Quote Submission
Should I check that I have properly completed and attached all of the required documents with my submitted Quote?
Yes. Prior to the Quote Opening Deadline, a Bidder should review the documents comprising the submitted Quote to ensure that all of the required documents have been completed and attached. Oftentimes a Quote is deemed non-responsive because a Bidder fails to attach a required form or attaches a blank form. To review a submitted a Quote, a Bidder should log into NJSTART and review each document attached to the Quote submission. Instructions on how to review a submitted Quote can be found in the Quick Reference Guide entitled How to Review a Submitted Quote, which is available on the NJSTART Vendor Support Page under Vendor Reference Guides.

Quote Submission
Please confirm a Bidder may deliver a hardcopy quote instead of submitting a response electronically.
Please be advised that all Quotes shall be submitted electronically through NJSTART.
4
Exceptions
Will the State allow Bidders to take exception to any of the Standard Terms and Conditions?
As stated in Bid Solicitation Section 2.2, Exceptions to the State of NJ Standard Terms and Conditions (SSTC): “Questions regarding the State of New Jersey Standard Terms and Conditions and exceptions to mandatory requirements MUST be posed during the Electronic Question and Answer period and shall contain the Bidder’s suggested changes and the reason(s) for the suggested change(s).” Moreover, as stated in Bid Solicitation Section 3.11, Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions may render a Quote non-responsive.
5
Section 1.1, Purpose and Intent
Page 1 (Section 1.1) of the Bid Solicitation states "A single Contractor is not eligible to be awarded both Category 1 – Infrastructure and Category 2 – Non-Infrastructure Contracts; therefore, the previously awarded Contractor for Category 1 – Infrastructure is not eligible for the Category 2 – Non-Infrastructure Contract award resulting from this supplemental Bid Solicitation". a. Is the prime contractor for Category 1 services eligible as a subcontractor for Category 2 services?
The Bid Solicitation was revised as part of Bid Amendment #1, posted on October 1, 2025, to remove the restriction that did not permit the same Bidder/Contractor be awarded Contracts for both Category 1 and Category 2. The current Contractor for Category 1 is now able to submit a Quote in response to this supplemental Bid Solicitation and be eligible for award of Category 2. Please be sure to refer to the most recent version of the Bid Solicitation. Any revisions to this Bid Solicitation will be posted via Bid Amendment and posted in NJSTART.

Section 1.1, Purpose and Intent
Page 1 (Section 1.1) of the Bid Solicitation states "This Bid Solicitation includes a pricing evaluation preference for Small Businesses and Disabled Veteran-Owned Business." a. For prime contractors which do not fall into this category, is there a target percentage for DBE participation? b. If a Small Business or Disabled Veteran-owned business is included as a subcontractor, does the pricing preference apply to all firms included on that bid, or only to the portion of the pricing related to the qualifying firms?
The pricing preference applies to the primary Bidder submitting its Quote and not to its subcontractors. As specified by Revised Bid Solicitation Section 8.9.2, Price Evaluation, if the Bidder at the time of Quote opening is registered as a Small Business Enterprise and/or a Disabled Veteran-Owned Business (DVOB) with the New Jersey Department of the Treasury Division of Revenue and Enterprise Services in accordance with Bid Solicitation Sections 3.8 and/or 3.9, the Bidder will receive a pricing preference of 5% when ranking Bidders based upon the weighted consumption/market basket model used to evaluate pricing.
7
Section 1.2, Background
Page 2 (Section 1.2) of the Bid Solicitation estimates that NJDOT "will require each Contractor to perform between four (4) and eight (8) research projects per year, but does not guarantee any volume of work." a. Can NJDOT clarify the approximate size of each research effort in terms of dollar value? (Eg, 4 studies at $100k each, or 2 large studies at approximately $250k each, plus two small studies at approximately $50k each).
The size of a research study varies based on the scope and type of project, therefore an exact budget cannot be determined without knowing these details. However, for some context, typical estimates for small projects average under $50,000, medium size projects average around $50,000 - $100,000 and large projects average above $100,000.

