SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
INSTRUCTIONS TO OFFERORS
L.1 SUBMISSION OF OFFERS
L.1.1 Purpose: These instructions prescribe the format of proposals and describe the approach for the development and presentation of the proposal data. They are designed to ensure the submission of information essential to the understanding and comprehensive validation of proposals. Offerors are cautioned to follow the instructions carefully.
L.1.2 Submission: Both electronic and hard copy proposals are required, as detailed below, on or before the date and time set for receipt of proposals. An Offeror that fails to submit both an electronic copy and hard copy proposal will be deemed non-compliant and will not be evaluated or further considered for award. Submission of proposals via email is not authorized. All offers must be submitted in ENGLISH or with English translation. English translation will control for offers submitted using such IAW FAR 52.225-14. Offers submitted in other than English and without English translation will be determined “Unacceptable” and eliminated from competition.
a. Proposals shall be received no later than the due date and time specified for receipt of proposals via one of the addressees listed below. Offerors are advised that the Contracting Office is located on a military installation and gate access is required to enter and deliver proposals. Additionally, the base post office is closed on U.S. Federal holidays.

b. Contract Inquiry: All questions shall be submitted to Ms. Jana Bunch, Contract Specialist, jana.j.bunch.civ@mail.mil AND Mr. Aaron M. Schulz, Contracting Officer, aaron.m.schulz.civ@mail.mil no later than 10 calendar days after issuance of the solicitation. The subject of the e-mail(s) shall be “W564KV-17-R-0001 - Mission Command Training Support.”
Questions shall annotate a reference to the specific solicitation factor to which they pertain. The Government is not obligated to provide responses to all questions submitted by Offerors, but will consider them and incorporate changes into the RFP as deemed necessary. Government responses to questions will be incorporated via an amendment to the RFP for review by all Offerors; therefore, do not mark questions/comments with a restrictive legend and do not include proprietary information. It is the responsibility of the offeror to access FedBizOpps (www.fbo.gov) to obtain amendments and the most current information regarding this solicitation.
c. Proposals shall include separate files/binders for each volume. Technical parts A & B may be submitted as a single volume. The Offeror shall confine submissions to essential matters sufficient to define the proposal and provide adequate basis for evaluation. All pages of each volume shall be appropriately numbered and identified by the complete company name, date and RFP number in the header and/or footer. Should there be a discrepancy between the hard copy and electronic information provided, the hard copies shall take precedence.
i. Electronic copy proposals: Electronic proposals shall be submitted via compact disc (CD).
Digital files shall be compatible with Microsoft Office 2013 and submitted on a CD-ROM in uncompressed files. Offerors are permitted to submit proposals on a single CD; however, all file names shall include the respective company name, document name, and volume number (using abbreviations as necessary). Proposals shall include separate electronic files for each volume.
ii. Hard copy proposals (Volumes II & III only): Offerors shall submit twelve (12) hard copies of Volume II - Technical & Volume III – Past Performance in accordance with the instructions of this section. Proposal volumes shall be submitted in separate binders, tabbed appropriately, and must include a cover page with the name of the Prime offeror, address, CAGE code, phone number(s), email address(es), solicitation number, and point of contact. Each binder shall be clearly labeled with its title and a copy number (e.g., copy 1 of 12). Proposals shall be in sealed envelopes/boxes clearly marked with the solicitation number.
d. It is the Contractor’s responsibility to ensure the Government receives both electronic and hard copy proposal submissions on time. A complete proposal received after the exact date and time set for receipt of proposals will be considered late and will not be considered for award. With regard to hard copy proposal submission, there must be acceptable evidence to establish that the proposal was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers.
e. Page Limitation: If the page limits are exceeded, the pages in excess of the limit will be removed and not evaluated. The following are excluded from the page limitations: Covers for volumes, tables of contents, glossary of abbreviations and acronyms, indices, title pages, cross reference indexes, and section dividers if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal. Section dividers will be counted if they contain any other material information required for the evaluation of the proposal. Additionally, pages marked “This page intentionally left blank” will not be counted. Page limitations are as follows:

f. Offers, modifications, revisions, or withdrawals of Offers received after the date established in this
RFP for receipt of proposals will be handled in accordance with FAR Clause 52.215-1.
