by other companies.

The required brand-name-only components listed in Table 1 are the interior components of the PQAS-E units that have been fielded to Active Component (AC), National Guard (NG) and Army Reserve (AR) units in the Army. The Technical Manual (TM), New Equipment Training materials, and Quartermaster School training doctrine are based on these specific brand name components. The brand-name-only components are essential to this effort to ensure Army personnel are trained on the same equipment in the field and receive specialized training of PQAS-E Instrumentation. If Army personnel are not trained on the same equipment that is fielded, operations in the field can be delayed and analysis and reporting of fuel quality may be misrepresented. The contract resulting from this effort will provide the means necessary to continue training Army personnel on currently established

Quartermaster School doctrine. The main factor which further justifies the need to procure the brand name items listed in Table 1 is the ability to maintain continuity and standardization between the fielded PQAS-E systems and new PQAS-E Instrumentation Sets used for training. Procuring items other than those listed in Table 1 will cause the following major disruptions in the fielding and training of the PQAS-E Instrumentation Set:

non-conformance to current PQAS-E configuration; obtaining new safety certifications;

testing of the new equipment; the creation of a new TM; and the adjusting of all training/fielding documentation concerning the new equipment.

Program Delay: Competitive acquisition of the components contained in the PQAS-E Instrumentation Set would result in an unacceptable delay to the program. The minimum program delay expected due to testing (one year), training (90 days), technical manual (one year) and training/field documentation (90 days) would be at least an additional two and half years. The lack of PQAS-E Instrumentation Set past the required delivery date of April 2017 will impact force training and hinder the Army’s ability to effectively and efficiently analyze Aviation and Ground Vehicles petroleum supply. This lack of analysis may result in catastrophic loss of both Army equipment and personnel.

Table 1 lists the brand name components essential to Government requirements, thereby precluding consideration of products manufactured by other companies.

6. Efforts to Obtain Competition:

a. Effective Competition: This procurement action will be synopsized in Federal Business Opportunities (FBO) as required by FAR Subpart 5.2, to alert interested contractors and subcontractors of this procurement. A copy of the solicitation and any pertinent documents will be provided to any interested sources.

b. Subcontracting Competition: This is not a single source situation. Offerors are required to submit a subcontracting plan IAW FAR 52.219-9.

7. Actions to Increase Competition: None. Adequate competition is anticipated amongst offerors who can provide the brand name items listed on Table 1.

8. Market Research: A Sources Sought notice was posted in FBO on 2 May 2016 and closed 16 May 2016. Only one response was received from a small business. In addition, market research was conducted as required by FAR Part 10 via the internet, phone inquiries and symposiums. Research was performed on all components in the PQAS-E Instrumentation Set to determine if equivalent components existed in the market place that could provide the means of maintaining interoperability between the current and new sets, and meet all component requirements called out in the Operational Requirements Document (ORD). Research showed that no components, other than those listed in Table 1, fully met all Government requirements. The most recent market research was conducted by the lead engineer and the lead chemist for the PQAS-E from FY15 to present. The lead engineer and chemist maintain close relationships with the instrument manufacturers in the industry. This allows them to keep up to date on the state of the industry and they routinely meet with the instrument manufacturers to demo new instruments. To date, the current PQAS-E Instrumentation Set is still the best solution to providing the PQAS-E its full testing capabilities.

To utilize components other than those currently contained in the PQAS-E Instrumentation Set and authorized through the supply catalog would create serious, long term logistical and training issues as explained in paragraph 5. The particular products listed in Table 1 are essential to Government requirements, and market research indicates these other companies’ similar products do not meet Government needs of standardization. In addition, there would be substantial duplication of cost if the brand name items were not procured.

9. Interested Sources: To date, only Federal Resources Supply Company has expressed an interest in the acquisition. The notices required by FAR 5.201 will be published and any responses shall be considered.

10. Other Facts:

Procurement History. From 2010 – 2012, a total of 61 PQAS-E units have been procured (via MIPRs to Rock Island Arsenal). At the time, the model was for Rock Island to order individual components from the OEM and assemble/mount the components together in an ISO container. The complete fielded PQAS-E systems consisted of 30 plus components, the ISO container, and power generator, which were then fielded to AC, NG and AR Army units.
