About this file

This is a Questions and Answers document issued by the Delaware Department of Transportation for an open-end PCC patching contract covering the Central region for fiscal years 2026 through 2029 under Project Number T202706503. The contract is structured as an open-end agreement with no predetermined work locations, meaning the Department will issue task orders as patching needs arise throughout the four-year performance period. Work will be performed on Delaware's Central region roadway infrastructure following established technical specifications and construction methodologies. Item 801500 addresses Maintenance of Traffic as a lump-sum item with a breakout sheet identifying four estimated traffic applications. Additional pay items for temporary signs, drums, cones, arrow panels, and Traffic Management Areas (TMAs) are listed separately under items 802003, 803001, 805001, 808002, and 810001.

Pricing is structured on a unit-price basis, with contractors required to submit bid prices for each line item on the breakout sheet. The Department clarified that payment for Traffic Management Areas listed on the breakout sheets will be based on the quantity and price of each TA actually used during construction, while any additional TMAs required beyond those specified will be covered under the individual contract line items. Notably, the Department will not include annual price increase provisions during the 1,095-day contract term, and pricing must be established upfront without the benefit of site-specific details, quantities, or predetermined locations since the contract operates on an open-ended task order basis.

Project Title: OPEN END- PCC PATCHING, CENTRAL, FY 26 - 29

Q # Question Answer 3 The contract duration is 1,095 days. The Department has historically included a provision to negotiate price increases after each calendar year. Will this be the case this time?

No.

2 The special provisions for Item 801500; Maintenance of Traffic, Rehabilitation indicate that temporary signs, drums, cones, arrow panels, and TMA's are to be included in the lump sum price. The proposal also contains separate pay items for these same devices.

Please confirm that payment for the devices will be made under the individual contract items (802003, 803001, 805001, 808002, and 810001) and not be considered incidental to the lump sum under Item 801500. If not, please advise what the individual items are to be used for since there are no plans or locations.

The TA's called out in the breakout sheets are the ones anticipated to be used. Any other TA's required will be covered by the individual contract items.

1 Item 801500; Maintenance of Traffic, Rehabilitation is a LS item with a Breakout Sheet. The project is open-ended with no predetermined locations. The Breakout Sheet lists estimated quantities for four (4) different traffic applications that could be used.

(Question continues on next page)

The price bid on breakout sheets for the TA's listed for each day are the prices that will be paid.

Q # Question Answer Please confirm that payment will be based on the quantity/price of each TA actually used during construction as listed on the breakout sheet. If not, the breakout sheet quantities will not be related to the actual work and we will need the Department to advise what we are to base our pricing on since there are no plans or locations for us to determine.