g. Proposal font type shall be limited to Arial, Courier or Times New Roman equal to or larger than 11 point font size. Graphics, photos, and charts may use color; however, offerors are cautioned to use colors that are legible if printed in black and white. Tables and illustrations may use a reduced font no less than 10-point and may be landscape. 11X17 fold-out tables may be used for tables/graphic representations only and will be counted as one page per fold-out.
h. Margins shall be at least 1 inch on the top and bottom and 3/4 inch on the side. The Contractor shall number each page in order to eliminate any confusion. In the event an offeror creates an ambiguity in their page numbering, the Government may exercise its own discretion in counting pages.
i. Microsoft Excel files submitted shall be unlocked, formula driven, and numbers shall not be hard coded, where applicable. Spreadsheets shall be in Microsoft Excel 2013 compatible format (.XLS format).
j. Submission of the documentation specified below will constitute the offeror’s acceptance of the terms and conditions of the RFP, concurrence with the performance work statement and contract type.
k. It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, should discussions become necessary, the Government reserves this right. If this occurs, a competitive range may be determined and offerors will be notified.
l. If an offeror believes that the requirements in these instructions contain an error, ambiguity, omission, or are otherwise deemed unsound, the offeror shall immediately notify the Contracting Officer and Contract Specialist in writing by email with supporting rationale.
m. The proposal shall be valid for 180 days from the required submission date.
n. Updates related to this RFP, to include the RFP, amendments, notices, and other information will be made available on the Federal Business Opportunities (FBO) website at https://www.fbo.gov/. It is the responsibility of the offerors to access FBO to obtain amendments and the most current information regarding this solicitation. Offerors are deemed to have knowledge of all documents that are posted to
FBO.
o. The submission shall be clearly indexed and logically assembled. All proposals shall be Unclassified and proprietary information shall be clearly marked. Failure to comply with all requirements of the proposal submission instructions may eliminate an offer from consideration.
p. Offeror must be registered in the System for Award Management (SAM) and have a Commercial and
Government Entity (CAGE) Code.
L.2 PROPOSAL PREPARATION INSTRUCTIONS
L.2.1 Offeror’s proposal shall consist of four separate Volumes as follows:

L.2.2 All information pertaining to a particular volume shall be confined to that volume. For example, no Cost/Price information shall be included in any volume other than the Cost/Price Proposal volume. Additionally, Volume II – Technical, Part A – Subfactor 1 - Experience shall be submitted separately from Past Performance, though some of the same information may be submitted in both volumes, as outlined below. The offeror shall confine submissions to essential matters, sufficient to define the proposal in a concise manner and permit a complete and accurate evaluation of each proposal. Note: Technical data submitted in Volume II will be considered in the evaluation of the Technical Factor, and may also be considered in the price realism analysis.
L.2.3 Offerors are cautioned that “parroting” of the technical requirements or the PWS with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal.
L.3 CONTENT REQUIREMENT
L.3.1 VOLUME I – GENERAL DOCUMENTS:
L.3.1.1 Standard Form 33 (SF 33), Solicitation, Offer, and Award – An authorized official of the firm shall sign the SF 33 and all amendments and certifications requiring original signature. Amendments must either be acknowledged on the SF 33 or individually signed and provided with the proposal. The executed SF 33 is not evaluated for source selection purposes but is required to help determine contractor responsibility. An Acrobat PDF file shall be created to capture the signatures for submission. Failure to provide the SF33 could result in the rejection of the offeror’s proposal.
L.3.1.2 Partnerships / Teaming Arrangements. If applicable, offerors participating in partnerships / teaming arrangements for this requirement shall submit their partnership / teaming agreements with their proposal. All partnership / teaming agreements shall include the following information:
o Provide a complete list of the corporate names (no abbreviations) of all partners / team members, addresses, points of contact, phone numbers, DUNS numbers, and CAGE Codes.
o Submit a copy of the partnership / teaming agreement that demonstrates the relationship between firms and identifies the contractual authority to bind the firms. This agreement needs to be signed by the appropriate individuals of each firm.
