SECTION C-1.0 GENERAL

C-1.1 Introduction This Performance Work Statement (PWS) is for Contractor Owned-Contractor-operated (COCO) fuel services at Laughlin Air Force Base, Texas. The Contractor will operate, maintain, manage and provide retail/bulk fuel services as described herein for all fuel facilities, related structures, and property described in this PWS. Refueling operations and maintenance will be performed IAW best commercial practices. As required, the Contractor shall furnish all personnel, equipment, facilities and/or material necessary for providing these services.

C-1.2 Mission Statement The Contractor shall provide COCO operation and maintenance services for bulk and retail refueling services. The Contractor shall be responsible for operation and maintenance of all facilities and equipment, and will be accountable in accordance with the terms and conditions of this contract.

C-1.3 Scope of Work The Contractor shall perform required tasks to include fuel operations, management and administration pertaining to the receipt, storage and handling, and issue of DLA Energy fuel products. In addition, the Contractor shall ensure all personnel are adequately trained to perform job tasks, maintain the security of facilities and computer systems, and comply with base, local, state and federal laws and regulations.

C-1.4 Contract Performance The Contractor shall monitor performance and ensure contract compliance as prescribed by the Contract Compliance Plan submitted. The Contractor shall perform and achieve performance standards for each task. The Contractor shall submit performance based plans to ensure performance standards are met and comply with applicable regulations as described in section 3.0 of this PWS. The Contractor shall ensure compliance with and be responsible for obtaining copies of all applicable federal, state and local laws and regulations, including changes.

C-1.5 Personnel Qualifications The Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations. The Contractor shall be able to read and understand English to the extent of reading and understanding printed regulations, detailed written orders and operating procedures, training instructions and materials, and shall be able to compose reports that convey complete information.

The Terminal Manager shall have specialized experience in and knowledge of DoD fuels management instructions and procedures; receipt, handling, and storage methods; properties and characteristics of petroleum products; safety precautions; accounting procedures; principles of inventory control; and shipping petroleum products via tank truck as appropriate to a military installation, as well as, maintenance and repair of retail fuels terminals, systems, and equipment.

The terminal manger must have completed FMD (Fuels Manager Defense) automated system training and have experience processing fuels transactions using FMD. Should FMD recertification be required, the contractor will be responsible for all travel costs associated with such training. The Contractor shall interpret, enforce, and comply with all federal, state, county, and local environmental laws and regulations.

C-1.6 Suitability Investigations Contractor personnel shall successfully complete a background investigation which includes, at a minimum, a National Agency Check (NAC), before operating a computer workstation that has access to a government server or when the Contractor employees require unescorted entry to restricted areas. These investigations shall be submitted by the Laughlin Air Force Base at no additional cost to the Contractor. The Contractor is responsible for submitting documentation to the appropriate office for applicable employees and shall comply with the DOD 5200.2-R, Personnel Security Program.

C-1.7 Contractor Manpower Reporting The Contractor shall report all Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Logistics Agency via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. C-1.8 Drug Free Workplace The Contractor shall establish and maintain a Workplace Drug Testing Program in accordance with Executive Order 12565, “Mandatory Guidelines for Federal Workplace Drug Testing Programs”, dated September 15, 1986 and Section 503 of Publication 100-71, 5 United States Code (USC), Section 7301, the Supplemental Appropriations Act for Fiscal Year 1987, dated July 11, 1987.

C-1.9 Applicable Directives The Contractor shall comply with applicable statutory and regulatory requirements and validated best commercial practices. This requirement applies to all performance criteria and deliverables set forth in this document. Appendix - E provides a list of directives and other guidance that are applicable to the performance of this contract. The list is not all inclusive. In the event of conflicting guidance, the most stringent shall be enforced. The Contractor shall contact the Contracting Officer (KO) and/or the Contracting Officer’s Representative (COR) for clarification.

C-1.10 Quality Monitoring and Evaluation DLA Energy shall utilize a Quality Assurance Surveillance Plan (QASP) to monitor and evaluate the Contractor’s performance throughout the contract performance period. DLA Energy may also perform customer satisfaction surveys, which may be used as part of the assessment of Contractor’s performance. The Contracting Officer has the option to increase the frequency of surveys to address contract compliance issues as needed.

SECTION C-2.0 PERFORMANCE REQUIREMENTS

C-2.1 Fuel Operations Retail dispensing will be provided for refueling of ground vehicles/equipment including ultra low sulfur diesel (ULD), and unleaded gasoline. Bulk issue dispensing will be provided for ULD.

