This amendment provides answers to questions which were submitted in reference to solicitation SPE300-17-R-0023. DLA Troop Support’s answers are provided in red font. The answers are provided for clarification purposes only and do not change the solicitation requirements. In the event of any discrepancy between the answers provided and the solicitation documents, the solicitation documents will take precedence. Minor revisions may have been made to the questions for clarification purposes. DLA Troop Support does not intend to entertain any additional questions before SPE300-17-R-0023 closes.

1. QUESTION: Would it be acceptable to DLA if a company associated with a buying group purchases product used for the DLA directly from a grower/shipper or broker rather than through their buying group? Of course, this would all be documented and available for review by the DLA as requested on the weekly audits or on a full, on site audit.

RESPONSE: All pricing must be in accordance with the Economic Price Adjustment language and other price related terms included in the solicitation and resulting contract.

2. QUESTION: It would be extremely helpful to get greater clarity as to what (to DLA) constitutes an economic incentive that DLA is entitled to a portion – and what doesn’t.

RESPONSE: Please see the Economic Price Adjustment language and other Rebates/Discounts and Price-Related Provisions included in the solicitation.

3. QUESTION: The solicitation states a 6 times factor will be used in the evaluation of the distribution price (DIP), which places company that is affiliated with a buying group, at a huge disadvantage. When you take $1.00 x 6 = $6.00 per unit DIP; multiply that by the total cases to establish the total weighted aggregate DIP, this dramatically increases and ensures a company’s total evaluated cost is over inflated and places them out of the competitive range and not eligible for award.

RESPONSE: Offers will be evaluated in accordance with the terms of the solicitation.

4. QUESTION: If a company declared $.85 to be returned to DLA and keeps $.19 by adding it to their distribution price, how is that passing on any and all rebates to DLA? If the Contracting Officer ask you to put part or all of the rebate into the distribution price then you failed to meet the requirement of passing all rebates to the Government.

RESPONSE: All pricing must be in accordance with the Economic Price Adjustment language and other price related terms included in the solicitation and resulting contract.

5. QUESTION: Is the removal of any monies that are off invoice funds from the delivered price component and added to a distribution price, legal and within the solicitation provisions?

RESPONSE: It is an offeror’s responsibility to price offers accordingly, however, all pricing must be in accordance with the Economic Price Adjustment language and other price related terms included in the solicitation and resulting contract.

6. QUESTION: Does DLA consider Buying Groups funds consistent with customary commercial practices and they should be treated as earned income?

RESPONSE: Earned income provisions are not included in this solicitation.

7. Will this solicitation be award from weighted or unweighted totals from the market basket?

RESPONSE: Offers will be evaluated in accordance with the terms of the solicitation.

8. QUESTION: DLA did not provide any columns or a place to account for rebate/discount/deviation in the FF&V market basket.

RESPONSE: Offers should be submitted in accordance with the spreadsheet and instructions included in the solicitation.

9. QUESTION: 52.216-9064 ECONOMIC PRICE ADJUSTMENT has a definition of earned income used by other Departments. Allow the use of value-added services are services performed by the Contractor in accordance with commercial practice. We request the same language be used in all subsistence solicitations including FF&V.

RESPONSE: The terms and conditions included in this solicitation will apply to any resultant contract.

10. QUESTION: In the Place of Performance, it states you are required to list all facilities that are going to be used before award of contract. When and how will an awardee be allowed to use a subcontractor and their facility after award of contract?

RESPONSE: The successful offeror will be required to perform in accordance with the terms of its contract.

11. QUESTION: We are requesting a conference in Philadelphia to review all new requirements.

RESPONSE: No conference is scheduled at this time.
