The awarded Contractors may only utilize those Brands as approved and listed by the State. Approved Brands are listed in this Method of Operation. Each Contractor remains solely responsible for the performance of its Brands under the terms and conditions of the Contract with the State. The State may request the removal of Brands for cause, including Contractor responsibility reasons.

Contractors and their awarded Brands shall only accept orders for, and provide quotes for, the specific brands and Category of equipment and services that were awarded to them.

Contractors awarded equipment in Amateur Radio Equipment, Aircraft, and Marine Categories are authorized to provide all equipment supporting that service, including, at a minimum, antennas, base station control equipment, mobile and portable transceivers, packet data transmission devices, GPS, navigation, emergency location transmitters, etc.

Specific details regarding a Category/Price Line and specific requirements for all other Contract-specific items, such as, but not limited to, installation, shipping, maintenance, warranty, training, and Contractor responsibilities can be found in the appropriate sections of the Bid Solicitation. If there are questions regarding a Contractor’s product offerings, the Using Agencies and Cooperative Purchasing Partners should contact the Contractor. Contractor contact information can be found in Section 8.0 Contractor Contact Information of this Method of Operation. Questions about Contract-specific items should be directed to the State Contract Manager.

State of New Jersey Legislative and Judicial Branches, as well as Cooperative Purchasing Partners, shall place orders with, receive invoices from, and make payment directly to the Contractor.

Executive Branch Using Agencies will each follow their own internal review and approval processes prior to engaging with the Office of Information Technology (OIT) processes, when appropriate. CPPs are responsible for independently reviewing all Contractor quotes and verifying pricing against the posted Contract price lists in NJSTART before issuing a purchase order to the Contractor. The State Contract Manager will no longer review or approve quotes on behalf of CPPs. CPPs may contact the State Contract Manager for assistance if clarification is needed; however, the responsibility for validating pricing and ensuring compliance with the posted Contract price lists rests solely with the CPP.

5.0 PRICING

Using Agencies and CPPs are to adhere to the pricing that is listed in the price catalogs that are posted to NJSTART. All pricing is firm-fixed and may be updated quarterly on NJSTART.

All Contractors, and their awarded Brand(s) prices include all transportation charges, FOB Destination, to all State Using Agencies. Escalation clauses shall not be accepted.

The Contractor, and their awarded Brand(s) discount percent (%), is firm for the period of the Contract and shall not be updated at any time.

Using Agencies and CPPs should independently verify the accuracy of all such quotes by utilizing the Contractor’s attachments on NJSTART. Using Agencies and CPPs should not use pricing sheets submitted directly to them from the Contractor/Brand.

5.1 PRICING UPDATES

The awarded Contractor must submit pricing update requests to the State Contract Manager. The awarded Brands shall not contact the State Contract Manager or the Division of Purchase and Property directly for a pricing update request. If a price update request is approved, the updated price catalogs will be uploaded to NJSTART.

All Using Agencies and CPPs shall use the pricing sheet on NJSTART when verifying the accuracy of a Contractor’s pricing. Using Agencies and CPPs should not use pricing sheets submitted directly to them from the Contractor/Brand.

Pricing update requests should be submitted in a single document that includes both new and existing Contract items. Tabs are permitted, but the submission should be consolidated into one (1) file. The Excel format should include the following columns for each line item:

· Line Number of Contract Award

· Unique Part Number

· Description

· List Price

· Discount %

See Section 7.0(e) of this Method of Operation for Maintenance Quotes instructions.

6.0 PROJECT ENGINEERING AND SITE MANAGEMENT

Any custom design work, site modification, or system integration must remain within the confines of the Purpose and Intent of this Method of Operation. Rates for Project Engineering and Site Management are included on a Contractor’s State-Supplied Price Sheet, Schedule B. The Contractor shall provide a written quote to the Using Agency/CPP specifying all service charges in advance of the purchase of the equipment/system.

If Project Management services are required, the Contractor should adhere to the State’s project management standards which are specified in the document posted at the following link: http://www.nj.gov/it/docs/vendors/ProjectManagementAppendix.pdf.