Fuel operations at the retail fuel facility must be safely and efficiently conducted to receive, store, and issue petroleum products with appropriate controls to ensure adequate fuel quality, inventory accuracy and environmental compliance in accordance with DLA Energy guidance, the highest industry standard, and best commercial practice.

C-2.2.1 After-Hours Response The Contractor shall establish an after-hours notification mechanism: a means of being contacted in the event emergency services or workforce augmentation is. All services required outside of the normal hours of operation shall be met within two (2) hours as measured from the time the Contractor is notified until the operator is in position to perform the service required.

C-2.3 Contractor Labor Hours Reporting The Contractor shall report all labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Logistics Agency via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: https://www.ecmra.mil.

C-2.4 Operations The Contractor will perform all fuel operations, inventory management, quality surveillance, maintenance, training, safety and environmental protection functions at the ground fuel service station. The service station will provide fuel support to authorized reimbursable Defense Working Capital Fund (DWCF) customers that have approved DLA–Energy purchase devices or have an assigned DODAAC, FEDAAC or "2A" DODAAC.

C-2.5 Product Receipt The Contractor shall at all times safely receive product without causing delays, interruption, or demurrage. This applies to response times for duty hours, non-duty hours, and extended surge operations at the specified refueling sites. During commercial tanker truck receipts, the Contractor will escort fuel delivery trucks from and to the gate for all sites.

C-2.5.1 The Contractor will order fuel using the appropriate DLA system and shall immediately notify the DLA Energy Region office of any inventory/quantity discrepancies or the DLA Energy QAR and COR of any quality discrepancies.

C-2.5.2 The Contractor shall schedule inbound fuel shipments, receipts utilizing appropriate DLA Energy systems (i.e. PORTS, EBS, etc.). Receipt notification shall include the quantity received, mode of delivery, delivery date, shipment source, grade or type of product, and any special instructions. The Contractor shall immediately notify the COR/QAR

7 As of June 13, 2019 designated office of any fuel quantity or quality discrepancy; the COR will then notify DLA Energy Americas East. The Contractor shall not offload off specification fuel unless a waiver has been granted by DLA Energy-Q (Quality/Tech Support Office). The Contractor shall prepare all documents required for product receipt.

C-2.5.3 All incoming product shall be sampled in accordance with the most current version of MIL STD 3004 and Quantity determination shall be performed as outlined in DoD Manual 4140.25, DLA Energy Interim Policy P-2 and API Manual of Petroleum Measurement Standards (MPMS). The Contractor shall accomplish and submit all appropriate documentation to the DLA Energy Regional Office.

C-2.5.4 During transport truck receipts, the custody and risk of loss shall pass from the carrier to the Contractor when the product passes from the end of the truck discharge hoses into the Contractor’s receiving facility.

C-2.5.5 The Contractor shall not receive and dispense fuel from the same tank simultaneously.

C-2.6 Product Storage The Contractor shall at all times safely maintain product quantity, quality, and availability to meet its intended use as specified by the contract. The Contractor shall maintain the product storage facilities, as well as maintain product stock levels required to support the mission and planning requirements, within allowable limits. Product will be maintained to preclude degradation, contamination, commingling, or other occurrences which render the product unsuitable for its intended use. The Contractor shall immediately notify the COR/designated office of any issues which impact the integrity, quantity, or availability of fuel in storage.

C-2.7 Product Issue Except for scheduled maintenance, and other occurrences of which the COR has been notified, the Contractor shall maintain a tank in the ready-to-issue mode for bulk and retail dispensing 24/7.

The Contractor shall issue product without causing operational delays and ensure that all product is on specification. The Contractor shall immediately notify the COR of any discrepancy or issue that may result in the inability to issue product.

C-2.8 Automated Dispensing System Key Management The base shall provide the Contractor with a data file containing the fuel keys currently in service that the Contractor will upload into the automated fuel dispensing system. The Contractor shall be responsible for issuing and revoking keys as requested in writing from the customer units. The base shall provide the Contractor with fuel key data files as changes occur to issued fuel keys.

C-2.8.1 Contractor shall maintain databases as necessary to provide all required reports required by the contract, including but not limited to, customer account numbers, responsible office for key/card holders, key/card serial numbers, and other key/card information. The Contractor shall provide required reports as prescribed by DLA Energy.

C-2.8.2 The Contractor shall be responsible for receiving maintaining, issuing, reprogramming and revoking keys as requested in writing from the COR and in accordance with DLA Energy Interim Policy P-5. The Contractor shall issue replacement keys within two working days after receiving the written request from the COR, and the same day for emergencies as directed by the COR.