L.3.1.3 Subcontractor Letter(s) of Commitment: If applicable, offerors shall provide Letters of Commitment for all proposed major subcontractors, as defined in L.3.1.4.
L.3.1.4 Subcontracting Matrix – If the Offeror is utilizing subcontractors, it shall provide Attachment 0003 – Subcontracting Matrix to identify all of its subcontractors, CAGE codes, the tasks they will be performing, and estimated dollar value of the work to be performed. This information will be used in the evaluation of all factors. A major subcontractor is defined as a subcontractor who is expected to perform PWS tasks requiring Top Secret clearance and/or at least 10% of the total proposed cost/price.
L.3.2 VOLUME II: TECHNICAL
L.3.2.1 Technical - Part A
L.3.2.1.1 SUBFACTOR 1: EXPERIENCE:
a. This factor considers the offeror’s recent and relevant specialized experience providing simulation and mission command training support services with at least two (2) years of experience providing the same or similar support as required by the PWS.
b. Recency and relevancy are defined in paragraph M.3.1.1.3.
c. The offeror shall provide the following details of all recent and relevant contract experience: (1) Company
Name, (2) Point of Contact, (3) Contract/Subcontract Number, (4) Company Address, (5) Contract Start & Completion Dates, (6) Place of Performance, (7) Total Value of Contract (or total estimated value if contract is incomplete, (8) Description of Contract/ Contract Type, (9) Brief description of services (10) Customer POCs.
Offerors may provide copies of Part I of the Past Performance Questionnaire for this subfactor if they choose.
The offeror shall also include a narrative explanation clearly detailing how the previous contracts are relevant to the requirements of this solicitation. (Note: Copies of the contract details and contract narrative should also be provided under Volume III – Past Performance.) The Government is not bound by the offeror’s claim of relevancy. The Government reserves the right to determine whether a service is the same or similar.
L.3.2.1.2 SUBFACTOR 2: FACILITY CLEARANCE:
a. The Offeror must possess a current Top Secret Facility Clearance by the Defense Security Service (DSS) at the time of proposal submission. This is required in order for the Offeror to request and sponsor an individual employee’s Security Clearance to perform the functions identified in the PWS. All subcontractors must possess either a Top Secret Facility Clearance or Secret Facility Clearance at the time or proposal submission, depending on the tasks the subcontractor will be performing. The offeror shall provide objective evidence showing the current facility clearance level for the Prime Offeror and all proposed subcontractors.
b. Attachment 0003 – Subcontracting Matrix will be used to verify the clearance level required for each proposed subcontractor. The Government will verify the Offeror and its proposed subcontractor(s) possess the required Facility Clearance levels via the Defense Security Services (DSS) Industrial Security Facilities Database
(ISFD).
L.3.2.2 Technical - Part B
L.3.2.2.1 SUBFACTOR 1: EXECUTION PLAN. The Offeror shall submit a detailed execution plan showing its understanding of and approach to performing the requirements of the solicitation, which specifically addresses the following elements:
a. Transition during Phase In and Phase Out.
i. Phase In –
1) The offeror shall detail its processes and outline a realistic and feasible timeline for onboarding a new workforce during the Phase-In period to assure readiness prior to full performance under the contract. These processes shall include how the offeror will finalize any draft plans and staffing issues, obtain Common Access Cards (CAC) and installation access, obtain necessary licenses, conduct a joint inventory of government provided equipment, safeguard Privacy Act information, and fully man and provision all offices and locations.
2) The offeror shall demonstrate the ability to fill the proposed positions under the Status of Forces Agreement (SOFA) with Germany, the Shell Agreement with Italy through the DoD Contractor Personnel Office (DOCPER) and/or utilizing European business rules in the case of Ordinarily Resident (OR) employees. The offeror shall demonstrate a clear knowledge of all necessary documentation and timelines needed for Technical Expert (TE), Analytical Support (AS), and Technical Representative (TR) status accreditation applications as it applies to the offeror’s management approach and cost proposal, and in meeting the requirements of the PWS.
ii. Phase Out – The offeror shall detail its processes and timelines for continuing full performance while providing a successful and cooperative transition for the follow-on contract as required by the PWS. The Offeror shall detail its plan for executing a realistic and feasible time-phased approach to transitioning-out all of the PWS requirements.