Section 3.0, Quote Submission Requirements
According to the Pre-quote conference PowerPoint, the only requirements that the bidder shall submit are Section 3.13.2, Section 3.13.8, Section 3.14, Section 3.18, and Section 3.25. Is this all that is needed for submission? Are there any other sections that you suggest that we should submit? For the previous Transportation Infrastructure submission there were many other sections to submit such as the entirety of the forms in Section 3.13, along with Section 3.15 Management Overview, 3.16 Contract Management, 3.19 Organization Experience, 3.20 Location, 3.22 Resumes, 3.23 Experience with Contracts of Similar Size and Scope, 3.24 Financial Capability of the Bidder. Should we submit any of the aforementioned?
The Pre-Quote Conference PowerPoint Presentation Slide 5 outlines the mandatory requirements that a Bidder shall submit as part of its Quote. Please review Section 3.0 in its entirety for all Quote submission requirements. Some Bid Solicitation requirements may state that it "should" or “may” be submitted with the Quote, meaning it is highly recommended and may impact the Bidder's technical evaluation score if not submitted. If the requirement states that it "shall" or "must" be provided, then it is mandatory.
As specified by Revised Bid Solicitation Section 2, Pre-Quote Submission Information, the Bidder assumes sole responsibility for the complete effort required in submitting a Quote and for reviewing the Quote submission requirements and the Scope of Work requirements.
9
Section 3.18, Sample Case Study
Pages 11 and 12 of the Bid Solicitation (Section 3.18), which describes the requirements for a sample case study, asks Bidders to "determine the dollar share of the total estimated budget it would allocate to perform the literature review, technology transfer, survey(s), research plan, data collection, reduction, and analysis of data, reporting of findings, meetings and presentations, and implementation, and include justification for its decision." a. Should bidders include an estimated budget value to complete this case study, or simply report an estimated share allocated to each activity? b. Can NJDOT clarify the number of peer reviews from other states and MPOs that are included in the intended scope of this study? (Eg, interviews with 5 states, or a desktop review of plans from 20 MPOs, etc.) c. Should the Case Study be formatted to meet the requirements listed in Section 4.7.1 PLAN?
A. It is recommended that the Bidder estimate the value of the project in total by considering how much each activity costs. The Bidder should determine the dollar share of the total estimated budget it would allocate to perform the literature review, technology transfer, survey(s), research plan, data collection, reduction, and analysis of data, reporting of findings, meetings and presentations, and implementation, and include justification for its decision.
B. The Bidder may assume interviews with five (5) states and a desktop review of 15 MPO plans.
C. There is no mandatory outline for the sample case study response required in Bid Solicitation Section 3.18. The Bidder can create its own plan to demonstrate its ability to perform the research.
10
Section 3.22, Resumes
Pages 12-14 (Section 3.22) lists requirements for resumes and personnel qualifications for the positions of Chief Engineer, Program Manager, Project Engineer, Principal Engineer, Senior Engineer, and Assistant Engineer. Pages 20-22 (Section 4.11) lists additional roles, including Engineer Technician and Clerk Typist. a. Are the positions listed above required titles and functions for Bidders to submit? Given the Non-Infrastructure focus of this solicitation, would a similar structure (eg, Chief Planner, Principal Planner, etc.) be acceptable, or are those titles specifically required to be identified? b. Many positions require a bachelor of science degree in Engineering. Given the Non-Infrastructure focus of this solicitation, are other disciplines acceptable if they are commensurate with the areas of expertise required to satisfy the research topic areas listed in Section 4 SCOPE OF WORK? For example, may bidders propose personnel with degrees in Economics, Political Science, Planning, or Public Administration in lieu of staff with Engineering degrees? c. Each of the personnel categories listed in Section 3.22 requires licenses. Given the Non-Infrastructure focus of this solicitation, may this requirement be satisfied by certifications of a similar nature in a different discipline? For example, may bidder propose an individual with a PMP certification rather than a PP certification?
A. The Bidder may use the appropriate alternative titles and staff outlined in Revised Bid Solicitation Sections 3.22 and 4.11 to provide the solicited Category 2 - Non-infrastructure services.
B. The Bidder should submit personnel resumes meeting the education qualifications as outlined in Revised Bid Solicitation Section 3.22.
C. The Bidder should submit personnel resumes meeting the certification or licensing qualifications as outlined in Revised Bid Solicitation Section 3.22.

Section 3.25, State-Supplied Price Sheet Instructions; Section 8.16, Contract Award; Section 3.13.13, Business Registration Certificate; Section 5.3, Performance Security
Can bidders propose a small project team (1–2 personnel) for rapid-turnaround studies, or must all eight labor titles be filled at contract award? Will NJDOT award to a single vendor or use a multiple-award model (e.g., task-order pool)? Are academic institutions eligible subcontractors, or must they hold active NJ Business Registration Certificates? Can teaming/joint ventures include out-of-state partners if the prime is an NJ-registered SBE/DVOB? Confirm that no bid bond or performance bond is required.
In order to be eligible for award, the Bidder must submit its all-inclusive hourly rates for Contract Years 1, 2, 3 and 4 for all nine (9) labor titles on the Revised State-Supplied Price Sheet. Failure to provide all the required information may result in the Bidder being deemed non-responsive. Please review Revised Bid Solicitation Section 3.25 carefully for price sheet instructions.
This is a single award Contract for Category 2 - Non-infrastructure services only. Only the Bidder awarded a Contract as result of this Bid Solicitation may provide non-infrastructure services under Category 2.
All Bidders and Subcontractors must provide proof of a valid Business Registration Certificate as outlined in Bid Solicitation Section 3.13.13.
All Bidders and Subcontractors must provide proof of a NJ Business Registration Certificate and comply with Affirmative Action requirements outlined in Bid Solicitation Sections 3.13.13 and 3.13.10, in order to do business with the State of NJ. Out-of-State businesses can submit a form online (Form NJ-REG) to become registered in NJ via https://www.njportal.com/DOR/BusinessRegistration/Home/FirstStep.
This Bid Solicitation does not require a performance or bid bond.
12
Section 3.25, State-Supplied Price Sheet Instructions; Section 8.9.2, Price Evaluation
The state-supplied price sheet instructions (pages 14-15, Section 3.25) require listing all-inclusive hourly rates by year, but not submission of estimated expenditures or costs by year. a. Can NJDOT clarify how price sheets will be evaluated? Will bidders with lower overall hourly rates for listed staff be favored over those with higher rates?
The awarded All-Inclusive Hourly Rates submitted in the Revised State-Supplied Price Sheet will be used for each project budget that is submitted throughout the Contract term. As defined in Bid Solicitation Section 9.2, All-Inclusive Hourly Rates are comprised of all direct and indirect costs including, but not limited to: labor costs, overhead, fee or profit, clerical support, travel expenses, per diem, safety equipment, materials, supplies, managerial support and all documents, forms, and reproductions thereof. This rate also includes portal-to-portal expenses as well as per diem expenses such as food.
It is the intent of the State to award one (1) Contract award for Category 2 - Non-Infrastructure, to that Bidder whose Quote, conforming to this Bid Solicitation is most advantageous to the State, price and other factors considered.
In accordance with Section 8.9.2 of the Revised Bid Solicitation, the Procurement Bureau will utilize a weighted consumption/market basket model to evaluate pricing. If the Bidder at the time of Quote opening is registered as a Small Business Enterprise and/or a Disabled Veteran-Owned Business (DVOB) with the New Jersey Department of the Treasury Division of Revenue and Enterprise Services in accordance with Bid Solicitation Sections 3.8 and/or 3.9, the Bidder will receive a pricing preference of 5% when ranking Bidders based upon the weighted consumption/market basket model used to evaluate pricing.