C-2.8.3 To procure additional VIL-Keys, the Contractor should order VIL Keys IAW the guidelines outlined in DLA Energy P-5.

C-2.9 Accounting for Fuel/Inventory Management

The Contractor shall account for fuel in accordance with I-119.04 and DoD 4140.25-M, “Management of Bulk Petroleum Products, Natural Gas, Coal”, and other applicable DLA Energy policies and procedures. DLA Energy Policies are online at:

C-2.9.1 Physical Inventory Management Shall Include Documenting each order, receipt, transfer, sale, loss, credit, gain, and adjustment, maintaining auditable product document control files, using inventory measurement practices that support product accountability and auditability.

C-2.9.2 Inventory The Contractor shall be responsible for and perform all fuels inventory, accounting and administrative functions using Fuels Manager Defense® (FMD) and EBS software provided by DLA Energy. The Contractor will provide computer hardware in compliance with contract provision I119.04. Internet will be provided by the Contractor. The Contractor will reconcile all inventory transactions monthly within 2 days after the last day of the month.

The Contractor shall process the required documentation for server access; as well as meet all Laughlin AFB requirements for access to the DoD server, if required. The Contractor shall be responsible for determining reorder cycles and ensuring that adequate stocks are on hand to fully support mission requirements. The Contractor will coordinate with the Air Force Petroleum Office and DLA Energy Region Office to re-order fuel as needed using the appropriate DLA system, as required. The Contractor shall be prepared to convert to a process of re-ordering fuel supplies through the Enterprise External Business Portal (EEBP) once this system is fully implemented. The Contractor will coordinate with the DLA Energy Region Office for issues involving inventory and accountability.

C-2.9.3 EBS Computer Software and Hardware The Contractor will provide the appropriate hardware for the COCO facilities, and DLA Energy will provide the appropriate software for EBS/FMD support of COCO fuel facilities.

C-2.10 Product Quality The Contractor shall ensure proper product quality. Quality control includes, but is not necessarily limited to visual inspection of product receipt samples, daily recirculation of all fuel dispensing systems/equipment and periodic receipt and bulk storage all level/bottom samples. No petroleum product shall be received or issued until product quality determinations have confirmed conformance with specifications. 9 As of June 13, 2019 fuel receipts prior to issue without disruption of mission support. Products shall be issued on a first-in, first-out basis unless otherwise specified or directed by the KO/COR. Additional sampling/testing may be required as determined by the KO/COR.

The Contractor shall take all samples and ship those requiring analysis to the Air Force Petroleum Agency fuels laboratory, Wright-Patterson AFB, OH. Samples shall be shipped within 72 hours of being drawn.

The KO/COR shall be notified immediately of any suspected fuel quality issues prior to fuel receipts, transfers or issues. The Contractor shall take retention samples when directed by the COR. Samples representing receipts of capitalized products shall be properly marked by the Contractor as to product, source, and date taken for retention as determined by the COR.

The Contractor shall provide all necessary laboratory supplies and replacement equipment without additional government funding.

Sample requirements for all product grades will be accomplished IAW applicable MIL-STD-3004 standards with regard to fuel quality.

C-2.11 Safety The Contractor will ensure Contractor personnel have a safe and healthy work environment. It is essential that personnel handling fuel products and related equipment at the fuel facilities are thoroughly knowledgeable of the principle hazards to be encountered and how to prevent or reduce these hazards IAW applicable federal, state and local laws and regulations. The Contractors safety plan/program shall instruct employees how to eliminate the hazards or cope with them in a safe manner. Contractor shall comply with applicable safety requirements and base fire regulations at all times and shall maintain documentation showing compliance which shall be available to DLA Energy or designated representative at any time. Contractor shall provide 24-hour contact information to the base fire department dispatch center. The Contractor shall provide and replace as necessary all Personal Protective Equipment (PPE) and other safety items required for performing operations and maintenance tasks.

C-2.12 Security The Contractor shall incorporate necessary physical, personnel, operations, communications, and information system security to obtain and control access to applicable restricted/controlled areas, ensure only appropriate computer and information access, and maintain integrity and safety of applicable fuel facilities, equipment, and vehicles. These security measures shall include controlling access by only authorized personnel to fuel facilities and equipment under Contractor control to include escorting personnel while in the area. The Contractor shall inspect gates, fencing, and security lighting surrounding fuel facilities and perform maintenance and repairs as needed. Gates, buildings, and system valves will be secured when not in use. The Contractor shall conduct background checks meeting National Agency Check and Inquiry (NACI) standards or higher as required for Contractor personnel. The Contractor shall ensure requirements for application, receipt, use, and turn-in of personnel badges are met such as for Common Access Cards and flightline/restricted area badges. The Contractor shall establish information systems security measures appropriate to the level of computer use. The Contractor shall establish liaison with appropriate base law enforcement agencies in development and implementation of security measures. The Contractor is not responsible for providing dedicated guards. Force protection is the responsibility of the base. After hours