b. The offeror shall provide detailed plans for the execution of day to day tasks at JMSC hub and spoke sites as well as JMRC. The offeror shall provide a detailed plan identifying the contractor management approach that demonstrates flexibility and agility while implementing cost effective enhancements and responding to unanticipated changes. The offeror shall describe their ability to manage, track, and report on the following elements: progress, contract funds status, personnel manning and training, contractor operation and management status, and status of assigned government equipment. The offeror shall also describe their approach for managing multiple tasks or exercises at different locations.
c. The offeror shall provide detailed plans for the execution of exercise schedules to include coverage of JELC events and surge periods within the fixed price workload data. The offeror shall explain how this support will be provided within its proposed overall staffing levels and shall provide a crosswalk showing its approach to its staffing plan and their understanding of exercise/event schedules.
d. The offeror shall detail its approach to MSEL management, scripting, and scenario development to include
JMRC OPFOR and intelligence scripting. The offeror shall explain how it will support these dynamic tasks and provide appropriate quality control of products.
e. The offeror shall provide detailed plans regarding its approach to logistics management and property management. The offeror shall explain how this support will be provided within its proposed overall staffing levels and shall provide a crosswalk showing its approach to its staffing plan and their understanding of exercise/event schedules.
f. The offeror shall provide detailed plans regarding its approach Observer Controller Trainer support. The offeror shall include their plan to maintain workforce currency in doctrine, tactics, techniques and procedures.
g. The offeror shall provide detailed plans regarding its approach to Gaming support. The offeror shall explain how this support will be provided within its proposed overall staffing levels and shall provide a crosswalk showing its approach to its staffing plan and its understanding of exercise/event schedules.
h. The offeror shall detail its approach to managing Part Time on Call personnel. The offeror shall include their plan for maintaining an appropriate pool of personnel and how they will ensure their currency.
L.3.2.2.2 SUBFACTOR 2: STAFFING PLAN. The offeror shall submit a detailed personnel staffing plan addressing the items below. Additionally, the Offeror’s Staffing Plan shall directly correspond to the cost/price volume.
a. Offerors proposed approach to recruit and retain employees throughout the life of the contract effort along with
Offeror’s crosswalk to proposed compensation plan. The offeror shall also address how they will keep employees trained in emerging concepts and technologies to make certain that all support provided to the Government is up-to-date and valid to fully meet the requirements of the RFP.
b. Organizational and Management Structure showing the clear and logical lines of authority and communications among the various sites.
c. Staffing plan identifying all positions required to meet the tasks listed in the PWS. This documentation shall include labor categories/types along with proposed hours, proposed position descriptions, levels of expertise, experience levels, clearances associated with the position, and location of the personnel.
d. Qualifications of the Program Manager and other proposed key personnel.
L.3.2.2.3 SUBFACTOR 3: RISK MITIGATION PLAN. The offeror shall provide a comprehensive Risk Mitigation Plan that identifies and mitigates risks associated with their proposed strategies as well as risks associated with contract performance.
L.3.3 VOLUME III: PAST PERFORMANCE
L.3.3.1 The Government will evaluate the Offeror’s recent and relevant past performance information to assess overall performance risk and the offeror’s likelihood of success in meeting the requirements of the PWS. The Offeror may submit recent and relevant past performance for itself, its teaming partners, and proposed major subcontractor(s) (as defined in paragraph L.3.1.4). All information submitted under Volume II – Technical, Part A, Subfactor 1 – Experience should also be submitted in the Past Performance Volume. Note that the Government may review other sources of past performance information besides the PPQ. The Government reserves the right to determine whether a service is the same or similar.
L.3.3.2 Past Performance Questionnaire(s).
a. The Offeror shall submit no more than five (5) recent and relevant contract references. Recent and Relevant are defined in Section M, paragraphs M.3.2.2.9(a-b). For each reference provided, the Offeror shall complete and submit Part I of Attachment 0004: Past Performance Questionnaire. If an offeror submits more than five (5) references, only the first five as listed sequentially in Volume III will be considered in the past performance evaluation.
b. For each reference provided, the Offeror shall email a blank copy of Attachment 0004: Past Performance
Questionnaire (PPQ) to its customer or appropriate Government or Prime contractor representative, requesting they complete the PPQ in its entirety. Completed questionnaires shall be emailed to both Mr.
