SPRBL l - l 6-Q-0002

1. Contracting Activity:

2. Description of Action:

DLA Land at Aberdeen 6001 Combat Drive Room Cl-301

APG, MD 21005-1846

This Justification and Approval suppolis the acquisition of repru:able parts using other than full and open competition procedures for a five-year, Finn-Fixed-Price, Indefinite-Delivery/Indefinite Quantity contract, with no options. The requirement is for production and delive1y of the Control, Motor-Generator; National Stock Number (NSN): 6110-12-345-6331 , Pait Number: 08977. The acquisition will be conducted using procedures outlined in Federal Acquisition Regulation (FAR) Subpait 13.5 - Test Prograin For Ce1tain Conunercial Items in accordance with 41 USC 1901. The guaranteed minimum for this acquisition is and the contract maximum value is - The Best Estimated Quantity (BEQ) value is Alm y Working Capital Funds will be used for this eff 01t.

3. Description of Supplies:

The following part is related to this acquisition, which suppo1ts the maintenance and sustainment of the PA TRI OT Electric Power Plant (EPP) III system:

Nomenclature NSN Part Number BEQ Quantity

Control, Motor-Generator 6110-12-345-6331 08977 4

The EPP III system is manufactured by J enoptik Defense and Civil System (CAGE 1 VD6 l) (fo1merly known as Lechmotoren GmbH). The EPP III is a self-contained, mobile electric power plant that consists of two Geiman-manufactured 150kW/400Hz diesel engine-driven generator sets and associated equipment, including a power distribution unit, groundin s stem fuel tanks and distribution s stem and cable reels with ower and control cables

Knon-Bremse Rail Vehicle Systems GmbH (fo1merly known as Transtechnik GmbH, CAGE:

Cl672) is the original equipment manufacturer (OEM) of the this pait1

, which was selected for use in the EPP III to meet the US Almy and PA TRI OT perfo1mance requirements of the EPP III. This pait is a reparable spare required to maintain existing PATRIOT 150 kW Generator Sets. This item prepares and regulates the exciter voltage off of the synchronous generator in order to regulate the output voltage required by the RS and ECS loads and maintain power quality. It consists of the

1 The previous J&A identified Lechmotoren as the OEM. This is incoITect. Lechmotoren was the OEM for several parts associated with the previous acquisition, but not for these pa1is. KnoIT-Bremse Rail Vehicle Systems GmbH is identified as the OEM in WebFLIS and through market research.

SPRBLl-16-Q-0002 equal power distribution, linear regulator, averaging circuit, and voltage sensing transfo1mer boards.

4. Authority Cited:

10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reasons for Authority Cited:

. The Acquisition Method Code is 3; DF ARS PGI 217. 7 506 states that the NSN is for the second or subsequent time and should be acquired directly from the manufacturer. The Acquisition Method Suffix Code (AMSC) is C; DFARS PGI 217.7506 states that the paii requires engineerin source a roval b the desi control activi in order to maintain the uali of the s ai·e ruts .

. The Government does not possess technical data (drawings or specifications) that comp ete y efine fonn, fit, and function of the items being procured. Additionally, the foim, fit, and function of the EPP III and its spare paiis are not defined in any nationally recognized industiy standard or specification. Use of any other source 's spare pa1is would require additional testing and redesign since any other source's spare paiis would not be compatible with existing EPP III engmes.

Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s) . The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the paii. An alternate source must qualify in accordance with the design conti·ol activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the paii in the intended application.

It is estimated by CECOM engineering personnel that the cost to qualify a new Conti·ol, Motor Generator would require a $1M to $10M investment which significantly exceeds the estimated price of this procurement, and is not anticipated to be recovered through competition. The EPP Ills must be standardized so that the same models ai·e in the field to ensure interchangeability and effective operation of the PA TRI OT MDS, and to enable interchangeability of maintenance support.

6. Effo11s to Obtain Competition:

This is a proposed, non-competitive, follow-on acquisition of supplies previously awai·ded on a non-competitive basis (W15P7T-11-D-A201). The previous justification recommended that the Government continue to conduct market reseai·ch to asce1iain if there are any changes in the market place that would enable future actions to be competed. The Conti·acting Officer

SPRBLl-l 6-Q-0002 detennines that these effo1is were completed through market research conducted in anticipation of this acquisition.

CECOM technical expe1is issued a Sources Sought notice on Federal Business Oppo1iunity (FBO) on March 19, 2015 titled "MARKET-SURVEY-5810-1." The announcement required interested paiiies to respond by April 2, 2015. Results of the sources sought notice are located in the mai·ket research section of this document.

The Contracting Specialist conducted market research which is explained in the market reseai·ch section below. The proposed contracting action was synopsized in accordance with FAR 5.201and posted to FBO on June 9, 2015. This effo1i yielded no additional potential sources .

In addition, DLAD 52.217-9002 (Oct 2014), Conditions for Evaluation and Acceptance of Offers for Pait Numbered Items, will be included in the solicitation. This provision will identify the necessary conditions required to supply an alternate paii.

7. Fair and Reasonable Cost:

As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on the use of some combination of cost/price analysis or a compai·ison of proposed prices with an Independent Government Estimate. The total estimated contract value is less than the $750,000 threshold requiring ce1iified cost or pricing data.

Therefore, data other than celiified cost or pricing data will be obtained, as needed, to support a fair and reasonable price detennination.

8. Mai·ket Research:

CECOM received one response to the FedBizOpps Sources Sought Notice issued Mai·ch 19, 2015. That response was from Jenoptik Advanced Systems, LLC (fo1mally Lechmotoren GmbH).

The Contracts Specialist conducted seai·ches of Federal Logistics Infonnation Service (WebFLIS), Haystack, i2Log, review of previous award, and internet seai·ches in the month ofFebrnary 2016.

The review of the previous contract (W15P7T-11-D-A201) was awarded to Lechmotoren GmbH (now known as Jenoptik). In reseai·ching the acquisition of this aii it was dete1mined that Jeno tik is the OEM for the overall EPP III s stem.

Research for potential vendors listed as being capable of providing this paii was conducted in April 2015. Emailed requests went out on April 24, 2015 with responses due back May 1, 2015 to businesses that were identified by the applicable No1ih America Industiy Classification System (NAICS) number 335312. No responses were received, so another request for interested vendors was sent on 8 May 2015. A total of 10 emails were sent which resulted as follows: one (1) company is not interested; one (1) stated that they had no stock, and eight (8) companies did not respond. The market research conducted in this acquisition has resulted in no source other than Jenoptik, serving as a distributor for KnoIT-Bremse Rail Vehicle Systems GmbH.