10 As of June 13, 2019 security checks are performed by LRS or Security Forces personnel. The Contractor will respond immediately upon notification to correct security issues. Contractor personnel should be identified to the LRS and Base Security Forces as mission-essential as required to facilitate base entry and ensure uninterrupted fuel support during normal base operations, deployments, exercises, and contingencies as well as during periods of heightened security or inclement weather. The Contractor may be required to enter into a long-term Visitor Group Security Agreement (VGSA) if deemed necessary by base security forces or by virtue of the contract security requirements.

C-2.13 Environmental Protection The Contractor shall actively protect and enhance the quality of the environment by adhering to all applicable regulatory requirements and by preventing or controlling pollution at the fuel facilities. The Contractor shall ensure dike draining or similar discharge actions are properly approved, performed, and documented as required. The Contractor shall provide sufficient initial and replacement spill response and clean up material for facilities and vehicles as required and properly dispose of hazardous material accumulated. If the Contractor receives a visit from or a Notice of Violation (NOV) from a federal, state, or local agency, the Contractor shall immediately notify the COR or Contracting Officer. The Contractor shall support and participate in either the host base or the DLA Energy Environmental Management System.

C-2.13.1 Government Provided Documents Laughlin Air Force Base will provide the following environmental documents as applicable: Spill Prevention Control and Countermeasures (SPCC) Plan; Spill Prevention, Response Plan (SPRP); Oil Pollution Act 1990 (OPA 90) Facility Response Plan (FRP); Hazardous Waste Management System; National Pollutant Discharge Elimination System (NPDES) Permits Program; Storm Water Pollution Prevention Plan (SWPPP); Integrated Contingency Plan (ICP); and Oil Pollution Prevention Operations Manual.

C-2.13.2 Leak Detection The Contractor shall conform to all federal, state, and local laws, regulations, and guidelines concerning environmental protection.

C-2.13.3 Spill Response

1. In the event of a fuel spill, the Contractor shall make notifications IAW the SPCC Plan, FRP, or equivalent plan. Notifications shall be initiated immediately but no later than 15 minutes after discovering the spill.

2. For all spills, the Contractor shall immediately initiate necessary actions to stop and contain the spill. For small spills, the Contractor shall clean up the spill using appropriate spill response material and properly dispose of residual material. For large spills, removing ignition sources, evacuating personnel, cordoning off the area, and directing traffic may be required until relieved by appropriate authority.

3. Spill response actions beyond those outlined above should be provided by a spill response team and/or qualified spill response Contractor IAW applicable plans.

4. Clean up actions required beyond emergency spill response should be provided by remediation Contractor IAW applicable plans.

5. The Contractor should attempt to recover usable fuel to the greatest extent possible.

C-2.14 Training Requirements The Contractor shall ensure that each employee in the fuel operations workforce successfully completes job specific and mandatory training required by Federal, State and Local statutory and regulatory requirements. The Contractor is responsible for maintaining each employee’s requisite certifications or licenses on file.

The Contractor shall establish and maintain a training program to ensure that applicable personnel receive training in the areas defined below and in accordance with all federal, state, and local laws and regulations. Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations. The Contractor shall maintain documentation of training records which will include, but not limited to employees name, date of training, course information (synopsis), and test results, if applicable.

C-2.14.1 DLA Energy Provided Training The Contractor will ensure employees are fully qualified at the performance start date of the contract. DLA Energy will provide the following classroom instructions; Fuels Terminal Manager/Property Administrator/Responsible Officer course, (5 days), and the Fuels Manager Defense (FMD) course, (15 days). This training will be funded by DLA Energy.

This includes training, transportation and lodging. DLA Energy will only fund the cost of training for initial two (2) individuals hired into requirement positions. Any additional employees requiring training will be funded by the Contractor. The Contractor will submit requests for classroom slots to the COR who will approve or disapprove requests based on contract requirements. Once approved, the Contractor will make a written request to the Contracting Officer for scheduling. If required, the Contractor shall ensure that all employees attend and participate in the Annual Spill Response Training.

