These NSNs have been assigned an Acquisition Method Code (AMC) of “3” and an Acquisition Method Suffix Code (AMSC) of “C.” According to DFARS PGI 217.7506, the NSNs are being acquired for the second or subsequent time and should be acquired directly from the manufacturer. 6. Market Research/Efforts to Obtain Competition (10 U.S.C. 2304(f)(3)(D)&(E): Market research has been conducted to find other potential sources for the production of the EPP III. Technical experts supporting CECOM published a Sources Sought Announcement to find potential sources capable of producing the parts needed to support this requirement. A market survey was posted to the Government Point of Entry (GPE) from March 19, 2015 to April 2, 2015, with a list of required spare parts to sustain the EPP III. The only company that responded was Jenoptik Defense and Civil Systems (CAGE Code D0857), a distributor.
The Contract Specialist conducted an internet search of the IHS Haystack Gold database, Army i2Log, and Federal Information Service (WebFLIS) during the month of May 2015.
Current market research has not yielded any other manufacturing sources that can meet the Government’s requirements.
The Contracting Officer synopsized the proposed contracting action on the Federal Business Opportunities (FedBizOpps) website on June 12, 2015. The synopsis was posted for 15 days in accordance with FAR 5.203(a). In addition, Defense Logistics Agency Directives (DLAD) 52.217-9002 (Oct 2014), “Conditions for Evaluation and Acceptance of Offers for Part Numbered Items” will be included in the solicitation. The Contracting Officer will also include FAR 52.244-5 “Competition in Subcontracting” (DEC 1996), which requires the contractor to select subcontractors on a competitive basis to the maximum practical extent consistent with the objectives and requirements of the contract. This J&A will be made available for public inspection via FedBizOpps after award, in accordance with FAR 6.305.
7. Price/Cost Considerations (10 U.S.C. 2304(f)(3)(C)): The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. Detailed documentation and justification of price reasonableness will be disclosed in the official price negotiation memorandum to be prepared upon completion of negotiations.
8. Actions Being Taken to Overcome Barriers to Future Competition (10 U.S.C.
2304(f)(3)(F) DLAD 6.303-2(a)(S-90)(i) DLAD 6.303-2(a)(S-90)(ii): Army Communications-Electronics Command previously purchased these spare parts from Jenoptik, under contract W15P7T-11-D-A201. This contract was awarded to Jenoptik on July 29, 2011 using the FAR 6.302-1 sole source authority-exemption to full and open competition. In that J&A, the Government stated that the Government would continue to conduct market research to ascertain if there have been any changes in the marketplace that would enable future competition. Since that J&A was signed, market research has continued to be conducted. Specifically, it was discovered during this market research that Jenoptik did not own the TDP for the electric engine starter and BC alternator, which are
