About this file

This is a Sole Source Justification Form (Bulletin Reference Number 27-444DHS-MENTH-B-51451) submitted by the Illinois Department of Human Services, Division of Behavioral Health & Recovery. The document justifies the selection of Kathryn DuPree of Crosswinds Consulting LLC as the sole source vendor to serve as the independent and impartial Court Monitor for the Williams v. Pritzker Consent Decree. Ms. DuPree was appointed by federal Judge Lefkow on May 27, 2022, and the State argues that no alternative vendor can be selected because the final determination of the monitor rests with the federal court. The justification emphasizes that the vendor's unique appointment by the federal judge, combined with her extensive experience working on consent decrees in other states, makes her the only available source for this service.

The contract is for a new one-year term beginning July 1, 2026, and ending June 30, 2027, with an estimated value of $315,000 and no renewal options. The Court Monitor will be compensated at an hourly rate of $300 per hour and will be responsible for evaluating state compliance with the decree, identifying areas of non-compliance, mediating disputes between parties, submitting semi-annual and annual reports to the court, and processing travel expenses and administrative costs. The budget includes work, travel, administrative assistance, and consultant services, with estimation based on the unknown scope of quality reviews and data validation. Funding will be provided through State Appropriate Funds. The procurement history shows this is a continuation of monitoring services, with prior contracts dating back to October 2017, all classified as sole source awards except the initial contract, which was an exemption.
