Method of Operation for T1841: Geographic Information Systems Services

This document is a Method of Operation for the T1841 Geographic Information Systems (GIS) Services Contract issued by the New Jersey Department of the Treasury, Division of Purchase and Property (DPP) under Bid Solicitation #26DPP01215. The contract is available to State Using Agencies, quasi-State entities, counties, municipalities, school districts, volunteer fire departments, first aid squads, independent institutions of higher learning, County colleges, and State colleges through New Jersey's Cooperative Purchasing Program. Local governments and school districts may also participate as Cooperative Purchasing Partners, subject to compliance with the Local Public Contracts Law and Public School Contracts Law.

The contract encompasses two primary service categories: Price Line 1 (GIS Spatial Data Development) and Price Line 2 (GIS Application Development and Implementation Services). The contract has a base term of three years with optional extensions up to two additional years, not to exceed one year per extension. Services are awarded on a Firm-Fixed Price basis through a Mini-Bid process for project-based engagements. Seventeen contractors have been awarded across these service categories, including Aerial Information, Inc., Cybertech Systems and Software, PMG Software Professionals, and thirteen additional firms such as Bowser Geospatial, Civil Solutions, and Michael Baker International Inc. Using Agencies must issue Requests for Quotations (RFQs) with detailed Scopes of Work to all awarded contractors in the applicable category, allowing a minimum of four weeks for quote submission. Contractor responses must include staff resumes, project references, firm-fixed pricing based on quoted labor rates and estimated hours, detailed methodology, deliverables lists, and completion dates. Mini-Bid awards are determined based on proposed methodology, deliverables, staffing plans, schedules, competitive pricing, and other factors evaluated by the Using Agency.

V. Using Agency Process Guidelines

To solicit firm fixed price Quotes for a Project-Based Engagement, a Using Agency shall create a Request for Quotes (RFQ) with a Scope of Work (SOW) that corresponds to one (1) of the following service category line items:

1. Spatial Data Development; and/or

2. GIS application development and implementation services.

If a project includes the use of multiple service categories, a separate RFQ must be created for each service category.

(Note: A SOW can be written as a separate document or included within an RFQ.) Each RFQ must be sent to all awarded Contractors on the relevant service category line item.

We encourage the Using Agency to hold an optional pre-conference with the State Contract Managers (OIT OGIS) to review any questions or concerns involving the SOW and/or vendor selection.

RFQs shall be sent via email to all awarded Contractors under the applicable category sought after in the RFQ. The timeline for a Contractor to submit their Quote is left to the Using Agency’s discretion but it is recommended that Contractors are provided four (4) weeks, at minimum, to allow time for Contractors to complete more thorough and in-depth Quotes unless there is an urgent need to post for less time. The length of the Mini-Bid period must be stated in the RFQ. Changes are not permitted after the RFQ is posted.

If modifications to a SOW are required, the current Mini-Bid shall be cancelled and a new Mini-Bid with an updated SOW shall be issued.

Mini-Bids may be cancelled by a Using Agency if proposed costs from Contractor proposals are not within the Pro-ject’s budget or specifications with the SOW have not been met.

VI. Contractor Requirements

Upon receipt of a Mini-Bid request the Contractor should acknowledge the Mini-Bid request and their intent to submit or decline the request for a competitive Engagement Response via email to the respective Using Agency Project Manager within five (5) Business Days of receipt.

To be considered for project award during any Mini-Bid process, the Contractor must respond within the timeframe specified within the Request for Quotations (RFQ). If a Contractor does not respond to the Mini-Bid request within the specified timeframe, then the Contractor will be ineligible for Mini-Bid award. If the Contractor responded with their intent to submit a competitive Engagement Response, but the response was not received within the timeframe specified within the RFQ, then the Contractor will be deemed non-responsive to the Mini-Bid. The Contractor’s En-gagement Response shall include the following:

1. Staff resumes proposed to be assigned to the project;

2. Minimum of three (3) references for completed projects similar to the Mini-Bid RFQ project requirements;

3. A firm fixed price based on the Contractor’s quoted labor rates for either Price Line 1 and/or Price Line 2 and the estimated number of hours required to complete the project;

4. A detailed methodology of how this proposal will meet the Scope of Work in the RFQ;

5. List of all project deliverables; and

6. A completion date.

VII. MINI-BID EVALUATION AND SELECTION

Contractor’s submitted Mini-Bid Engagement Response will be evaluated by the Using Agency to select the best response based on the proposed methodology, deliverables, staffing plan, schedule, competitive pricing and other factors.

Applicable to State Agencies only:

After the RFQ closes, the Using Agency must:

1. Submit a single document to the State Contract Managers that includes the RFQ and all valid Mini-Bid En-gagement Responses.

a. No reply should be expected. Proceed to item 2.

2. Conduct an internal review of the Mini-Bid Engagement Responses and score the responses by the criteria cited above.

a. The Using Agency is encouraged to have an optional meeting with the State Contract Managers to review the responses and discuss any questions or concerns that may arise.

If no Mini-Bid Engagement Response is deemed acceptable, the process stops. If one or more Mini-Bid Engagement Responses are deemed acceptable, then the Using Agency may proceed with their procurement via NJSTART. In-cluded in the NJSTART procurement must be the final scorings of the Mini-Bid Engagement Responses by the Using Agency and the selected winning response. Note that the State Contract Managers will review the final selection in NJSTART and nothing further needs to be submitted directly to them.

VIII. SUBCONTRACTOR GUIDELINES

Services performed by Subcontractors should be included in a Contractor’s Quote under the following conditions:

1. The Contractor must have the State’s prior approval for use of the Subcontractor based on its Subcon-tractor Utilization Form; and

2. Subcontractors may only be utilized for the GIS service categories specified on the Contractor’s sub-contractor list.

To add a Subcontractor, or service category for an existing Subcontractor, the Contractor must submit a Subcontrac-tor Utilization Plan form to DPP for approval. The following forms for the Subcontractor must also be included:

1. Affirmative Action Employee Information Report;

2. Chapter 51/EO 117 Summary;

3. Disclosure of Investigations and Other Actions Involving Bidder;

4. Disclosure of Investment Activities in Iran; and

5. Ownership Disclosure.

All the forms listed above are available from the DPP website at https://www.nj.gov/treasury/pur-chase/forms.shtml.

A Contractor may not add GIS service categories for an existing subcontractor or add a new subcontractor until written approval from the SCM and DPP is provided to the Contractor.