C-2.14.2 Contractor Provided Training The Contractor shall provide the following training to all employees: OSHA Hazard Communication, Confined Space training, Hazardous Waste Operations and Emergency Response (HAZWOPER), OSHA Lock-out/Tagout, Personnel Protective Equipment, fuel operations, and environmental compliance, and DoD Antiterrorism (AT Level I Awareness training) IAW applicable Federal, State and local laws and regulations.

Additional training requirements are as follows:

C-2.14.2.1 The Contractor will provide familiarization training to the Base’s Fire Department on the facilities and procedures when requested.

C-2.14.2.2 All Training records will be made available to the COR upon request.

C-2.15 Contractor Furnished Items The Contractor shall provide sufficient and adequate tools, personnel protective equipment, vehicles, and other items needed to adequately and safely perform all operations and maintenance tasks required by the contract. The Contractor shall ensure compatibility between Contractor items and on-site facilities, systems, and equipment.

C-2.15.1 Disposition of Contractor Furnished Items Contractor items identified herein shall be used solely in the performance of the work in this PWS. The Contractor shall not store items in excess of the contract requirements on base property. Upon termination of the contract, all Contractor items shall be removed from base property within 30 days. Thereafter, the Contractor shall be charged the prevailing commercial storage rate for any items kept on base property.

C-2.15.2 Uniforms, Clothing, and Safety Equipment The Contractor shall provide a distinctive company uniform for personnel to wear in the performance of their duties. Uniforms shall be maintained in a clean, serviceable condition and replaced when excessive wear requires. The Contractor shall provide all personnel safety equipment including safety shoes, safety glasses, reflective vests, sound suppression devices, cranial protection, gloves and other identifiable special safety equipment for specific operation and maintenance procedures for personnel. When a cap is worn, it will have the company logo on the front. No other caps/hats are authorized.

C-2.15.3 Contractor Furnished General Purpose Vehicles The Contractor shall provide sufficient general purpose vehicles with appropriate capability to meet the contract requirements including but not limited to escorting fuel deliveries where required, towing bowsers, transporting personnel, and performing expeditor duties as needed. The vehicles shall have a distinctive company logo or marking to ensure ease of recognition. The Contractor is responsible for ensuring any vehicle is properly licensed IAW local civilian requirements, registered with base security if applicable, adequately maintained, flightline capable if applicable, and operated only by licensed and qualified personnel. The Contractor is responsible for providing fuel for Contractor general purpose vehicles. The Contractor may request to establish a Fuels Purchase Agreement (FPA) to allow purchase of DWCF ground fuel for use in Contractor general-purpose vehicles.

C-2.16 Unauthorized Use of Facilities The Contractor shall not permit or authorize personnel to store or repair any personal property including boats, vehicles, trailers, motorcycles, etc., on leased property. In addition, the Contractor shall not utilize on-site equipment, property, or facilities for storage or repair of Contractor-owned vehicles and equipment not specifically required by the contract provisions.

Parking of personal vehicles used for transportation to and from work will be permitted in designated vehicle parking areas during working hours. The Contractor shall not allow employees to cook, smoke, have open flames, or have flammable materials in the work areas or inside any building. The Base Fire Department will designate a smoking and cooking area.

C-2.17 Report Fraud, Waste and Abuse The Contractor shall promptly report to the contracting officer and fraud counsel any indications of fraud, waste or abuse as well as any investigative contact (investigative/audit agency name, investigator/auditor’s name and phone number) concerning fraud, waste or abuse.

C-2.18 Notification of Correspondence and Visits The Contractor shall immediately provide the Contracting Officer and COR copies of all correspondence and notification of any visits relating to federal, state, or local officials or agencies and other personnel or Contractor that visit the retail fuel facility.

C-2.19 Maintenance The Contractor shall maintain the COCO fuel systems, e.g., equipment, facilities and grounds according to manufacturer specifications, best commercial practices, and the Maintenance Plan to include all operator, preventive, and other maintenance.

C-2.19.1 Maintenance Records Maintenance, repairs, inspections, and test findings will be electronically and manually recorded and maintained in permanent facility files. The Contractor is required to keep all maintenance records using a Computerized Maintenance Management System (CMMS). The Contractor shall develop and maintain an electronic database on deficiencies and problem areas needing corrective work. Record keeping includes all noted deficiencies found and work performed at the fuel facility; even if performed by another organization or Contractor. Records will be maintained for the duration of the contract and turned over to DLA Energy or designated representative upon completion of the contract. In addition, DLA Energy or designated representative will be allowed unlimited/unrestricted access to the Contractor developed database.