Aaron Schulz (aaron.m.schulz.civ@mail.mil) and Ms. Jana Bunch (jana.j.bunch.civ@mail.mil). PPQs must be received by the closing date and time of this RFP. Questionnaires received after the proposal due date may not be considered.
c. Completed PPQs are not to be reviewed by the Offeror. Once the questionnaire is completed, it is considered For Official Use Only. The names of the individuals who complete the questionnaires will not be disclosed to the Offeror. Note that Past Performance Questionnaires returned directly to the contracting office will not be subject to page limits per the proposal instructions of this section.
L.3.3.3 Contract Narrative. For each reference provided, the offeror may provide a specific narrative explanation describing the objectives achieved and detailing how the effort is relevant to the requirement of this RFP. The offeror shall also either provide a copy of any Cure Notices or Show Cause Letters received on each contract listed, or state that there were none. If copies are provided, the offeror shall also provide a description of any corrective action implemented by the offeror or proposed subcontractor. The offerors shall indicate if any of the contracts listed were terminated, in whole or in part, and the type and reasons for the termination. If none of the contract references were terminated, the contractor shall state such.
L.3.3.4 Subcontracts. The offeror shall provide an outline of how the effort required by the RFP will be assigned for performance within the offeror’s corporate entity, and, if applicable, among the proposed subcontractor(s). The information provided for the prime offeror and each proposed major subcontractor must include the entire company name, company address, CAGE Code, DUNS Number and type of work to be performed by citing the applicable Government PWS subparagraph number. This includes all subcontractors who will be providing services which require Top Secret Facility Clearance or whose subcontract is for more than 10% of the total proposed cost/price (less FAR 52.217-8 Option to Extend Services calculation). This will be verified by comparing the Subcontracting Matrix to the Subtotal (Cell I43) of the Cost-Price Matrix to determine the percent of work a subcontractor is performing, and/or comparing the tasks identified in the Subcontracting Matrix to the DD254. This section will further include written consent of major subcontractors to allow the disclosure of their past performance information to the Offeror. In addition, Letters of Commitment shall be included for all major subcontractors.
L.3.4 VOLUME IV – COST/PRICE
L.3.4.1 The offeror shall submit a cost/price proposal that will be evaluated for completeness, reasonableness, realism, and balance. Cost/Price proposals shall be sufficiently detailed to demonstrate and support the offeror’s clear understanding of the technical requirements. The burden of proof for the credibility of all proposed prices and compensation plan rests with the Offeror. All offers shall be in U.S. DOLLARS. The cost/price proposal shall consist of the following:
a. FPAF CLINs: The Offeror shall provide its proposed price for all FPAF CLINs in Microsoft Excel detailing its fixed prices and summarizing using Attachment 0005 - Cost/Price Matrix for the base year and option years. Attachment 0005 will be used to calculate the total evaluated price. The prices shall include all personnel; management; transportation inside of the hub, spoke, and JMSC/JMRC; travel to include logistics support movement of equipment; and other services necessary to perform the requirements outlined in the PWS. Additionally, any overtime is to be included in the proposed fixed price CLINS. The details shall include the the number of hours per labor category and per location, the compensation for each labor category for each location, the number of trips (per location and number and type of personnel per trip) traveling inside the hub, spoke and JMSC/JMRC, the details for travel to include logistics support movement of equipment, and the details for any additional services necessary to perform the requirements outlined in the PWS. The FPAF CLINs shall also include any materials or equipment not provided by the Government which are necessary to perform the requirements of the PWS. The details provided shall track to the technical proposal Staffing Plan and to the Compensation Plan provided. The Government has set the award fee at a maximum of 5%. The total price for the FPAF CLINs will be calculated by the Government by adding 5% to the proposed fixed price.
b. Cost Reimbursable (Non-Fee Bearing) CLINs (Travel): A surrogate number has been provided for the Cost Reimbursable Travel CLINs to be used for evaluation purposes only. The Government provided surrogate numbers can be found in Attachment 0005 - Cost/Price Matrix.
