Combined Synopsis/Solicitation

Request for Quotation Number 1333ND20QNB640272

THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN

ACCORDANCE WITH THE FORMAT IN FEDERAL ACQUISITION REGULATION (FAR) SUBPART

12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL

ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE.

THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING

REQUESTED; A WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED.

THIS SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES UNDER

THE AUTHORITY OF FEDERAL ACQUISITION REGULATION (FAR) PARTS 12 AND 13, AND IN

ACCORDANCE WITH A CLASS DEVIATION OF THE FAR, ISSUED BY THE DEPARTMENT OF

COMMERCE, IN ACCORDANCE WITH FAR 1.404, TO INCREASE THE SIMPLIFIED ACQUISTION

THRESHOLD (SAT) FROM $150,000 TO $250,000.

This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-05 effective March 30, 2020.

The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a small business size standard of 1,000 employees. This acquisition is 100% set-aside for small business.

The non-manufacturer rule applies to this solicitation. Reference Federal Acquisition Regulation (FAR) clause

52.219-33 Nonmanufacturer Rule.

To be awarded a set-aside contract or order, as a nonmanufacturer, the Contractor must:

(i) Provide the end item of a small business manufacturer, that has been manufactured or produced in the United

States or its outlying areas; (ii) Not exceed 500 employees; (iii) Be primarily engaged in the retail or wholesale trade and normally sell the type of item being supplied; and (iv) Take ownership or possession of the item(s) with its personnel, equipment or facilities in a manner consistent with industry practice.

Quoters must possess an ACTIVE registration in the System for Award Management system when submitting a quotation and shall continue to be registered until time of award, during performance, and through final payment of any contract resulting from this solicitation. The Contracting Officer will confirm that quoters have an “active” registration at the www.sam.gov website upon receipt of the quotation. If the SAM.Gov registration is not active, the quotation cannot be considered for award.

The National Institute for Standards and Technology (NIST) has a requirement for a spark plasma sintering

(SPS) system. The SPS system will enable NIST to fabricate high-density (> 95%) bulk compacts from powders for a wide range of complex materials as required for accurate transport property measurements, the preparation of targets of compositionally complex and commercially unavailable compounds for use in NIST’s combinatorial pulsed laser deposition system (to grow new and mission critical composition spread film samples), and the development of measurement science for understanding the fundamentals of the SPS technology for manufacturing of electro-ceramics.

This SPS system will significantly enhance NIST’s materials-processing infrastructure for preparing artifacts suitable for material-representative property measurements. It will also enhance NIST’s ability to deliver http://www.sam.gov/

Reference Materials (RMs), Standard Reference Materials (SRMs), and renewal SRMs at a lower cost and at a faster pace.

Responsible quoters shall provide a quotation for all of the following line items. All equipment must be new.

Used or remanufactured equipment shall not be considered for award.

LINE ITEM 0001: QTY 1 EACH, SPARK PLASMA SINTERING FURNACE meeting all of the specifications identified in the attached statement of work. Reference requirements for delayed manufacturing/delayed delivery.

LINE ITEM 0002: QTY 1 JOB SET-UP AND HOOK UP OF EQUIPMENT

Reference the attached statement of work for requirements.

LINE ITEM 0003: QUANTITY 1 JOB, TRAINING

Reference the attached statement of work for requirements.

LINE ITEM 0004: QUANTITY TWO-YEAR WARRANTY

Reference the attached statement of work for all warranty requirements.

DELIVERY

Delivery terms shall be FOB Destination. The Contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery.

TRAVEL

Travel to the NIST, Gaithersburg, Maryland campus, is required for the set-up and hook up of the equipment.

All travel costs are the responsibility of the Contractor and must be included in the firm fixed price.

ACCEPTANCE CRITERIA

Final acceptance by the Government shall be granted after successful completion of delivery, set-up, hook-up, confirmation that the equipment meets all required specifications, and training. Should any deficiencies be noted prior to final acceptance, the Contractor will be notified of all deficiencies, and provided the opportunity to correct all deficiencies at their expense, in accordance with the commercial terms and conditions of the contract.

PAYMENT SCHEDULE

A payment schedule will be negotiated with the successful quoter. The Government prefers that the Contractor be paid in one lump sum payment upon successful completion of delivery, set-up and hook up, and demonstration of salient characteristics, however, partial payments may be authorized.

Quoters are advised that the Government cannot pay more than 15% of the total amount of the award as a

“deposit” and/or prior to receipt and acceptance of the equipment, and that at least 40% of the total amount of the award will be included in the final payment upon successful completion of all required work.

EVALUATION CRITERIA AND BASIS FOR AWARD

The Government intends to award a purchase order, resulting from this solicitation to the responsible quoter whose quotation, conforming to the solicitation, results in the best value to the Government, price and other factors considered.

The following will be used to evaluate quotations:

Technical Acceptability

Experience

Past Performance

Price

Experience, past performance, and price will not be evaluated if a quotation is not technically acceptable in accordance with the technical acceptability evaluation factor.

All non-price factors, when combined, shall be equal in importance to price. In determining best value, preference will be given to system with smaller footprint dimensions, and/or ram strokes in excess of 75mm, and/or current output in excess of 4,000 A.

TECHNICAL ACCEPTABILITY

Technical acceptability will be evaluated to determine that the quoted equipment meets all required specifications. Quoted system modifications will be evaluated, as applicable, to determine the feasibility and likelihood for success relevant to the quoted modification(s).

EXPERIENCE

Experience shall be evaluated to determine the depth and breadth of the quoter’s experience manufacturing the same or similar equipment.

PAST PERFORMANCE

Evaluation of Past Performance shall be based on the references provided and/or the quoter’s recent and relevant procurement history with NIST, its affiliates, and/or other relevant references. Past performance evaluation shall determine the overall quality of the services and end products provided by the Contractor.

Quoters with no relevant past performance shall receive a neutral rating.

PRICE

Price will be evaluated to determine that the total price is consistent with the technical portion of the quotation and is a fair and reasonable overall price to the Government.

REQUIRED SUBMISSIONS

NIST LOCAL-53 CONTRACT PERFORMANCE DURING CHANGES IN NIST OPERATING

STATUS

http://www.acquisition.gov/

Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays. However, throughout the contract period of performance, there may be circumstances beyond the control of the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), that will impact normal days of business operation, such as inclement weather, power outages, etc. In circumstances such as these, the Contractor must call the appropriate NIST campus status line to verify the operating status:

Gaithersburg Campus Operating Status Line:

(301) 975-8000

(800) 437-4385 x8000 (toll free)

Boulder Campus Operating Status Line:

(303) 497-4000

During a lapse in appropriation, access to Government facilities and resources, including equipment and systems, will be limited to excepted personnel for both Federal employees and Contractor personnel. If performance of the contract is onsite and/or requires Government interaction, unless you have been, or are notified that you are to work under an excepted status, you will automatically enter a temporary work stoppage.

The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at https://www.nist.gov/ and/or the NIST operating status lines. Additionally, Contractors are encouraged to monitor public broadcasts or the Office of Personnel Management’s website at www.opm.gov for the Federal Government operating status.

NIST will provide notification to all contractors that are determined to have excepted status. All excepted contractors are required to continue performance and communicate with the appointed Contracting Officer’s

Representative (COR) for further guidance, or NIST Contracting Officer if a COR is not appointed.

Contractors with supply or service contracts that are fully funded at the time of contract award and do not require access to Government facilities, resources, or active administration by Government personnel in a manner that would cause the government to incur additional obligations during the lapse in appropriation may continue performance.

(End of clause)
