1. 1 – If a bidder cannot provide component level pricing for all services attached (as they are CPT descriptors), can the bidder provide a bundled price for numerous sequence numbers?
Yes, a bundle price is ok. Lot of these tests are reflexed, if positive and not done if they are negative.
1. Would the inability to provide a price for each line item disqualify a bidder from the RFP?
The price, no, but they need to offer the test. We understand the pricing may go up for complex testing.
1. Does MML currently provide the Minneapolis VA with courier services? This is not typically something we would include in an agreement unless we can be assured of a $60K minimum due to the costs associated with it. Can we remove this requirement?
There is a current currier in place, that picks up in the afternoons Monday through Friday. We wish to continue this. We do send more than $60k yearly to them, but do not want to be obligated to spend a minimum dollar amount unless we have to.
1. The following language on page 23 “VA reserves the right to approve the assignment of individual personnel furnished by the Contractor to perform the functions specified in the contract” is problematic as we would not allow the VA to determine who performs the work.
Removed from PWS.
1. Turnaround time indicates 4/8/14-17 days of receipt of specimen. However, we would not necessarily meet this. Turnaround time is as indicated in our then current MML Test Catalog.
Turnaround times are correct.
1. Can we remove the proficiency testing language at the top of page 24?
Replaced with: CAP proficiency testing must be found acceptable for all testing being performed by vendor. If any tests are discontinued due to failed proficiency testing then the vendor is not to perform those tests for the MVAHCS and must notify MVAHCS immediately.
1. Can we remove the third paragraph on page 24? MML cannot allow access to our laboratories for any kind of audit.
Same replacement as 6.
1. Testing Summaries – MML provides a summary each month in the invoice of tests ordered, but there is not a cumulative summary sent annually.
Ok to remove – Removed from PWS.
1. As far as test changes, MML provides notification when possible. However, if there is something that happens outside of our control, we may not always be able to provide prior notification.
This is a general rule, emergencies do happen and notification afterwards is ok. We can’t just have methodologies changing without being notified, and if we do not approve of the new mythologies we need to know so we can send patient testing to a vendor that performs the method we approve for treatment of the veterans.
1. Under Section 7, Ordering Procedures, MML cannot police the requirement to notify the VA when the TO reaches 80% pf the bulk order.
Ok to remove – Removed from PWS.
1. On page 28, there is language requiring MML to provide a contact for which orders are placed through. Is this how the VA handles orders today? I don’t think this is typical.
This is currently how the VA is operating. We do not contact for every sample, but this person of contact is to have a person to contact in case of issues and to hold accountable for our samples. We have this in place for all of our referral laboratory testing.
1. Can patent indemnity on page 31 be removed?
Unable to remove.
1. Are bidders able to insert an additional “Comments” column to the right of both option years?
Yes.
1. B.2 Limitations on Subcontracting and B.3 Subcontracting Commitments – are these two sections applicable? We do not utilize subcontractors for testing so I am hesitant to have language that allows a 3rd party on site for auditing.
These will remain in the solicitation but would be not applicable in your case.
1. Can the following be removed? 52.227-17 “Rights in Data – Special Works – Unable to remove.