C-2.19.2 Building and Ground Maintenance The Contractor shall maintain all facilities buildings and grounds in accordance with Base guidelines. The Contractor will ensure buildings are clean, free of debris, and pest free. The Contractor shall be responsible for mowing and trimming the grounds. The Contractor shall not permit or allow fire hazards to accumulate in buildings or on grounds.

SECTION C-3.0 DELIVERABLES

C-3.1 Pre-Award Contractor Detailed Plans The Contractor shall provide the following plans that will accompany their proposal.

C-3.1.1 Staffing Plan Contractor shall provide a Staffing Plan for consideration that accompanies their proposal.

The Staffing Plan shall be a comprehensive and detailed matrix outlining all manning aspects, to include sub-contracting, and requirements regarding the management and labor force. The plan shall include a detailed organization chart reflecting the number of employees identified by wage determination, job classification, and full/part time employee status, a brief description of the tasks to be performed, and the duty description.

In addition, a manning matrix ultimately defining manning in terms of Full Time Equivalents (FTEs) for a typical seven day work week shall be included.

C-3.1.2 Property Restoration Plan The Contractor shall provide a detailed plan that will accompany their proposal, for the removal of all facilities, components, utilities, and any other equipment or material provided or installed by the Contractor. The plan shall include planned coordination with project stakeholders, milestones, timelines, and related data to return the premises to the condition identified by the Laughlin Air Force Base provided environmental assessment of property and per requirements identified in the executed land lease.

C-3.2 Post Award Contractor Detailed Plans Following contract award, the Contractor shall have 60 days, unless otherwise indicated, to submit the detailed plans listed below to the COR and Contracting Officer for review and acceptance. The plans are considered dynamic documents and shall be updated as required throughout the contract period. Updates will be provided to the COR and Contracting Officer for review and acceptance as changes are made. These plans may be used by the COR for monitoring and assessing contract performance.

C-3.2.1 Contract Compliance Plan (CCP) The Contractor is responsible for ensuring compliance with all contract performance requirements. As such, the Contractor shall develop an inspection system to monitor overall contract performance. The inspection system is to include a written Contract Compliance Plan (CCP) developed and used by the Contractor to measure performance on a continuous basis. The CCP shall include performance based plans. General performance criteria shall include the Contractor’s ability to provide continuous support capabilities as specified in this PWS, record keeping and reporting procedures pertaining to administrative requirements, bulk storage operations, facility/equipment maintenance, and upkeep and appearance of grounds and facilities under Contractor control. The CCP shall include time specific checklists for evaluation of all operational and preventive maintenance requirements. The CCP shall address procedures for corrective actions including the resolution of Corrective Action Report (CAR) and Contract Discrepancy Reports (CDR) generated by the COR. The Contractor shall submit a CCP to the Contracting Officer for review and approval within 30 days after contract award. The CCP shall be made available for DLA Energy or designated representative to review, upon request, at any time during the contract performance period.

C-3.2.2 Operations Plan The plan shall provide comprehensive and detailed step-by-step procedures (recommend checklists as attachments) covering all operating requirements.

C-3.2.3 Maintenance Plan Contractor shall provide a detailed maintenance plan for all facilities, equipment, and system components. The plan shall address all requirements and identify the frequencies, methods, and procedures for documenting and accomplishing the maintenance objectives set forth and will be developed IAW applicable directives including manufacturer’s recommendations, best commercial practice, and industry standards.

C-3.2.4 Safety Plan The plan shall outline procedures necessary to maintain safety IAW applicable federal, state, and local laws and regulations. At a minimum, this plan shall include industrial hygiene, Confined Space Entry, Disaster Preparedness, Fire Prevention and Protection, hazardous waste operations, Personal Protective Equipment, Emergency Response, Safety and Health Standards, Hazardous Communications, Lockout/Tagout, Fuel Handling Operations, Safety Data Sheets, accident /incident reporting, and safety procedures during general fuel handling operations. The plan shall also include the name of the responsible individual that will monitor the safety program and maintain records.

C-3.2.5 Security Plan The Contractor shall provide a detailed plan outlining procedures necessary to maintain security of the facilities, data processing equipment, as well as any Contractor-Furnished Equipment (CFE), tools, and materials. The Contractor’s security plan shall outline policy, guidance, and procedures regarding facility access controls, visitor logs, lock and key controls, random patrols of facilities, Automated Data Processing (ADP) security, and other force protection measures, including increased Force Protection Conditions (FPCON) to deter unauthorized access, visitor entry control, and communications.