Section 4.0, Scope of Work, Section 4.9 Meetings and Presentations; Section 4.10, Implementation; Section 5.11, Procurement Efficiency Program
9. Confirm whether Non-Infrastructure Research may include resilience, emergency-management, or environmental-planning tasks. 10. Will NJDOT provide access to existing datasets (e.g., crash or roadway inventory)? 11. Are virtual quarterly meetings acceptable in lieu of in-person sessions? 12. For the Implementation Plan, are demonstration projects required or can recommendations suffice if implementation is outside contractor control? 13. How will project-level funding and approvals be issued — via PO or blanket release? 14. Should quarterly sales reports be uploaded via Periscope or directly to the Contract Manager? 15. May contractors use secure U.S.-hosted cloud tools (e.g., Teams, SharePoint) for data management?
The Category 2 - Non-infrastructure services Contract will include all stated tasks.
If access to existing data is needed, NJDOT will provide the necessary data as appropriate.
Virtual Meetings may be acceptable, however NJDOT will have the discretion to determine if the quarterly meetings will occur virtually or in-person.
The Implementation Plan may include demonstrations. Should results of the research not be amenable to immediate implementation into practice, the Contractor shall ensure that its implementation plan includes recommendations for the additional work necessary to reach the implementation stage. The Contractor shall submit the implementation plan to the SCM for approval and perform a subsequent presentation of its implementation plan upon direction of the SCM. Please refer to Revised Bid Solicitation Section 4.10, Implementation for more information.
Project-level funding will be issued via Purchase Order.
The Contractor shall submit a Sales Report documenting all sales made under the Contract. | 14 |
Section 7.1, Indemnification
Would the State consider modifying the indemnification clause in Section 4.1 of the Standard Terms and Conditions such that the contractor's indemnification obligation is predicated on the contractor's own negligent acts or omissions or willful misconduct? We respectfully request the following modifications to Section 4.1(a): “Indemnification for Third Party Claims - The contractor shall assume all risk of and responsibility for, and agrees to indemnify, defend, and save harmless the State of New Jersey and its officers, officials, agents, servants and employees from and against any and all third-party claims, demands, suits, actions, recoveries, judgments and costs and expenses in connection therewith: a. For or on account of the loss of life, property or injury or damage to the person, body or property of any person or persons whatsoever to the extent arising from or resulting from the negligent acts, errors, or omissions, or willful misconduct, of Contractor, its agents, employees, or subcontractors under this Contract or the order;”
The State does not accept the proposed modification. The State declines to limit its potential risks or waive any potential legal rights beyond those outlined in the Bid Solicitation.
15
Section 8.9.2, Price Evaluation
6. Clarify whether the 5 % SBE and DVOB pricing preferences are cumulative or separate under the weighted evaluation model. 7. May we include a separate attachment explaining indirect-cost assumptions for price lines without rendering the bid non-responsive? 8. Can annual escalations apply during optional extensions beyond 2029?
The 5% pricing preference will apply to individual Bidders registered as a Small Business Enterprise and/or a Disabled Veteran-Owned Business at the time of Quote Opening. The 5% preference will be applied to eligible Bidders' total Quote pricing which will be evaluated as 5% lower and ranked accordingly.
The pricing preference is capped at 5%. If a Bidder is registered as both a Small Business Enterprise and a Disabled Veteran-Owned Business, the pricing preference for that Bidder will be 5%. For more information on this preference, please review Bid Solicitation Section 8.9.2.
