About this file

This document is the Terms and Conditions for a DHS commercial acquisition (70Z03826QB0000138) for the acquisition of commercial items and services, effective November 3, 2025.

The solicitation anticipates award on a brand name basis with evaluation conducted in accordance with FAR 12 criteria. Award will be made to the lowest-priced offeror rated as technically acceptable. Technical acceptability is evaluated as either "acceptable" or "unacceptable" based on the offeror's ability to provide new manufactured commercial items from an Original Equipment Manufacturer (OEM) or OEM-approved source with exact part numbers matching the requirements schedule. Only the lowest-priced offer will be evaluated for technical acceptability; if that offer is unacceptable, the evaluation process continues with successively higher-priced offers until a technically acceptable lowest-priced offer is identified. Offerors must submit the "Requirements – 70Z03826QB0000138" excel sheet with completed unit prices, and prices will be evaluated for fair and reasonableness with quantity discounts and prompt payment discounts included in pricing.

Key contractual requirements include: a 60-calendar-day period for acceptance of offers; F.O.B. Destination delivery to USCG Aviation Logistics Center in Elizabeth City, North Carolina; electronic invoicing to ALC-Fiscal@uscg.mil; Certificate of Airworthiness in accordance with FAA procedures (FAA Form 8130-3/8130-4 or EASA 1 Form); Certificate of Conformance per FAR 52.246-15; quality assurance with immediate notification of defects, material changes, or counterfeit/suspect parts; detailed contractor quality control manuals addressing risk management and inspection processes; flow-down of all requirements to subcontractors; and traceability documentation for all parts. The contract includes extensive compliance requirements covering security prohibitions (covered telecommunications equipment, FASCSA orders, Sudan and Iran restrictions), sustainable products and services per EPA guidelines, certification regarding responsibility matters, prohibition on delinquent tax liability or felony convictions, and addressing DEI discrimination. Additional provisions address child labor, convict labor, equal opportunity for workers with disabilities, service contract labor standards, combating trafficking in persons, buy American requirements, and various security and homeland security acquisition regulation clauses specific to USCG operations.