C-3.2.6 Environmental Protection Plan The Contractor shall provide a comprehensive and detailed plan that will ensure compliance with federal, state, local and installation environmental laws, regulations and other guidance. This plan shall be effective at the start of the contract performance period. The Contractor's plan shall address petroleum based fuel spills and contingencies, including any spilling, leaking, pumping, pouring, emitting, emptying or dumping into or onto any land or water, spill prevention control and countermeasures, Contractor response to containment, cleanup, and disposal and spill reporting procedures to the appropriate DLA Energy Region, COR and, if applicable, federal and state officials.

The Contractor shall immediately report to the COR any nonconformance and/or noncompliance with applicable federal, state, local or installation environmental laws and regulations.

The Contractor shall, when given a verbal and/or written notice of environmental noncompliance or nonconformance, immediately initiate corrective action to expeditiously resolve the noncompliance and/or nonconformance deficiency.

C-3.2.7 Training Plan The Contractor shall provide a detailed plan that identifies employee training requirements and procedures necessary to maintain annual training requirements. The plan shall identify: length of training, specify initial or recurring training, training sources, and a brief description of courses, such as safety, environmental protection and job qualification training. The plan shall include a sample training record or method of documenting personnel qualifications/certifications. The plan shall address the training requirements and methodology for Contractor personnel. The Contractor is responsible for ensuring all individual training requirements are accomplished.

C-3.2.8 Quality Control Plan The Contractor shall develop a comprehensive plan to ensure that products placed in the care of the Contractor are properly handled, remain on-specification, and are ready for issue. The plan shall include policy and procedure regarding product sampling, visual examination of samples, and the submission of samples needing further analysis to the Government fuel laboratory. In addition, the plan shall outline the documentation of samples and test results, reports and records keeping, and actions to be taken in case of unacceptable test results. The plan shall fully outline Contractor responsibilities for quality surveillance under this contract.

C-3.2.9 Inventory/Accountability Plan The plan shall describe how the Contractor intends to perform the required services in order to ensure that all transactions are reported and inventory is accounted for as required during the performance of the contract IAW DOD 4140.25M, DOD Management of Bulk Petroleum Products, Natural Gas and Coal, and all applicable instructions, policies, and regulations. The plan shall include detailed procedures showing who, what, when, how often, for the following operations, as they affect inventory/accountability, and an organizational chart that identifies responsible parties for the same operations as follows: Receiving, Quantity Determination, Issuing, Records and Reports and Corrective Action.

C-3.2.10 Phase-In Plan To ensure a smooth option period transition in the change of work effort, the Contractor shall develop a Phase-In Plan. The Contractor’s Phase-In Plan shall describe in detail the transition between outgoing and incoming Contractor and how responsibility for services changes over with no interruption in services.

C-3.2.11 Phase-Out Plan The incumbent Contractor recognizes that the services provided by this contract are vital to DLA Energy’s overall effort, that continuity thereof must be maintained at a consistently high level without interruption. The Phase-Out Plan shall include provisions for actions to assist and coordinate in the changeover of all functions on the contract performance start date. The plan shall be coordinated with all affected activities and managed to minimize any adverse impact on the flying training mission. The incumbent Contractor shall provide sufficient numbers of personnel to conduct a joint inventory of all equipment and provided facilities, publications, accounts, records, etc., with the successor Contractor and government representatives to ensure inventories/accounts are accurate and complete. The incumbent Contractor shall ensure shortages, equipment/tool condition issues, and other contract requirement issues are rectified prior to account changeover.

C-3.3 Reports/Records Unless exempted by law, the Contractor, when requested by DLA Energy, shall promptly provide all records (electronic and otherwise) related to operations and staffing, contract quality assurance, fuel quality control, safety, security, environmental compliance and spill control, maintenance, training and property management.

APPENDIX A

FACILITY SPECIFICATIONS

NOTE: All facilities will be capable of operations for a 30 year lifespan.

The contractor shall provide the COCO bulk and retail fuel capability for ULSD and MOGAS based on known and projected mission requirements. The contractor shall perform all fuel operations from the COCO bulk and retail facility.

Laughlin AFB will provide DLA Energy with a detailed Environmental Baseline Study which will identify any existing land contamination, if any, for the proposed sighting of the contractor's bulk and retail facilities. The contractor will only be held accountable for additional contamination shown to reasonably result from the petroleum products under their purview. Furthermore, Laughlin AFB will provide utility stub outs to the COCO facilities perimeter.

Retail fuel operations shall not include demolition of existing tanks, conducting alongside aircraft refueling, or making truck deliveries, all of which will be performed via other contracts.

Note: Contractor facilities shall maximize conservation of energy, water and additional utilities.

