JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. Do not use marketing language in this document. Language such as “This company has made its mark,” “This company is recognized as industry’s best,” and “This company is the leader in…” is unacceptable.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
Purchase of the following marine heated windows: FIVE (05) NSN 2090-01-501-5982, Window, Marine, P/N KS-19597, used on WTGB-140. ONE (01 EA) Window, Marine, NSN 2090-01-419-3039, P/N KS-28156-31, Used on WLB-225. TWO (2 EA), P/N:
KS-28572 NSN: 2090-01-566-4827, used on 175-WLM.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. These items are heated windows for the WTGB-140, WLB-225, WLM-175 cutters.
They have specific heat dissipation requirements and are designed to work with the existing window controllers. The drawings, tolerances, and technical data for these windows are proprietary to Cornell-Carr Co.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). The OEM holds the design specifications for the require windows needed to support multiple cutters. The vender does not provide this item through a distributor or resale market.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
The Coast Guard did not purchase the manufacturer's proprietary data rights and therefore cannot determine with certainty that an alternate part number would mount to, interface with, or operate effectively with Coast Guard Cutters. Failure of an alternative part, not conforming to the OEM's specifications, could cause damage to the cutters. The manufacturing drawing and specifications have not been purchased by the Coast Guard.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. When the Coast Guard purchased the original equipment there were no requirements for manufacturer's drawings, detailed parts lists, design or testing procedures.
OEM is the only known manufacturer that has the techniques, design specifications, testing, quality assurance capability, and documentation necessary to manufacture these parts as used onboard Coast Guard Cutters.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. COR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be difficult. The Coast Guard cannot require any vendor to release proprietary information.