c. Cost Reimbursable (Non-Fee Bearing) CLINs (PTOC): Offerors shall use the estimated quantities provided at Attachment 0005, Tab 2 - PTOC Hours to determine the total estimated value for proposal purposes. The Offeror shall provide a detailed cost element breakdown containing other than certified cost or pricing data prepared IAW FAR 15.403-3, and 15.408 Table 15-2 with the exception of the certification found at Table 15-2(I)(A)(9). The Government requests that the breakdown include the Offeror and its subcontractors’ labor rate build-ups to include base rate and indirect rates utilized to develop the proposed loaded labor rates. The electronic spreadsheets must contain all working formulas, algorithms and calculate the proposed costs. This data shall clearly explain how the Offeror arrived at the proposed rate for each labor category.
Additional details may be requested as necessary to support the proposed costs. Each individual CLIN's total value shall be populated in Attachment 0005 - Cost/Price Matrix for the base year and option years.
d. The Offeror shall complete Attachment 0005 – Cost/Price Matrix for the base and all option years by populating the highlighted blue cells. All un-highlighted cells are formula driven. All highlighted cells need to be populated. For areas that the Offeror intends to propose no cost, Offerors shall populate those cells with a zero (0).
e. The Offeror shall fully support the Cost/Price Matrix by providing a narrative on the cost and pricing assumptions, as well as additional sufficient cost and price detail that supports the proposed costs/prices as they relate to the proposed technical approach. Cost/price detail shall include all personnel and management structure and compensation (see paragraph f), transportation inside of the hub, spoke, and JMSC/JMRC; travel to include logistics support movement of equipment; and other services necessary to perform the requirements outlined in the PWS.
f. Compensation Plan for Professional Employees. Offerors shall provide a total compensation plan in accordance with FAR 52.222-46, Evaluation of Compensation for Professional Employees, setting forth salaries and fringe benefits (i.e. DoDDS schools) proposed for the professional employees who will work under the contract. The offeror shall advise if different compensation plans are used for various skill levels and shall describe these differences. The offeror shall summarize any supporting data, such as recognized national and regional compensations surveys and studies of professional, public, and private organizations used in establishing the total compensation structure.
g. The supporting price information showing the clear audit trail from the technical approach to the associated
CLINs shall be submitted in spreadsheet format in MS Excel. MICROSOFT EXCEL FILES SHALL
REMAIN UNLOCKED AND NUMBERS SHALL NOT BE HARD CODED.
h. The Offeror shall also provide the most current compliance status and date of adequacy/inadequacy determination for the following systems; Accounting System, Estimating System and Purchasing System.
If the Offeror does not have an approved Accounting System, a Pre-Award Survey may be required. The Offeror shall provide any known/cited accounting system deficiencies. The Contracting Officer will request an accounting system audit or follow up audit from DCAA. The Offeror shall also identify any deviations from the Offeror's standard procedures in preparing this proposal. If the Offeror proposes to absorb a portion of costs, explain the reason and impact on cost and the specific accounting treatment that will be given to those absorbed costs. The Offeror shall provide the same information for any subcontractor with which they intend to establish a cost or T&M type subcontract arrangement.
L.3.4.2 If a proposed subcontractor chooses to provides it cost/price information independently to the Government, it shall submit its cost/price proposal IAW the submission instructions outlined in paragraph L.1.2 above. The subcontractor shall clearly identify in its proposal the prime offeror associated with its proposal submission.
a. The Offeror also must ensure that its proposed subcontractor(s) submit their information by the proposal due date and time and all the proposed values that pull forward to the Offeror's proposal are consistent with the subcontractor(s) overall proposed price, along with identifying supporting data and explanations. The Offeror is responsible for ensuring that the proposals of these other entities conform to the same criteria, including supporting data and explanations.