The contractor will retain regulatory liability for the facility. The contractor shall be responsible for paying any fines or penalties assessed against Laughlin AFB or the Air Force for environmental violations resulting from acts or omissions of the contractor or its employees, subcontractors, or agents. This obligation is in addition to any fines or penalties that may be accessed directly against the contractor for the same conduct.

The contractor shall provide all manpower, equipment, and material resources as necessary to provide these services. No Government facilities are available for use at this location. All facilities, equipment or materials furnished by the contractor shall be suitable for retail dispensing of ULSD and MOGAS products. The contractor’s facility must also have the ability for bulk issue of ULSD. The contractor’s technical proposal will identify the types of materials that will be utilized throughout the fuel distribution system. The services are required to be operational within 12 months of contract award.

a. All tanks and facilities used to provide the services shall meet the requirements of the current American Petroleum Institute (API) Standards, National Fire Protection Association (NFPA) Codes, National Electric Codes, and all local, state, and federal laws (including but not limited to 40 CFR 280, 281 and 112) and regulations applicable to tanks and facilities of the type utilized. These facilities shall meet best commercial standards with components and fixtures that allow proper service interface with military tactical and non-tactical vehicles and equipment. The contractor shall be responsible for obtaining all permits necessary for operating, and constructing these facilities, including, but not limited to hot work permits, dig permits, tank registrations, air emission permits, erosion and sediment control, underground injection control or sanitary permits, storm water discharge and aboveground storage tanks when required. The contractor shall be responsible for obtaining all inspections by state and local authorities, as required, prior to operation. A copy of all environmental permits when issued new or upon update will be provided to the Laughlin AFB Civil Engineering Environmental Division.

b. Retail dispensing pumps shall be equipped with spin on filtration capable of precluding high particulate to 10 microns or less and water removal.

c. Facilities shall be equipped to provide air and water for vehicle servicing.

d. The retail/bulk dispensing area shall be configured with adequate energy efficient lighting for 24/7 operations. An automated key lock system shall be provided for retail and bulk dispensing and data capture. Automated retail dispensers shall be unmanned 24/7. All bulk transactions shall be supervised by the contractor to ensure safety and prevent spills.

e. Automated facility shall consist of latest version of DOD standard source data collection equipment and shall be designed to interface all receipts, retail issues and accounting transactions to the FMD.

f. The contractor shall provide weekly project status reports during construction to the KO and

COR prior to the start of performance.

g. The facility shall provide for safe access and exit, to include a marked traffic pattern within the facility. Traffic flow pattern to and from the facility shall be provided by the installation during the pre-solicitation conference.

h. Vehicle retail pump dispensing area shall be provided with a weather canopy.

i. Bulk stands shall be provided with a weather canopy. Bottom bulk loading is required with a minimum single bulk loading point for ULSD. Bulk loading shall only be performed under the contractor’s supervision.

j. The contractor shall ensure all fuel loading/unloading meters are calibrated semi-annually.

k. The facility shall be enclosed with security fencing and force protection measures IAW installation design guide and the UFC.

l. The contractor shall provide an auxiliary power source with automatic switch gear to enable the facility to be operational 24 hours per day during power outage and emergency situations.

m. Utility tie-in points will be provided by installation near the perimeter of the proposed site.

The contractor shall install utility advanced meters so installation can monitor energy and water consumption. If irrigation water is to be utilized it must be separately metered. The contractor will provide for recalibration of utility meters in accordance with manufacturers recommendations. The installation will provide for utilities.

n. Primary power distribution at Laughlin AFB is privately owned by Rio Grande Electric

Cooperative (RGEC). The contractor must subcontract RGEC for all primary electrical work within the contractor retail site perimeter.

o. The infrastructure will have all appropriate and required Title V Air Permit required control devices to meet all federal, state, and local environmental requirements.

p. The facility must have impervious surfaces where the potential to release hazardous materials exist and must have impervious joint sealers in all seams and potential pathways to subsurface soils.

q. The facility must have flow and contours of finished surfaces to guide spilled materials as prescribed by all federal, state, and local environmental requirements in the event of a catastrophic tank or equipment failure.

r. The contractor will be required to supply as-built drawings in AutoCAD (version to be compatible with installation's version at time of submission) format to the COR to be utilized by emergency response personnel to monitor system changes/modifications.

s. The contractor will maintain hazardous waste storage locker on site.

t. The contractor facilities shall include an emergency shower and eyewash station.

u. Tanks will have separate receiving manifolds to prevent comingling of products and allow for accurate quantity determinations after receipt, without prolonged issue servicing delays.

v. Designs shall comply with Laughlin AFB…