SECTION M - EVALUATION FACTORS FOR AWARD
EVALUATION FACTORS FOR AWARD
M.1 General. This acquisition will be conducted using a Best Value Tradeoff Process authorized at FAR 15.101-1;
therefore, the proposal that is determined to be the most beneficial to the Government given appropriate consideration to the three (3) evaluation factors (Technical, Past Performance, Cost/Price) will be awarded. The Government expects to make a single award with a 4 month phase-in period, one (1) 12 month base period, four one year evaluated option periods, and a 6 month option IAW FAR 52.217-8 as a result of this RFP. The Government will make an award to the responsible Offeror (in accordance with FAR 9.1) whose proposal offers the overall best value to the Government based on the established evaluation criteria. An award under this RFP in no way obligates the Government to obligate additional dollars or additional option year periods.
M.2 Evaluation Methodology
M.2.1 Contractor proposals will be evaluated in two distinct phases. In Phase I, proposals will be evaluated based on Volume II – Technical Factor, Part A: Subfactor 1: Experience and Subfactor 2: Facility Clearance. Only proposals receiving a Phase I rating of “ACCEPTABLE” for both subfactors will be evaluated in Phase II. In Phase II, proposals will be evaluated based on the Technical Factor, Part B subfactors, past performance, and price. The objective is the selection of a contractor whose overall proposal demonstrates the best value to the Government based on the specific criteria and a trade-off analysis. Offerors are cautioned that the award may be made to other than the lowest price offeror or the most highly technical rated proposal.
M.2.2 In Phase I, an offeror must receive a “ACCEPTABLE” evaluation for each factor in order to receive further consideration for an award in Phase II. THERE WILL BE NO FURTHER EVALUATION/RATING IF AN
OFFEROR’S PROPOSAL RECEIVES AN “UNACCEPTABLE” RATING FOR EITHER SUBFACTOR IN
PHASE I.
a. Phase I – Acceptable/Unacceptable basis. The evaluation factors in Phase I are:

b. Phase II - The following factors and subfactors will be used to evaluate each proposal:

Volume III – Past Performance Volume IV – Price
i. During Phase II evaluations, the Government will assign an adjectival rating to each Technical Part B subfactor, and write a narrative evaluation reflecting the identified findings.
ii. The factors for Phase II, including the technical subfactors, are listed above in descending order of importance. The Technical Part B subfactors, when combined, are more important than past performance. All non-priced factors combined are significantly more important than price. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for each Technical Part B subfactor. Additionally, in order to receive consideration for award, a rating of no less than “Neutral Confidence” must be achieved for the Past Performance factor.
M.2.3 In accordance with FAR provision 52.215-1 “Instructions to Offerors – Competitive Acquisition”, the Government intends to evaluate proposals and award a contract without discussions with offerors. However, the Government reserves the right to hold discussions, if necessary.
M.2.4 All proposals shall be subject to evaluation by a team of Government personnel. Contents of written proposals and written responses to Evaluation Notices (if applicable) will be evaluated to determine the degree and extent to which the requirements set forth in the RFP are satisfied. No assumptions will be made by Government evaluators regarding areas not defined in the Offeror's written proposal.
M.2.5 Prior to award, the Government shall make an affirmative determination of responsibility by analyzing whether the apparent successful Offeror complies with the requirements of FAR 9.1. An apparent awardee found not to be responsible will not receive an award. The Government may directly determine the responsibility of the apparent successful Offerors subcontractor(s) with the requirements of FAR 9.104-4.
M.2.6 The Offeror is required to provide adequate documentation which proves its accounting system has been determined adequate by the Government to support the Cost CLINs on this contract. Failure to provide the required documentation shall impact the contracting Officer's responsibility determination. Absent an adequate accounting system, an Offeror cannot be determined responsible under FAR 9.104-5 and will be ineligible for award.
M.2.7 Definitions:
a. Significant Strength: An aspect of an offerors’ proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.
b. Strength: An aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
c. Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.
d. Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance. See
FAR 15.001.
e. Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
f. Uncertainty: Any aspect of a non-cost/price factor proposal for which the intent of the offeror is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).
g. Adverse Past Performance. Past performance information that supports a less than satisfactory rating from sources where the information is from other than formal rating systems such as “PPIRS” or “FAPPIS.”
M.3 Evaluation Criteria
M.3.1 PHASE I
M.3.1.1 VOLUME II, PART A, SUBFACTOR 1: EXPERIENCE
M.3.1.1.1 The Government will evaluate the Offeror’s contract references to determine whether they have recent and relevant experience.
M.3.1.1.2 Information submitted under Volume III – Past Performance will not be considered in the evaluation of this subfactor.
M.3.1.1.3 In order to receive an “Acceptable” rating for this subfactor, the offeror must demonstrate recent and relevant experience. An offeror that does not demonstrate performance which is both recent and relevant to this requirement will receive an “Unacceptable” rating, and will not be further evaluated for award. The Government reserves the right to determine whether a service is the same or similar.
a. Recency is defined as any contract under which any performance, delivery, or corrective action has occurred within the following time standards: five (5) years prior to this RFP closing date, even if the contract award date is outside this five (5) year window.
b. Relevancy:
Relevant: Present/past performance effort involved the same or similar scope and magnitude of effort and complexities this solicitation requires, and the business entity has performed the services for at least two (2) years.
Not Relevant: Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires, and/or the business entity has performed the services for less than two (2) years.
M.3.1.2 VOLUME II, PART A, SUBFACTOR 2: FACILITY CLEARANCE
M.3.1.2.1 This subfactor evaluates whether the Offeror possesses a current Top Secret Facility Clearance granted by the Defense Security Service (DSS) at the time of proposal submission, as well as whether all proposed subcontractors possess the required Facility Clearance at the time of proposal submission (either Secret or Top Secret).
M.3.1.2.2 In order to receive an “Acceptable” rating for this subfactor, the Offeror must possess a current Top Secret Facility Clearance and all proposed subcontractors must possess either a Secret or Top Secret Facility Clearance depending on the tasks they will be performing as outlined in the Subcontracting Matrix. M.3.2 PHASE II
a. The Government will evaluate Part B of the Technical Factor against all of the listed criteria identified in Sections L & M. A combined technical/risk rating will be assigned to each subfactor based on an overall assessment of the risk in conjunction with the strengths, weaknesses, deficiencies, and uncertainties identified in the offeror’s proposal. The Technical Factor - Part B includes the following three subfactors, listed in descending order of importance:

M.3.2.1 VOLUME II – TECHNICAL, PART B

a. This factor considers the extent of the adequacy, effectiveness, and comprehensiveness of the offeror’s technical approach, the extent to which the approach meets the requirements of the solicitation, and whether the Offeror’s technical approach demonstrates an ability to execute the Mission Command Training mission without introducing unacceptable risk, and provides appropriate mitigation of risk for continuity of operations.
b. The Government will perform an integrated assessment of all technical subfactors, assessing them against the criteria set forth below in order to determine a combined Technical Risk/Rating, for each subfactor.
M.3.2.1.1 VOLUME II, PART B, SUBFACTOR 1: Execution Plan: The offeror will be evaluated on their comprehensive understanding of and proposed approach to executing the following elements:
a. Transition during Phase In and Phase Out to include realistic and feasible timelines, as well as the knowledge and ability to fill the proposed positions under the SOFA with Germany and the Shell Agreement with Italy, through DOCPER and/or through application of European business rules for Ordinarily Resident (OR) employees.
b. Execution of day to day tasks at the Joint Multinational Simulation Center (JMSC) hub and spoke sites as well as the Joint Multinational Readiness Center (JMRC). This includes the proposed contractor management approach and the contractor’s ability to demonstrate flexibility and agility, implement cost effective enhancements, and respond to unanticipated changes; the Offeror’s approach to managing, tracking, and reporting on progress, contract funds status, personnel manning and training, contractor operation and management status, and status of assigned equipment; and the Offeror’s approach to managing multiple tasks or exercises at different locations.
c. Execution of exercise schedules to include coverage of JELC events and surge periods within the fixed price workload data. This includes the offeror’s understanding of exercise/event schedules as evidenced by its proposed staffing levels and crosswalk to its staffing plan.
d. MSEL management, scripting, and scenario development to include JMRC OPFOR and intelligence scripting.
e. Logistics management and property management to include its understanding of exercise/event schedules as supported by its overall staffing levels and crosswalk to its staffing plan.
f. Observer Controller Trainer support, including its plan to maintain workforce currency in doctrine, tactics, techniques and procedures.
